good morning. thanks for joining us. i'm scott mcuse. laura garcia-cannon tried her best but i think it best that she take a rest. >> yes. i'm marla tellez in for jon today. we begin with the latest on developing news. b.a.r.t. trains are up and running but the threat of a strike still loom this is morning. despite another marathon overnight bargaining session b.a.r.t. and its unions have yet to come to a deal. christie smith is live where b.a.r.t. says it made its best and final offer. good morning. >> reporter: good morning to you, marla and scott. they went well past that midnight deadline and still no strike so the good news is that the b.a.r.t. trains are rolling again. and b.a.r.t.'s union telling us they will be back here a little bit later today to look at the proposal that was presented to them. but b.a.r.t.'s gm made it clear on her way out that this is their best last and final offer. while they talk one more day for

hundreds of thousands of commuters it's another day to wait about what's next. the marathon session finally broke off just before 3:00 this morning here in oakland while members of atu one of b.a.r.t.'s largest unions stood outside waiting for word. the best last and final offer according to b.a.r.t. means they upped their offer to 12%. we'll talk more about that in a minute. b.a.r.t.'s chief negotiator says that unions have not looked at it yet. earlier a spokesperson said they were cautiously optimistic. then the tone changed. >> if the district rescinds its last best and final offer and continues to negotiate with us in good faith then we will be optimistic. but at the moment we're not optimistic. we would adds vivise the riding public to make sure they have alternative transportation. >> i nope they are going to look at it. we're open to any ideas over the two weeks they might have.

we'll try and keep that conversation open. it's time to bring this to a close. the bay area is tired of going to bed at night not knowing if b.a.r.t.'s open or not and we need to bring this to a close. it's been long enough. >> what she was referring to, the unions have two weeks to consider the offer. they say they are offering $7 million more than friday night so. here's how it stacks up. according to b.a.r.t.'s gm a 3% raise per year, 12% tot well 4% going to pension and 9.5 for medical. again at this point new deadline midnight which could mean that there may be a strike tomorrow but we'll have to wait and see. reporting live in oakland, christie smith, "today in the bay." >> thank you. the wait and see moments these last-minute decisions whether there will be a strike or not has many b.a.r.t. riders angry. for many they don't know if they have a ride to work until they wake up in the morning. jodi hernandez is live at the b.a.r.t. station in walnut creek. riders are fed up.

>> reporter: they are very much fed up. the b.a.r.t. station here in walnut creek opened on schedule at 4:00 a.m. b.a.r.t. riders arrived here feeling pretty relieved that the trains are rolling at least for one more day. i'll tell you, it was a welcome sight for many to see the b.a.r.t. trains moving at least for today. riders tell me they spent last night checking the internet, watching television to try to see if they would inzreed a ride to work. as christie mentioned a possible strike could be delayed for just one more day. so while folks are feeling relieved they are also feeling very frustrated that this thing isn't settled yet. >> very frustrated by the whole thing. you know, i just feel like we're -- the public is being

if there is a strike we will start at 4:00 a.m. tomorrow to help you get around that dprid lock. >> a former san jose school teacher is suing a group of parents and girls for defamation for reporting alleged sexual misconduct. the families accused john of inappropriately touching their 10 and 11-year-old girls at holy spirit catholic school. the elementary school and eventually the police cleared the p.e. teacher. now the teacher filed suit claiming the ordeal stained his reputation and ruined his teaching career. >> investigators trying to figure out what sparked an apartment fire in mountain view. the fire broke out just before 8:00 last night on calderon avenue. that's off highway 85. everybody made it out of the apartment before firefighters arrived. the crew desire rescue two cats from the apartment. one child suffered minor smoke

inhalation. >> santa clara county's board of education criticizes a south bay school district after it forced almost a dozen charter school students to repeat a year of classes. the 45 students had to find new schools when the charter closed in june according to the "mercury news." eight of them enrolled in the campbell district which refused to give them credit for their classes. one parent tells the merck not even p.e. credit was accepted. the board is upset because other districts awarded students full or partial credit. campbell superintendent says the district does not recognize work from unaccredited schools. >> could be hard to come across the little cigars like the ones on the screen. they have a variety of flavors, popular with young people in recent years. the proposed ban would apply

only to retailers in unincorporated areas of alameda county. county officials will discuss the ordinance at a meeting thursday. >> apparently i'm not young people because i never heard of them. meteorologist christina loren, it was a gorgeous weekend bought cool start. >> definitely. san francisco, looking good right now no. flight delays. it is columbus day, a lot of people might be heading back to work for business so i want to point out we're looking good across the nation with no delays. want to make sure you get to where you're going on time or you know what's going on. 39 degrees, a cold start up in petaluma. so it's feeling more fall-like each morning. but our temperatures are going to return to summertime levels throughout this afternoon. 49 in livermore, and 50 in san jose. so this is where we're headed throughout the day today. a return of the 80s.

