>> announcer: from nbc news, this is "today" with matt lauer and savannah guthrie, live from studio 1-a in rockefeller plaza. and good morning. welcome to "today" on a wednesday morning. i'm matt lauer. >> good morning everyone. i'm savannah guthrie along side al roker and natalie morales. >> welcome to day nine of the government shutdown. no end in sight. embarrassing for lawmakers in washington. we want to report some furloughed workers are back on the job. they are with the centers for disease control and prevention. they're back on the job. they're still not being paid but they're brought back in because of a salmonella outbreak linked to chicken. first, today's top story that andrea mitchell broke. it is a story of military families caught in the middle of the political in-fighting.

this is the live look at dover air force base where behind those gates, family members are gathering for a somber ceremony as they collect their loved ones remains. it is happening about 100 miles way from washington where the outrage over the lack of death benefits for the families is one of the most embarrassing points of the government shutdown. we just learned that secretary of defense chuck hagel will be there as well. let's go to andrea mitchell with the latest. good morning. >> reporter: good morning. as the solemn ceremony takes place, on capitol hill, the story sparked outrage from lawmakers who vow to fix the now a private charity has stepped in to do what the government did not do. take care of families of fallen service members. at dover air force base, a solemn ceremony to mark the return of service members killed last week in afghanistan. some of the families in dover

paying for the flights. they did not get emergency beth benefits because of the shutdown. $100,000 to be paid within 36 hours of a death to help pay costs. the charity has stepped in to take place of the u.s. government. >> i'm hopeful this is a temporary measure. we are in it for as long as we need to be. >> reporter: the mother of fallen service member marine lance corporal jeremiah collins. >> for the sacrifices, i don't understand why this is a benefit that is withheld. >> reporter: another of the fallen, special agent joseph peters, a 24-year-old officer from springfield, missouri. serving in afghanistan after two tours in iraq. the father of a 20-month-old son. his wife issued this statement. it is upsetting because my husband died for his country and my family is left to worry. my husband said if something

happened to him, we would be taken care of. on capitol hill on tuesday, outrage from lawmakers. speaker john boehner will introduce a bill today to reintroduce the benefit today. >> the house will act on this. >> reporter: gop senators john mccain and lindsey graham are outraged. >> shouldn't we as a body, democrat and republican, shouldn't we be embarrassed about this? >> your government let you down at the time of your need. >> reporter: family members are angry and hurt by the stalemate. the senate and white house have rejected other piecemeal bills to fix shutdown problems, this is one that is hard to reject. savannah and matt. >> thank you, andrea. >> we have chuck todd the political correspondent with more. >> good morning, matt.

>> we hear lawmakers using words like embarrassment and shame over the emergency death benefits. is it possible that shame might force real action on the shutdown? >> i'd like to think it would actually force a resolution on the larger issue. i think what is more likely is what andrea outlined. you will see the house act on this bill. one thing the senate and house have done while they rejected the idea of little bills like this to reopen parts of the government, anything that has had to do with the military and anybody fighting overseas, that, the president has done. he signed the paycheck law. i would be shocked if this did not immediately get to the president's desk perhaps before the close of business. >> let's look at the bigger picture. we have been talking about defunding or delaying obama care. we are segueing into a heated debate over raising the debt ceiling. the tea party seems very much dug in here. both sides seem dug in.

yet john mccain had this to say on tuesday. let me play it for you. >> how is this going to end? we know how it's going to end. we know how it's going to end. sooner or later the government will resume its function. sooner or later we will raise the debt limit. the question is how do we get there? >> that's a very realistic comment from a guy that's seen his share of battles. can that mindset prevail. >> reporter: i don't know and if john mccain could bring any other republicans with him beyond a handful maybe there would be a resolution or we wouldn't have even been in this place in the first place but that's not where the republican party is today. you're right, the tea party side of this is dug in. now, there was a lot of heated rhetoric yesterday but behind the scenes you see shifts, john boehner is no longer talking about health care. the issue isn't there. paul ryan who was the republican vice presidential candidate, the

