we'll give you the details coming up. >> a live look outside, san francisco, what a beautiful look at the embarcadero. crisp, fresh on this monday morning. september 23rd, this is "today in the bay." good morning to you. thanks for joining us. i'm laura garcia-cannon. >> good morning. i'm marla tellez in for jon kelley. we begin with this developing story overseas. kenya's interior minister announcing two militants have been killed after a military operation at the west gate mall in nairobi as several large blasts rocked the area where dozens have been killed in a hostage siege is now in its third day. we have new video just in, it shows dark smoke billowing from the mall. reporters on the scene heard multiple blasts and a barrage of

gun fire. this is a live look. security forces are trying to rescue an unknown number of hostages from inside the mall held by al qaeda-linked terrorists. at least 68 people have been killed. an australian woman who managed to escape says at first she thought noise was scaffolding falling. >> it was clear that it was something more than a rotary. we looked for somewhere to hide so we decided to run for it as well. >> militants say the attack is in retaliation for kenyan intervention in somalia. >> new details on a gas line break in san bruno. pg&e crews have capped the leak but working to fix the line after a construction crew hit it last night. it happened in the area of san bruno avenue and huntington avenue near el camino real. christie smith is live in san

bruno with the latest. good morning. >> reporter: good morning to you. you know, you can still smell a little bit of natural gas in the air. the break was actually behind me, orange barrier that you see there. pg&e has capped that leak. that happened after 1:00 this morning. the crews i spoke with said they weren't sure how long it might take to replace that two-inch main. last night around 9:15 a cal train construction crew hit a gas main near huntington and san bruno avenues. no evacuations or injuries. this is three or four miles from the location of the deadly gasline explosion that happened in 2010. cal train service in both directions was stopped, passengers taken by bus to millbrae or to b.a.r.t. to carry on. the work will elevate the tracks above three streets that run in san bruno. that project expected to be completed next spring and work

we're told will continue today. cal train service expected to be back to normal and again, that gas leak has been capped. reporting live in san bruno, christie smith, "today in the bay." >> it's 5:03. the trial begins for a former high school student accused of trying to rape one of his teachers. police say 21-year-old david velasquez tried to rape one of his teachers in the parking garage of summit prep high school in january last year. he reportedly tried to force her 18 car when another teacher came along and scared him off. he has pleaded not guilty. >> six people charged. they are expected to be in court. the suspects allegedly left steven reed and a 19-year-old woman bound and gagged on brussel street last december. reed later died at the hospital. the suspects are charged with murder. >> the 49ers smith son an

indefinite leave of absence as he deals with personal issues stemming from his arrest friday for dui. bob is live in santa clara. we know that number 99 he's not going to play thursday against the rams. >> reporter: you are correct. good morning to you. 49ers ceo jed york made the announcement yesterday after the game against the colts saying that star linebacker aldon smith would not be -- who was arrested friday for duri could miss more games, this is an indefinite suspension, there is no time table when he will be back. smith did apologize after yesterday's game and acknowledged that he will seek help. >> first off i wanted to apologize to the team, the organization, my family, everybody i let down. i want to let it be known this is a problem and it's something

that i get fixed. >> getting somebody down and paying them to sit down when they are going to seek treatment in the future, that didn't seem like an appropriate punishment. i know it might not sound reasonable, but for alden to be able to face the media, face his teammates, and take full responsibility for what he's doing, we felt that was the best situation. >> friday's arrest is not the first time smith has been in legal trouble. earlier this month he was sued by a man who claims that the man was shot at a party at smith's house last year. the suit alleges that smith was drunk when he fired shots in the air to get people to leave his party. reporting live in santa clara, bob redell, "today in the bay." >> thanks. adding to the 49ers trouble, new report there is may be bad blood between frank gore and head coach jim harbaugh. the chronicle reports that gore yelled at harbaugh at the end of the team's 27-7 loss to the

