to pick up and move just nine months after opening. bob redell is live in los gatos with the latest on this heated debate. >> reporter: good morning. because of new rules, templar sports here, that beige building there behind me, had two options. they can stop selling guns, or it can move across the street if it wants. it cannot be at the location it's at as that location does not satisfy the new rule requiring a 250-foot clearance from places that cater to kids. while that spot across the sleet does. it was this week that the los gatos city council passed new laws for gun shops. these kinds of businesses must apply for an annual permit and be at least 250 feet away from schools, churches, parks, government buildings and businesses geared toward children. the city took up the issue when

residents protested the 07ing of templar sports. just after the mass shooting in new town, connecticut which was perhaps one reason why people felt so adamant about this. they feel like it's a threat to public safety. there have been packed public hearings and this new ordinance. the city has given templar sports four years to move or give up its gun sales. the lawyer representing the sale says this deadline make nos sense. if this is a public safety issue as the city claims why is his client not being forced to move now. templar sports is considering legal action. bob redell, "today in the bay." >> 5:02. the milpitas police department is getting a high tech boost to help fight crime before it happens. the city signed a three-year contract with pedpoll which

makes cost mayor to predict which are hot spots for crime. even weather conditions can determine where officers should be deployed. the system has been used in parts of los angeles. milpitas police say the system should be up and running next month. >> a trial for a daycare worker accused of abusing children. keith woodhouse stands accused of inappropriately touching nine children at two daycare centers where he worked. some of those alleged victims as young as 5 years old. two are expected to actually testify in court today. a jury has heard testimony from four other alleged victims. >> a school district could roll out new training for employees to help report child abuse or neglect, after a former coach and custodian was convicteded of lewd acts against students. live in belmont with more on the

plan, to try to better protect children. good morning. >> reporter: good morning to you. the school board president is saying that this has been a tough couple of years, that one of the basic requirements of a school district is help keep hides safe. tonight as they are looking at going above and beyond what is required by the state when it comes to abuse and neglect this after the conviction of andre edwards earlier this year for sexual misconduct with a student. he is serving a 9 month jail term. this is alleged to have happened where he worked from 1987 to 2011 cloching cross country running and basketball. the board of the elementary school district will discuss extending the state mandated one-time training requirement to be bi-yearly. all staff are mandated reporters of suspected abuse and neglect.

they are proposing to retrain all staff this fall and retrain so staff is reminded of their responsibility and the warning signs of neglect and abuse. the plan is for this ball is to provide one time training and one-time retraining every other year. it's to institutionalize awareness. the meeting is 6:00 at the district offices. christie smith, "today in the bay." >> park safety expected to be front and center at the parks commission meets today. the public expected to be at the meeting to talk about the recent incident at holly park where a mother was run over by a rec and parks truck. the driver did not stop but later turned himself in. charges have been filed in this case but they have not been filed but could be filed later this month. >> a school board is expected to

take a vote on whether to increas sensor one of its membering. there are several complaints about this man, steven nelson. he was elected to the board last november. he sent harshly worded e-mail and shouted at the headquarters. he is aware he offended some and is not surprised by the censure vote. >> happening now officials in mexico say hurricane manuel has now killed a total of 80 people and 60 others are reported missing this morning. the u.s. national hurricane center says that man yu center says that man yel is moving up mexico's pacific coast. it's expected to produce 75 miles per hour wind, up to 10 inches of rain today. some areas flooding and dozens

this crash, may be a couple of vehicles had gone down. waiting for the update but they haven't given one so they may be worried about this. we're looking at slow drive for westbound highway 4, and eastbound that's counter commute you still have construction around summersville. not a big deal now. north bay, traffic smooth, down in toward that richmond bridge. >> political leaders across the area are teaming up to get people to pledge to never text and drive. leaders and at&t will be at overfelt high school joining them to join the it can wait movement. the goal to get people to put down the phone when driving. >> in the east bay leaders will challenge each other to a competition to see who can get the most residents to make that pledge. >> i like that kind of competition. >> save lives.

this year alone, the rest will be hired starting in july of next year. many of the new employees will be used to help meet the needs of the federal affordable care act, and the staff a new county jail that is currentlying built in redwood city. >> the federal affordable care act is better known by its nickname obama care. it's at the center of a fight in washington which could call into question the full faith and credit of the united states. scott mcgrew at issue whether we pay our bills. >> the debt ceiling. it needs to be raised to pay the bills we've already run up. there are some in congress, particularly in the very conservative wing of the republican party who will not negotiate over the debt ceiling unless obama care is delayed or cancelled. the speaker of the house who has been protective of america's credit wortiness, worried about that he backed down, will allow those in his party's right wing