house republicans chief budget guy, he has an op-ed today that barely touches this issue. if you look and wonder is there quote unquote good news to find out what the end game is, there is. house republicans seem to be dropping the health care thing. the question is whether the tea party folks will be okay with that. i don't think they will but it does feel like the leadership of the republican party is trying to get away from it. if they do, then we'll actually see an end game. >> quickly before i let you go, the president expected to announce janet yellen today to replace ben bernanke. do you expect smooth sailing for her in terms of confirmation? >> reporter: i don't. given how the tea party wing of the republican party feels about the federal reserve and you'll see ted cruz and rand paul and guys like that make her confirmation hearing a fairly rough ride. she'll make it but i don't think >> chuck todd at the white house this morning.

thank you. now some federal workers are back at work to track the salmonella in chicken. we have the latest from gabe gutierrez. >> reporter: some people have ended up in the hospital. that is raising questions whether the government could be doing more to stop the outbreak in it wasn't partially shutdown. it's back to work this morning for some furloughed cdc workers on the job battling a salmonella outbreak that involves seven strains. some appear to be resistant to antibiotics. since july, 278 cases in 18 states. doctors say the outbreak is spreading quickly. >> a lot of this is sends people to the er. >> reporter: the u.s. da traced to raw chicken by foster farms

operating at 2/3 of the normal staffing levels. back to you. >> gabe gutierrez, thank you. there is a surprising arrest this morning in the case of the motorcycle gang that attacked a man driving an suv here in new york. this time is undercover police officer facing charges. we have nbc's stephanie gosk with more. >> good morning, matt. this undercover officer came forward three days to officials. he first told officers he never got involved in the altercation. after the video appeared showing his role. the bikers of the family had no idea as the confrontation grew tense and violent. a new york city undercover detective was there the whole time. moments after a biker attacked alex lien's driver's side with a helmet, the video shows the detective joined in and smashed the rear window.

the police sources say he took off on his bike as lien was pulled from the car and did not take part in the beating. the 32-year-old police officer now faces charges of riot and criminal mischief. his undercover operation at the nypd says is deeply sensitive is over. before the new video was uncovered, the head of the detectives union had concerns it took three days for the detective to come forward and admit he was there. why did it take him so long to step up? >> i don't know that, but that's going to be problematic. >> reporter: internal affairs had been investigating a possible role of as many as five other off-duty police officer whose may have taken part in the unauthorized rally. the story with the dramatic confrontation has unexpectedly shined a light on the most sensitive operations. an undercover detective who investigates biker gangs in

florida spoke to nbc news on condition of anonymity. >> if you are infiltrating a group and in deep cover, you are actually living with them day-to-day. >> reporter: for an undercover cop, there is always a danger of being exposed. >> there have been federal offices as well as state that have been killed when their identities have been compromised. so it can be rather dangerous. >> reporter: the new york detective turned himself in just as police released photos of four more suspects wanted for questioning. this investigation is far from over. sources at the nypd says the detective had been involved in occupy wall street operations, but now his identity has been exposed and his badge and gun turned in and he faces possible years in prison. >> stephanie, thank you. and natalie is falling

with barbara bueno. christie joked he could walk and chew gum at the same time. he said i can also do this job and deal with my future. a san francisco hospital facing serious questions this morning after a woman's body was found in a hospital stairwell. two weeks after a patient went missing. kristen dahlgren is live in san francisco with the latest. good morning. >> reporter: good morning, natalie. still no positive i.d. on the body yet this morning. for the missing woman's family, it doesn't make sense. authorities were supposed to have scoured the area for clues. now they are investigating a mysterious death. hospital officials say they don't know the identity of the body found in the exterior stairwell at san francisco general. for the family of lynne spaulding, who disappeared from the hospital two weeks ago, it brings anguish and questions. >> her family and friends are distraught.

