meanwhile, al made his way to the set of "million-second quiz." he slept in his pod overnight and we'll talk to him in just a little while. >> there it is. also ahead, the man that made a controversial online confession to a deadly drunk driving accident. he's now turn himself in to police but not before speaking out to nbc news exclusively. we'll hear from him in a bit. >> we want to begin on a tuesday morning with president obama weighing new options in syria even as he gets set for tonight's speech. nbc's peter alexander is at the house. peter, good morning. >> reporter: matt, good morning. new details just this morning. syria's foreign minister telling nbc news that syria accepted a russian proposal that it would give up its chemical weapons even as syria bombs rebel-controlled areas for the first time since the u.s. threatened strikes there. also this morning, we're out today with a brand new poll and president obama faces what's perhaps best described as a virtually impossible task tonight, trying to convince americans. in the words of our pollster, the american public's red line

on syria appears to be stay out. with fast-moving developments that could head off a military strike, our new poll shows president obama faces a steep uphill battle. nearly 60% of americans want their member of congress to oppose u.s. strikes. and only one in four believe attacking syria is in the u.s.'s national interests. it could be averted, the assad regime welcomed russia's offer to work with syria after john kerry said on monday assad could avoid strikes by giving up chemical weapons immediately. >> turn it over, all of it. without delay. >> reporter: on capitol hill with word of a potential diplomatic breakthrough, harry reid delayed a vote on authorizing strikes. it was already a tough sell. if congress voted today an nbc news count shows the senate vote would be a tossup with 56 senators undecided. but with 217 votes needed to

pass the house, so far only 24 congress members said they would vote yes. just minutes ago, press secretary jay carney told me the white house is skeptical but cautiously optimistic about syria's new claims that it is willing to give up its chemical weapons. matt? >> certainly a new development. peter alexander at the white house. peter, thanks very much. >> i sat down with president obama monday at the white house. i began our conversation by asking him if he is confident he can get the votes in congress from military action in syria. >> i wouldn't say i'm confident. i'm confident that the members of congress are taking this issue very seriously and they're doing their homework and i appreciate that. >> if this resolution fails in congress, would you act without congress? the answer could be yes, no, or i haven't decided. >> i think it's fair to say that i haven't decided. i am taking this vote in congress and what the american people are saying very seriously.

i knew by bringing this to congress that there was a risk that the american people just couldn't arrive at a consensus around even a limited strike. if you ask somebody -- if you ask michelle, do we want to be involved in another war? the answer is no. people are wary about it. understandably. they have seen the consequences of this last decade. so i recognize how important that debate is and it's my belief that, for me, the president, to act without consensus, in a situation where there's not a direct imminent threat to the homeland or interests around the world, then that's not the kind of precedent that i want to set. and i'll evaluate after that whether or not we feel strongly enough about this that we're willing to move forward. >> syria's foreign minister said today syria would consider

giving international control to it's chemical arsenals. >> right. >> did you welcome that step? are you skeptical? does it seem like a stalling tactic? >> i think a famous american president once said, trust but verify. but between the statements that we saw from the russians, the statement today from the syrians, this represents a potentially positive development. we are going to run this to ground. we are going to make sure we see how serious these proposals are. >> does it feel like a ploy? >> this could potentially be a significant breakthrough, but we have to be skeptical because this is not how we have seen them operate over the last couple of years. >> you said these strikes, if they take place, will be limited. my question to you is, how could you possibly know that? if we strike and iran retaliates or hezbollah and we strike u.s. citizens at home. what then, you may want limited action, but can you really

promise it? >> look, nothing is 100% guaranteed in life. but i think it's fair to say that our military is outstanding. our intelligence is outstanding. and we have shown ourselves capable of taking precision strikes on military installations in ways that would degrade assad's capabilities to deliver chemical weapons that would have a significant impact. but that would not lead to escalation. >> assad today when asked if he would retaliate had a message. he said expect everything and members of congress are saying we're skeptical because we don't think the administration has a strategy for day two, day three, day four. >> well, that's just not the case. first of all, syria doesn't have capabilities to retaliate against us. iran does but iran is not going to risk a war with the united states over this, particularly given that our goal here is to make sure that chemical weapons are not used on children.

