eastbound. you see both at the same level. because there is no problem at treasure island tunnel, no problem at the toll plaza. you can see the lights along the east shore freeway. friday could be a different flow. it will mean a different flow. >> thank you. now to a developing story in colorado, a massive wall of water that was expected to hit boulder overnight, well good news, it's spread out and faded. just a huge break for the area. it has been a tough go, the 30-foot surge was spotted at about midnight but it flattened out in a wide area of the canyon before hitting the city. a weather spotter reported that large wall of water containing vehicles and debris and all sorts of things rushing down. this happened last night. a notice was sent out to residents to evacuate. severe weather so far has already killed three people. >> new this morning all lanings on southbound 101 reopened

following a fatal crash. chp says a car hit a pedestrian near brokaw road before 11:00 last night. officers say the driver stayed at the scene and was cooperating. two southbound lanes were shut down along with a north first street on ramp. both reopened by 1:00 this morning. the cause remains under investigation. >> there is a strange twist in san jose's recent homicide. they will only charge craig uehara with manslaughter. they don't think he was trying to kill daniel winslow when he fired. winslow's body was found in a van sunday. investigators say winslow and a friend they were trying to retrieve a stolen truck from yuhara's property when yuhara confronted them with a gun. they allegedly drove at him who then opened fire. police still looking for the man who was with winslow.

>> police are investigating a homicide after the body of an hawaiian tourist was found on the back porch of a boarded up home. he was found on the patio of the home just a few blocks from foothill boulevard. he was lying face down suffering from major head trauma. police initially thought he was homeless until a friend reported him missing to police. officers are treating this case as a homicide. the san francisco rec worker accused of running over and killing a woman is out on bail but could be back in court. the district attorney's office telling the "san francisco chronicle" prosecutors will likely decide whether to file criminal charges against tom bernowski at the end of the month. they say the 57-year-old struck and killed crissy van meyer when he drove his city truck through the grass in holly park. she was lying there with her baby and her dog at the time.

>> the woman accused of jumping on a stage and attacking a 73-year-old blues singer at a festival is expected in court. police say dina lynn andrews potter will be arraigned today. she allegedly attacked lester chambers in july after he dedicated a song to trayvon martin, the teen shot and killed by george zimmerman in florida. there is no word on what triggered the attack. chamber filed a civil lawsuit against andrews potter, the city of hayward and the bay area blues society which sponsors the event. >> a seat back delaying the new stadium stopping it from opening. the "mercury news" reporting that the 18,000 seat stadium hit another construction delay, would be the second delay in three months for that facility which will be located across from the international airport. officials originally expected to play in the new $60 million

stadium at the start of next season but when builders started excavating the site in june they found concrete vaults deeper than expected. the stadium opening has now been pushed back to at least 2015. >> the contentious negotiations between b.a.r.t. and its union show no signs of getting better. manger negotiations are expected to start next week, b.a.r.t. met separately with two of the larger unions to deal with smaller issues. b.a.r.t.'s board decided against offering some of the budget surplus to workers. if a deal is not reached by october 10, b.a.r.t. workers are expected to walk off the job. >> following a rough dangerous battle promising news with firefighters on mt. diablo expected to have the fire contained later today. the so-called morgan fire now 95% contained. that is spectacular news. the fire scorching more than 3100 acres.

just a stalled pickup truck. watch for slowing around the madera boulevard. we're looking to the east bay, the east shore freeway. no problem at the maze and the approach. slowing for 880, it's the southbound side that construction crew should be moving. down to two, maybe one lane as they start to move the crews and that should be cleared as you approach 5:15. there is the big slowing for now, that short section toward 23rd. >> 4:39. today the fremont police department will be renamed in honor of one of the city's notable leaders. it will be named in honor of the late bob wasserman. a former police chief, councilman and mayor passed away at the age of 77. the dedication ceremony will take place at 4:00 p.m. in front of the police station on stevenson boulevard. the event is open to the public. >> in the spirit of friday the 13th, the famous winchester

mystery house is holding its annual bell ringing ceremony. 13 the magic number. the bell will ring 13 times today at 1:00 p.m. which is 1300 hours, in honor of sarah winchester who was fascinated by the number 13. this year's bell ringers from the down syndrome connection of the bay area. this is an organization that receives donations from the mansion's fountains. you know you can find all kinds of symbols so 13 throughout the house and that includes 13 palm trees and yes, 13 restrooms. kind of spooky. >> very interesting. >> cool stuff. we know twitter's going public but we don't know much else and why the san francisco company is allowed to keep us in the dark. >> i'm guessing probably make a whole lot of money. we have new information about that massive fire that destroyed a good portion of the new jersey boardwalk. they cannot catch a break out

