about 4:31. happy to see you. i'm jon kelley. >> i'm laura garcia-cannon. let's check that forecast with meteorologist christina loren. good morning. >> hey, good morning to you, laura, welcome back, mr. jon kelley. good morning to you at home. a great looking day shaping up, we're tracking showers in the forecast as well for tomorrow. but today, you'll likely notice a chill in the air. temperatures running cooler in places like santa rosa and we're going to continue to drop off so if you are leaving now make sure you grab a sweater. let's check in with mike inouye and the roads. >> good morning. folks at home we have mostly clear as far as the freeways go. traditional road work. i want to shout out this in san francisco. we have a report of a crash and maybe a brush fire related to the crash. this is going on right around where we think is the summit of the twin peaks boulevard. that's got a lot of activity. we're working with san francisco police department on this because chp, this is not a major

freeway so they are not going to handle the situation a. car may have gone off the road and caused a brush fire. we're checking on injuries and the impact to the streets. we'll send it back to you. >> breaking news in san francisco where homicide detectives are calling the death of an infant suspicious. around 12:30 this morning the san francisco police department got a call from san francisco general hospital regarding a death case. a mother brought her infant in to the hospital where the child died. the medical examiner determined the death suspicious. officers are taking a closer look at the mother's home on monterey boulevard in the glenn park neighborhood. christie smith is on the way to the crime scene. she'll have an update at 5:00. >> now to a developing story in santa cruz county where investigators are now looking into the cause of a destructive fire overnight. these are new pictures to show you soon after the flames broke

out. this happened in the hills above atoss. two homes and one other structure were destroyed. they had to evacuate homes for fear of the flames spreading. crews were able to control this and we are happy to report nobody was hurt. >> no deal but still no strike plans either. that's the word from b.a.r.t. and the union this morning. both sides planning to resume talks in a few hours from now. the deadline is looming. the cooling off period ordered by governor jerry brown ends on thursday night. but the union, they say they don't plan to strike on friday. management and workers, they are still fighting over pay and benefits. >> we want to leave every opportunity open to try and get this deal done. we are keeping all options on the table. >> i don't want to go any further into characterizing thou negotiations are going. the mediator asked us not to

publicly talk about what's going on. we're going to leave the bargaining at the bargaining table. >> no question it's a bitter few months. b.a.r.t. workers went on a four-day strike in july. then in august govern brown issued the 60-day cooling off period. we can tell you there still is a chance of a second strike and that's because hundreds of people are street gather in oakland for a rally in support of b.a.r.t. workers. union members will be joined by leaders and passengers at frank igawa plaza. >> it's 4:34. sheriff deputies are on the lookout for this man, jose jimenez. deputies say he is the mastermind behind a major drug ring. he is accused of running the operation out of his home near story and white road. detectives seized $125,000 in cash, two loaded handguns and 30

pounds of crystal meth and cocaine. >> this type of a seizure is unusual, there are a lot of drugs on the street. it is a major operation by the amount when you look at 29 pounds of crystal meth, cocaine and heroin. big seizure, these drugs were destined for the streets in santa clara county. >> investigators say one man was arrested but jimenez who was not home at the time of the raid. they are now looking into whether the operation was connected to one of the mexican drug cartels. the street value, $1.5 million. 4:35, a fire might involve a criminal investigation. officials say it could be a drug house. the fire started last night in the basement of a home near 7th and st. james in downtown san jose. firefighters had the flames under control quickly.

they say illegal wirg in the basement caused the fire. oth items were found boarded up. >> a high school teacher in fremont now facing child molestation charge this is morning. david williams a teacher at kennedy high school, police arresting him on friday after the the parent of a female student reported he inappropriately touched the teenager. the 66-year-old now being charged with three misdemeanors of annoying or molesting a child under the age of 18. he is due in court next month. >> a former hayward police officer now will be in court today facing charges of extortion. police arresti ining him after woman came forward. they questioned her about possible forged prescriptions and then he allegedly demanded money from her. he grew up in hayward and he handed in his resignation yesterday. the police chief says her department has a zero tolerance policy for corruption.

