into an apartment. christie smith is live at the scene. you saw police put that man in handcuffs. >> reporter: that happened about with an hour ago. when it comes to this story you don't hear things like this often. their bank robbery suspect they were looking for up on the rooftops fell through the roof and that's how they nabbed him. i want to step aside so you can see the street is back open here on san bruno avenue. they were looking for a man in black after a silent alarm was tripped about 4:00 this morning. that suspect finally brought down and taken into custody a while later. police tell us the man was spotted on a security system inside the bank of america with a crow bar in his hand. firefighters brought out a long aerial ladder truck as they believed he was hopping from rooftop to rooftop. they closed down the street and police went up looking for him. they brought in a dog. on the third roof they found

him. >> we eventually found the suspect on top of one of the roofs, a couple buildings away from bank of america where he eventually fell through the roof top of that building and we were able to capture him and put him in custody. >> reporter: police tell us that so far they haven't found a weapon, a gun, but they did locate the crow bar. they don't know if cash was taken. the suspect was not hurt in all of this. at this point they are taking a close look at that to see if anything is out of place, anything is missing. i asked one offer his opinion on this and he said hey, i don't really know what the guy was thinking. reporting live in san francisco, christie smith action "today in the bay." we're also following a developing story in chicago where a 3-year-old boy right now is in critical condition after being shot in the face.

and 12 others including two teenagers also injured after a late night shooting spree at a basketball court. the chicago police department says the victims range in age from that 3-year-old up to a 41-year-old. a witness telling the "chicago sun-times" men showed up and started shooting from a gray sedan before shooting toward cornell square park and firing at people in that area. the park now we can tell you is on chicago's southwest side. marla tellez joining us from our newsroom. she has all of the ongoing details. good morning. >> i'm happy to report the 3-year-old boy is doing well, believe it or not, after being shot in the jaw. he made it through plastic surgery and is doing well with his family by his side. here is a picture, little dyante howard. he was with his mother when the gunman let loose. his uncle tells the "chicago sun-times" dread lock men shot

at him before opening fire on this large group of innocent people. at least ten ambulances responded to the scene. witnesses say at least 20 shots were fired. >> i think it was like ak, a lot of shots, got to be careful. keep the kids safe. >> the boy's uncle telling the paper, quote, they have been coming around for -- coming around here looking for people to shoot every night just gang wanging stuff. it's what they do. end." police say they do in fact believe this latest shooting is gang related. three people are listed in critical condition, the 10 others in serious to fair. out of the 13 shot 10 are male. gun ivens violence is starting to be a problem last year. police say they stepped up efforts this year, they put morf

officers on the police, paying more overtime and they say homicides are down 23% in 2013. compared to last year. >> and that shooting, mala, in chicago just one of two nationwide this week alone. investigators in washington, d.c. are still trying to determine what prompted a man to kill 12 people at a navy yard. law enforcement sources tell "the washington post" they are investigating whether a worklace issue sarked the killing. the post rarts that people who worked with aaron were concerned about his job performance. nbc news has not independently verified the report in the post but we should point out director of the fbi tells nbc news alexis began shooting on the fourth floor with no discern tabl patterns, moving without any direction or a purpose. the oakland police

department will hold a graduation ceremony for their second graduating close. the force is still under staffed. the oakland police department has 116 officers, down from a high of 836 officers back in 2008. the police department just received a federal grant that will pay for 10 more officers. some neighborhoods are paying for their own private security to patrol the streets. it is now hired to patrol the oakland hills so people can have some peace of mind. >> just the need for the people. they want to come out, walk the dog. >> city of oakland says money from the federal grant for more officers will last three years. after the city will have to come wake-up the money on its own. >>it's the weekend, and here is now apple diehard fans celebrate. they wait in line, lay on hard

streets. we have video with a look at that apple store in los gatos. surprisingly apple co-founder steve wozniak will not wait people in the apple lines. he says he is too tired this time. apple fans, they gathered in new york city. in front of that glass cube at apple's flag ship store. you can see the store had to set up ropes to keep order there. the apple craze sweeping not only the nation but the planet. this is in beijing, people in the apple store in london as well. it's a big party. feel the fever. the first person in line says he had been waiting since tuesday. congratulations. we'll have team coverage of the apple hype and all of the magic