>> your chief of staff called these strikes limited and consequential which seems almost a contradiction in terms to me. today secretary of state kerry said the strikes would be unbelievably small. what does that mean? are we talking a pin prick? >> no. >> a knockout blow? a punch in the gut? >> the u.s. does not do pin pricks. our military is the greatest the world has ever known. when we take even limited strikes, it has an impact on a country like syria that doesn't have tremendous military capability. they have tremendous military capability relative to civilians. they have a significant capability relative to children being gassed but they don't have a military that matches up with ours in any kind of way. >> when you saw those videos and i assume you have, can you tell me your reaction to them not only as a president but as a father? >> i was heartbroken.

i would recommend everybody look at these videos. horrible things happen around the world all the time. horrible things happen inside of syria every day and all of us recognize that america cannot try to solve every problem around the world or stop every terrible thing from happening. when we talk about limited strikes, no boots on the ground. limited in time and scope. i have to emphasize that over the last four and a half years i have shown great restraint when it comes to using military power. >> pretty candid at the white house yesterday. >> especially on the subject of whether or not he has the votes in congress which will be the key and will he go even if he doesn't get that vote. >> he hasn't given a direct answer. that was the closest thing, look, i haven't decided. the candor about whether they have the votes is key. tonight he addresses the nation. nbc news will have live coverage of that 9:00 eastern, 6:00 pacific time. we turn to florida where george zimmerman is back in the headlines again. this time for allegedly

threatening his estranged wife. nbc's kerry sanders is in lake mary with details on this. hi, kerry. >> reporter: good morning, matt. shelli zimmerman filed for divorce from her husband george zimmerman five days ago. on monday, police were called to her father's house where there was some sort of confrontation. now, it's common in divorces. both sides are now pointing fingers at each other. and there is still, this morning, a little bit of confusion as to whether george zimmerman was armed as police first believed he was. >> i don't know what he is capable of. i'm really, really scared. >> reporter: shellie zimmerman called 911 after 2:00 in the afternoon on monday to say george zimmerman was outside her father's house in a car and police protection was needed right away. >> he's in his car and he continually has his hand on his gun and he keeps saying, step closer. he is just threatening all of us with his firearm. >> step closer and what?

>> and he's going to shoot us. >> reporter: she said zimmerman acosted her father. >> he punched my dad in the nose. my dad has a mark on his face. >> reporter: he was briefly detained by police and questioned. initially lake mary police said they got a gun from zimmerman but late monday a spokesman from the department clarified saying that information was wrong. >> we never had contact with a weapon. we never touched a weapon. we don't know that there's even a weapon here. >> reporter: zimmerman's attorney, mark o'mara said in an interview zimmerman did have a gun but said there was never any threatening with a firearm and the 911 tape was a case of heightened emotions. >> i think everybody got a little out of hand. there may have been pushing and touching. that happens a lot in divorce situations. >> reporter: police said after investigating shellie zimmerman's father had no injuries. >> the fire department looked at him and he didn't have anything obvious. >> we the jury find george zimmerman not guilty.

>> reporter: since his acquittal on second degree murder and manslaughter charges in the death of trayvon martin george zimmerman continued to make headlines. stopping to help victims of an auto accident in sanford, florida. >> what a coincidence. >> reporter: stopped for speeding in texas but let go with a warning. posing for pictures as he toured the factory where the gun used in the trayvon martin case was manufactured and just last week stopped once again for speeding in lake mary. nobody was arrested in monday's incident and police say no charges are being filed. >> they're getting divorced. they really shouldn't have contact right now. so no, it's obviously they need to stay away from each other and keep things calm and work through the attorneys. >> reporter: the officers who responded had cameras on the dashes of their cruisers as well as wearing cameras on their chests. that will be part of the public record and maybe released as early as today.

also, inside shellie zimmerman's father's house, they have a security camera system. police confiscated that to see if it jives with what shellie zimmerman told them in the 911 call. >> kerry, thank you very much. lisa bloom is today's legal analyst. good morning to you. >> good morning. >> let's be clear here. in a case of alleged domestic violence, police have a right to make an arrest even if the alleged victim of that violence doesn't want an arrest to be made. what about the fact that no arrests were made here? >> that's right, matt. it's very common for domestic violence victims to recant their story. if indeed there was domestic violence here. and there were several witnesses allegedly to this incident. there's shellie zimmerman's father. there's a city worker that she refers to on the 911 call. there's george zimmerman's body guard. so all of those people should be interviewed and the security cameras should be reviewed to see what they show. >> as a point of law here, we now know from george zimmerman's lawyer, mark o'meara, that there was a gun in the possession of

george zimmerman. he has a permit, by the way, to carry that weapon. but what does the law say about what would be considered threatening with the weapon? if that gun never left the holster, could it be used as a threat? >> absolutely. if he's patting the gun and indicating he is going to use it in an improper way, that's brandishing. that's criminal harassment and that would be a crime. ironically, it's perfectly legal for him to walk around with a concealed weapon. what's not legal is for him to take it out, use it, refer to it, or threaten anyone with it. >> i think the point in story that was made, this is not a legal point. this is a common sense point. it would be best under these circumstances for these two to simply stay away from each other. >> well, that's right. they don't have restraining orders against each other but that would be advisable and let's also remember that shellie zimmerman recently pleaded guilty to perjury so her credibility is probably an issue that the police are looking at as well. >> lisa bloom in los angeles this morning. lisa, thank you very much. >> thank you.

