chemical weapons. it's accepted a proposal from russia to place its weapons under international control so they can be dismantled. russia's foreign minister says russia is working with syria to prepare a detailed plan of action which will be presented soon. syria says it is agreeing to the deal to, quote, derail the u.s. aggression. russia will finalize the plans with the united nations secretary. marla tellez is digging into the details and if it will be enough to avert military strike by the u.s. she'll have an update. >> and now to breaking news in berkeley. the coroner on scene of an early morning apartment fire as the flames erupted from the third floor of an apartment building. this one on oregon street near telegraph avenue. christie smith is live in berkeley where investigators are there working on a cause of the fire. good morning. >> reporter: good morning to you. that's right. they are working on a cause and

residents who were displaced are now leaving with their pet, with family and friends looking for a new place to stay after a fire ripped through the third floor of an apartment here. one man was initially unaccounted for. the coroner had to be called to the scene. it was about 1:30 in the morning when firefighters were called to this apartment here on oregon street near telegraph. a three-story apartment building on fire. they say that flames were shooting from the third floor when they arrived where neighbors say a man in his 50s lived. they say firefighters, that he was unaccounted for initially, then taken to the hospital from his unit. they say that unit was very hard to get into because it had a metal door. the rest of the residents in the unit say they heard a banging on their doors as they were sleeping to get out. one woman who lives below the third floor unit says the man has passed away and she also often smelled smoke coming from that unit. >> he is a smoker and he likes

to burn candles, so we're thinking something happened, might have happened. and last night at about 11:30 i was in my living room i could smell smoke. i wasn't sure what it was. i thought it was mt. diablo. i thought it cannot be all the way here. i detected the smell of smoke i know. >> reporter: firefighters say that there are protocol and notification issues that often go with calling the coroner, so they are still dealing with that. again, still trying to find a cause. the fire investigator is still here on scene. firefighters tell us that they will be here for quite some time. reporting live in berkeley, christie smith, "today in the bay." >> thank you. it's 6:03. a developing story in contra costa county with smoke billowing as a wild fire continues to burn through thousands of dry brush on mt. diablo. air quality is a concern as firefighters tryget a handle on the flames. we have incredible video to show

you, showing the intensity of the flames that firefighters are up against. look at the glow of that. in fact, 700 firefighters are now on the fire lines. bulldozers, helicopters, planes trying to contain the fire. it's burning on the northeast side of mt. diablo state park. almost 4,000 acres burning, 20% contained. the numbers could change any moment. bob is live in dublin with new details. >> reporter: good morning. as i speak firefighters are meeting here at camp park, their temporary command for the morgan fire. right now they are meeting getting update on the latest numbers. as of last night, 3718 acres burned, 20% contained. the headline is that the firefighters have stopped the advance of this fire because it's been at that 3700 acres burned since yesterday afternoon. they do not believe that's going to change much overnight.

the number they are trying to change is containment. it's 20% contained, they are meeting now and we should know shortly whether they have been able to improve upon that. there were two factors in the firefighters' favor yesterday. one was the weather. at some points the weather, the wind, did start blowing in the direction of the fire. in other words, they had the fire burning in on itself. so that might have helped with containment. cal fire credits the firefighters. they have 700 firefighters here assigned to the morgan fire. you saw some of them in the chow line getting ready for tweeanot 24-hour shift. some attack choppers and they have dozers throughout cutting lines. they give themselves a lot of credit, this has been a very difficult fire season, it's been unusual in terms of how dry things have been. and they are up mt. diablo which it's a mountain, it's steep and

got a lot of treacherous terrain which makes this very hard to put out. >> the fire behavior we did see in may and even that we're seeing today, we don't normally see that behavior until october-november. it's very dramatic fire behavior. i can't stress that enough that you know, it's definitely presents a new hazard. >> the hazard being thib things move faster? >> the fuel beds are receptive the fire and then if you throw a little bit of wind on it, no humidity, a little heat, it multiplies. >> reporter: the morgan fire had at one point threatened 100 homes located up mt. diablo. firefighters have also been able to protect the historic lookout building and beacon along with communication equipment at the summit of mt. diablo. firefighters right now here at incident command in dublin are receiving an update on the latest numbers. we'll see if that percentage of

