are you awake. ? i'm marla tellez in for laura garcia-cannon. >> we hope you are, watching us. thanks for joining us. it is 6:01. i'm jon kelley. we have breaking news happening in san jose this morning. a hit-and-run crash that sadly kills two women. investigators are out looking for the driver still on the run this morning. this crash happening at around 3:15 this morning near the intersection of first street and sky port in san jose, that is where "today in the bay's" bob redell is live at the scene. he has all the latest on this deadly car crash. >> reporter: good morning, jon. not far from norm mineta air national. police want to find the driver of that silver mercedes behind me. the vehicle to the right that was involved in this very serious accident that killed two women. this happened around 3:15, 3:20 this morning. investigators trying to figure out who is at fault. they know the two women in the toyota yaris, that's the vehicle

with the blue tarp over it. they were making a left-hand turn off north first onto sky port when they collided at the intersection with the mercedes. not clear who had the right-of-way. the collision was so severe, one of the women didn't survive long enough to the hospital. she was declared dead on the scene. the other woman died at the hospital. it's hard to tell how badly hurt the driver of the silver mercedes is. clearly okay enough to get out of the car and leave the scene. police will be checking local hospitals to see if anybody shows up with injuries consistent with this accident. the car is not stole loan. according to sjpd, they'll want to know if this person was under the influence, had an outstanding warrant or just panic and made the wrong decision. two women killed at this intersection, north first street and sky port. it could be an hour or two before this intersection is reopened as the investigation continues. live in san jose, bob redell,

"today in the bay." >> thanks so much. it's 6:02. right on schedule. the new eastern span of the bay bridge is set to open by tomorrow morning's commute. today in the bay's christie smith is live in oakland with an update on the finishing touches that crews are putting on the brand new span. christie, good morning. >> good morning, marla. kind ofd hard to believe that the earthquake that damaged the old bay bridge in the first place happened 24 years ago. tomorrow for the first time delivers will finally be able to drive on the new span. there was talk of it possibly opening before 5:00 tuesday morning. a bridge spokesperson says it's just too early to say that yet. but as of sunday, about 80% of the final work on the $6.4 billion span that was built to be more seismically safe is done. the roadway connector to jer ba buena island and treasure island is completed. contractors continue to grind up pieces of the old bridge to make

traffic maps and other transit options. now to the latest on the crisis in syria. we received word nato's chief is convinced the syrian government is behind last month's chemical attack. anders rasmussen says he's been presented with concrete information and he is convinced not only that a chemical attack occurred, but that the syrian regime is, in fact, responsible. in the u.s. president obama is meeting with congressional leaders today urging them to approve a plan to take military action in syria. senator john mccain and perhaps others will be meeting at the white house today to discuss all of this. lawmakers, they are divided over whether to authorizes a military strike. secretary of the state jon kerry says there's more evidence syria's government used lethal sarin gas in the attack. some lawmakers have criticized

the president for taking too long to decide on the military action. at 6:30, we'll go live to washington, d.c. for the latest on these on going negotiations. 6:05. police in palo alto have an image focusing on one of the robbers. they say he's about 30 years old, six feet tall and weighs about 200 pounds. police say he and another man robbed the couple just after midnight tuesday in the parking lot of the post office on east bayshore road. the husband handed over his wallet and the suspects took off. this morning investigators are looking into the death of a crab fisherman. the national park service says the man died yesterday at tomales bay after falling off his boat. he was pulled over and dragged over by the weight of a crab pot. investigators say the man was not wearing a life jacket. this morning more positive

news as firefighters continue getting handle on the rim fire burning in yosemite. the latest report from cal fire showing the fire now 45% contained. it has also burned more than 350 square miles since it started on august 17. higher humidity levels this weekend helping the crews make progress as the firefighters work in harm's way. they still have a long way to go. full containment not expected for another three weeks. labor day travellers were met with all that smoke in the air in yosemite valley. this is from over the weekend. smoke from that fire drifting into the valley on saturday, and at times it was so thick it made it very hard to even see half dome. we're told that air quality now has started to improve, but park visitors are still being told to avoid any strenuous outdoor activity to avoid taking that all down into your lungs. >> i've never seen it look like that before. >> that is rough. that fire is unbelievable. >> we wish all those