meantime, natalie is on the story of another major wildfire. good morning again. >> good morning, savannah and matt. more and more people forced from their homes outside san francisco by the wildfire growing by the day. pushed by high winds. the blaze in mt. diablo state park now covers more than six square miles and is now threatening 100 homes prompting mandatory evacuations in the area. the fire is 20% contained. voters in new york city are going to the polls in a hard fought primary for major. the democratic front-runner, bill de blasio is hoping to get enough votes to avoid a runoff in a race that includes anthony weiner trying to make a political comeback. republicans are also picking their candidates. the winner in november will succeed michael bloomberg. two potential 2016 rivals will be face to face in philadelphia. former secretary of state hilary clinton will be given the national constitution centers liberty medal for her years in public service and work on human rights and she'll get the award from the group's chairman, former florida governor jeb

bush. toyota is recalling 800,000 vehicles for a second time to fix a suspension problem that a fix last year did not resolve. affected by the recall are 2006 to 2011 rav 4s as well as lexus hs-250 hybrids. the problem involves a rear suspension arm that can rust and possibly lead to a suspension failure. now, wall street and what is moving the markets. cnbc's mary thompson joins us. getting lots of attention, apple. >> that's right, natalie. today apple is expected to introduce two new phones, a high end and cheaper version of the iphone 5 in multiple colors. it's aimed at recapturing the global smartphone market where samsung has been making big gains. there's a lot at stake for apple and we'll have more later in the program. walmart customers can trade in their old smartphone and get

>> good morning everybody. i'm jon kelley. investigators looking to the cause of a deadly fire. the coroner telling us a 56-year-old man has died there. the three-story building caught fire at 1:30 this morning forcing a lot of people out of their home. crews now starting to get the upper hand on the fire burning on mt. diablo in contra costa county. very good news. firefighters gaining significant ground. more than doubling containment of the fire from 20% to 45%. they have also downgraded the size from 3700 acres to 3200. the fire also causing trouble with the air quality is expected around mt. diablo.

matthew cordle sat down with us exclusively. his last public statement before turning himself in. >> i hope the canzani family can get closure from this and that they find peace some day and that people take my message to heart. >> reporter: minutes later he was in handcuffed facing up to 8 1/2 years in prison on charges of driving under the influence and aggravated vehicular homicide. >> i hit vincent can szana. >> in a statement one of his daughters accused cordle of using the video to get a lighter sentence. >> it's not about me. it's about the message. >> reporter: he also says the attorneys stood by his decision. >> the attorneys i have now never told me to lie and they were supportive of the decision

to plead guilty. >> his motivations were sincere. he wanted to raise awareness. >> but prosecutors say the public confession doesn't change the fact that cordle's blood alcohol level was twice the legal limit. he was behind the wheel of a car going wrong way on the freeway early in the morning with a .19 blood alcohol content. that case is one we aggressively prosecute and seek a maximum kind of sentence. >> now there's a few proceeds but he plans to plead guilty at the arraignment this afternoon or shortly there after. sentencing could then happen about 30 days after that. his attorney says whatever the sentence cordle plans to spend his time continuing to spread that message about the dangers of drinking and driving. >> kristen, thank you so much. let's take a turn now and get a check of the weather from mr. roker. >> announcer: today's weather is brought to you by new fast acting advil. nothing works faster.

she says the police immediately became fixated on her lack of emotional display over the death of her 80-year-old husband alan, repeating her makeup was not running. the coroner said alan's death was a homicide. >> he died as a result of blunt sharp objects. >> reporter: and after her arrest, goodman spent two nights in riker's island jail before more detention back home at l.a., followed by months under house arrest. then last november -- prosecu r prosecutoprosecuto prosecutors dropped the case, unable to proceed because of insufficient evidence. despite that her lawsuit says mrs. goodman suffers on a daily basis. the public humiliation is unending. no comment from the lapd it's hard to win these kind of lawsuits. police have some form of limited or qualified immunity. that as long as the police officer is acting reasonably under established law he's allowed to be wrong. goodman's attorney say the
