situation. and whether hostages are being r rescued. a burst of gun fire heard coming from the west gate mall in nairobi. a twitter post from al shabaab says it's still holding hostages alive in the mall and that fighters are still holding their ground. but a journalist with a kenyan newspaper says his sources have told him the military is making progress. >> the forces that taken over the first floor and the second floor. >> we know there were american victims but u.s. officials athey are looking into claims by al shabaab that americans also participated in the attack. kenya's foreign minister told pbs's news hour that two or three americans and a british woman are involved. >> and just in to the newsroom

we're getting initial reports of a magnitude 7.4 quake in a remote part of pakistan. the usgs reports the quake struck 42 miles northeast of the district in the southwest part of the country. so far no reports of damage or injuries. an update to breaking news in oakland. an innocent bystander is dead after police say two suspected shooters tried to get away. police say two people shot at a home and car at 82nd and rugsdale street. the suspect's car crashed into another vehicle less than two miles away. christie smith joins us live outside oakland police headquarters. the suspects are now in custody. >> reporter: yeah, that's exactly right. good morning to you. we just left that intersection a short time ago. there is a light pole down laying in the street and oakland police officer there helping out, some crime scene tape dangling in the intersection.

one oakland man dead, two others in custody facing very serious charges this morning. the car that the man was in broadsided at 82nd and church street flipped over. this is near the east mont mall. it happened around 11:00. the driver in that car killed. just so happened that oakland police were patrolling that area and came across this horrible crash scene. the officers realized that the suv uv in this wreck was similar to the description they had gotten of a car involved in another violent act less than a mile away at 82nd. why that house was picked police don't know but no one was hurt. we can tell you both men are in custody. they face serious charges including vehicular manslaughter. christie smith, "today in the bay." >> thank you. 5:03. new details on a story in east

palo alto. police searching for at least two suspect who is shot at a car full of people. police say they found three victims on university avenue between bell street and runamid, two had been hit. bob redell is at police headquarters there. investigators, they have any idea on motive? >> reporter: looking at possibly road rage, possibly gang related. those are two theories they are working on. good morning. this started before 1:30 this morning when police received a 911 call from three people in a red subcompact, driving down university avenue to say they were being followed closely by people 18 white camry. as police were heading out to respond they could hear six gun shots. then the shots happened on the university of michigan about a quarter mile from the police station where i'm at. police found the red car, rear window shattered down university, closer to 101.

three passengers on the side of the road a. driver was grazed in the arm, the 18-year-old girl who lives here in town was sitting in the back of the car, she was grazed in the left arm, the passenger up front was not hit at all. >> i can't even say if it's gang related. i can't say if it was road rage. leading up to it they didn't say anything about any sort of dispute or argument between the parties in both cars. it was just they said they were driving along and all of a sudden this white car shows up behind them, high beaming them. >> the people in the red car were not able to get the license plate number. they say it was a white newer model toyota camry with tinted windows, two to three people inside last seen possibly headed eastbound. sergeant carson we heard from is not 100% sure what led up to the shooting. he believes the victims were reluctant to tell police the whole story.

reporting live, bob redell, "today in the bay." >> a 2-year-old pittsburg girl is recovering after being hit by an suv. the collision happened last night. the girl was chasing after a ball on the street when she was hit. the driver of the suv didn't see her until it was too late. he stopped and helped the girl until medics arrived. >> a neighborhood figuring out how to rebuild after a fire damaged a centerpiece of the community. the fire tore flew the zion first church of god in christ yesterday. the smoke could be seen across the bay. firefighters were able to get it under control but not before it caused $900,000 in damage. people in the community say they don't want to lose the church. >> it's been on this corner for 97 years, and this church has been a serious community outreach for this entire community. and it's very devastating.