>> reporter: the 57-year-old disappeared on september 21st. in the hospital for just two days, she was being treated for an infection. nurses checking her every 15 minutes. until one check when she was gone. >> how could someone be in a hospital under medical supervision and leave their room unnoticed? >> reporter: spaulding was frail and on medication and possibly confused when she vanished. the hospital launched an investigation at the time and security cameras could not confirm she left the hospital. her family blanketed the area with missing posters and pictures of the spunky british native who lived in san francisco for years. launching a facebook page. find lynne. the post, sfgh has some questions to answer at the least. nobody checked stairwells? so we are expecting some time of identification possibly later on

today. the hospital says it is cooperating with authorities. one thing to note, natalie, those were emergency exit stairwells, they should have had alarms on the doors. that would indicate somebody was using them. >> kristen dahlgren in san francisco. thank you. emergency crews at the scene of a fire in oklahoma after a natural gas line exploded sending flames shooting in the air. it happened near the kansas border. this is amateur video shot minutes after the explosion. several homes had to be evacuated. no one was injured and no property damaged. some firefighters in brussels have come up with a unique way to protest budget cuts. after the cuts were announced, firefighters set up outside the prime minister's office and sprayed water and foam at police officers who were guarding the government buildings. the firefighters are protesting the cuts to insurance benefits and insufficient staffing.

major protests inside capitol hill or on capitol hill, people are feeling the sting of the shutdown. we started the #ifishutdown. over 300,000 people have chimed in. this is from a mom. she says if i shutdown, feet up, tv on, kids fighting. #ifmomsshutdown. a newspaper writer, i love this. he says this would be next week's newspaper. digging deeper. a blank slate. moving on to the dentist's office. he says empty dental chair. no one getting work done. if we had the luxury, if that is the right word, to do what members of congress are do, this is what our world would look like. i like that people are venting and letting their voices heard in a different way than the past. this is a new way, i think, of protests, guys. >> i have to say one silver lining, clever things going

hannah anderson tomorrow on "today." we begin with the latest on that 9-year-old boy. a stowaway on a flight from minneapolis to las vegas. we're learning about how he got through security and we're hearing from his father. john yang is live in minneapolis. john, good morning to you. >> reporter: good morning, matt. that's right. this morning the 9-year-old's father tells nbc news he tried to get help for his son's behavior problems and now he wants his son back home but sources tell us he is still in las vegas in child protective services custody and there's no indication yet of when he'll be flying back here to the minneapolis airport. the same week he snuck on to a flight to las vegas, authorities say the 9-year-old boy stole a 30-foot delivery truck in minneapolis before slamming it into a parked suv and crashing it into a police cruiser. at a local water park, sources close to the investigation say he would sneak in by joining big families. they say child protection services had been looking in on

him since december. when he turned up in las vegas, his father who doesn't want his name used told nbc news by phone he thought his son was at a friend's house. >> i take full responsibility of my actions. i miss my son. i want my son to come home. >> reporter: the family spokesman said the boy's parents struggled with his behavior. >> you know, they were frustrated and looking for help. >> reporter: this morning, we're also learning more about the boy's mysterious trip. at the tsa checkpoint he got in between a family, similar to the reported water park trick. he then got a bin and removed his shoes even though children his age aren't required too. delta airlines is investigating the biggest mystery, how he got on to the plane. sources say security video shows him talking to a gate agent that turned away to talk to someone else. shortly after the three hour 20 minute flight took off they

book late. >> i know but you don't in this book. >> because this book is not about cases. this book is about lessons and i did talk about the lessons. >> and the lesson you say about this is not let your emotions control you. >> that's correct. now if you want to deal with the facts or the nonfacts of the case you'll have to deal with that in the book i did on that ten years ago. what i dealt with was even though i believed her and represented what i believe you don make it personal. i may believe you're wrong but to get into name calling and degrading you is something you have to say wait a minute that's not going to help the cause. >> and the anlage you use in this book is what you say is the way you dealt with trayvon martin is that you did not make that personal. you made it about the facts. >> i did not demonize them. i dealt with the facts. i never went to zimmerman's trial.
