a very good wednesday morning to you. thanks so much for joining us. i'm laura garcia-cannon. i'm marla tallez in for john kell wi kelly. students at a south bay high school have learned a popular math teacher has been arrested accused of having sex with a minor. bob, he is already finding some support online. >> reporter: good morning to you, marla. yes. we have seen some tweets in support of hugo cortes guzman that paint him as a positive role model for students. santa clara police have a different opinion. yesterday, late afternoon, they took him in for questioning. after the interview, they arrested him for allegedly having sex with a minor. whether that person is a student at santa clara high, police will not say. cortes guzman teaches math at this school and is also involved

in avid, a program that helps mostly low-income students prepare for college. the district sent a letter letting parents know about the arrest alerting them that he has been placed on leave. the letter asking parents not to jump to any conclusions. that he is presumed innocent. if anyone has any more information about this case, to contact police. a few young people, possibly students at santa clara high have opened up on twitter about his arrest. one tweet reads, he was my fave teacher in santa clear ra. another one calls him an amazing teacher who cares for his students and the school. quote, stop believing these dumb rumors. i believe he is not guilty, unquote. reporting live here at santa clara high, bob redell, "today in the bay." it is 5:01. we know a chico state nursing student is a 21-year-old woman from livermore. christina chesterman was riding

her bike over a bridge in chico when she was hit been an suv. she died yesterday. her family says her organs will be donated. the bay area news group reports she was thrown 120 feet in her buy sib bicycle. the driver, a 19-year-old, took off after the crash but was tracked down by police later sunday night. hoover is now charged with vehicular manslaughter and driving under the influence no arrests yet in that brutal beating of a pleasanton man. they are still interviewing several local teens. late friday night, 51-year-old david lamont went outside of his home after hearing loud voices. his wife found him beating and unconscious in the streets. the father of two is still in a coma this morning. a potential witness telling nbc bay area he saw a gold or metallic brown suv leaving the area around the time of the beating. pleasanton police say the persons of interest attend both

high schools in pleasanton z. >> an elderly couple facing eviction in less than an hour. they are refusing to leave the home they have lived in for decades. "today in the bay's" christie smith live outside the couple's home. this is a fight over rent control. >> reporter: that's exactly right. good morning to you. they could be evicted within the hour. they have called this san francisco apartment home more than 34 years. they are saying no. they are going to stand up to a system that favors developers over poor families like themselves. they are refusing to leave. 74 gum gi lee sfoek to us about raising seven kids in the two-bedroom rent-controlled apartment. they pay $778 a month in rent but recently, the buildings new owner told the tennants that he was evicting them under the ellis act. the state law that allows property openers to clear the building with buyouts. the units are supposed to be fixed up and put back on the market.

apparently, there is a way to get around this. all very stressful for this family. the lee family spoke with us through an interpreter. >> i feel really stressed and anxious. >> the target undervalued rent-controlled properties. you clear the property and resell it as luxury tenancy in common units. >> with the housing market on the way up, the san francisco rent board says in the first six months of last year, landlords filed 62 ellis act eviction notices. so far this year, that's just about double to 125. lee says she can't afford to move in this area where one bedrooms are going for $2,000 a month. supervisor, david chu, says he is hoping to change the laws and give seniors priority on the affordable housing list. activists say they plan to be here all morning to help this

family out. reporting live in san francisco, christie smith, "today in the bay." 5:04. two people have been arrested suspected of robbing a line of casual carpoolers in the rock ridge neighborhood. some of the victims of monday's robbery identified 22-year-old delonte johnson and a 17-year-old boy as the suspects. police believe they, along with a third person, held up about 20 people at gunpoint as they waited at line at the carpool stop on hudson street near claremont avenue. some of the people in line ran away. mosquito fogging is just about to take place in the brentwood area and last until 10:00 a.m. they will be in the southeast corner of holland tract road north of the holland tract marina. it is due to a high number of mosquitoes and the detection of west niles virus in the area. if you didn't mind yesterday, you will be okay with