indianapolis colts, the paper says gore had choice words for harbaugh but did not elaborate. after the game gore said, quote, when things are not going right you get frustrated. end quote. he did not say anything else about the confrontation. 5:06. state appointed board of officials will discuss what should be done with $280 million in redevelopment funds from the city of santa clara. the state officials ordered the city to cough up the cash saying it should go toward schools, public safety and other services. santa clara was one of several cities to transfer its redevelopment assets to other projects and departments after the legislature voted to shut down redevelopment agencies more than two years ago. the $279 million from santa clara will go to a special board set up to decide how and where that money should be used. >> we welcome you to the second day of fall, certainly feel likes fall more and more. >> love it.

>> yeah. it is also time to celebrate meteorologist christina loren's birthday. >> thank you. it's going to be a nice day to get outdoors wherever you live across the bay area. not too hot in the east bay and not cold at the coast so here's what we're working with on a monday morning. back to work, back to school, 55 degrees in concord, 56 in san jose, and starting out pretty crisp out there in places like gilroy and santa rosa and the low 50s expecting to see the upper 40s before the morning is finished. 5 to 8 degrees warmer this afternoon. the cool ocean breeze will pick up. the winds could play a factor. i don't know if they get both races in or the one race out at the america's cup. what we're looking at is a building breeze so basically two start time opportunities. 1:15 and 2:15. right now it's looking pretty breezy for both. we'll have to wait and see. a cloudy start, a sunny cooler finish. throughout tuesday then the isolated showers i told you about, those are expected as we

get into your wednesday so. here's what we're working with, one of the warmest days in the period, 78 degrees in fremont, 85 in livermore, 81 in napa and 71 degrees in san francisco. we'll take a closer look at the america's cup forecast coming up. first, i want to check in, see how we're doing on a monday morning, the man who knows, mike inouye. >> good morning. i know from this shot that oakland is fine at the coliseum. northbound with the taillights past the coliseum. in the earlier construction zone. we saw earlier slowing. no problems from this shot. the earlier slowdown around the area heading into downtown has cleared up. haven't heard about delays created by this. you may be up a couple lanes toward 23rd but still registered for construction approved for the next few minutes. a smooth live for west highway 4. we expect slowing kicking in.

the bottom level there coming into the screen off the left side a little slowing, down to 60 miles per hour. that's not what i'm worried about. i'm worried about a hazard. it's a dog running around highway 4 eastbound at around 8th street. westbound you see slowing as well. but that's probably again just through that typical build for the morning commute. we'll follow those issues. here the tri-valley, the yellow, approaching 580 we have slowing just below 60, there is a crash i hear reported through the area confirming information from chp. not a lot of detail. so far just word of a possible crash in the area. back to you. >> thanks. 5:09. the faa is about to finalize its restrictions on in-flight gadget use. the guidelines are expected to allow reading e-books, listening to music and watching videos. the ban on making phone calls and receiving e-mail and text messages is expected to remain

welcome back. we continue to take live looks, yes, live pictures from kenya this morning. this is a mall where some are captive. we're seeing thick black smoke billow from the building. we'll continue to give you live updates as so many have been killed. san francisco strip club suing oracle after one of the employees ran up a hefty tab on a company credit card and oracle

refused to pay. according to the chronicle, the suit claims the employee racked up $33,000 in services over two nights last year. oracle refused to pay the charges on a company issued credit card. oracle declined comment. the fingerprint reader on the fi phone 5s has been hacked. don't be too alarmed. >> all security can be defeated if you have enough time and resources. a bank vault is unsecure if you have enough dynamite. despite the fact that at least two groups over the weekend managed to lift a fingerprint, create a fake plastic fingerprint and fool the iphone. this video from san francisco security expert mark rogers, he uploaded his hack just an hour or so after a german hacking group did the same. they will likely win several thousand dollars offered as a