containment has improved. reporting live, bob redell, "today in the bay." >> let's check weather conditions throughout to get more, let's check in with meteorologist christina loren. good morning. >> good morning to you john and laura. a yot of those firefighters got ú attling the rim fire and this morning temperatures are warm up there on mt. diablo. 76 degrees, 24% humidity which is actually up 3 to 5% from yesterday at this hour. winds straight out of the west is the reason why your sustained speed is 13. we expect the winds to start to relax throughout the next few hours which is good news. but the wind is coming out of the west at this point so a lot of that smoke is starting to drift now into the san joaquin valley. yesterday we had wind out of the northwest pushing ar lot of the smoke into livermore. it's starting to push it toward the unincorporated area of the

mountains. 90 later on, 15% humidity, wind out of the west-northwest are going to shift but more calm than yesterday. 10 to 15 miles per hour sustained. it's going to be the cool ocean air moving into the area so more comfortable day for firefighters. we'll have your local frakt in a few minutes. back to you, jon and laura. >> thank you very much. new this morning arson investigators on scene of a fire at the america's cup pavilion. we have a live look at the bleachers that the pavilion. a section of the bleachers that cause fire is now out of view but the pavilion is located between pier 27 and 29. that fire was reported just after 3:00 this morning near the broadcaster's booth. the cause of this fire does remain under investigation and so far no arrests have been made. >> at 6:08, cofires ignited thursday night at bethel

lutheran school and across the street at cupertino high school. the fire at cupertino high school destroyed sports equipment but at bethel church's preschool damaged a major building. it will be closed for several months now and the school will combine classes for its preschool and elementary school studentings. the principal of bethel says staff has been told someone allegedly set those fires and authorities have taken a 15-year-old boy into custody. authorities have not confirmed those reports. >> a lot of people probably filling up lunch bags. >> work in the morning. >> got to be organized and ready. that means you got the road coming up. anthony is in for mike to tell us what you can see once you get your lunch bag and pail out on the road. >> i do all of that the night before. we wake up at 4:00. >> you don't even have kids. >> i'll grab the wrong tie.

i want to get you updated on developing action in the east bay. firefighters say they have managed to keep a wildfire from spreading further right now on mt. diablo overnight action. we had a chance to speak with fire crews this morning who say a change in the wind pattern actually turned that fire back on itself overnight. that looks rough. on itself overnight. more than 3700 acres, currently about 20% contained. our bob redell is live at the command post out there in dublin getting all of the latest details for you and we'll give you a live report coming up from him a little later on in this hour. >> here is a look at some of the other top stories. a fire at an apartment building in berkeley has forced several people out of their home. it may have killed one person. the three-story building caught fire this morning. the coroner is at the scene.

so far officials have not confirmed whether a person has died. >> the senate judiciary committee holding hearings that could lead to the legalization of marijuana nationwide. lawmakers say they hope for changes in banking laws to allow more secure transactions between the buyers of marijuana and the sellers. >> hours ago syria's foreign minister says the government would accept russia's proposal to turn over chemical weapons. the terms of the agreement have yet to be released. president obama says he would prefer a diplomatic solution but remains skeptical that syria will follow through. >> let's checkñjr business and tech. scott mcgrew, a man of many talents, has documents in one hand, an iphone in the other. >> two things are going to happen. one involves documents, the other the new iphone. i do understand iphones are exciting but we talk about the documents for a minute first. today the government is going to hand over a disc of data to the