today's forecast. it was a nice day yesterday. it was. today is going to be windier and cooler, still, feeling like fall as we transition between the two seasons. we are going to jump right back up to summertime norms getting into this weekend. if it was too cool yesterday, if you think 67, 68 degrees is too cool in the south bay, we have good news. we are going to warm you back up. temperatures this morning, pretty chilly. cool enough for a jacket. we are expecting some of your numbers to fall into the upper 40s before we hit the lows. the coolest point of the day is typically right around sunrise. here we go, 57, san francisco. 57 in san jose. winds are certainly building out there. we're going to see these winds kind of jump around. all your wind speeds will be going up and down all morning long. expecting the strongest winds this afternoon.

fueled by some internet stocks that have been on fire. 5:13. i'm sure mike will remind you. howard at third street closed again today for oracle open world. it has caused a shortage of hotel rooms in san francisco. you have open world and the unexpectedly long america's cup. larry ellison blew off his own keynote at the conference to attend the sailing competition. i was reading and struck by this. oracle open world is so big, the population of san francisco rose by 7%. >> no kidding. >> i had no idea it was that big i knew it shut down roads crews in southern california making progress against a wild fire that forced the evacuation of 40 homes in the san bernardino foothills.

the 200-acre fire started late yesterday afternoon near the heavily traveled interstate 15. 30 homes were evacuated as a precaution. none have burned. >> it is that time of year talking about wild fire after wild fire. >> still fire season. we are now in fall. temperatures are going to feel like fall for one day only, one day only. get it while it is cool. 5:15 now. that was some really impressive racing on the san francisco bay. and, you know what? i'm not going to say whether or not the race will go on but based on my forecast, i can tell you it is going to be another close call. we probably won't find out until right up until the moment that race is slated to start. that's about 1:00. you can catch all the action on nbc bay area. taking a live look here, san francisco looking good. our winds are coming out of the northwest. for us, that means we are going to see some pretty blustery conditions as those winds pump from the north.

that's usually a dry wind as well. you want to keep that in mind. not packing a lot of energy or a lot of moisture. we still could see some showers. i want to show you where in a moment. look at this. we just climbed in san francisco. 24 miles per hour sustained speeds there. we are going to see these numbers go in and out all morning long. i will be tracking the stronger gusts. as you know, if you drive a high-profile vehicle, that can certainly impact your ride to work this morning. right now, strongest wind at the immediate coast and up through the north bay. this is a view of what we're expecting as far as clouds and showers. at 2:00 p.m. you can see mostly clear conditions for most of the bay area. a deceptive sunshine where you look ott out your window and it looks beautiful. temperatures breaking into the upper 60s for today. a much cooler day here in the south bay. if we do get action, the window opens from 2:00 p.m. to 4:00 p.m. as far as showers go. for the most part, those will

specialist on site. >> in that order, probably. >> yeah. you need the health specialist at the end. california doctor's quick thinking is credited with saving the life of a bakersfield community leader. >> a woman started choking on her food while out to dinner. they tried the heimlich maneuver but it didn't work. that's when this man here, dr. royce johnson. he used a friend's pocket knife to cut open her throat and insert a hollow cylinder of a pen to help her breath. she is expected to be okay. that's extreme but it worked. >> right place, right time. 5:21. fights outside of yankee stadium keeping hun keeping hundreds of people from getting in to see the game. we'll tell you about the little toy that caused all this trouble coming up.