prize being the first to hack the fingerprint. when it comes to apple we're waiting on sales figures. we assume the company will give some kind of hint how well phone sales were over the weekend. 5 million is the number to beat. 5 million iphone 5s sold the first weekend back almost a year ago. let's check the markets ahead. good morning, bertha. >> good morning, scott. some blogs say that apple sold out in all 11 countries where it launched so we'll see whether they held back inventory to create demand. futures meantime are pointing higher, likely due in part to positive economic data out of china. despite a drop in stocks on friday t markets are still coming off their third straight week of gains, we're going to get data in with 15 minutes on manufacturing, then later we'll have data on housing and

consumer confidence. a lot of folks are going to watch what fed officials will be saying this week, speaking throughout the week, looking for clues as to whether they are going to vote next month at the end of the month for taper starting in october. the dow falling 185 points on friday, starts at 15,451, the nasdaq slipping 14 to 3775. of course scott, we're eight days away from the potential government showdown depending on how things go down in d.c. that's likely to impact the markets. >> it will. bertha coombs, thank you. julian assange is speaking out against a movie about him and his website. he says this movie "the fifth estate" is not accurate. he got a copy of the screen play which of course he uploaded to the internet. the creator did ask him to consult on the making of the film but he declined. the primary issue is whether

anyone was hurt by wikileaks leaks. the movie according to the script makes the argument that people working for spy agencies were killed after the release of secret documents. we have not seen that and wikileaks points this out, government testimony has never accused him of that. this movie definitely does so. julian assange upset about the movie but released to the internet. >> that part not surprising. thank you, scott. >> meteorologist christina loren now to talk about the monday forecast, it's the second day of fall, her birthday, a lot going on on this monday. >> yeah. you know, a lot of people trying to get sleep out of their eyes, extra cup of joe on a monday. i have good news, we've got fantastic air quality out there thanks to the showers that came through. we needed the rain. and temperatures are running a little warmer in most of your bay area cities. but chances are on a sunday

morning you were sleeping in at this time. 24 hours ago, though, it was warmer. so if you did walk the dog yesterday morning you'll notice that difference. we still have the same clear sky and temperatures are cool enough for a sweat every or light jacket. we see plenty of 50s. we had 60s waking up last week. this morning the 50s. to drop off in the upper 40s as we head throughout morning hours, then we're going to climb up quickly between about with 10 and noon. once the sun is out there. we're talking about temperatures at lunch to 72 degrees in fremont. 74 in palo alto. what a beautiful day for lunch outdoors. 73 in san jose and 77 degrees in antioch so get without your lunch, enjoy that air quality as it will last for a while. we have another reinforcing shot of cold air and moisture as you get to this week. 79 degrees for today in san jose, 78 fremont, 84 concord 84 for gilroy and comfortable at

the coast. that's weather story of the day. you're getting the beautiful beach temperatures, 75 in santa cruz, 71 in san francisco, at least for now. temperatures are slated to tumble the next couple of days. 85 degrees for today. down to 77 for tomorrow, then we're going to see the low 70s inland. by wednesday with a few isolated showers. right now chance isn't looking great for whole bay area. the best chance in the north bay and the east bay. thursday into friday looking pretty good warming back up in the low 80s. getting toasty on saturday. that means great opportunities to hit the beach while we're seeing the summerlike readings. 92 inland saturday and 75 degrees at the coast. it's 5:18, monday morning. you went for a drive over the bay bridge. >> it was nice. it was right after christina, rain had come down for the day and so beautiful clear skies as well. it was a great drive, i'll tell you. much bert drive now as well.