the temperatures we're not going to see 90s, upper 70s to low 80s inland by 3:00 and then things cool off quickly into the evening if the winds coming in off the ocean. so cooler finish, then a chance of showers to kick off the weekend. mike. >> we like the clearing trend. we haven't had that. looking to the bay bridge, we had a crash, now at the very bottom lower left-hand corner of your screen. now it's cleared from the area. there is a backup that formed as that -- double-check, i used our emeryville camera. i do see that is moving despite the fact our digital camera, the fact track and cash, we see there is a little slowing in the area, nothing severe. it's friday. the maze moves lightly. east shore the same. livermore, dublin, even highway

i want to get you up to speed on the top stories. police in san francisco arresting a burglary suspect after chasing him from rooftop to rooftop early this morning. officers believe that man tried to break into a bank of america on san bruno avenue in the bay view district. then got stuck out on a roof. he eventually then fell through a weak spot right into an apartment before he was taken away in handcuffs. >> also in san francisco, police investigating a shooting that killed a man and injured a woman. officers say they had to use pepper spray to disperse a crowd of people at the scene. no word on suspects. >> tropical storm manuel has now killed a total ofvid 97 people n in mexico. also 68 people are missing after the massive landslide near the pacific coast. the storm has been pounding the region with heavy rain and flooding now for days.

>> happening now, people all over the world waiting in line to get their hands on the precious new iphone 5-c and 5-s. >> the fever sweeping the globe. that may be fading a little this time. we have a live look outside the apple store in palo alto. a decent crowd. not as big as the ones we've seen in the past. >> scott mcgrew joins us live. you told people there was no need to light up over night but they did it. >> right. the iphone 5-s that presumably everyone is lining up for went on sale on the internet at midnight and apple is promising delivery in a few days. it's only if you really, really want the phone right now you line up. you heard folks in tokyo getting their phones and lining up and holding up their steve jobs pillows. apple not giving us a specific number how many will be available. in the past you have been able

to come in during your lunch hour. out of australia, folks getting their phones as well. the iphone 5-c has been available for preorder for about a week now. if you ordered one of those they will hand you one today. apple did not make the s available with that preorder. i have to believe that apple can generate the optics. he joins us live from downtown palo alto. >> reporter: yeah, there are quite a lot of optics behind me. here we are in the corner that leads up to the apple store. you're looking at the end of the line. so my guess at least ten people here. if you go to the end of the line those are people showing up now. these are probably what time did you show up? mid night so 2:00 in the morning. some 2 in the morning. why did you have to be here so early when you can get it later in the day? >> just wanted to get it first day and you know, hanging out

apple shares tendm+ñ to sink a announcement of a new phone. because you can't get a good measure ofa!3x sales waysed on lines. we need sales data to really understand what's good or bad. here is a sobering statistic. when iphone 5 went on sale apple was trading at $700 a share. today apple will open at $472. what a difference a couple of months makes. to be honest it's not the sales at the mall that count. it's china. the iphone 5-c was for china, china, when we get that, that's what owe zbho that will be interesting to see. >> cold hard reality. 6:18 now. kind of chilly out. christine is off. good to be decent day, right? >> a little cooler than yesterday for sure. we're going to see one of the reasons we've got the low clouds across the bay with maybe some

mist. our temperatures are philly, 40s and 50s. unlike the 40-degree warm-up in the north bay, we're talking temperatures mainly in the 60s and 70s around the bay. an all-day sea breeze this morning. we'll see how things behave at 1:15 this afternoon. we think the winds will be close to the limit for the america's cup race early in the afternoon. by< the evening, oakland, partl cloudy, cooler day in the east bay. highs generally close to 70 in oakland. if the game goes on, bundle up as the clouds continue to fill in. looks like we fast forwarded into october. we got the system approaching the coast. eventually some rain for the north bay. roblly as early as the evening commute. the rest of the bay area, some areas of light showers, maybe a brief burst of moderate showers for the hill top saturday afternoon. sunday, clear our skies but but feel chilly out as we get

through the weekend. the highest rain totals for the first system ofmy september, probably .1 inch but the north bay in sonoma county may get a quarter inch. 78 in san jose. 70s near 80 around pleasanton. 60 san francisco. mid 70s in the north bay. you hook at the high, cooler with mostly cloudy conditions. the stafrt the weekend, the second half it new bad. at 8:00 officially sunday evening fall begins. >> i'm going to wait for it and watch the clock change. watching the change for the colors. we go to orange, north 880, slow, a burst of traffic. i chicagoed cameras and where we see the blitz just a start of your commute. then it simmers down. that should be clear by now.

