people what does it mean if assad wins and the opposition loses? >> reporter: the president's window to make his case is closing. he heads overseas tonight. where he'll try to gain international support. even some russian lawmakers told vladimir putin, they want to come to washington to vote against president obama's plan. and what to watch for over the next several days is members of coming reluctant to support any military action. saying they want better clarity about what it will look like. they want the scope and scale to be better limited. that is something that the officials here say they are willing to accommodate. >> thank you so much. let's turn to senator john mccain. he is making headlines. he joins us from capitol hill. good morning to you. >> good morning.

>> you said yesterday on the white house north lawn for congress to reject the president's call for military action would be, quote, cat trough fik. does that mean you are a yes vote for military action even if it doesn't go as far as you would hope? >> no, it does not. i can't support something that i'm afraid maybe doomed to failure in the long-run. but it still are be catastrophic if we turn down and reverse a policy that was -- an action that was going to take place. i think it does horrendous damage to the credibility of the president of the united states. but if this resolution doesn't do with what we discussed with the president yesterday, getting sufficient weapons and the right kind of weapons to the syrian army, and changing the momentum

on the ground in syria from assad's favor to that of the pre-syrian army, then this resolution will not have the desired effect. >> everyone knows that syria is an array of pad and worse options. is it better to do nothing than something that is limited? >> i think it's a very tough call. but to do nothing, is as i said, would have kons kwepss throughout the world. but to do something that really other words, some token strikes and then some time later assad uses those chemical weapons again? what do we do then? go through the same routine. the president of the united states put himself in a very difficult position when he said two years ago that assad should leave. a year ago that there was a red line in the use of chemical weapons. and now after saying that he would launch strikes is now

referring to congress for their approval or disapproval. it's a very difficult game that he's playing. and the stakes are incredibly high. and by the way, this is already a regional conflict. >> and very quickly, just to be candid with the american people, if the u.s. were to engage in military action in syria, what are the chances that that's the end of it? is there any scenario that the u.s. does not get more deeply involved? >> yes. you provide the weapons and you take out the air power that is the distinct advantage that assad had. you commit to no american troops on the ground and you can reverse this. the pre-syrian army is viable, strong and moderate. and anything that tells you anything different isn't telling you ut truth. we need to reverse the situation on the battlefield. russian weapons and arraignian

weapons are pouring in. >> i've got to leave it there. but at this moment, do you have confidence that this resolution will pass? >> say that again. >> do you have confidence that this will ultimately pass the congress? >> i hope -- i hope so. but it's got to be a resolution that will achieve the goals that i just described. and if it doesn't, then obviously then i can't support it. >> senator john mccain, always good to get your perspective. thank you. >> and natalie is here with new details on how and why the u.s. government is now monitoring a key ally. >> paying just as much attention to pakistan as it does to al qaeda and arain. this court reporter a new report to the washington post. it shows that the united states has ramped up its surveillance of pakistan's nuclear arms. according to the report the

in key west with the details. kerry, good morning. >> reporter: good morning, willie. coaches are always telling athletes that their mental game is just as important, maybe more important than their physical skill and nowhere is that more evident than today in diana nyad's incredible victory. this is what raw determination looks like. after 54 hours, 52 minutes, and 18 seconds of stroke after stroke after stroke, more than 110 miles, one stroke at a time. >> you should never ever give up. >> reporter: and at 64 years old, this is what triumph sounds like. >> we knew you were going to do it. we are so proud of you. >> reporter: and what inspiration means. >> you're never too old to chase your dreams. >> i'm going to find a goal, a dream and i'm going to do it too. >> reporter: her record breaking swim took two nights to complete

but was 35 years in the making. beginning with her first attempt in 1978. the begees were at the top of the charts but despite attempt after attempt plagued by strong currents, rough weather, sharks and painful jelly fish stings, she persisted. >> i'm not a quitter. >> reporter: this time she was ready with a new protective suit, a specially designed mask and a sting stopper cream. as she neared her goal i talked to her team by radio. >> can you believe that diana made it this far? >> unbelievable. we witnessed it ourselves and we can't believe it. >> reporter: and then finally to the cheers of a crowd waiting on the beach, the moment her supporters around the world had been waiting for. >> i love the journey. >> reporter: hours later she left the hospital, still sun burned, her lips and tongue