the dublin interchange, north 680 t slowing was showing up, that has cleared. the earlier crash, maybe reports of a crash, called chp. no, nothing actively working throughout. good news. again a smooth drive. the only thing for the tri-valley slowing which started here as you look out 84 and 580 westbound. pretty typical. we're looking toward antioch, westbound the commute starting to kick in. the volume kicked in before 5:30 when we see right now. eastbound g news. no word of that doggy running around so no problems, the dog was not hit. a smooth flow toward the bay bridge, a live look and show you, an easy flow. we're starting to see a volume and see if the cash lane starts up. a live look, the foster city side of the bridge, a look at the south bay. san jose, the volume, no delays

throughout. >> 5:19. two teachers unions are trying to stop the closure of city college of san francisco. they plan to file a lawsuit. the unions will hold a news conference to explain the suit against the accrediting commission for community and junior colleges. city college of san francisco is set to lose its accreditation in july after the commission decided the college had not done enough. it's the largest community college in the quun 33,000 students. >> now to a preview of an exclusive investigative unit report, some of the richest guys around but an investigation by nbc bay area discovered that you the taxpayer have been helping subsidize some of their travel all over the world. 757 private jet one of seven owned by the founders of google. by now just about everyone has heard about the deal between

early monday morning. i was in san francisco over the weekend. it was half gorgeous, half rainy. nothing to complain about. it's 5:24. >> we know which half you liked. a handful of teenagers among hundreds to trash an upstate new york home return to the scene of a party to clean up the mess. the home in suburban albany owned by former raider brian holloway, around 300 teens broke in and had a party. they posted the pictures on social media. a few returned to the home and apologized and actually helped to clean up. >> at the annual emmy awards. >> one of the biggest went to a show that is about to finish its final season. >> "breaking bad." >> the series picked up its first emmy as best drama. it finishes last week.

aldon smith played yesterday against the colts, the game that the 49ers lost. he is out for thursday's game and could be out longer. reporting live in santa clara, bob redell, "today in the bay." >> 49ers new stadium running short on parking spaces and now the team is trying to figure out how to fix it. it is 5,000 spaces short. the team is looking at leasting a used soccer complex next to levi stadium. that idea not sitting well with santa clara residents. there is concerns that the parking problem could impact a nature preserve a half mile from the stadium. the city is urging people to stay calm saying there is no final decision on the issue yet. >> clothing chain abercrombie & fitch reportedly reached agreements. khan won a lawsuit claiming she

was fired from her job at a clothing store because she wears a head scarf as part of her muslim faith. abercrombie claimed it violated its policy for how employees should dress. it appears that policy could be changing. >> details on a gas line break in san bruno. caltrans is up and running after a broken gas line caused a scare. it happened in the area of san bruno and near el camino real. crews have been working on an upgrade to tracks. christie smith spoke to caltr s caltrans. >> good morning to you. that gas leak is capped. they did that just after 1:00 this morning. now and then you can pick up the smell of natural gas, crews are in the middle of the street working to repair that gas main. they tell us that the schedule will be normal just as you might

expect for a monday morning. we saw the 5:15 train roll through southbound on time here where a construction crew working on a multi-million-dollar project struck a gas main last night. cal train services both directions were stopped. no evacuations or injury but a reminder of what occurred. this happen add few miles from that deadly gas line explosion in 2010. this is part of a project to elevate the tracks in san bruno. a spokesperson was asked why they didn't steam know that line was here. >> well, this is an area where there's a lot of pipe, a lot of utility lines, it's a very complicated project. even though we had people on the scene looking for this sometimes these things happen. >> this project elkates the

tracks at san bruno, san mateo and angus avenue to improve traffic safety. the pg&e crews working here tell me they don't know how long when they can replace that but again the gas leak has been capped. christie smith, "today in the bay." >> we had an up and down weekend as far as the forecast goes. now we're going to see what monday holds. christina loren, happy birthday. >> i appreciate that. good morning to you. temperatures are comfortable to start the day. it is cool out there. and these numbers are dropping off. 51 degrees now in gilroy, we started out at 52 degrees there. we expect the upper 40s in santa rosa, napa and gilroy. over the course of the next hour, winds are going to pick up. especially throughout this afternoon. you're getting warmer where ares where our wind speeds later on.

