>> and i'm jon kelley. good morning everybody. the good news is yes, b.a.r.t. trains are running but the reality is that might not be the case in less than 24 hours. yeah t 60-day cooling off period ends tonight at midnight and yes, we are still not sure if trains will be running in the morning. christie smith is live at the west oakland b.a.r.t. station. she spoke to riders who at this point are saying hey, they are tired of it. the back and forth has gone on too long. good morning. >> reporter: good morning to you, jon. frustrated is putting it mildly. at this point we still don't know if there will or won't be a b.a.r.t. strike. negotiations picking up later today. there is word of new tension at the table. at this point the commuters i'm speaking with seem resigned to the fact a b.a.r.t. strike will happen so they are going ahead and talking about their alternate plans. what's happening at this point is that we have new video of

trains rolling where commuters are telling us they thought that the 60-day cooling off period ordered was enough to get this whole deal worked out but so far that hasn't happened. for a while it looked like there was progress with b.a.r.t. and its largest unions. late last night the union said that b.a.r.t. looked like it was reversing course. b.a.r.t. withdrawing its offer, that's a miscommunication. this time the unions didn't give their usual 72-hour notice of a strike, saying they want to focus on making a deal happen. once again they are looking for other ways to get around. >> complete and total inconvenience. drive here, park here, take my hour nap before work. >> i'll have to drive, yeah. the difference is $300 a month between the b.a.r.t. fare and driving. >> not too happy about it but you do what you have to do. >> reporter: no, not happy at all.

if a strike does happen, b.a.r.t. will again offer shuttles, ac transit is using more big 60-foot buses, the ferries are boosting service. last time b.a.r.t. went on strike it fell during the fourth of july. it was a holiday. the concern this time it could be worse. i spoke with a union representative. they tell me they are going to go to the board of directors meeting this morning and speak there, then negotiations continue at noon. christie smith, "today in the bay." >> as always appreciate the update. we have more details on the b.a.r.t. labor talks. you might remember in early july b.a.r.t. workers did walk off the job almost five days leading to jammed up bridges and crowded buses. they agreed to extend the contract for 30 days until early august to try to reach a new agreement. when that could not be done the governor stepped in and mandated

from washington in our next half hour. >> and we have new update on the bodies found 18 san francisco general hospital stairwell. the san francisco medical examiner confirmed it is the body of missing lynne spalding. however, there is no cause of death available at this time. they are performing more tests to try and figure that out. a hospital worker found her body more than two weeks after she disappeared from her hospital room. family says she may have been confused because of medication she was taking at the time of her disappearance. >> three months after a young oakland girl disappeared a special pray vigil will be held on her second birthday. the family of daphne web is not giving up hope. they will hold a special vigil where daphne was first reported missing. the vigil starts at 4:00.

>> today is deadline day for foster farms, the usda threatening to shut down three foster farm plants involved in a recent salmonella outbreak. unless the company can explain how it plans to fix the unsanitary conditions that led to this. one of those plants is located outside of tracy. the other two in fresno. the outbreak has sickened hundreds of people including some here in california. the company has not recalled any of its products so far, instead it's warning customers to make sure the chicken is cooked at least 165 degrees, which is always common sense in general. >> wove got a live look at the oakland coliseum. a bit quiet now but that will change. you are warned to expect a lot of traffic in the east bay. the a's are in a win or go home

call prioritization. if we can't pay every bill pay treasury note holders first, china, and we'll get to social security recipients later. lew says that is a dangerous idea. there he is in the glasses and blue tie. he calls it irresponsible, he says the government really shouldn't try to prioritize what it owes because all debt should be treated equal. strangely, if the u.s. does default it could help social security. admittedly this is a weird silver lining. if we turn into the world dead beats interest goes up and social security's investment is in treasuries. so social security would make money on the deal so. this is proof the whole thing is a lot more complicated. some on capitol hill say default would have no effect. there is no historic proof of that because we've never done it. here is another thing that might not work the way you think. u.s., we're freezing aid to

laura. very early this morning we started tracking this, the prime minister of libya ali zeidan, abducted by what we later learned were rebel groups. this was political not related to our own raid last weekend. now he's been tweeting that he's fine, back in the office as you said. he has been meeting with officials there, and he has been on live tv talking about the situation. apparently they had him for six hours after gun men captured him from the hotel where he had been living. he is under scrutiny for corruption and some of these rebel groups urged him to step down. tweeting after he was released he said if this was an attempt to get me to resign it didn't work, i am not resigning. so, that situation that seemed so urgent earlier this morning seems to be over with the prime minister safe but under scrutiny.