still swollen, diana nyad's spirit seems as resolute as the moment she set out from havana and swam into the record books. >> you can dream, you can be vital and in your prime. i may not look it right now but catch me on a good day, i'm in my prime. >> reporter: she told us this morning as she was taking the final strokes toward the beach, she was looking for a television camera because she wanted among the first words recorded when she came up on the shore to be never give up. clearly, she has taught all of us that, willie. >> kerry sanders in key west. thank you so much. joining us now diana nyad herself. good morning. congratulations. >> willie, thank you very much. >> i'm going to ask you about your emotions in just a minute but after 53 hours through jelly fish, sharks and rough seas, how are you feeling physically this morning? >> you know, i feel all right. it's amazing how the emotional

can lift the physical. i remember the feeling only too well. right here in key west the last few years not making it and i felt pretty beat up and sore and down and tired. but to see that beach and see those people and to come in with my intrepid crew, it just takes all the physical pain away. >> this dream was 35 years in the making. your first attempt was in 1978. what was different about the fifth attempt that didn't happen for you in the first four? >> well, number one, i had the jelly fish expert of the world with me. before we went out saying i hope we get lucky and make it through and the animals are the most deadly in the ocean. so she was there every minute diving around me saying they're not in the water right now. i also work with a prosthetics maker to make the mask to protect me from the jelly fish.

very difficult to swim in. i took in a lot of saltwater and now i have huge abrasions in the mouth from the mask rubbing. but, the jellyfish, i decided the resolve was so strong to make this swim, that i had to get through them. that's their world and i had to get through them. that was one big difference this time. >> for all the physical challenges you outlined this is an incredible mental test as well. 110 miles from cuba up to florida. what do you think about at mile 50 or mile 70? what keeps you going? >> you know, there are certain all marathon swimmers and mountain climbers and endurance -- extreme endurance people that have songs and chantings and countings but i'll tell you the truth, with all the experience i have, especially in this ocean, i didn't realize how much suffering there was going to be. it was very wavey. i got very lucky with the gulf stream.

it was going right where i was going so that stayed me. but the wind action was huge. the jelly fish mask made me take in a lot of saltwater. so sick as a dog and we couldn't -- my crew couldn't find anything for me to eat or drink that i could keep down. i was vomiting constantly almost throughout the whole 53 hours. >> wow. >> and you know, you don't have strength anymore. so i wasn't out there just kind of swimming and daydreaming like usual. i was dealing with a crisis. >> well, diana nyad you are officially super human. i don't think there's anybody else that could do this. you are so cool. you are such an inspiration and it's a thrill for us to talk to you this morning. congratulations. >> willie, thank you so much for talking with me. never give up. >> never give up. >> can we just do what we want to do. >> unbelievable. >> she is truly amazing. i cannot imagine, the grit, the

you can see the backup there at the toll plaza. for the official word let's check in with our official guy.  to roll is a figure of speech because folks are slow rolling. the chopper moved the view towards the maze. it is just yñjammed. barely moving around the berkeley curve. that is the case all the way down out of the area. this is the incline heading over the bay bridge as you are making the curve. the bridge itself moves smoothly. o we are talking about the slower speeds coming off of the bridge and from the top of the screen all the way down around. a lot of folks want to use the bay bridge. they may have slowed the metering lights down, also. south 680 an earlier crash on the shoulder. it has been quite a problem since about 6:30. as the sun comes up you can make out the bottom of the screen

14-year-old and then suspended all by 31 days and gave him one day credit for time served. morales committed suicide before the case went to trial in 2010. at sentencing, he said morales was older than her chronological age at the time of the rape and was probably as much in control of the situation as he was. that angered the victim's mother. >> i was horrified. i n't believe in justice anymore. it was a joke. >> reporter: two days ler he apologized for his comments. >> i'm not sure what i was attempting to say at that point but it didn't come out correct. what i said was demeaning to all women and not what i believe in and irrelevant to the sentcing. >> reporter: but he didn't change the sentence. now the prosecutor is trying to change that. >> certainly i'm disappointed in this sentence but i have a job to do and my job right now is to

figure out if this case can be appealed because of some legal error. >> reporter: in an interview the victim's mother said it's hard to explain to her younger brothers and sister. >> what happened to him, mom? what do you say? nothing. >> reporter: the state's national organization for women joined the chorus of outrage. >> we will no longer stand by. >> reporter: there's calls for the judge to step down or be impeached. >> when a judge losthat sense of trust from the community it's time for the judgeo stop being a judge. >> reporter: no word on what happens next as the controversial comments reverberate in the voices of protest. for today, john yang, nbc news, chicago. the judge apologized for the comments but it maybe too late based on the protests. coming up next on trending, look

