today. a home invasion robbery has ended in gunfire near the corner of lodi avenue and norfolk street off highway 101 in san mateo. there is at least one person shot. but authorities say they're looking for more victims. "today in the bay's" arturo santiago joins us from the scene with new information. good morning, arturo. >> reporter: good morning, marla. police are not releasing a whole lot of information on this. we do know about one victim, a 24-year-old man who had been shot. san mateo police got the call at around 1:00 this morning. they came to a home on the 1500 block of lodi avenue. that's when they found the 24-year-old victim. he had non-life-threatening injuries and was taken to the hospital. as for what happened, police only said there was an exchange of gunfire. >> not going to rule out anything at this point. we're still investigating this. we're going have to interview some people to determine exactly

what happened. >> reporter: police say there may be other victims, but they did not go into any further detail. but there was a report of a victim with multiple gunshot wounds who walked into the regional medical center in san jose and died. but san mateo police are not commenting on that case. police plan on being out here at the scene for several more hours as they continue to gather evidence and process the scene and continue with their investigation. live in san mateo, i'm arturo santiago, "today in the bay." an investigation is under way in sunnyvale after officers shot and killed a man in the parking lot of a popular restaurant. the shooting happened in the parking lot of hobe's restaurant yesterday afternoon. there was a confrontation between officers and a man inside a white pickup truck. witnesses say they heard the shots. >> about 30 seconds to a minute later, we heard what sounded like more knocking. we came out and found out it was

actually gunshots. the suspect's name has not been released. hobe's was shut down yesterday, expected to reopen this morning. no customers or workers were hurt. you might remember about three months ago vice president joe biden made a surprise stop at this same restaurant to visit with customers. such a sad story out of the east bay. a 2-year-old boy was hit and killed by a boy in oakland. it happened yesterday on embarcadero near 8th avenue. police say the boy was playing in a parking lot outside an abandoned building. his mother was nearby selling fruit out of her truck when a car rolled through the parking lot and hit the boy killing him. police say it appears to be an accident and the driver is cooperating with the investigation. a new warning this morning from uc berkeley police after a pair of indecent exposure incidents on campus. early yesterday morning the student living in the dorms says

she came out of a bathroom stall and a man was in the room exposing himself. on monday night another woman studying in a housing complex said she saw a man watching her through a wichb dough with his pants down. police are not sure if the two incidents are related. the recent bay bridge closure is causing an unexpected side effect. a dozen b.a.r.t. train cars are out of service for repairs after moving hundreds of thousands of commuters across the bay during the closure. "today in the bay's" christie smith live with more on what's being done to get the trains back on track. >> reporter: b.a.r.t. was the go-to service when the bay bridge was shut down. it ran 24 hours a day. we didn't hear any complaints except that the trains were crowded. now we're learning the cost of that and the repairs that are needed. there were almost 400,000 extra trips from passengers during that time.

since then more than a dozen rail cars had to be pulled out of service. earlier it said it saw double the number of issues and failures. doors not opening, overheating. stuck windshield wipers like deferred maintenance on car. some rail systems have multiple sets of tracks. what they can do is work on trains with one set of trx and roll them on another. that's not the case for b.a.r.t. the third rail has to be shut down for the work to take place. b.a.r.t. cranked out an extra 235,000 miles, extra 7,800 in maintenance. they think it will take at least a week to catch up with everything. christie smith, "today in the bay." let's check in with meteorologist krosh. i was trying to toss to you earlier, but now you're there. let's talk about it. how is the weather? >> i'll take it any time. i'll take any sort of compliment from you. just thinking about me makes me

feel good. thank you terry mcsweeney. good morning, marla. glad to have both of you here with us this morning. we're so bless phd the bay area, it's been so lovely. a major heat wave in southern california whereas we are going to see just spectacular conditions for today, starting with the current temperatures, 61 degrees in concord, at 62. good morning, oakland. you couple that with a comfortable summer breeze and we're looking really good for today. temperatures are going to be comfortable today and tomorrow. i've got to warn you, we are going to crank the heat up as we get into the next couple weekends. this is what we're talking about. for today temperatures will be nice and comfortable. want to put everything into perspective, though. september 22nd is the official kickoff of fall. you really want to keep that in mind. as you know around the bay area, it can get cool very quickly. enjoy your beach conditions while they last. 89 inland. bay side 79. 69 degrees at san francisco. santa cruz today 75 degrees. count on extra traffic over 17 for that reason alone. let's check on your drive right

