story in the south bay where it's been a deadly and vile want weekend. san jose police are still searching for the man may say stabbed his wife to death. they found the woman with at least one stab wound around 10:45 last night inside her home. she was pronounced dead at the scene. police tell us the husband is the primary suspect. he apparently ran from the home into the neighborhood and is still at large this morning. this homicide is the city's 36th of the year. another man is fighting for his life after he was shot in a different san jose neighborhood. this shooting happened at a home on bordeaux lane just after 5:00 yesterday evening. when officers arrived, they found a 38-year-old man with a single gunshot wound to his chest. he was taken to the hospital and overnight, police tell us his condition worsened and now his injuries are considered life threatening. witnesses said they heard an argument then gunfire. and we're learning more this

>> candles and a picture of tony and his dog were placed in the area where he took his last breath. while investigators are not confirming andy zumini is in custody, the family said he is held by the police. >> i'm in shock, i can't believe it. i feel terribly, terribly bad for my mother. >> zumini was the father of ten children. his family said he loved fixing up cars and rescuing stray dogs off the street. vanessa and priscilla say they want to carry on their father's good legacy. >> hopefully we can live up to just the standards he had for himself. >> and that was george reporting. the zumini family is planning a vigil in front of their father's home at 7:30 tonight. new this morning, all lanes of highway 35 near los gatos are open again after a deadly fiery crash overnight. it happened just before 11:00 last night on highway 35. also known at skyline boulevard. this is in the santa cruz

mountains. they say the car caught fire, one person died at the scene and two others were air lifted to the hospital. no word on their condition yet this morning. right now, it appears only one car was involved and the cause of the crash is under investigation. >> this morning, fire crews are still at the scene of a brush fire that burned dangerously close to a neighborhood in south san francisco. this happened near hillside boulevard in chestnut avenue around 2:00 yesterday afternoon. the fire quickly spread and burned about 40 acres on the south side of san bruno mountain. the fire drew resoiurces from tn different agencies, helicopters and more than 50 firefighters on the ground. in the end, crews managed to keep the fire away from the homes but dozens of people had to evacuate their homes. >> with this heat, you know, you hear the fire at yosemite, you know -- look, i have a goosebump here, just the thought of it. it's very scary. >> can't blame her. fire crews spent all last night

the national weather service said nearly an inch of rain fell in just 15 minutes near the site where a wildfire burned. so far, no reports of any injuries. san jose firefighters opened a brand new fire station this weekend. station 24 is near the corner of yerba buena road in san jose. a fire department spokesman said the new station marks a turnaround after steady cutbacks. >> given in light of the reduction in services over a period of years, this is a step forward for the city of san jose to provide fire protection services right now when they're needed where they're needed. >> people at the opening got a chance to tour the fire house, shake hands with the firefighters, mayor chuck reed was also there to celebrate the opening and restoration of services. and the new station is opening just in time. hot temperatures, dry conditions, have firefighters across the bay area on high alert this morning. san francisco enjoying a nice,

cool blanket of fog. if you thought yesterday was hot, brace yourself because it's going to get even warmer today across the bay area, waking up to mild temperatures this morning. if you're about to head out, enjoy it while you can. rob mayeda has all the rest of the forecast from the weather center, and it's interesting to see because it was hot in san francisco, too, even though there was fog. >> we had temperatures in the 80s in san francisco yesterday. many places don't have air conditioning down towards the bay. you get in the 80s and it feels hot. we are starting off the morning in the areas in yellow in the hills. 70s. that's as chilly as it's been this morning. off to the east of san jose, 24-hour temperature change shows you some of the inland east bay locations and into the north bay, starting off warmer than the same time yesterday. now, the sea breeze trying to start back up again, but notice, only southwest at 10 into fairfield and giving that the marine layer is less than 1,000

feet thick, you're not going to see a lot of cooling inland today. air quality in the moderate range today. the highest will be in the east bay valleys with the index closer to 100, but the weather is going to be nice for all the sporting events around the bay area. 49ers kiging off against the packers. we have temperatures there in the 80s. also, the san francisco giants taking on the diamond backs. should see temperatures in the 70s to mid-70s out around at&t park, and over towards the east bay, the oakland a's. all this happening around 1:00 or so. the temperatures upper 70s to 80s, and by the way, america's cup, race three and four, seeing the same temperatures and the late-day sea breeze kicking in. the monsoon moisture is staying off to the east of the bay area. here's a look around san francisco this morning, and then breaking up slightly into the afternoon. santa cruz should see a little sun and then the fog will sweep back in, and you see the sunny skies we have inland. a check of the temperatures around the bay area today.