throw by colt's back up quarterback caught oliver smack in the face. the kind of hit that leaves a viewer wincing in pain, let alone the victim. >> that's got to hurt, still. quite a sting. >> oh my god. >> those balls are heavy. >> despite it, oliveve kept reporting telling the new york ily news that she thought you don't want to be wimpy. you just have to push through it. push she did until the next morning when she woke up to a hold on to your head kind of inding headache. turns out like so many of the players she covers, oliver had a concussion. the sensitivity to light started and some nausea too. my whole body was sore, oliver explained. i really could not take light. the light from thetv, the accent lighting, the sun was my enemy. my blinds were drawn. it was miserable. >> what happened is she was hit in the backside of her skull and the ball moved her head a

twisted it. what happened was the brain twisted inside the skull and probablyit up against the inside part of thekull causing a concussion. >> reporter: a frightening experience but oliver isn't alone. sideline reporters have a long history of being on the wng side of the play. as for oliver, she pent five days hiding inside a dark room at home. the ordeal a lesson for the veteran reporter on just how dangerous the sport can be. >> i start wondering how these guys go back to being hit, she said, taking all of that punishment a week or two later. >> oliver will be back on the sidelines this sunday in san francisco when the 49ers play the packers. she is promising to keep her hit on a swivel. you have to watch the ball. make sure you keep your eyen the play. >> but it's hard to do. you're trying to talk to somebody and have a nversation. >> it's interesting. it gives her new insight on the sport she covered for so long. >> she is one of the great

activis, but what comes to mind when you think of alzheimer's disease? activists believelzheimer's has an imagine problem. >> it's a bummer of a disease you almost have to have the most fun charity event imaginable to counter act that weight in some way and make people excited about participating in it. >> i'm happy that i've been the face of this disease. >> reporter: as with magic johnson d hiv, michael j. fox and parkinsons, the hope is many more celebrities will ld their faces to the disease, like seth rogen and his wife, actress lauren miller whose mother was diagnosed at the age of 55. it can be brutal. i'm at that point in my life where my girlfriends are becoming best friends with their mothers and, you know, on sunday i fedy mom dinner. >> thank you for coming. it's not easy to get people to do this kind of thing. >> reporter: rogen and miller are raising awareness and money with their fund-raising event called hilarity for charity.

>> yes, but it will take a long time to do that. >> alzheimer's is a devastating diase. >> like many others in the battle for money, republican senator susan collins who lost her grandfather and other relatives to the disease says congress must match the funding of the other big diseas. >> we spend less tha $500 million on research to find a means of preventing or treating or curing alzheimer's. that makes n sense at all. >> ccer at $6 billion a year made enormous progress. hiv/aids is $3 billi a year. we made enoous progress. 500 million, we're not going to make it. >> alzheimer's actist. >> how do u remarkethe disease? >> brain health. living a healthy life. is having a check up from the neck up as common and unlettening as a check up from the neck down. >> if i did a commercial

tomorrow and showed 5 or 6 people in their 50s showing i have alzheimer's, i am alzheimer's would be one way to say it's effecting this bubble and not off if the future. >> this is the most feared disease. we need to take that fear and turn it into engagement and action. >> it may come as a surprise but there's a national alzheimer's act signed in 2011 and it comes for discovering ways to prevent and treat alzheimer's by the year 2025 b b thateems like a far way off. >> let's get the conversation going a little more. let's bring in melissa. you are a pr ecutive and you lost your mom to alzheimer's. we don't need to think of the disease as hing an imagine problem but do you think there's an effor >> yeah, absolutely.

i think there is a negative stigma that surrounds this. often people think of it as a disease that old people get, but it's really not. it can affect younger people. and the caregivers of those who have the disease. a national stage can maybe help and change that negative image. >> first of all, you want early intervention. you want people to be aware for their own health. but you also need the research dollars. >> as you saw what aids gets, what cancer gets versus what a alzheimer's get. young people are going to take care of their parents. we have boomers coming of age. it is an issue for young people like melissa who lose their mothers. >> you mentioned maybe having a safe place. >> i think caregivers, grandchildren of people are affected and children of people like myself.

i was 17 when i first started to be affected by that. but i think that having a celebrity to kind of see that face. and a younger person who is saying they have been exposed to the disease will help to change the negative stigma. we can engage younger generations as well so socially connected. it would be amazing to have them lead the charge, change facebook and twitter purple for alzheimer's day. >> melissa, great to have your persian. >> hopefully it will make a huge distance. we will report all through the week on "today". trying to tell you what's out there. exercise. and new innovative programs. >> our conversation is really just beginning. thank you so much. appreciate it. and now we will send it over to willie. >> all right. savannah, thank you very much. j.d.salinger's the catcher and the rye is the right of passage for thousands around the world. now a new biography and mov is revealing details about the author. >> catcher and the rye caught my attention when it first came out. >> there had not been a voice like that. so personal, to revealing. somebody had stripped the layers away from his soul. >> it said on the cover this book wil change your life. and i bought the book but i was afraid to read it because i didn't want my life changed. >> it's magical. you're like how did he do that?