was shot in the cheek by men in a gray sedan, then turned to the park and started firing at people in the area. the park is on chicago's southwest side. right now that toddler said to be in critical condition, three others in serious condition. the rest of the victims including both teenagers are in good or stable condition. the shooting appears to be gang related but they have not released descriptions of the suspects. marla tellez gathering new information. she'll have a live report. >> to capitol hill where we are now about 11 days from a possible government shutdown. today house republicans meeting to discuss their strategy on that debt limit and the republican controlled house could vote this morning on a plan that would defund obama care and continue funding the government until 10 days before christmas. senate majority leader harry reid calling that vote a, quote, waste of time because the measure stands no chance in the senate which is controlleded by

democrats. tracie potts joining us live from washington, d.c. right now. and tracie, what will happen if congress does not act by september 30? >> reporter: if this vote doesn't go through today, jon, and they can't come wake-up a way to come wake-up a budget or extend the current budget, past september 30, then the government goes into shutdown mode and it will go into that mode within a half a day, so by october 1 at noon, the government will be in shutdown mode. and here's what that means. there will be a delay in processing federal benefits. service cuts for military veterans. no processing passport applications. data delays for economic data, you know the jobless numbers and other things we bring to you on a monthly, sometimes weekly basis. national parks, they will get shut down f. you plan a vacation you might want to pay attention to what's going on. and several other things as well. like medicare, new applications, new applications for student loans, you won't see those get processed quickly.

interestingly, there are some things that won't be affected. your mail won't be affected. that's a different budget area altogether. social security checks, they won't be affected. lots of seniors will be happy to hear. that by the way, pay for congress, it won't be affected either. >> of course not. maybe hopefully pressure will push them into acting. tracie potts, thank you. >> 6:33 a. former san mateo county probation chief found guilty of possessing child pornography will be sentenced this morning. 62-year-old stewart james forest was arrested inhe december afte the postal inspection service reported he possessed hundreds of images on his computer. forest claims he bought child pornography to do research for his job. he faces up to three years and eight months in prison and will have to register as a sex offender. >> george shirakawa jr. wants new charges dismissed.

shirakawa now facing a false impersonation charge for allegedly sending a phony campaign mailer insulting a city council candidate back in 2010. today a judge holding a hearing on shirakawa's request to dismiss that charge. earlier this year you may recall shirakawa admitted to misusing public funds. he then resigned from the board of supervisors. >> limousine describe group is urging governor brown to veto a bill to require all limos have emergency exits. they wrote to the governor to protest that bill saying the standards for the new exits are not clearly defined and the time table is unrealistic. the bill cleared the legislature and is;kú awaiting the governo signature. the bill comes in response to the deadly limo fire earlier this yir. five women died when flames blocked the doors at the back of the limo. another bill requiring safety inspections on limos that carry

fewer than nine passengers also on its way to the governor's desk. >> hopefully that will make a difference. 6:35. let's get it over to rob in for christina. a good looking sun rise. >> in the south bay pretty nice. a little chilly right now. you can see a few fingers of low clouds filling into the south bay now. most of the low clouds on the coast around san francisco where it's 57. 58 in san jose, mid-40s to start off in the north bay. the sea breeze off to an early start. it's going to increase for the afternoon and we'll see those onshore winds pull in low clouds. some rain producing clouds showing up, possibly as early as late this afternoon and evening. north of the golden gate and this will push into the south bay by tomorrow morning. so today's highs no 90s on the board, mainly 60s and 70s across the bay area. 78 in san jose. low 80s south of downtown, 60s for san francisco. that's a drop from near 80