electronic frontier foundation in san francisco under court order. these documents are brand new declassified information about how the fisa courts work and how the government uses the patriot act to monitor your phone calls. the efs victory in this case dates back to before the ed snowden story when they had illegal wire taps during the bush administration. it's a big deal. but admittedly in a string of big deals in domestic surveillance and monitoring of phone calls. let's talk about shiny new things. we take a live look at the cupertino headquarters of apple. today is the day apple unjails well, we don't know what, but we think two new iphones, call them the iphone 5 and then the iphone cheap for emerging market. we should get information about the ios 7. more big news, hue bet packard

sky but that's going to lead to a cooler day. you'll likely be looking forward to that in the extreme east bay. we hit the triple digits yesterday. 101 in livermore yesterday. today about 94. here is san francisco. socked in with fog at this hour. but it's not going to last all day. we're at about 58 degrees to kick off the day. in san francisco, they are getting ready for another round of the finals for the american's cup. if you're going to head out to the waterfront and many will be, make sure you bring your sun screen. 68 degrees at 11:00 a.m., 1:00, 72 the first race is at 1:15. if you can't get out there we've got you covered here on nbc bay area. we'll have all of the action live. 93 degrees, 83 in fremont. 72 in san francisco, the upper 80s on the way for wednesday and thursday. and then temperatures are going to creep up a touch friday into saturday. level back off, though, as we head into the weekend. >> things are slow on 880, on the 880 southbound at marina

boulevard our first accident from oakland keeping things slow. our second on 880, a little murt south, you can see that's keeping things slow not only 880 but toward san mateo bridge. this is where things really slow down because all of those cars come through all of those separate accidents. very slow over to dumbarton bridge and into san jose. and typical slow spot through the altamont pass, stop and go as you head to livermore. that's 880, the headlights headed toward sus the southbound direction. things are moving smoothly once you get past those accidents and out farther north to the bay bridge, you can see lots of cars starting to stack up. we have fog over the bridges this morning. >> can't wait until it clears. it's 6:19. coming up, which bay area

thanks for joining us. we're bringing you a live picture. this is the america's cup pavilion. there is activity. arson investigators at the scene of a fire there at the america's cup pavilion. a live look. a section of the bleachers reportedly caught fire. a little out of the view. pavilion between piers 27 and 25. fire reported after 3:00 this morning near the broadcaster's booth. right now the cause of the fire is under investigation. no arrests have been made. >> at 6:23, the federal government cracking down on dog breeders who sell puppies over the internet. dog breeders who breed more than four females and sell those puppies on line will now be subject to the same oversight faced by whole sale breeders. under the regulations online breeders have to apply for licenses and be subject to federal inspections.

the new rules come in response to a federal report that uncovered grisly conditions at so called puppy mills across the country. >> a new bill restricting state government agencies from scrambling cell phone service now one signature away from becoming a law. the bill comes in response to b.a.r.t.'s controversial decision back in 2011 to shut down mobile service at four stations to prevent a protest. the legislation would require all government entities to obtain a court order within six hours of a crisis before actually interrupting cell service. the bill did clear the california legislature last week and now awaits the approval of governor brown. >> 6:24 a. plan to make palo alto more bike friendly is up for discussion at a meeting tonight. leaders want to create a mike boulevard from park fwloofld laguna avenue. the corridor would be equipped with signs and other safety

features to indicate area of roadway shared by cyclists and drivers. the meeting is at 7:00 at barron's park elementary. >> report cards for the best colleges in america. apparently it's good to go ivy league with princeton university taking top honors. the top three are ivy league schools. harvard behind princeton at two on the list, yale number 3. the top ranked bay area university, that being stanford, stanford looking and feeling good tied for fwift the university of chicago. uc-berkeley doing a good job. the top public school on the list at number 20 overall. this list for the record ranks colleges after looking at selectivity, retention and that very important graduation rate. >> got to be proud of our local schools. >> got to be fair too.