how did he put it all together that way and lead me through it in such a way that iould land just like that in that final statement where you're so grateful to him and you want to go find him. >> shane is the director of salinger and coauthor of a companion biography. it took you nine years to put this project together and the biggest revelation that is j.d.salinger continued to write if not publish. >> he continued to write every day for four years. he never stopped writing. he would work every single day. he was disciplined and we know that work is coming. >> you report he had a plan to have it published after his death. how do you know this? what is your sources? have you seen this material? >> we did a nine yr investigation. we interviewed over 200 people. we have the first people to ever

find photos of him. the details of his first wife which is an extraordinary story and in the course of that nine year detective story we were fortunate enough to find two dependent and separate witnesses who had seen this work and who had told us and identical story about when it would be published and it's very exciting for millions of fans around the world. >> there was rumors swirlg around that there was a vault and we know more about the content of the books. >> he is gng to unite these two families so that the great master works of j.d. salinger will be the two families and the work completes this sort of great story of these two milies that he has been working on since the early 40s. >> speaking of family, j.d j.d. salinger was private. did his family cooperate in the

project? how did they feel about so much being revealed? >> there was initial cooperation with one family member. that didn't workout. we have produced this film over 9 1/2 years. it's a labor of love for everyone involved in it. what we heard from his friends is it's the closest that anyone has ever seemed to getting inside his head. at the film festival, he knew him for years and he said you got him. that was the jerry i knew. former lovers who spent time wi him also said that. so it's been quite rewarding. ken bur said that the film was extraordinary which was a huge endorsement for us and real validation for all the work we have done. >> there are other revelations in the book. we don't have time to catalog them all but what in your mind -- the other thing that's mo surprising to come out of this project? >> i think how much the war deeply influenced j.d. salinger.

world war iiroke him as ayman but made him as an artist. that was an extraordinary thing to understand. j.d. salinger landed on d-day and participated in a liberation of a concentration camp and married a german woman. there were so many fascinating details about him and his life. >> and what do you think tha famously private person would think about all of this being ou there. so much of him being exposed. >> what i sincerely hope is that he would expect the at the kad that went into telling his story right. it needed to be told. it's a fascinating story and we did everything in our power to tell it right. >> thank you so much. >> thank you for having me. >> i should mention the biography is out today. the movie com out on friday. >> tnk you. >> coming up next, how would you handle it? one family struggles rsing a

c.j. likes to play with girl things and likes to be treed as a girl. use terms like gender creative and gender non-conforming. what does that mean for you. >> it all means he's a boy that doesn't golong with what society thinks a boy should be. he is a boy. he knows he's a boy. he likes his boy body b isn't comfortable with what society thinks a boy should be. >> take me back to the moment when you first realized that he was a little bit different than other boys his age. you talk about going to the barbie aisle. the pink aisle and he lit up. >> yeah he found a barbie in my oset. he came alive and his entire li we mark by before barbie and after barbie. i took him to the pink aisle which i had been hiding from him because we have boys so we went to the blue aisle and he just lit up. >> how have you been handling this as a dad. be real honest. has there ever been a moment

when you said i wish c.j. would pick up a baseball with me? >> to be honest, there's a lot of moments like that. there is an evolution process. we have grown leaps and bounds as parents, but there's days of frustration. but the biggest thing in all of this is love your child no matter what. we built a house, love and trust and safe environment and that's the most important thing that i can give to my kids. >> you can build a safe environment in a home but what you can't control is what happens when you go outside the house. i'm a father of a 6-year-old. going to first grade, one of my great fears is when she goes out and people start making fun of who she is or what she's wearing. how much do you think about that with c.j. >> i think about it every day. people can be rude and hav negative reactions to him.

he chooses to selfdit so he has a public personality and private personality but still he'll wear the gir shoes out and the girl socks and necklaces. so we're trying to raise him to be a strong confident person. and hopeor the best and then watch out for bullying and teasg. >> any concerns for yo lori, opening up like this publicly. you have identified him as perhaps gay. u said you don't know if he's fwa, maybe he's transgender. do you think he'll look out and say i wish my mom hadn't put all of that online where it lives forever? >> i was careful with everytng i did and all the choices i made and the's going to be no denying it. he's going to see every picture of him. you can tell that he is gender non-conforming and there's no shame. we're just hoping we can educate people about kids like c. >> he has a great big brother who looks after c.j. again,he book is raising my rainbow. it's a great story. thank you so much.