>> a health alert this morning for people who eat foster farms chicken. a salmonella outbreak linked to raw chicken sickened nearly 300 people, most in california. the usda says it was packaged at three facilities. there is no recall in effect, just a warning to make sure you thoroughly cook the chicken, properly clean everything, the raw meat touches. information on the screen, product numbers to look for. but we also have these listed on our website, nbcbayarea.com. it will be a presidential day in san jose. former president jimmy carter and his wife, they are getting their hands dirty on a construction site in town celebrating 30 years working with habitat for humanity. the former first couple of experts with tools and the concept of providing low income housi housing. they will be joined by garth brooks and trisha yearwood for a project. the couple kicked off the bay

up. more 40s than yesterday. grab your coat, your jacket. something you can peel off later on as we are going to hit the 70s by about lunch time in places like san jose, palo alto and livermore. plenty of low 60s at noon along the coastline. still the forecast, a nice rebound later on. highs between about 3:30 and 4:00 p.m. i'm forecasting 70 straight up in san francisco. comfortable conditions for that celebration of coit tower. we're looking pretty good right now. i'm still tracking the showers, a chance kind of slight, i'll show you the storm track of the system in my next report. stay tuned for that. mike, let's get the update. >> a couple things. to the south bay and we'll look at the traffic flow. we don't have a lot of problems. right where it says willow glenn, the expressway on the maps slowing shows up. it just kicked in. nothing reported on that.

north 17, this connector between santa cruz county and the south bay, reports of a deer that was hit northbound at deer creek road. only two lanes and one might be affected by the injured deer so be careful through the area until animal control can arrive. we'll see this over the next month or two about because it's rutting, they are looking for partners for deer. we see the san mateo bridge, no problem, haze in the air but the peninsula moves and visibility on the bridge is fine right now. we look at the bay bridge we see a clear view into san francisco. this is the second of the incidents in san francisco around twin peaks boulevard. around the summit as we understand there is a crash and a brush fire. we're getting more details. back to you. >> that's a pretty shot, though. >> we are treated visually every day. still ahead on "today in the bay," this one's hot off the press. up close and personal look at

the christmas list. 4:45. today a trial starts for five people accused of taking part in bernie madoff's ponzi scheme. a crime bilking investors out of billions. let's turn things over to bertha coombs. happy tuesday morning. >> happy tuesday. happier if i had that diamond ring in my stocking or hopefully at christmas. futures are pointing to a flat open on wall street. the market slumped on monday, investors are worried about what's going on in washington. we've got the deadline to raise the u.s. debt ceiling and we're not seeing progress when it comes to discussions. the dow and s&p 500 closed at a one-month low. no one is panicking yet. the head of moody's says it's extremely unlikely the u.s. will default on its debt. let's hope so. we were scheduled to get data on

the trade deficit but because of the shutdown that is going to be postponed. the dow starts the day at around 14,936 after falling 137 points, and the nasdaq at 3770, after losing 38. americans are apparently being a lot better about spending keeping credit cards in their wallet. new government data shows that credit card balances fell for the third straight month, possible evidence that consumers are being more cautious. other borrowing has picked up. non-revolving debt, auto and student loans rose 8% and has been on the increase over the past two years. and jury selection begins today in the fraud trial of five of bernie madoff's former employees, the group includes his secretary, they are accused of helping to hide madoff's ponzi scheme, falsifying records for years, and i think there was something about a love triangle,

being part of this. big soap opera. >> seems like the perfect made for tv event or maybe the big screen. thank you very much. good to see you. >> new this morning, what goes down must come up, construction set to begin on a new cal state east bay campus building to replace the one imploded over the summer. look at this. the old 13-story ward hall, good-bye, demolished back in august. fascinating to watch. after the 42-year-old campus building was deemed seismically unsafe. so construction on a new building is set for later this month. a meeting will be at noon today at the campus library. >> it's intriguing the engineering that goes into that to make it go. once in a while we see the bad story where it falls to the side. >> clear the scene. clear sky this is morning. >> better that it's manmade than natural forces. that's a great reminder. we are in earthquake country, we