we reach out to the community, this is an open door church where they can come in at any time. >> we don't yet know when worship services will resume. >> a san jose man shot by police officers is about to get a big payout from the city. today the council is expected to approve an almost $5 million settlement for javier gonzalez guerrero. in october twof 011 officers shot him more than 20 times. when they mistook a toy gun he was holding for the real thing. the toy gun was part of a halloween costume. >> happening now fire crews in southern california trying to get a containment on a fire burning in the san gabriel mountains in los angeles county. the fire has tripled in size to about 190 acres since it first started yesterday afternoon. firefighters say a nearby condo

meantime we're waiting for clarity out of washington as to whether there is going to be a shutdown one week from today. this morning we're going to get data on home prices, the index, and consumer confidence as well. we'll have the dow starting at 15,401, the nasdaq at 3765, after slipping 9. and burger king, well, they are trying to make you feel less guilty if you want to have some french fries. the fast food chain is launching crinkle cut fries that it says has 20% fewer calories than regular fries. a small order of its new satisfries 270 calories, the credit is is a new batter that doesn't absorb as much oil. a small $1.89 versus $1.59 for regular. if the math is correct that's almost 20% more to get 20% less. >> that's pretty good tag line. bertha coombs, thank you.

half moon bay, pacifica, ocean beach. just remember, along with that high surf comes very dangerous rip currents so you want to take it easy out there, swim with a buddy, swim at a guarded beach. a lot of us know that water is cold. we head throughout day, much cooler than yesterday. we're not going to see much action in terms of precipitation until we hit tomorrow. nice and clear all the way through about 10:00 p.m. then i stop the clock, into tomorrow afternoon, between about 3:00 and 4:00. we expect a little bit of light shower activity from concord up to fairfield. you have the chance in santa rosa, don't think we'll see much south of the golden gate bridge or the bay bridge. our chances slim. don't get caught under the drizzle or the rain and say she didn't tell me about it. 77 degrees in livermore. 75 in santa teresa. 79 in gilroy and 75 degrees in los gatos. these are the kind of numbers

that we yearn for when we do hit the winter months and of course as you know around here we're transitioning into fall. it starts to get cool pretty quickly so keep in mind it's going to be nice but our beautiful days, they are numbered at this point. temperatures look like this. the upper 70s for today, mid 70s tomorrow. thursday into friday, mike's favorite, the 80s come on back and then saturday into sunday a little warm but you can hit the beach. on saturday, 91 degrees looking good. also the swells decrease. >> we're working with the 65s. for the most part. we'll show you where they are coming down as far as the speeds right here as you might expect. westbound 580 out of the altamont pass, the merge off 205 and 580, that blends with traffic and causes our average speed to come down as you head into the tri-valley. averages at 45 for the bulk of the slowing through one construction zone that is westbound 580, the construction eastbound because we don't typically have a lot of traffic, that's what you see coming

toward us. the taillights i know it's black and white but still this is from our caltrans camera. a smooth flow. by the time you get to the dublin interchange, you hit here at 680 no problems down through pleasanton. 84 starting to show that slowdown around and a typical pattern for the tri-valley. we'll see how things are shaping up into the south bay for fremont. a nice smooth flow coming toward me. continuing down toward mission boulevard. the south bay itself on the maps shows you no problem. your typical build a little bit for 101 as you pass by 680 and will bog down the next 25 minutes, the commute about 6:20. construction remains but not a major concern. a live look outside we'll see how things are for the peninsula. the volume builds but you have to limit for 101 and 280.

victims in all on university avenue between bell street and runnymeade. bob, investigators are now saying they have doubts about the victim's story? >> reporter: they believe that the victims were reluctant in telling them the truth so they are trying to figure out was this gang related, was this possibly road rage or was it something else. again, epa detectives trying to figure that out. this started before 1:30 this morning, marla, when police received a 911 call from three people 18 red subcompact driving down university. they were calling to say they were being followed closely by two to three people 18 white camry with tinted windows. the people are flashing the high beams at them. as police were heading out to respond they heard at least six gun shots. then the shot spotter indicated those happened on university of michigan about a quarter mile from the police station. police find this red car with the rear window shattered a few

was white newer toyota camry with tinted windows, at least two people, possibly as many as three inside. last seen possibly again at an eastbound on university. reporting live, bob redell, "today in the bay." >> an update to breaking news in oakland. police say two men who shot up a house and car ended up killing an innocent bystander while trying to get away from the scene. police say the shooting happened overnight at 82nd and rugsdale street. the suspect's car crashed into another vehicle less than two miles away. christie smith joins us live outside police headquarters. the suspects now in custody? >> reporter: good morning. oakland police say those two men t two suspects were absolutely flying down church street in east oakland and may have blown through a stop sign when they rammed into a man's car, the driver it actually flipped over.