firefighters the absolute best. it is a muggy start on this labor day. it was muggy last week as well. rob mayeda is in for christina. >> we've been seeing the tropical moisture coming from the south, a few stray showers around the bay area. that airflow aloft starting to send the smoke away from the yosemite valley towards the lake tahoe basin. air quality alerts continue f. around the bay area we've seen a few showers mainly in the east bay hills to start the morning. north of mt. hamilton, towards east of livermore and tracy, a little sprinkle there. here comes the moisture up out of the south. this is the reason for the mugginess, unusually juicy air coming out of the sub tropics into the bay area and will probably stick around through today and later this evening into tomorrow, we start to see the moisture plume move off to the east. breezy and clearing conditions

san jose police right now looking for the driver of a car that crashed killing two women. then driver ran from the scene. this happened after 3:00 this morning on north first and sky port, not too far from casino matrix. a chain-cutting ceremony takes place at 3:00 this afternoon to celebrate the new eastern span of the bay bridge. caltrans workers have been at it around the clock since thursday night. tomorrow morning the bridge will be packed once again. nato's chief wrapped up a news conference more than an hour ago saying he did see evidence about an august 21st attack in syria. he is convinced the syrian authorities were responsible for a chemical weapons strike. president obama right now trying

to get support on the domestic front and internationally as well for military action to be taken against syria's regime. something you don't see thauchb in sin city, flash flooding in las vegas has caused road closures over the labor day weekend. some areas measured as deep as five feet closing roads and flooding yards. at least 22 people had to be evacuated. no injuries have been reported. unusually high moisture levels have been hanging over las vegas for several days bringing heavy rain and thunderstorms. inmates in los angeles county jails are being released early because of budget problems and overcrowding. "the l.a. times" reporting inmates convicted of violence and sex crimes are being set free after serving as little as 40% of their sentence. the los angeles county sheriff's department has released 23,000 inmates early. sheriff officials tell the newspaper it's because there's

not enough money or resources to keep them behind bars. the department only releases inmates serving traditional county jail terms, not prisoners who are released to the county. officials in newport beach closing a popular section this labor day weekend because of a sewage spill. about 77,000 gallons of raw sewage spilled into a three-mile stretch of newport bay. that is nasty. warning signs are there posted along the shore telling people they shouldn't enter that water because it could cause illness. the department of o environmental health says bacteria levels nein that water near storm drains have very high. no word on when it may reopen. a whole lot of sand will be soon pumped tont shoreline right here in the bay area starting this month. crews will haul in 82,000 cubic yards of sand to robert crown

memorial state beach in alameda. the $5 million project will restore the beach to what it was some 26 years ago. all the storms and a rise in sea level has really changed that landscape since way back. work expected to be done by november. a popular san francisco restaurant is reopening for business today throwing an e. coli outbreak over the weekend. public health officials say 14 people got sick after eating at burma assumer star on clement street in the richmond district. nine of those people fell ill after eating there august 16 or 17. the restaurant's owner issued a statement saying, quote, we are working with public health officials to identify the exact cause of these incidents and the city has reassured us that this was an isolated case and that san francisco burma superstar is a safe place to eat. happening right now, when you have trouble getting out of

bed, this is your inspiration. a 64-year-old is swimming from cuba to florida. just moments ago diana nyad's team sending out these gorgeous pictures saying she's about five miles from the finish line in key west. that is a beautiful thing. nyad has attempted the 100-plus-mile swim a total of four times previous to this. these are the pictures there to take in just into our newsroom this morning. they've been tweeting these out, keeping us posted. it shows cruise ships making the way for ms. nyad as the sunrises out on the east coast. if she succeeds, she will become the all-time record holder for the longest unassisted open ocean swim. she has no wet suit. there's no shark cage. so diana nyad, true warrior. i like some of the hash tags. >> fearless nyad, the other shore, cuba to florida. all over twitter right now.

nile virus. officials say they're going to target hot zones in north san jose and milpitas from 11:00 wednesday night through 4:00 a.m. thursday. this week's fogging will bring the total to ten foggings. the old record was seven. mosquito see son is expected to stretch into october if the weather stays warm. high-tech firms fighting plans to shelf a patent office in silicon valley. budget cuts known as sequestration threatening the office's planned opening. tech leaders say this cut is unfair because the promised patent office was never going to be funded by taxpayers. instead it was supported by $2.8 in ranl patent fees. representative mike honda whose district includes silicon valley says he's seeking a sequestration exemption for that office. u.s. patent and trademark office ceo says the austerity policy