now. here is mike. >> every time you give a great forecast and talk about how great it is in santa cruz. everybody who drives 17 complains. i'm going to say it's bad. i'm not the meteorologist. looking at the san mateo bridge, a nice flow of traffic. there's a repost of a stalled vehicle along that flat section somewhere right around the fog line. that's one of the painted lines along the edge of the roadway so you know during fog when you come to the edge of the roadway. we don't see any slowing despite that. look at the sensors on our maps. we see a smooth flow as far as the sensors across 92. dumbarton bridge moving smoothly. over to the peninsula side, arturo is at the scene of the home invasion robbery. that's norfolk and lodi is the intersection just south of kehoe. the off-ramp at kehoe is open. no effect to the freeway. norfolk is a pretty major roadway. that may affect your drive. you'll have to get rerouted about a block or two around.

over to the east bay, looking at 4880 through oakland where northbound still has a little slowing as they continue to clear the last of those crews from between the coliseum and downtown, pretty much 90 is when things are cleared there. we'll walk you through that coming up. back to you. look forward to it. 5:08. safe way agreed to pay hundreds of thousands of dollars as part of a settlement after being sued for air pollution. the environmental protection agency claims safe way violated the clean air act by failing to properly repair coolant leaks in its refrigeration equipment. the coolant is known to damage the earth's ozone layer. under the settlement safe way agreed to reduce the coolant leaks and pay a $600,000 fine. a federal court denied an appeal from a peninsula high school to validate hundreds of ap test scores thrown out by the college board. students and parents at mills

steering wheel as you cross the open water bridges. a bit of a pressure ingredient. this will keep our temperatures very summer like for today. right on track with seasonal averages. plenty of 60s and 70s around the coast. 80s to the very lowest 90s in your inland city. antioch will hit about 91 degrees. i'm forecasting mid 80s in livermore. a lot more comfortable out there today. this is what we're expecting in those winds. wherever you see the waerm colors, that's where we'll see the winds crank as we head throughout the afternoon. 20 to 30-mile-per-hour sustained speeds. at the immediate coast you'll get gusty conditions later this evening. we call them sundowners, at their strongest between 5:00 and 8:00. 77 degrees on the way to fremont today and 79 degrees right here in beautiful san jose. 79 degrees. hard to beat that as you kickoff the first week of september. as we head through the next couple days, temperatures are

going to crank up. this might be our last round of near record breaking heat all summer long. that means if you're trying to get over to the beach and want to kids down to warm santa cruz, gorgeous conditions for next week. back in the 80s by wednesday. >> i like the 80s. looking over here tracking the north bay. no major issues as far as slowing goes in our shot. southbound on 101, just over the crest is lincoln avenue. along the stretch, reports that a car has hit and killed a dooefrmt reports are that there was activity in the lanes. i don't see any of this problem because north san pedro and lincoln. watch for little slowing. we'll look at the maps through the same area. this is where i marked right here with the arrow. i don't see any slowing through the area, except for a blip that shows farther north. it might be actually before you

get to north san pedro in our camera view. right now the richmond-san rafael bridge showing speeds a fraction below the speed limit as the volume builds coming over from the richmond side. this ashby avenue area starting to show surface street congestion as folks head over to university. this entire stretch has been very slow for the last couple days ever since the bay bridge reopened. it will probably continue for the next week or so as folks probably head over there. if you didn't have to take the bridge but you could, a lot of folks are doing that because it's such a spectacle. we have the configuration changes a little bit. these lanes may just look cleaner. there's also an issue. you can't cut between these lanes because the plastic dividers are there. we see a pattern lining up on the ride as you approach the toll plaza. it may again be an issue because the dividers are there.

watching for this continued pattern. across the span, a nice smooth drive as well. around the bend and all the way over toward treasure island, there's no major issue. but right around this bend, as you get near this canopy of cables, folks slow a bit. on average, less cars going across the bridge right now than there were before the changes because they've slowed the metering lights. prepare for big delays getting out of the city. last couple days, two, three-hour delays from some of the folks getting out of the city and to the east bay. keep that in mind as you plan your day. the bridge will be there after the big rush. 5:18. san francisco could soon be illegal for law enforcement to detain someone solely based on their immigration status. supervisors are expected to consider and approve the proposal today. its author, supervisor john ave. low says the current situation in the city has created a, quote, drag net that is