he was killed there at the scene. this happened around 11:00 last night. if you know the area, it's right near the east mont mall. oakland police tell us that they were patrolling and came across that horrible crash scene. two men taken into custody. the officers at the scene realized the suv was very  similar to the description of the car tied to a shooting a short time before, less than a mile away. someone opened fire, both a car and house at 82nd and rugsdale. fortunately, no one hurt there and police say they are not sure why that home and car were picked in that neighborhood. these two men taken into custody facing serious charges this morning. including vehicular manslaughter. reporting live in oakland, christie smith, "today in the bay." >> thank you. just in to our newsroom, new after shocks in a large quake in a remote part of pakistan.

the initial quake 7.8 in magnitude, then minutes later followed by a 5.8 aftershock. the usgs says both quakes struck about 42 miles northwest of the arwalen province in the southwest part of the country. so far no reports of damage or injuries. >> police now say a group of high school students are responsible for a brutal attack that left an east bay man in a coma. david lamont was attacked outside his pleasanton home on middleton place near livingston place. police say the father of two went outside just after midnight saturday morning to ask some people to stop being so loud. when he didn't come back inside his wife found him unconscious and bleeding in front of the home. investigators now believe the people responsible are high school students from several different schools including two in pleasanton. police have not yet arrested the

students. the victim's wife is still in shock. >> so horrible, and so cruel. and the fact that they left him there to die. it's just -- i can't even understand it. >> lamont remains in the hospital this morning in critical condition. >> 49ers linebacker aldon smith has reportedly entered rehab. nfl.com reports smith will miss about a month as he gets treatment. the team put him on non-playing status yesterday. says it will only bring him back if he is cleared by doctors. smith was arrested for dui friday after police say he crashed his car into someone's front lawn in san jose's silver creek neighborhood. it will be up to the nfl to decide if smith will be suspended or fined. smith's first court appearance is scheduled for november. >> santa clara council will talk about the parking short at the

future home of the 49ers. it was revealed the team is about 5,000 spots short and that led to speculation that the city will relocate some youth soccer fields and pave them over to make up the difference. local soccer leagues are unhappy and so are environmentalists. if the soccer fields are moved they will likely be placed in a nearby nature preserve which would require wiping out thousands of plants and trees. >> call them the comeback kid. team oracle to race again. race 17 and if needed, 18, are slated for today after oracle won its fifth consecutive race against team new zealand. both have eight wins. today's race would have been a winner take all finale but team usa was docked two points before the competition, that means the americans still need three more

wins while new zealand needs one. you can watch the action at 1:00 in the afternoon on cozi tv, that's comcast 186 and on air at 11-2. >> and christina, you were out there last week broadcasting live. sort of like the america's cup personal meteorologist. >> i wish. they certainly have guys that are very well paid to do that job. good morning to you. i'm not an expert on the currents that come into the san francisco bay. they can be erratic. and what happens is when those currents are strong they have to lower the wind criteria. today that will likely be the case. we're going to see rough seas as an area of low pressure starts to move closer to the california coastline. for us that means the high surf will continue to move in as our first large swells of the season. 61 in san francisco, at 56 in napa, 57 in sonoma where you're from, marla tellez. and 58 degrees in san jose. 54 in gilroy a. good looking day shaping up. the winds pick up throughout

we continue to follow the latest on that hostage wags at a mall in senia. officials just announced three soldiers have died and eight others injured in a fight with militants. meanwhile we are still waiting for word on what is happening inside the mall as we give you a live look at the area. it has been four days since the militant group al shabaab entered the mall in nairobi taking dozens hostage. now kenya is saying americans are among the militants. tracie potts is live in washington with america's investigation into those allegations. >> reporter: good morning. that came from kenya's foreign minister saying there were a couple of young men 18 and 19 who were americans involved in that attack but u.s. officials

say there is no confirmation of that, no names, no identities, that will have to come from the kenyan government. until then, no confirmation from the u.s. new this morning more gun fire explosions this morning, off and on as both group, the terrorist group and police claim they have the upper hand in the situation. kenyan police said that there were explosives left by the attackers that they were trying to detonate early this morning, and they have been urging patience as we await word from kenya's president and other officials as to what is going on there. we do know that dozens of people, 62 confirmed, have died at this point. we is that number before the three officers that you mentioned so it's not clear if they are included in the count or not. what is clear, the morgue, they are getting ready for dozens of people to be examined there. >> thanks so much. >> two men facing charges in