senator roberts say, oh, they don't have any answers. they're not willing to fix obamacare. the truth of the matter is, we've been talking about this fo welcome back. taking you back to the u.s. senate where the fill buster continues to go on. senator rand paul is speaking. ted cruiz handed it over to him as they are continuing to keep this going on trying to defund the health care law. we are going to keep tabs on what's going on there in washington. it is 5:24 locally. organizers of running with the bulls event say they are now looking at venues outside of san francisco. san francisco's animal control and welfare commission passed a resolution last week voicing its opposition to the event and requesting that the organizers stop using the city's name in ads. according to the examiner, the great bull run, llc, says it is now exploring venues between san jose and sacramento, though not within those cities. it is build as a chance for

people to run a quarter mile track with 24 bulls. i'm good. i don't need to do that. organizers say the bulls are treated humanely. the event in northern california is supposed to be held in june. >> the people themselves not so much. call it a bobblehead breakdown. 18,000 yankee fans who lined up to score a marie anna rivera bobblehead got heated when the train bringing them came late. the track bringing the bobbleheads from the train to the stadium had hydraulic issues leading to more delays. stadium workers handed out vouchers until the bobblehea arrived after the third inning. people were very frustrated. reports of some fist fights breaking out. so many of the collectors wanted them right here, right now. >> i guess they didn't really go to watch the game. christina loren, what's going on with the forecast.

>> a pretty good impersonation of a bobblehead. good morning. we have a really good-looking day shaping up. temperatures are going to be cool. it is going to feel like fall. after all, we noare now into th new season. break out the scarfs and the boots if you want to. we do have wind prevailing out of the northwest. as we head throughout the day, we are going to continue to see the northwest wind push off to the southeast. it will get gustier and gustier as we head throughout the afternoon. major impacts, gusts, 20-50 miles an hour. that could knock things down if they are not tied down in your backyard. tomorrow, more blustery. thursday afternoon, increased fire threat as well. that goes up with those dry north winds. we lose that moisture associated with the system. finally, friday, the winds subside. we'll take a look at who could see showers. a small area we are watching.

from nbc bay area, this is "today in the bay." thanks for joining us. i'm laura garcia cannon. federal transportation officials have opened a brand new investigation into asiaa airlines was required to post a toll-free number within an hour of the crash to gather and distribute information to families. they were also required to provide transportation and lodging for family members coming to be with injured loved ones. several passengers are suing saying they failed to provide timely information after the crash a teacher at a south bay high school is off the job after being arrested for having sex

and told him his wife lost her purse in the store. the manager directed him to the lost and found. well, that's when police say the man punched the manager and just ran away. police say the manager is in the hospital and still not in a condition to speak. they don't know if the two know each other. despite public outcry, santa clara says a plan to bulldoze a third of a local nature preserve is still in option. last night's city council meeting was packed with supporters of the ulistac natural area. the city is considering a plan to bulldoze some of the preserve to make way for soccer fields. the fields next to levi stadium will likely be paved over to create several,0 thousand parki spaces. bitter opposition to the idea remains. >> soccer fields can be moved anywhere. the 40 natural acres of ulistac

he could stand all night long. they are telling us he never left the senate floor or yielded. although there have been a number of other republicans that jumped in thoep hhelp him and c this marathon filibuster from time to time. they are trying to do anything to delay today's vote that would provide a budget and prevent a government shutdown. this vote would keep all the money in for the president's health care program, for the affordable health care act. that is something that conservative republicans do not want to see. they are trying this delaying tactic. because it is connected to the budget, if things are delayed too far, it could possibly lead to a government shutdown squeeze the time essentially that the house and the senate have to work out some agreement on that budget. that's a hard deadline next week. >> something we will keep our eye on. thanks so much. in the meantime, a big part of the new health care l takes effect in less than a week.

the obama administration is unveiling the details of the new exchanges where people will be able to shop for health insurance. some mid-range benchmark plan will average $328 per month for an individual. health and human services secretary, kathleen sebelius, will give an overview of plan choices today. >> troops have defeated a group of terrorists that attacked a shopping mall in nairobi. some attackers may be hiding inside with weapons and boobytraps. the country's president has declared three days of mourning over the attack. at least 61 civilians, six security forces and five al shabaab militants are known to have been killed. this was kenya's deadliest attack since the 1998 truck bombing which killed more than 200 people. the government says 11 suspects have been arrested for the mall attack. >> you know what that sneemeans