something else. i will say it's sort of the ying and the yang. on the negative end i had this beautiful jelly fish mask. i'm sure you saw it and it allowed me. it's all silicone and even goes into the mouth so the deadly anims, they give a fatal sting couldn't get me. i always had a suit and i had gloves and i had booties. but i never could figure out how to breathe and protect the mouth. so they mad me this beautiful mask and it worked so i have to be happy and grateful but with the waves, we had bad weather in terms of wind and that made me swallow, as you puttingit, all kinds of sea water. i have deep lacerations all over the mouth. really painful. and but the ying and the yang, the good thing, the gulf stream

shined on us. it's always going in the wrong direction. it's always huge turbulence but for me it went north and i wen north with it. >> what was it, the fifth time diana and you mentioned the gulf stream and you mentioned weather but what was it that you think made it possible this time around? at got you over it? >> well, y know it's all of those factors outthere. yo can't control them but you have to have some intelligent answer to em. you hav to have solutions. the world's leading expert o the box jellyfish was literally with me throughout the night with the shark divers. she was in the water with her lamp and she had a net. she was literally scooping up jellyfish and telling me get over there. get the mask back on, you need it know even thoh you're swallowingaltwater and i started vomiting a lot because

of the saltwater. once you get in that situation yodon't want to eat any food. then you start losing stngth. then you start gettingcold. i'll tell you something, that first night, saturday night, those 13 hours were hell on earth. but i had angel with me. i had john bartlet, my navigator who is a genius and he has figured out the gulf stream. we got lucky with it but he also knew it and my whole team, 35 people, just rock. >> diana, given all that you have been through, i know you are getting back in the water relatively soon in october but it's a special benefit here for hurricane sandy relief; is that right? >> it is. i'm going to, along with my personal goals in life, my sort of cause is going to be we have this beautiful pool built by the olympic pool people. we're going to install it in harold square and i'm going to

significant are fall and winter and one of the things we need to think about is our language. when we think about fall we think we are going to fall down. we can callt autumnnd think about the positive aspect of the change and the colors. there's beautiful things that happen. people that have s.a.d. suffer and light is important. some people use light therapy. you don't have to use light therapy but get outside and get the vitamin d. have a balanced diet and move. even if you're bundling up, get outside and move. that will help to change the end end endorphines in your body and you'll feel better. >> you have to get them bk into a route. how do you get them into that? >> one thing i do, i start the first couple of weeks in august and i make sure that my kids do all the summer reading assignments. and i'm like it's that time of the year and i have an 8-year-old and 16-year-old. last night i said to her we're one week out so that means it's

time to go to bed earlier. >> this transitioning is very important. because a lot of times kids get off their schedule in the summertime and having a really balanced diet, exercise and a routine. kids do well with schedule and routine and the other thing is if an adult is not feeling great about it, get music in the house anget the music songs youl love on your ip and g them down now so in november you don't have to think about what am i going to listen to but get your spirit up. >> some dreadhe temperature changes. for those of us thaton't like being stuck inside all the time or when it's raining and it's cold outside, what can we do to movate oselves to get up and go? >> well, again, keep moving. if you have a friend that you're going to be able to meet on the corner and do a walk with, a lot of charities have walks and have programsutside to raise money. and if you can get a community tother and you can train, you will really have a motivation

police department over the next four years it would also restore the 10% pay cuts officers took during the recession. and firefighters say they are close to containing that rim fire burning in yosemite. this morning, cal fire saying the fire is 75% contained. if has burned almost 236,000 acres. that is an area larger than new york city. after the break, we will take a look that the forecast and mike will look at your morning commute.

good morning to you, it is 9:56, i'm marla tellez. san jose police say there is still no sign of the hit and run driver responsible for killing two women on their way to work at mineta san jose airport yesterday. the families of 63-year-old carmen zavalla and 16-year-old

christina deleon spent last night bringing flowers and candles to sky port and north first street. it was there, police say, the women's toyota was struck by a speeding mercedes. the women died from their injuries. the stubborn rim fire continues to burn near the hetch hetchy reservoir. today, we expect to get an update on the water quality there that affects 80% of bay area homes. since the fire began, crews have worked hard to make sure it does not spread to the hetch hetchy, the main source of drinking water for a good portion of the bay area. the day after labor day turns out to be a nice day. let's go ahead and check that forecast with meteorologist rob mayeda. good morning. >> we are still seeing a somewhat humid conditions around the bay area for at least one more day, but the showers have moved on. see high temperatures inland, upper 70s to low 80s around san jose, upper 60s around san francisco, mid-70s oakland, if you are in the valleys, enjoy the relative mild temperatures