just had an earthquake just a couple days ago in berkeley. about a 3.0 but it's that time you want to always consider you go to the store grabbing extra canned goods and stocking up on water supply. 54 degrees, good morning san jose. 45 in gilroy. thanks for waking up with us. we know it's early out there but the best news is when it comes to the weather you don't have to drive through the thick fog. it will be rolling in throughout the morning hours and it is a little chilly. but temperatures overall are going to be nice. one of the best seasons across the area if you like comfortable temperatures. you don't have to apply your own heat or ac. so this is what we're working with throughout the afternoon. temperatures are going to fall more so, from where we ended up yesterday. that means more of the upper 70s than 80s, trading those in for today. as we head through tomorrow we have a slight chance for showers especially into tomorrow afternoon. so you want to keep that in mind. looking pretty good for

thursday, gradual clearing, mid-60s to low 70s. so one day, one chance for rain in the forecast. i want to show you your futurecast. best chance in the south bay. one of those rare systems that comes up from the south. light activity from morgan hill north toward san jose. stop that clock again into tomorrow evening, and that chance increases a little bit more along the east shore and of course up to cupertino on the peninsula you will see some of that activity. so, overall temperatures pretty good for today. 79 in livermore, 78 in concord and 70 in san francisco. we're in fire season so we need the rain. the next couple days, it's going to continue to stay steady temperaturewise and we're talking about beautiful conditions. thursday into friday, staying nice and steady. and saturday into sunday, temperatures climb up which is great news if you want to hit the beach as we know, though t days are numbered. back to you, jon and laura. >> thank you. it's 4:50.

welcome back everybody. a live look at o.co coliseum. the a's trying to keep that fever going hoping to take care of business in detroit this afternoon so they don't have to play a game five back at home here on thursday. speaking of the a's, they need to win one more game to advance to the championship series. that could happen today. yesterday the green and gold a lot of flex appeal. three home runs. no doubt tensions will be high after bad blood between two players. the benches clear like they like to do, then a lot of pushing and shoving and trying to flex up and man up. but things did settle down and the a's go on to win this one by a final of 6-3. >> yeah, it was a little heated

4:55. we've got our man mike inouye out on the roads. >> wow, you are such a liar. look over here, we'll look at the roads, tell you the truth about that. the death stare. take to you the east bay where there are a couple of reports, first we have this slowing coming out of tracy but this might be partly because of the volume of traffic but also right around north flynn they are slowing but around north flynn reports of a small grass fire on the shoulder. smooth drive so far and we look at this camera around, we don't see anything as far as grass fires in the shot but it's only a limited view, a limited flow of traffic. you have speeds pretty good all the way through livermore and dublin no. problems as far as the dublin interchange or pleasanton for 680. the south bay moves smoothly in the northbound commute direction. northbound 17 right around bear creek we told you about the deer. there is activity in one lane so the sheriff's office is heading out. there is an injured deer.

>> good thursday morning. it's 4:59. getting you started. i'm jon kelley. >> i'm laura garcia-cannon. we have an update to breaking news in san francisco. homicide investigators have just arrived at the home of a baby who died early this morning. they want to know more about what the medical examiner is calling the baby's suspicious death. in the glenn park neighborhood of san francisco. christie smith just got there. what can you tell us? >> reporter: good morning to you. there are still a lot of questions about the suspicious death of a little baby. when we first arrived san francisco police had crime scene tape on the door of this home on the corner at monterrey boulevard. there were two patrol cars out front. now it's down to one and officers still going in and out of the house. this started around 12:30 this morning when a woman, a mother, brought her baby to sf general hospital for care. that's 3 1/2 miles away from this home we're at. the baby believedo