areas south of downtown san jose looking hotter. upper 90s for morgan hill, and as you head over to sennal and pleasanton, maybe over 100 in senole. upper 70s in alamo, san francisco, though, looks a little cooler. we may approach 80 briefly in the afternoon. slightly earlier that sea breeze, a little more cooling for the coast and peninsula today. that's the exception to the rule for the hot forecast. you can escape the heat, head over to san francisco or down the coast today. tomorrow, still looks hot inland. that's mainly for the try valley. as you get into tuesday and wednesday, ocean air conditioning is back for everyone, and we cool off nicely heading towards the middle part of the week. we're getting the last kind of summer heat wave in through the bay area. part will come down with the onshore winds later in the week. >> at least it's a day where there's plenty of other things to distract you.

metal shredding industry pumped out nearly 700,000 tons of leftover metals each year. metals that are potentially toxic or contaminated and it would be the single biggest hazardous waste stream if it were classified that way. the question is, why isn't it? we continue our investigation into the toxic substances control. >> this is where cars and appliance s go to die. california's seven biggest metal shredders including this one in

redwood city and this one in oakland, crush the junked cars into small chunks of metal. the industry is a big one, bringing in 500 million dollars a year. but what happens to the leftovers? including plastic, engine fluids, and painted metals? the shredded waste is treated with a cement coating. and trucked to dumps across the state, including the altima landfill in livermore, but a growing chorus of critics say the treatment that's supposed to make this safe does not last. >> we had no idea that this was the potential hazardous industry in our community. >> jesse marquez is president of the coalition for a safe environment. he lives near a metal shredder in southern california. >> you have gas tanks that will have residual gas in it, motor oil that will be on parts, brake fluid, metal parts will be painted and it is toxic and

hazardous because we have now identified lead and other chemicals that are part of that scrap metal process. >> in a 2002 study, the senior scientist peter wood found treated fluff from at least two facilities exceeding the levels for zinc and cadmium, and chemicals linked to cancer were found in all of the samples he tested, he recommended they stop classifying this as nonhazardous. >> we determined the waste needed to be treated as hazardous. >> six years later, they took action. in 2008, she sent a letter to the shredder industry, saying they would stop allowing treated fluff to be classified as nonhazardous to, quote, insure the safety of the public and community from the harmful exposure to toxins. >> then what happened? >> i don't know everything was

tossed out. >> they haven't reclassified the fluff as hazardous. >> there's. no accountability. >> today, the current director says the issue is still under review. >> do they consider shredder residue to be a hazardous material? >> the issue of shredder residue has been on my radar since very early on. >> is it hazardous? >> that's actually not a simple question to answer. once it's been treated, we believe that it is no longer hazardous. >> why aren't they taking back the exemptions they have given out to the industry? >> those are old and out of date and we need to revisit them. >> revisit them, but will you take them away? >> i don't know yet, but i can promise i have some of my best people working on this who are going to be coming back to me with a recommendation. >> they need to make decisions. >> an industry lobbiest fought the changes. just look at the money. the seven shredders collectively pay about $35,000 a year in

generation fees. if the waste was considered hazardous, those fees would jump to more than $500,000. industry representatives declined our request to speak on camera, but in letters to the state, they say if the rules were changed, repsychollers would ship the waste out of state. they insist studies show treated fluff does not pose a threat to the health or the environment. >> i did my best, i tried. >> meanwhile, the former director said the only way to address the failure to act on issues like shredder waste is for lawmakers to step in and restructure the department. >> nobody's responsible. it's like a giant assembly line with no beginning and no end and people are just assigned to a spot on it and oh, i just hammer like this or i put in the screw. it's like, what are we doing here? you know? it's a fundamental organizational management problem. >> the current dtsc director

>> they will gather to remember the fire and the eight people who died, knowing the neighborhood where they lived will never let them forget. nbc bay area news. speaking of the disaster and disaster response, nasa aims rerch in mountain view hosted a county wide emergency training event this weekend. dozens of santa clara county volunteers with community and emergency response teams divided into teams and went through a series of stations. activities included sunch and rescue, first aid, and deeming buildings safe or unsafe to enter. volunteers are just ordinary members of the community, maybe some of your neighbors, looking to help others in the event of a major disaster. the county's emergency services office said it is crucial because first responders dont always have the ability to respond to everything quickly in the beginning. >> realistically, the number of public safety employees that we have that are going to come out to help us, it's an