most cities, state and county offices will be closed to observe the holiday. we hope you have a great day. >> there are now hours until the united states defaults on its debt. talks in washington and a vote went nowhere. the treasury estimates the government will default on its debt payment nos later than thursday. putting the full face and credit of the united states on the line for the first time in the nation's history. wall street may have gotten ahead of itself. the dow rose hundreds of points in a single day last week on the expectation, the assumption, that we would not get this close to default. bertha coombs is live with an update. good morning. >> good morning. it doesn't make sense that we would default. it seems like such a self-inflicted unnecessary wound. this morning the futures are pointing to a sharply lower open, as over the weekend we saw that talks in the senate to reach a deal to end the government shutdown and avert a

u.s. debt default appear stalled. the head of the imf says there could be a massive destruction to the global economy if the u.s. defaults and china is weighing in, the state news agency calling on congress. no economic data on tap. and the bond markets are closed for this holiday but we'll see stocks trading. and on the hope going into the weekend we saw the dow closing up 111 points on friday to 15,237. the nasdaq rising 31 to 3792. the deadline, scott, is thursday. they really need something by tomorrow afternoon in the house tor senate to get it to the other chamber by wednesday so it can be signed and we can astlaert midnight deadline. >> very interesting. back in earning season the time where we get to see how the bay area companies are doing.

is picking up. it negates the marine layer so it pushes it back out to sea. also we're getting mixing in the atmosphere that we don't have to worry about fog. and that is great news if you want to get outdoors. make sure you have the sun screen handy. temperatures are chilly to start. 41 in santa rosa. we'll keep dropping the next couple hours. temperatures looking golden gate by about noon. 73 degrees is the forecasted high in san francisco. so that's a warm day in the city. 77 in oakland. and the same for us here in san jose. so not a big impact when it comes to the micro climates. temperatures just about uniform and that's the case all week long. look at these numbers. temperatures at 86 degrees by wednesday. we'll saturday to cool off for thursday into friday w. offshore flow it means it's going to be dry so we are watching for elevated fire danger.

we will keep you updated. let's check the drive. here is mike inouye. >> if you are not aware, b.a.r.t. system running, the trains are running and we're still waiting on whether or not, well, still waiting to hear on a deal so. far no deal. we're looking at that. on the roads we're looking at a smooth flow of traffic. we didn't expect to the be affected by the b.a.r.t. strike not this early in the morning. this is what we expect. out of san jose down to los gatos we had earlier reports of boulders across lanes. basically heading to the summit there is a curvy section, that's what's going on. that is cleared from the incident report but there may be clatter. this is the east shore, the approachthe maze. that's the east shore freeway at the limit. we'll show you oakland. the camera starts to tremble and christina talking about the shift in the winds. not a big concern. look how clear the view s. we're

looking toward the bay bridge. a clear flow back and forth between the city and the east bay without delays. and no problem for the peninsula. here is 101 north past the shopping center into the city. back to you. >> thank you. 5:20. governor brown has made final decisions on all of the bills sent during the last legislative session. last night his office tweeted throughout photo of an empty desk and the caption which means make hayes slowly in latin. according to the office the governor signed 800 regular session bills and ejected 96. one of the rejections over the weekend was submitted by south bay senator jim bell, would have extended the statute of limitations for some victims of childhood sexual abuse so they could file lawsuits. it was created in part because of this man who attacked a priest that he said abused him as a child.