wrongfully sweeping up innocent people. police chief greg suhr says he wants convicted fell lons and those with prior weapons convictions exempt from the law. we're getting an up-close work being done to the work at an event along the creek in east palo alto. they've been placing boulders and rocks to stabilize the creekbed and help control the water flow. crews are removing a century-old concrete barrier which kept fish from being able to swim all the way through the creek. the palo alto unified school district is recruiting parents to fix the report card system. the current report card is tied to the old state standards. they're forming an advisory committee to share ideas and review drafts of a new report card designed to reflect the common core standards in math

and language arts. those new standards will be fully implemented next school year if you're interested. applications for the committee are due september 16. >> now an exclusive preview of an investigative unit report. is it the biggest breakdown in toxics regulation by the state in the metal sledding industry pumps out 700,000 tons of waste each year. it would be the largest hazardous waste stream in the state if all of it was classified that year. for years regulators ignored their own warnings about how hazardous the waste really is. the department says it's complex and critics say regulators are failing. >> does the dtsc consider shredded residue a hazard. >> once it's treated, we don't see it as a hazard. >> what's impacting californians, the highest public health risk, nothing is a priority and nothing gets done. >> tonight at 11:00, the

5:23. a southern california hospital is under investigation and facing a lawsuit after an unconscious patient was mistreated by doctors. look at this. the "los angeles times" pulled this image in court documents. anesthesiologist at torrence memorial medical center covered a patient's face with stickers. a nurse's aide took the photo with a cell phone. the patient was a long-time

hospital employee. the hospital admits the incident happened. the employees were disciplined but not fired. as we have reported the nfl season starts tonight. fans are ready for another exciting year. especially the 9ers fans. they have to get ready to pay up, san francisco boasted the biggest spike in average ticket prices, up 85% from this time last year. average price will be $229 for a ticket. the single most expensive game this season also involving the 49ers. it's their september 15th game against the seattle seahawks played in seattle. the highest price will go to the bears. fans will pay about $446 a ticket. an 80-year-old idaho woman is getting national attention after she managed to scam a scammer. ruth o'leary says the man called saying she won $2.5 million. it's a pretty common scam. the scammer says send me some

money and i'll send you that amount back and much more. rule called him out. he kept calling, finally sending her a real $50 check to try to prove he was telling the truth. >> he said, okay, then. you send my $50 back. and i said no, i'm not sending your $50 back. for all the trouble i've gone answering the phone. no way. i'm keeping the $50. and he said, i will call police and have you arrested. i said, oh, okay, go ahead. in fact, i'll call the police for you if you want me to and we'll see who is arrested. >> ruth, ain't that the truth, took a second check the scammer put her to the check and reported as fraud. that check was worth $4,000. she also called the local sheriff's office. >> i think we should recruit ruth for our investigative unit.

"today in the bay's" arturo santiago joins us live from the scene. >> reporter: police got the call around 1:00 this morning. they responded to a home just down the street on the 1500 block of lodi avenue. when officers arrived on the scene, there was a 24-year-old man in the street who had been shot. he was taken to the hospital with what were considered to be non-life-threatening injuries. police say there may also be other victims, but they didn't elaborate on that. san mateo police have been here for several hours now. it appears they're going to be here for at least several more as they continue to collect evidence and process the scene. also overnight there was report of a victim with multiple gunshot wounds who walked into the regional medical center in san jose and died. police are not commenting on whether or not there's a connection to that shooting. at this point police are only confirming there was an exchange of gunfire that resulted in the 24-year-old victim. again, police will be here on the scene for several more hours as they continue to investigate.

live in san mateo, i'm arturo santiago, "today in the bay." 5:31. a san jose family is searching for answers after the sudden death of their mother. police say they now have arrested someone in connection to the death of reyna figueroa. her body was found in a car near san antonio elementary school in east san jose tuesday afternoon. police say it was a homicide but haven't released the suspect's name or a motive. they say the two knew each other. figueroa worked as a school yard supervisor. san jose police made two additional arrests in connection with a shooting death of a san jose state nursing student. the three men face homicide and gang enhancement charges. police say they were all involved in a gang-related shootout last month near third and san salvador. 19-year-old kimberly chico was in a nearby car when she was hit by a stray bullet.

walmart workers in san francisco and more than a dozen cities across the country are expected to hit the picket line. organizers of the protest say the company missed a labor day deadline to respond to demands including reinstating workers they say were illegally fired and a commitment toive prove jobs nationwide. the company says the protests are stunts do not represent the views of moat of their associates. repair work is under way for a dozen b.a.r.t. train cars worn out after moving hundreds of thousands of riders around the clock during the recent bay bridge closure. "today in the bay's" christie smith is live at the west oakland b.a.r.t. station with more work on the details to get the trains back on track. good morning. >> reporter: good morning, march los angeles train doors sticking, trains overheating. that's what b.a.r.t. says it's dealing with after it ran 24 hours a day during the bay bridge closure for five days.