syria had not even acknowledged it possessed chemical weapons. now it most certainly has. so here's what's happening, the last 90 minutes. syria accepted russia's proposal to place its chemical weapons under international control to eventually be dismantled. syrian's foreign minister says they agreed to do so to quote derail the u.s. aggression. russian officials say they are now working with syria to prepare a detailed plan of action that will be final itzed with the u.n., some lawmakers respond to the news including senator john mccain who says he wants to introduce an amendment that would require international monitors to verify that syria is complying essentially with the whole assad regime accountable. other lawmakers remain skeptical and want more information. >> can't really count on it until we know more about the proposal and how syria's going to respond. >> there really is no reason to have a vote until after that is fully explored. >> the only way to find south test. >> sometimes you have to shake

hands with the devil. >> just released this morning the latest nbc "wall street journal" poll that shows the majority of americans oppose military action in syria. 58% say no, they don't want congress to vote for military action. compare that to 33% who support the authorization. again, talk of military action could all be moolt now that syria says yes, we will hand over our chemical weapons. we'll see what the president has to say in his prime time speech tonight. what mr. obama really thinks of the assad regime. >> interesting. thank you very much. you mentioned the president speaking tonight. the president's speech tonight here on nbc bay area. you can see it from start to finish, this one will start at 6:00 p.m. right after nightly news with brian williams, we'll then return with the local news following the president's speech at 6:15 this evening. breaking news out of berkeley this morning where the coroner's office has confirmed to us one person has died in an

apartment fire. the three-story building caught fire 1:30 this morning a. man in his 50s living on the third floor had not been seen since the fire broke out. several other who live in the building were able to escape the flames. christie smith is talking to them as well as investigators. she'll have a live update in about with 15 minutes. >> a developing story in the east bay. we're getting new numbers on that fire burning on mt. diablo which is now about 45% contained. that is improved from what we were reporting earlier at 20%. we spoke with crew this is morning who say a change in the wind pattern has helped them keep the fire from spreading overnight. they have downgraded the number of acres burned from 3700, that now closer to 3200. our bob redell is at the command post in dublin gathering all of the latest information and we'll check in with bob in a few moments with a live report with

him in about 15 minutes. >> we're expected to learn more about how the rim fire impacted san francisco's water and power systems. the san francisco public utilities commission presenting an update at hetch-hetchy reservoir which supplies a lot of the city's drinking water. the fire has taken a toll on some of the electric power that travels through the burned area. the rim fire has burned more than 253,000 acres, it is 80% contained now. firefighters expect to have it fully contained next week. so far california has spent $100 million just battling that fire alone. tough go at it. >> a huge undertaking still in progress now. the firefighters risking their well-bei well-being. hopefully more containment. 6:34 now. let's look ahead and look at the sunny forecast. christina loren is here to tell us what's happening on a tuesday. >> good morning to you, jon and

laura. 45% containment. good news. here it's the wind that's helping coming off the ocean. you can see this is our live look at sunol. this is furthest to the east of all of our cameras. we have quite a few here. you can see plenty of stratus here. some of this is fog mixed with that smoke so it's smog. we head throughout the day we're going to keep the air quality alert. the good news is they were able to gain the upper hand and that westerly flow is going to persist. 63 degrees in livermore. at 61 in oakland, sx 5 in sunnyvale. temperatures are going to drop off. it's going to be warm. we stop the clock at noon as you break for lunch in oakland will be 67 degrees there, 78 at noon in fremont, and 81 degrees in livermore. we're getting the orange shading here on the map. it's going to be warmest part of the bay area. one more day of the 90s and then temperatures fall back to seasonal averages as we head

throughout tomorrow so. 93 degrees today, forecasted high in livermore. 85 in san jose. down from the 90s. we head on the south bay yesterday. so it's getting more comfortable already and when i show you the seven-day outlook, you'll see how much longer the cool conditions will last. starting tomorrow, though, we're back in the 80s. even in the hottest cities across the bay. let's check your drive. good morning. >> good morning. things are slow approaching the bay bridge. to the south bay we have an accident, a three-car accident on 87 northbound at curtner keeping things slow not only in that location but back to 85. there is another accident right at 85 and 87. and that is on the on ramp so things very slow there. we also want to take you out and show you what time looks like in fremont. we have three separate accidents, the first begins in oakland, the second at hayward and the third down at alberada boulevard. take it easy if you use that route. back to you. >> 6:36 now.