museum day live is coming up at the end of this month. you can get a jump start. that's the day museums across the country will open their doors for free. some of the museums participating in this september 28th event include the bay area discovery museum, cartoon art museum of california and the aerospace museum of california. you can't just walk in, you actually need a ticket. to get a ticket you can go online. they're available at the smithsonian website. many people said their good-byes to the old eastern span of the bay bridge as we get ready for the opening of the new span. online it seems like some people are a little bit confused. in the past few days several people have been posting photos on social media apparently bidding farewell to this guy. this is the western span of the bay bridge. that's not going anywhere. >> that's not what they're working on right now. >> take a look at the photos. the captions include "we are going to miss you old bay bridge" or "can't believe the

the key to getting it done is going to be do lawmakers believe the evidence that it was the syrian government that launched that chemical attack. nato's chief has seen the evidence and is convinced. russia's foreign minister says he's seen it, too. he's not convinced it was the syrian government. syria's foreign minister says any evidence is manufactured because they simply did not do it. so now for the u.s., it comes down to what lawmakers here on capitol hill believe. today we've got john mccain, the senator from arizona headed to the white house with we believe another republican senator to talk to president obama about this. the administration is making a hard push, the hard sell this entire week trying to get lawmakers on their side. 100 of them came back early over the weekend to try to make some decision or come to some consensus after a three-hour meeting hearing some of the evidence from intelligence officials. there was still no votes out there and still lawmakers who said they were undecided.

>> tracie, thanks so much. it is 6:31. while we know the president may be putting what happens in syria to a vote, he's also getting mixed support from local lawmakers. south bay congresswoman says while unlike iraq, she doesn't doubt the intelligence that assad carried out the chemical attacks but says she needs more information before making a final decision. peninsula congresswoman jackie speier echoed that sentiment saying any decision should not be made in haste. dublin representative eric swaldwell says he doesn't want the u.s. drawn into another conflict in the middle east that would put troops on the ground. >> the president's resolution as i have read it does not limit him from putting troops in to syria. if that is the case, i can't support it. >> i have to tell you i'm very

reluctant as it relates to taking any military action that could lead to unintended consequences and also that would set us back from a negotiated settlement. >> senator dianne feinstein says she agrees with the secretary of state's assessment that the u.s. cannot let syria's attack pass without a, quote, meaningful response. as for house minority leader nancy pelosi, she released a statement saying it is clear that the american people are wary of war, however, assad gassing his own people is an issue of our national security, regional stability and global security. pope francis spoke out on the earian conflict condemning use of chemical weapons. the pope said he was troubled by the terrible images from the recent attack and god would judge the actions of the attackers. the pontiff also asked the international community to make

good morning and welcome back. the nsa spy program targeting the presidents of brazil and mexico according to journalist glenn greenwald, a contributor to "the guardian." he says the documents obtained by former nsa contractor edward snowden show e-mails being read from mexico's president and also acknowledged communications between brazil's president. snowden admitted to leaking classified documents about two secret u.s. programs that monitored telephone calls and internet traffic. snowden is in russia after that country granted him asylum. egypt's former president is likely to face charges for

allegedly inciting deadly violence. egypt's top prosecutor says ousted president mohamed morsi will be tried for the killing of opponents who protested outside his palace. almost a dozen were killed after millions took to the streets demanding morsi stepped down. morsi was later ousted by egypt's military. more than a dozen other members of morsi's muslim brotherhood will also face trial. a south korean delegation will try to get a joint manufacturing complex with north korea up and running. both sides with meet in kason to find a date to reopen the complex. the industrial park is located inside north korea just past the border. more than 120 south korean companies employ 50,000 workers at the complex. it was shut down four months ago during heightened tensions in the peninsula. at the time south korea and the united states were conducting joint military ear sizes. breaking news we've been

the scene, not clear whether they would need treatment at the hospital. that's one thing police will be doing, checking local hospitals to see if anyone shows up with injuries consistent with this kind of accident. they're not sure why this person fled. the car is not stolen. part of the investigation will focus on whether this person had been drinking, if they had on outstanding warrant or just made the wrong decision. there was one man who was not related to the accident, not in either vehicle who police were speaking with. he might have been a witness, someone near at the time of the accident. again this happened overnight around 3:20 this morning. not clear what kind of information he was able to give to sjpd. reporting live in san jose, bob redell, "today in the bay." 6:46 right now. new numbers from yosemite, good news showing firefighters making great strides over the holiday weekend on the massive rhyme fire. now more than 228,000 acres of fire still being damaged out there. currently it sits as the fourth

largest in california history. the firefighters working hard, gaining a lot of ground over the weekend, now have the fire at 60% containment. the danger, however, not over. about 5,500 buildings still in harm ears way including about 4,500 homes. however, no new buildings were burned over the weekend and the fire, the cause of this fire still remains under investigation. we're looking at a warmup in the bay area. i wonder that means for yosemite valley. how are the conditions for the firefighters? >> things have gotten better. the humidity is up. we've been seeing light rain showers. air quality still an issue around mariposa county and lake tahoe hoe. over the last 24 hours, right there near the fire you've got some light rain at times, very close by, now 60% contained, and it does look like we're going to see the same conditions during the day today. that may help firefighters around the rim fire for the afternoon.