yesterday. 72 today in oakland. so a cooler finish to the work week. all leading up to the chance of scattered showers across the bay temperatures. we'll see the winds pick up, temperatures mild to finish the weekend. >> we're looking to the bay bridge toll plaza. it's friday. we have the metering lights on thefrmt turned on a half hour later than the other four days this week so a lighter and later build to the commute. we see the lanes to the right and next to the hov lanes showing a light backup. we'll show you the maps. we see no problem, a little slowing down the east shore freeway from richmond to berkeley. in the upper 50s. about 55, not a problem for the maze. smooth flow, also 55 down through san lorenzo, hayward and approaching the san mateo bridge across the bay. down to the dumbarton bridge, 880, clearing for 84 and 92 across the water, no big issues there. we'll show you palo alto where the volume of traffic is steady

a tragic story to report. a 5-month-old baby is dead in a freak accident at an airport in spain. according to the guardian newspaper, an american arrived at the airport with a baby and a small child wednesday. the mother apparently rested the baby carrier on the conveyor belt and then it became trapped in the machine. the weight of the carrier activated the special carousel for oversized luggage. i know it's heart breaking. the baby was carried off eventually trapped in the equipment. the mother and children had just arrived from london. the father was waiting at the airport. i can't imagine. >> makes you sick to your stomach thinking about that. 6:40 now. nearly 70 people listed missing after the massive landslide in mexico as tropical storm manuel continues to hammer that country's pacific coast. dirt, rock, mud just tumbling

down a hillside in the remote mountain village. the land slide buried half of the homes and left 68 missing. the land slide triggered by days of heavy rain from tropical storm manuel. the death toll now is still rising, it hit 97 people dead. officials suggest some of those missing may have taken shelter in neighboring areas. this is some amateur video showing the extent of all of the damage. army helicopters, they have been rescuing residents of that village and they take them over to acapulco. around 400 people so far survived that devastating landslide. >> 6:41. coming up, breaking news, a bank burglary suspect up on the roof. new details on the early morning search that stretched several stories up. >> and new iphones, you have an

we have breaking news from san jose. that's where crews respond to a house fire. they stumbled upon something more suspicious, a marijuana grow, this after 5:30 this morning crews got the call of a small house fire on wigwam court near chenoweth avenue. they were able to knock down the fire fairly quickly. and during the search of the house they found a small pot grow. no word on if anybody was home at the time of the fire. >> meantime, a developing story in chicago. 13 people now injured after a late night shooting at a basketball court.

the bank in question here is still behind crime scene tape this morning. i guess you could call this a bungled burglary. police checking rooftops for a suspect and suddenly he fell through the roof into an apartment. san francisco police found the man a little shaken up and took him into custody. put him in the back of a patrol car. this started around 4:00 in the morning with a bank of america security system on san bruno avenue. picked up an image of someone in the bank, dark clothes and a crow bar in hand. police searched for the guy, couldn't find him. then called the san francisco fire department. they brought a ladder truck to check those rooftops. they quickly spotted a man on the third roof that they checked and as he was putting his hands up, well, suddenly a section of the roof gave way and he fell through. >> there was a hole in the roof where he fell through, as we were ordering him to come and show us his hands and he just

went through the roof. >> what was in that building? >> the building that he fell through was actually an apartment building. >> people were in there? >> yes. there were people on the inside of that building. not necessarily the room that he fell through but there were people inside of the building. >> reporter: yes. can you imagine their surprise when somebody came through the roof. we were hoping to speak with that family later this morning but through all of this everyone was okay. no one really seriously hurt. police say that man was dressed very much like the man that was spotted in the bank so they think that it's probably the same guy. they tell me they recovered a kro bar but no gun. they are going through the bank to see if anything is missing. reporting live in san francisco, christie smith, "today in the bay." >> following nothing short of a wild scene, much calmer on a south bay highway.

officers say somebody opened fire on passing drivers wednesday night, police have now ordered extra patrols along southbound highway 101 north of mckee road where the attacks happened. police know of nine victims but it could be more. officers, they say the shooter used a bb gun but they don't know who the shooter is or why they did this. fortunately, nobody was hurt. anybody with information on this one should call chp. >> 6:53. police in menlo park could soon be armed with tasers. a handful of officers in menlo park armed with stun gavin newsoms part after pilot program to test if the weapons should be given to all officers. the police chief says he is working on a proposal to present to the city council. they are the only two that do not arm their officers with stun guns. >> happening now, people all