at 6:39, new this morning in india, four men could face the death penalty for a deadly gang rape on a moving bus. the men had been convicted on all counts including rape and

murder for an attack on a young woman in new delhi back in december. the victim died of massive internal injuries two weeks later. the case sparked outrage in india and pushed the government to pass new laws protecting women from sexual crimes. the men could be sentenced to death. >> an ohio driver who made an on line video confessing to causing a deadly wrong way crash is set to enter a plea today in court. >> my name is matthew cordal. on june 22nd, 2013, i hit joe vincent. >> there was really unprecedented. it was a three-minute video he admitted to hitting and killing a man in columbus, ohio. he is being charged with aggravated vehicular manslaughter and he could plead guilty as early as today in court. this video confession was taped earlier this month and posted on

right now major developments to tell you about this morning in contra costa county. crews finally starting to get the upper hand on that fire burning on mt. diablo, they have been working hard, now again good news. this is just incredible video from the ground showing how intense these flames were overnight. about 700 firefighters still working on that fire this morning. along with dozens of bulldozers, helicopters a s and planes. on the northeast side of mount ablo state park. this morning we're now getting the latest numbers on the containment of that fire. that's where we check in with bob redell in dublin. firefighters are pointing out

making major progress. >> reporter: yes, correct. good morning to you. they have more than doubled containment from 20% yesterday to 45%. the number of acres burned now just over 3200. if you look out from where we're at now, you can't even see the fire itself. you cannot see the plumes of smoke as we did yesterday. why is that? smoke as we did yesterday. why is that? >> what happenedfo it was the first night of the fire where it didn't burn the same at 3:00 in the morning that it did at 3:00 in the afternoon. it was cooler, there was more humidity and firefighters were in there, fresh firefighters, they came on the line, and they did a very aggressive fire fight last night and got more of this contained, put it more in the box. >> the weather cooperated and youed that manpower doing a lot of work which we know they are on 24-hour shifts.

route down 80, over to 37. so lots of traffic on the roadway there. if you use that route, if you are a familiar fan of that route. also 880 southbound headed down through hayward at h street, an accident keeping things close. and then bogs down toward alvarado boulevard. past that things flow. you can see this is just past alvarado, lots of the cars getting through. once you get naft location things are good to go. in the south bay accidents on 87 near willow glenn. that's teep keeping things slow all the way back to 85 where there is an accident, a two-car accident at 85 to 87 and also there is a slow go commute from 101 north, you can see outside, lots of cars on the roadway moving through san jose on the 101 northbound right now. >> thank you. 6:49. an update to breaking news, the

coroner has identified a man killed in an early morning apartment fire in berkeley. in the meantime, nearly a dozen people living at the apartment complex now looking for a new place to stay. christie smith joins with new details. >> reporter: good morning. i got off the phone with the coroner. the man who was killed in this fire overnight here in berkeley is a 56-year-old man, they identified him as andrew y52 goodwin. that is also what neighbors tell us, he lived on the top floor for several years, often kept to himself. that's where the flames were coming from when firefighters arrived about 1:30 this morning. they say it was hard to even enter the top floor unit because the door was metal. residents and several other units say they heard banging to get out. they say they looked upstairs

and saw the unit was burning and say that the man often burned candles and smoked. one resident smelled smoke around 11:30 last night but thought it might be coming from the clayton area. they say this happened fast while they were sleeping. >> get up, get out, there is a fire. i don't know what they were saying. they were just screaming in the middle of the night. we jumped out of bed and grabbed like some stuff and ran out. >> reporter: firefighters tell us they don't know exactly what started this fire. it's still a little dark, starting to get light now. they are finally able to take closer look inside. but they tell me they are going to be focusing on that third floor unit. live in workly, christie smith, "today in the bay." >> arson investigators on scene of a fire at the america's cup