america's cup taking place out there on the water, team oracle still in it. temperatures will be comfortable. headed out to the pier, i can tell you make sure you're ready for the breeze to potentially cancel the cup again today. the good news is winds are going to be as strong as over the weekend so there is a pretty good chance that race will go on. there is a slight chance with the current moving into the bay that they have to cancel it. 85 in livermore and 78 in fremont. the good news is if that happens we just get to keep on talking about it. thipt race to continue. hopefully oracle will stay in it throughout this afternoon. over to our sailor, captain mike inouye, ladies and gentlemen. >> hi, matie. talking about team oracle but also for oracle open world. they closed off power between third and fourth so you have that by the convention center.

that continues so. two places, lots of signage. toward the bay bridge, readings slow as far as the approach. no metering lights. pretty typical for this monday at 5:38. a look at the maps. a little blip shows up in emeryville. that's one of the first spots we'll see through that area. a nice flow but we're jamming up. jamming up toward pittsburgh and bay point. it flowed. it's that volume of traffic. a smooth drive, starting to pick up. we'll look at the san mateo bridge. nice easy drive across and a clear view of the high rise to the peninsula. as christie said despite the issue with the gas line, cal train is running 0en time.

results of a tactical move that they made to try to rescue more hostages. they say in response the militants in the mall had lit some mattresses on fire and that contributed to the smoke that we're seeing in these images coming out. they say that two militants have been kill and they rescued most of the hostages. as this unfolds here in the u.s. the fbi is investigating the possibility that as many as five americans could be behind this attack. they began investigating this after several names were posted on a twitter dhat is linked to the terrorist group that claimed responsibility. the fbi does not have evidence that those claims are true just in case nypz taking precautions as the general assembly gathered there. they put out heavy weapons teams in key areas in the city. some high profile target areas and shopping malls to be ready just in case. reporting live, danielle leigh. back to you. >> thank you very much.

and we also know at least five americans were injured in the attack including a uc-berkeley graduate. elaine dang seen here from her days at cal is one of 175 people injured. yesterday she post add picture of herself in the hospital with a bandage and caption proof that i am okay. her employer tweeted outpicture. >> the death penalty debate in the trial of the boston marathon bombing suspect. lawyers for dzhokhar tsarnaev will ask a judge to discuss the timeline and proper procedure for prosecutors to decide whether to seek the death penalty. eric holder will make the decision whether to seek the death penalty. the u.s. attorney's office in boston will make a recommendation. >> 5:43. the president and first lady go into new york city today for the 67th session of the united nations general assembly. the president will host the

world leaders ahead of his speech tomorrow. the meeting is expected to focus on u.s. efforts to disarm syria's chemical weapons as well as israeli palestinian peace negotiations. it will mark the first time president obama has had an opportunity to greet iran's new president. >> vice president joe biden and his wife jill head to colorado to visit areas devastated by recent flooding. they will survey recovery efforts. president obama declared colorado a major disaster area last weekend. eight people were killed by the rushing flood waters, more than 15,000 homes were damaged or destroyed. fema staff are on the ground providing assistance. >> new concerns for battling the rim fire. now erosion. the weekend rain and snow helped cool hot spots but also forced firefighters to evacuate some areas because of rock and mudslides. the challenge now is to prevent

running for that world series. what i can tell you we head throughout day we're going to see an interesting pattern. temperatures warmer by 3 to 5 degrees. we wake up with cloud cover on tuesday morning, then this disturbance coming through. it's going to cool us off and potentially bring very light, isolated showers up to the north bay and the east bay as we head throughout the second half of wednesday. a reinforcing shot of beautiful air quality. all that moisture coming through. we're going to hold on to the clear sky. nice after it rains. 78 degrees in fremont. 84 degrees in gilroy. getting comfortable readings at the coast. things start to change as we head through the next couple days, not looking so great for tuesday into wednesday. in the low 60s by wednesday, but the good news is temperatures warm up so a little bit of