>> good news that he's safe. thank you. >> to the latest on the government shutdown, some 20 top republicans will meet with president obama at the white house today looking for some way to try and solve two major issues. both hoping to reach some kind of agreement on ending the partial government shutdown, at least they are hoping to do that, also they don't have to raising the debt ceiling. the president invited the house gop but speaker john boehner opted for a smaller group. the white house now accusing boehner of trying to exclude tea party republicans, those who the president is trying to reach. >> the government shutdown is hurting the craft beer industry. the government agency is responsible for approving new applications for brews and labels. because the agency is closed nothing is getting approved. that means seasonal suds especially for the holidays probably won't make to the

couldn't do it. and i was about to cry but i wanted to hold it in there. >> that's one of the hardest things about having to postpone this event is watching the faces of the kids and hearing how disappointed they are. >> what a drag. kids crying because of that. the famed cliff house also impacted. the restaurant is on park land when the owners, they tried to open earlier this week, they were told if they did not shut down they may never be able to reopen. owners say they are losing more than $10,000 a day and they had to send away 170 employees. >> 6:34. millions of american who is receive food stamps will get fewer beginning next month went the temporary increase in the supplemental assistance program expires. some 47 million americans, many children, receive food stamps. >> a scary rye became scarier in orlando, florida.

toward the east shore, you got a lot of company so speeds are coming down. here the area of berkeley out of richmond, down in the 40s, upper 40s close to 50 miles per hour. and continuing to slow there. but the big concern for the east bay. both directions now, 880 approaching, crashes reported, all this big slowing. still a all right that at least the slow lane is blocked. no big describeses and all the way to the south bay we have travel speeds. 101 slow north from about the catholic expressway. now 680. a quick look at the peninsula with no problems along 101 and 280. >> still ahead, this has been a huge competition, now we can tell you a solar challenge winner has been crowned. but we're wondering, people want to know is it a team from stanford. >> a live look outside.

the man on the right arrived at the same russian airport where his son was stuck for more than a month while seeking asylum. he's visiting with his son in moscow. edward snowed season wanted in the u.s. for violating the espionage act. last summer snowden initially fled to hong kong, then russia. >> no, they are not number one but a team from sanford did finish in the top five of the world solar challenge. we have video of the first place team from the netherlands crossing the finish line in australia. those are smooth mobiles. it took 33 hours to drive and glide almost 1900 miles from northern australia to the southern part of the country. that's an average speed of 57 miles per hour. team stanford finished fourth. that is 57 miles per hour solar powered. >> not bad. 6:41. are we on the eve of a b.a.r.t.

real possibility. they have one more day to negotiate. seemed to be going well then we got word of a setback last night that happened at negotiating table. for commuters they are frustrated that they couldn't get it done in 60 days. the 30 minute commute on b.a.r.t. could jump to two to three hours. the 60-day cooling off period ordered by the governor ends at midnight. negotiations between b.a.r.t. and the unions seemed to be moving forward, then a snag. last night the unions said that b.a.r.t. management seemed to be pulling back but b.a.r.t. says no, claims that it withdrew its last offer are more of a miscommunication that went on. the unions didn't give their usual 72-hour strike notice, instead they said they wanted to focus on reaching a deal. b.a.r.t.'s riders are wondering if they will be forced off the trains again. they are still mad about the last strike. >> i had to carpool, i had to

the san francisco wrnical brings up this point. when teams in need after new stadium are successful local government become mors likely to open wallets. take the 49ers and their stadiustadiu stadium. what if coach didn't get to the nfc championship back a couple years ago. would there have been the financial support for the new stadium or how about the seattle mariners back in the 80s and 90s. that team was stuck for 18 seasons. voters struck down funding. then in 1995 the team wanted their division and the county ended up approving funding for safeco field. if they are successful maybe they could get out of this stadium that is obviously not getting rave reviews from fans.