now we're learning the downside of that. b.a.r.t. is saying at least a dozen rail cars will have to be pulled out of service for maintenance and repair work. during the five-day closure trains were full, the system a real work horse that kept the bay area moving. an extra 380,000 trips moving at the time. the maintenance, b.a.r.t. managers say it can't run all night. other large public transit agencies have multiple tracks to do, run trains at the same time. a third rail would have to be shut for the work to go on. i smoke with one b.a.r.t. ride who are has no patience for all this. >> you do see them occasionally. i don't think it should be a major problem. i think they should be prepared to run 24 hours a day as opposed to running the schedule they do run. new york city ones their trains 24 hours a day and they don't have the maintenance issues that b.a.r.t. is complaining about as of now.

so if that is their problem, get more people on board and fix your trains. >> reporter: here is how it stacks up, b.a.r.t. cranked out an extra 235,000 miles during the bay bridge closure. that amounted to about 7,800 hours in extra maintenance. it's saying b.a.r.t. mechanics believe it will take at least a week, maybe more to catch up with it all. live in oakland, christie smith, "today in the bay." the california public utilities commission is considering cracking down on popular app-based ride sharing services like uber, licht and side car. today the commission is expected to vote on proposed regulations that will apply to any company connecting riders with non-commercial drivers. under the plan the drivers would have to undergo a background check, a zero tolerance drug and alcohol policy and a strict insurance policy: the vote comes

one day after the nfl players association announced it's seeming up with uber to help players get around safely. every active nfl player is going to get a personalized key chain card with $200 in ride credits. they'll be able to use the service to get a ride in 20 sit dress across the u.s. uber says it hopes the partnership will help players keep out of trouble. >> i hate to say it. i think nfl players can afford to hire a driver. meteorologist christina loren, time to talk to you about a thursday, friday eve forecast. >> looking good. colin kaepernick, you need a chauffeur, give me a call. i'm sure marla would volunteer for that as well. your weather headlines tell the story of the day. a good looking day shaping up. it depends on where you live. if you want cooler weather, weave got that in store inland. slight cooling by about three to five degrees from yesterday's highs.

it's going to be the coolest of the next seven days, beautiful beach weather as we get into your friday. that's going to translate to a much hotter day inland. talking about an eight to ten-degree climb between today and tomorrow. then as we get into the weekend, hate to say it. we're talking near record warm negligent the bay area. 89 inland today, 79 bay side, at the coast 69 degrees. i'll show you just how hot it's going to be, where you live and when that heat will break in my next report. first i want to take a look at the morning drive. here is mike inouye. >> looking over here toward the berkeley curve where i did track as best i could the flashing lights. there was a rolling traffic break going on from university avenue. i saw folks very slow as chp went back and forth going through the maze and heading east on 580. that has cleared now. no report of what that incident was other than a stall in berkeley. now the traffic flowing smoothly

at the berkeley curve. taillights clustering in the cash lanes. you see it the last couple days as folks come off the eastshore freeway and interstate 880. we look at the maps and see a smooth drive as well down the same area. no major issues as far as speed flow. you saw the volume starting to build through the area. also building for west 580 out of livermore and toward the dublin interchange and slowing for 84 west, isabel to val vallecitos. we have slowing in the south bay which i'll show you coming up. 5:38 right now. >> speeding you through security. the new changes that will help you out of the bay area's three major airports. plus the president arrived in russia early this morning, getting ready to meet with world leaders. a live report on key issues including the hot topic, of course, syria.

and the president plans a one-on-one meeting there as well. the big topic they'll be talking about in that work session begins later this morning our time, the economy. while the larger countries are doing much better than when the g-20 first started meeting a few years ago, five years ago, the smaller developing countries are now having a tough time of it because interest rates are going up and they're having a hard time borrowing money to keep their economies going. that plus nsa leaker edward snowden, plus syria makes for a pretty full agenda this week. back to you, terry. >> tracie, thanks very much. we continue talking about the crisis in syria. the u.n. secretary general is calling for an international conference on syria to resolve the conflict. in a statement overnight ban ki moon said, quote, a political solution is the only way to end the bloodshed in syria, end quote. this comes as the u.s. congress votes on launching a military strike against syria in retaliation for the alleged use of chemical weapons.