to tie the future of the budget to obama care. the measure to cancel the affordable care act has been voted on countless times in the house but hasn't and probably cannot pass the senate. meanwhile, also in washington, a real surprise out of the fed wednesday as it announced it would continue its bond buying spree and that a taper or easing of easy money policies was not going to happen soon. which is pretty much the opposite of what the fed had been saying previously. that meant the charts on the stock market looked like a patient whit electric paddles. seema mody has more. good morning. >> good morning, scott. as you pointed out it was a big day on wall street and right now we're looking at futures higher after stocks rallied on wednesday following that fed surprise decision, not to cut back on its massive bond buying program which has kept interest rates low. the dow 500 hitting new highs,

later on now. talking about the temperatures let's show you. north bay, 49 degrees, look at novato, 46, fall coming our way as we head toward the weekend and it's starting to feel like fall. yes, you need a jacket but as we head to the afternoon t-shirt weather later today. we're seeing our winds light this morning. we don't have anything in the way of low clouds. that's going to change later on as we show you hour by hour, mostly sunny, clear skies. then late in the day we should see clouds approaching the coast and we will see the return of low clouds by tomorrow morning. out at the ballpark heading to the evening, a's taking on the twin, we'll see beautiful baseball weather. first pitch time after 7:00 so in the 70s and dropping to the 60s as the sea breeze picks up. satellite and radar is comfortably yet. watch the gulf of alaska. this is going to get closer tomorrow. it's going to lead to a friday cooldown and eventually a chance

getting here, a crash near the castro valley "y." >> a live look outside, crystal clear, lots of light, moving on this thursday, september 19. this is "today in the bay." it's 5:30 on the nose. thanks for joining us. i'm jon kelley. >> i'm laura garcia-cannon. we have breaking news to tell you about. firefighters are at the scene of a factory explosion outside of oklahoma city. it happened overnight. officials say two explosions happened at the chemical plant near the town of thomas. we have live pictures from the skeeb as you see the smoke continuing to billow. thomas is about an hour and a half outside of oklahoma city. just into our newsroom, officials say they have evacuated the surrounding areas, they don't know what caused the

fire or explosions that happened. more than nine hours ago. crews say it's too dangerous to go close to the site so they are letting it burn out. the danger is what's in that smoke that is moving there because of the winds. no injuries have been reported so far. >> of course keep you posted on that one. closer to home in the bay area, a peninsula elementary school district could soon play new higher standards on reporting child abuse or neglect on cam bus. this after the recent conviction of a former coach and custodian convicted of lewd acts against students. christie smith live now in belmont. she has more details on this plan to better protect our children. good morning. >> reporter: the state already has its requirements burt tonight this school district is considering going above and beyond that when it comes to training for its staff. this, as you said, after a former coach and custodian was

arrested. that man andre edwards was arrested earlier this year for sexual misconduct with his student. he was on viconvicted. it happened at ralston middle school where he worked as a coach and custodyion. according to the daily journal the elementary school district tonight will consider going beyond state mandated staff training for suspected child abuse or neglect. they are looking at making the one-time training requirement bi-yearly. the staff is reminded of their responsibility and what the warning signs are for abuse and neglect. they are going to make sure that everyone is covered. if you are interested the meeting is tonight at 6:00 p.m. 2960 hallmark drive here in belmont. reporting live, christie smith, "today in the bay." >> thank you.

5:32. parents at a south bay neighborhood are furious after the city removed the walk from in front after local middle school. san jose decided to remove the crossing at second and heading even though it ran up to burnett middle school. it's a dangerous intersection that had a few accidents. back in may 12-year-old daniel was hit by a truck. he was thrown about 145 feet. he still has a limp and scars. daniel was in a crosswalk when he was hit but now cross sidewalk gone. the city narrowed the lanes and put in a bike lane. the issue remain as lack of a crosswalk. they are urging the city to put the crosswalk back in. >> you can't believe this kind of chaos going and tropical dice, hope everything comes up aces. >> the council will try to push the department to put a

i want to give you a live look in virginia where a train derailed, ultimately injuring two engineers and sparked a fire. this happened early this morning in south hampton county in southeast virginia. there was a small fuel spill but this one has been contained. the fire has been contained.

we're not sure of theskç statu those engineers. >> the washington navy yard is back open this morning after investigators try to piece together a series of events that led to this week's mass shooting. questions remained about how the shooter was able to get in and whether gun control laws would have even made a difference. tracie potts live on capitol hill with the latest on that investigation. good morning. >> reporter: good morning. let's start with the workers going back to work. crews were there as they got led in the gate. there was a truck that had an issue so there was a backup with traffic. bottom line they are back in for the first time since monday, since that shooting. the fbi also still on site. building 197 closed as they try to figure out things. we're getting new details like words etched on the shot gun that the shooter used. it says, better off this way and my elt women. they aren't sure what that