more now on the crisis in syria. the the debate over u.s. intervention in syria grew louder this week after president obama failed to garner support at the g-20 economic summit in ri russia. now the stakes are higher. on tuesday, the president will make his waiss in a national address. larry gerston joins us now for more on the tense mome ntsz. great to see you in washington as the president said he would seek congressional approval, what can we expect from this speech from the president on tuesday? >> we talked about this last week. we said he had to do something like this. by golly, he will. it's the president's best opportunity to show why after two long wars, the united states must strike at syria over its use of chemical weapons. but it's critical to others and

in other ways, too. it's critical for the relationship between the president and congress. obama opened the door by asking congress to approve the strike. the stakes are large because he asked congress to participate. either way, congress responds something will happen. finally it's critical for public opinion. why? by speaking to the nation tuesday night, obama will be kind of a prosecutoring attorney, laying out his case for the jury, only this time the jury is the public. without movement on this front, not the public saying do something, it will be hard for congress to move. >> we have heard some of the arguments already saying that we can't just stand by and do absolutely nothing. do you think he'll introduce other arguments in his speech on tuesday or have we heard what we've heard and we're going to hear more of it? >> i think it's going to connect the dots. let's put it that way. look for the president to claim that syria has ignored the international chemical weapons ban. that goes back like 100 years, one of the world's most honored

treaties. killing innocent people who lost their lives by being at the wrong place at the wrong time. the president will also claim that if the united states doesn't launch a strike against syria now, the military surely will use chemical warfare again and in larger numbers and because they donknow we won't b here. and we'll open the door to iran and lebanon, hezbollah. so finally, one other thing. the president will point out the surgical nature of the strike. that's important. and unlike the regime effort changes in iraq and afghanistan, the effort here is to teach syrian president assad a lesson. a lot to do in that address. >> now, you know, it is a compelling list of arguments, but people can make the counter arguments and therefore congress could fail to give him the approval. why would they resist? >> a good question. and there are plenty of reasons.

let's begin with the evidence. some opponents argue that the evidence against assad just isn't strong enough. we have been down that path before, yes, there were chemical weapons, but were they used by syrian forces or the rebels by a way of tricking the united states into involvement? after all, we were tricked into the iraq war. how are these claims now any different than what we saw ten years ago? then there's this question of turf. opponents argue this is nothing other than a civil war. yes, assad is a brutal dictator, you better believe it, but it's not our job to save every nation from anti-democratic governments and also the question of a reach-in conflict. opponents argue that united states intervention will force syria and iran to attack israel. that will not only bring out an israeli response but a full-scale war, they claim. one that will also threaten economic stability, why? because of the soaring oil prices. so it's all kind of connected.

and finally, there's a war-weary world, and a war-weary nation. just as the g-20 nations backed off from support even as they acknowledged the crime, americans are tired of sending troops and materials abroad, even though they broke the back of the al qaeda movement, especially in afghanistan. you can begin to see both sides here, the arguments are compelling. >> now, we know, obviously, what happens if congress authorizes that strike against syria. then you know, the strikes will be imminent, i think, right? >> yes. >> if they say no, we go back to the beginning with the president says i don't need congressional approval, but i'm going to seek it. if he doesn't need it and doesn't get it, what happens then. >> this is being between a hard place and a rock. this is going to change the dynamic. 31sting a good deal of confidence into the hands of congress. look, emboldened republicans

saying, wow, they're going to draw the red line. their own red line when it comes to debt increase and other things, increasing on budget cuts before accepting any increase in the limits. and also expect resistance to the affordable care act. they're going to be beating their chests. liberal democrats opposing intervention will breathe a sigh of relief on that, but find themselves with fewer cards to play on the domestic side. remember, it's lot easier to stop legislation than it is to pass legislation. meanwhile, as congress grapples with the president, you can expect action on other bills to come to a complete halt. this has been accused of being a do-nothing congress as it is. compelling arguments, wow, this is a critical moment in the obama presidency and i would argue a critical moment for the nation to figure out who we are and where we're going. >> we're hearing the president

is doing a bunch of interviews to hair the same day as the speech, also calling members of congress. it's one phone call from one person. i don't know what i would do if i got that phone call. >> it's compelling. sometimes like regan and clinton, you know, people willing to talk to them, they would be dead set on being against what this presidents want and they go out chummy, arm and arm, because they were great communicators. obama has not enjoyed anything close to that relationship. some say it's because he's aloof. others say because members of congress didn't want him there from the get-go. one way or another, when he picks up the phone, they don't say, oh, okay. you're going to see resistance. >> i'm sure we'll talk to you on tuesday. >> stull ahead, taking the plunge, literally. how these newly weds celebrated