the priest cannot be prosecuted because of the statute of limitations. lynch was acquitted of the attack. he told the "mercury news" he does not believe 18 statute of limitations for victims of abuse. now wishing to put the issue to voters. the governor wrote statutes of limitation are tight tool preserve the fairness because over time evidence could be lost, memories can fade. under current law victim who is turn 26 before 2003 are unable to file lawsuits against private employers, governor brown also said that bill failed to hold the public entities equally accountable. >> an investigative unit, a nation wide problem, prescription drug abuse. our unit found that more die from painkillers and heroin and cocaine combined. right here in california there is a new approach to curb the

welcome back. new homeowners have repairs to do before they move in. police say a suspected drunk driver rammed his car into a newly purchased home in hayward early yesterday morning. the driver allegedly speeding when he hit the curb, flew through the air and right through the house. police say the driver was not hurt but he was drunk and arrested on the scene. nobody home at the time. >> not the kind of house warming gift you want. all right. not warm now but it's going to get warmer. >> yeah, it really is. good morning to you, marla and scott. especially as you progress throughout the week. starting today a few degrees warmer than yesterday's highs. inland about 82 degrees in the heat of the day. 77 bayside, 74 degrees, temperatures gradually warming all the way through wednesday. we'll show you how that looks for where you live.

would give part one more day, 24 more hours to try and reach a deal. also a group of state lawmakers stepped in and said that they asked b.a.r.t. workers not to walk off the job but also asked b.a.r.t. to withdraw its last best and final offer presented and keep on talking. as i mentioned the talks ended for 3:00 in the morning here and b.a.r.t.'s gm stood firm giving the unions two weeks to decide whether to take it or leave it. earlier b.a.r.t.'s chief negotiator said they were make some progress, this offer was presented about 4:00 p.m. but he says that they waited and b.a.r.t. got no response and said he's frustrated by that. this is similar to what was said last week when the unions said they wanted more time to look at the offer. early optimism quickly started to fade. >> if the district rescinds its last best and final offer, and continues to negotiate with us in good faith, then we will be

optimistic. but at the moment we're not optimistic. we would advise the riding public to take precautions and make sure they have alternative transportation. >> i really hope that they are going to take it seriously and look at it. we're open to ideas over the two weeks they might have. we'll try and keep the conversation open but it's trying to bring this to a close t the bay area of tired of going to bed at night not knowing sbart going to be open or not. >> reporter: the union of course says there are concessions, according to b.a.r.t. 3% more near, 4% going to pension and 9.5% to medical contributions. we'll keep an eye on things for you but again, b.a.r.t. trains rolling but the new deadline means the trains may not be rolling tomorrow.

forest during a hunting trip. he says he fell, hit his head and was knocked unconscious. he was in a fog bank and lost track of where he was. the sheriff's office searched for four days before they had to call it off. the san francisco native was doing everything he could to stay alive. >> he ate squirrels, he ate lizards, frogs, snake, whatever he needed to survive. >> his son says his dad reads a lot and watches wilderness survivor shows. he used all of that. until he was found by hunters over the weekend. >> later today we expect to get an update on the condition of potentially dangerous pg&e pipeline. tonight san carlos council will consider spending a quarter million dollars to look into the safety of that pipe line right

hill now with the latest. any breaks, any sign of a breakthrough? >> reporter: therl morning we heard senator bob corker say he hopes that they will have something by the end of the day today. that doesn't mean the government will reopen or will lift the debt ceiling that quickly but the beginnings of a compromise. frustration is mounting and we saw it spill over in washington at the world war ii memorial. conservatives and veterans took the barricades, dumped them in front of the white house. it caused a confrontation with officials. how frustrated people have become. today the house and the senate are both back in later this afternoon but before that the six democrats and republicans in the senate are now the pivotal focus of what if any compromise may come out of congress to get the government working and prevent an historic default.

you know that means it wasn't too hot for that. you know what, we're going to be climbing as we get into the week. may be a little too warm for an afternoon run. might be good to plan the outdoor strenuous activities on the earlier side. bay side 77 and 74 at the coast for your columbus day. let's find out how we're doing on this columbus day. everything is usual for a monday? >> things changed up. folks in the control room, we're going to take this one shot of the bay bridge. i want to spend a couple seconds on it. you notice the cash lanes. those are showing an unusually heavy backup and the fast track lanes year. fast track used by regular commuters across the bridge, those using cash probably not so regular. that may be indicating folks planned on driving in as a result of the possible b.a.r.t. strike so that's a different flow. however, the roadways in toward the maze so far moving pretty clearly so sounds like some folks had made changes. we'll track that as it affects the commute. there you see the changes. back to you.