park, new jersey this morning. exactly, what else can you say? a massive fire there that started in a custard shop. after it had been wiped out, they rebuilt it. after the storm that hit that area. now once again just hit hard in that area. governor chris christie out there yesterday just couldn't believe it. so many in shock. we will see what happens next. whether they will rebuild or not. 4:44 now. san francisco twitter going public has businesses excited. an ipo means employees can cash in on some of the shares creating a new wave of young millionaires. the owner of a nearby restaurant says twitter is breathing new life into a once sleepy neighborhood. real estate agents are excited. >> one gal was a google gal, the other guy was from frisco, they

twitter that have less than a billion dollars in annual revenue don't have to disclose details about their finances or the ipo until a few weeks before the actual offering so right now we just don't know. twitter launched seven years ago, has more than 200 million active users. futures are higher after stocks took a breather. the dow fell while the s&p 500 snapped a 7-day win streak. it may be friday the 13th that's not unlucky for the market. historically stocks close higher half the time. we'll get data on inflation and consumer sentiment. the dow falling yesterday to 15,300. the nasdaq slipping 9 to 3715. microsoft wants your old ipad. the company has been running a promotion to get consumers to trade in their old ipad for a gift card they can use in a microsoft store. it will pay up to $200.

too cool. just about right for this time of year. stick around, though, lots to cover. we're going to take to you the beaches, show you which will be best for the final full weekend of summer. back to you, jon and laura. >> we will look forward to that. thank you. 4:49. four men in india have been sentenced to death by hanging after being convicted of killing a woman they gang raped on a moving bus last december. the 23-year-old woman died of her injuries in a singapore hospital two weeks later. the case sparked widespread outrage across india and a push for laws to protect women. earlier this week after a trial that lasted nearly seven months the court convicted the four men of murder, rape and kidnapping. lawyers for the men say they will appeal. >> also on the international scene we have new video of an attack and suicide bombing taking place near the u.s. consulate in afghanistan. early this morning unidentified forces drove a truck up to the front gate of the consulate.

they started fighting at that gate and blew up the truck. good news, no americans were hurt but two members of the afghan security force, they died in this attack. the fighting we can tell you is now over. u.s. ambassador to afghanistan says all consulate personnel are safe. trying to find common ground, talks continue this morning between the u.s. and russia over syria's chemical weapons. u.s. secretary of state john kerry and the russian foreign minister lavrov are meeting again today to discuss moscow's plan for the government surrender chemical weapons. they were joined by the u.n. arab league special enjoy. the talks have prompted president obama to at least temporarily but his plans for a u.s. military strike on hold. new details released about the fire that destroyed part of the new jersey boardwalk as well as a number of businesses. this is a live look at seaside

park. pretty amazing to see the destruction. fire crews mopping up. had to put out so many hot spots. firefighters say they are glad they were able to stop it from being worse. >> through the brand new board walk that was just replaced after hurricane sandy. sent our resources up there and fortunately we were able to contain it. i don't even want to think about what would have happened if the we didn't stop it there. >> they did what they could but look at all of the thick black smoke, the flames and it was so tough out there. no word exactly how many businesses were destroyed by the six-alarm fire. a few firefighters were hurt but no major ji are injuries. the cause under investigation. >> more devastation but they are fortunate they got that under control. a big trench they had to dig that helped and they knocked it out. >> i bet they rebuild. >> chris christie will lead that pack. it's 4:51 now. we'll tell you about with the

game against the seattle seahawks, 49ers coach jim harbaugh returning to his roots set to be at palli high as the vikings take on their season opener. coach harbaugh who graduated from palo alto back in 1982 will act as an honorary captain for the coin toss. this is the team first game in its new renovated stadium. no shocker, we turn back the clock, harbaugh in high school voted most athletic back when he was a quarterback. the pregame ceremony all set. a ribbon cutting that will start at 7:00, the kickoff for harbaugh's crew at 7:30. >> so do you think you have what it takes to skate in a professional hockey game? san francisco bulls are giving local wannabes a chance to prove it by earning a spot on the roster with open try-outs at the cow palace.