around the bay area, you can see the moisture coming in off the ocean. this is tropical msture kicking off a few stray showers around discovery bay and san jose. look at the temperatures this morning, mid to upper 60s with mostly cloudy skies. a warmer start to the morning, but the clouds will help to block out the sun at times this afternoon which will keep our inland temperatures from getting too warm, even though we have a sea breeze. san francisco, we should see partly cloudy skies. lots of humidity and lots of cloud cover around the south bay and east bay. a chance of an isolated shower around the hilltops of the south bay and east bay. we're starting to see clearing skies. less humidity and temperatures will be -- today near 80 degrees, elsewhere, the sun blocked out by those clouds at times. low to mid 80s around the tri-valley and fairfield. 70s around san francisco and oakland, a balmy day around the bay. the north barks upper 70s to low

80s. lots of humidity today. the tropical moisture will move on by tomorrow with breezy conditions. as we get towards the weekend, summer heat comes back, 90s for the valleys. closer to the sea shore on saturday. we have new video into our newsroom on the progress on the beautiful eastern span of the bay bridge. it's set to open tomorrow morning and it is looking good. one of the biggest questions from commuters, this one opened earlier than expected. "today in the bay's" christie smith is live in oakland with details. sounds like you got a chance to go out on the new span and check things out. >> reporter: i have to tell you, my cameraman henry took a ride and the progress is looking good. all along caltrans has been saying that the newbridge would open at 5:00 a.m. tuesday. there is talk it could open earlier than that. the last thing a bridge spokesperson tolls toeld us is it's too early to say.

we can tell you that caltrans is telling us the finishing touches on the eastern span are 80% complete. this is new video near the toll plaza. striping is in at the toll plaza and well beyond. work at the yerba buena island roadway connector was completed as well. the bike and pedestrian paths being put in place. that will open tuesday at noon. i spoke with the chp this morning about how they plan to open up all the ramps to the bridge that have been closed down since wednesday, now leading drivers to a bridge they've never driven before. they say they plan to open all the ramps at the same time. once caltrans gives us the okay and says the bridge is ready for public traffic, we will stop traffic in the area leading to those points. caltrans will remove all the cones and the highway patrol will escort traffic into the area. we expect traffic to be very light at first because the opening will be a surprise to people and some people will be planning to go other ways.

"today in the bay." plans to name the western span of the bridge after former san francisco mayor will will brown, those plans have hit a little bit of a snag. three former city supervisors submitted a letter to state senator pro tem steinberg telling him not to name the bridge to brown. rul are known critics of brown. they say it would defy senate rules that require legislatures to only name transit architecture to be named only after those who have passed away. negotiations between b.a.r.t. and its unions remain stalled. everybody now pointing fingers. this morning b.a.r.t.'s union, the leaders there holding a news conference to highlight what they call b.a.r.t. management's attempts to delay negotiations to provoke a strike. the 60-day cooling off period

flu season usually doesn't get rolling until november. experts are saying it's never too early to start protecting yourself, especially your children. according to the american academy of pediatrics, right now is the perfect time to give your kids the flu shot vaccinations. this year some of the injections will protect against four strains, two a strains and two b strains that are likely to be circulating this fall. >> what we're really concerned about is people will start getting picky and will avoid getting vaccinated and they'll be susceptible to illness. over kids who can't stand taking the shots, they do have the option of getting the nasal spray version. happening right now, the 64-year-old endurance swimmer right now is on the verge of making history. you can see the shots that her team is tweeting out.

diana nyad trying to swim from cuba to florida. she's 64 years old, attempted this 100-plus mile swim four times before. she's now less than five miles from the finish. we have these new pictures to show you in to our newsroom. they'll be even more beautiful if ms. nyad makes it. they're making way for her to try and get there as the sunrises on the east coast. those are gorgeous. less than an hour ago, the team sent out a tweet saying she's about five miles from the finish line in key west, but, as i mentioned, some concerns right now over her health. a doctor following closely to nyad, they say her tongue and lips are very swollen, causing her speech to be slurred, also concerns about her airways, making it tough to breathe out there as she swims and works hard. if she succeeds, it will be a