syria is expected to be a topic of discussion at the g-20 summit as we just heard tracie say. china says a u.s. military strike could have global cons fences, particularly for the economy. meantime syria's government continues to blame rebel forces for the deadly attacks on civilians. during an interview yesterday, the political and media adviser to president bashar al assad called the attack a massacre and blamed it on terrorists and the extremists. she also criticized the u.s. and other governments for considering military action before revealing the results of the u.n. investigation on the alleged use of mem cal weapons. the full u.s. senate is expected to take a vote on military action next week. yesterday the senate foreign relations committee approved a plan to launch a limited air strike against syria. lawmakers from the house and senate will be briefed by white house officials in a closed door meeting today. football season is finally here. the defending super bowl

speeds coming down toward about 55 through the area. we'll see that smooth out and hit again just about 6:20. that's the pattern. 87, 280, 85 moving smoothly. over the last half hour i've seen areas like here north 85 towards saratoga and north 280 towards page mill road. those areas have seen slowing as well. i'm watching for reports of any activity. none so far. again, watch it. there's something that may be going on there again. i'll let you know if i hear about anything. right here at the dumbarton bridge, 84, san mateo bridge both moving smoothly toward the peninsula. that's the commute direction. 101 through palo alto, a smooth drive north. at willow a report of buckets in lanes. looks like they just got that cleared. all lanes cleared up towards san francisco. 101 through the north bay, a smooth drive as well. these curves right around the bend at north san pedro.iá- the freeway moves smoothly. novato down towards the san mateo bridge. a look at the bay bridge as you

cross the new span and the existing span. both westbound moves smoothly all the way into the city. a good flow of traffic and cash lanes are backing up at the toll plaza. back to you. getting through security at the bay area's three biggest airports about to get faster. oakland, san jose and sfo part of the tsa's expedited screening program which is expanding to improve 100 airports around the country. the program allows preapproved passengers to keep their shoes and belts on, keep laptops and liquids in their bags as they go through jeaning. not everybody qualifies. but with more people in the fast lanes, the regular lines should get shorter as well. a deal by governor brown should keep hundreds of millions flowing to bay area transit agencies. a dispute over the state's public employee pension law prompted the federal government to halt more than $1.5 billion in grants that were supposed to go to the state's public transit agencies. in the bay area alone, an estimated 600 million would have

been at risk. this includes almost $150 million for b.a.r.t.'s extension to san jose. the agencies will start getting the funds once the bill passes as expected. city college of san francisco is turning to one last lifeline in the fight to keep its accreditation. the college is asking for review by the accreditation commission. college officials are citing a little-known by law that would allow them to submit new evidence to the commission in hopes of reversing the decision. ccsf is set to lose the accreditation in july after the commission decided the college hadn't done enough to reform financial policies and management. a bay area congressman will pay a visit to san jose state to talk about the federal sequestration cuts. congressman mike honda will meet with students and faculty members in the biomedical and behavioral sciences. many of the students are part of a program that receives federal funding which was slashed as part of the sequestration cuts. he wants to find out how the

we have new images in the prime suspect in what police are calling the snake scam. police say this woman poses as an animal control officer, tells homeowners to go in the back yard while she looks for snakes. well, you go in the back yard and her accomplice enters the house. be keepers say they're losing tens of thousands of dollars because their honey is turning out red. state inspectors say it's likely the result of a single bee keeping operation that apparently was feeding its bees a syrup made of crushed candy canes. other bees discovered the syrup, then return to their own hives and that contaminated the hives. beekeepers say the red die showed up in the genetic material. they say the money not only looks bad, it also tastes pretty terrible as well. want to hear something

absolutely bizarre? an unusual pearing, the nra teaming up with the aclu. scott mcgrew, fighting yet another acronym. >> that's right. the nsa. the national rifle association has joined a lawsuit this morning brought by civil leb berities groups against the national security agency over the phone records scandal. we know the nsa keeps records of millions and millions of americans and their phone cause. they don't record the conversation, but they do keep record of the data, who you called, how long you talked, that sort of thing. the nra worries that data could be used to construct some kind of federal gun owner database. that's an idea the nra has always fought against. it's not the first lawsuit gun groups have brought against the nsa. in a separate case gun owners joined churches in fighting the spy agency for the same reason, that data about who people talked to, saying it's an invasion of their first amendment right to assemble.
