good morning. thanks for joining us. i'm scott mcgrew. >> i'm marla tellez. both jon and laura are off. a developing story for months, now into the night as b.a.r.t. negotiations continue between the transit agency and the union workers it employs. while you were sleeping both sides were still at it negotiating at caltrans headquarters in oakland. so far no strike has been called, but it is still looming. we do have team coverage. jodi hernandez is live at the walnut creek b.a.r.t. station with passenger reaction. we want to start with christie smith live in oakland with a look at the talks. any progress? >> reporter: good morning to you. well t marathon negotiations that broke off at the caltrans building at 3:00 this morning came up with this for you. your trains are rolling today, tomorrow could be a different story. basically, b.a.r.t. workers say they agreed to give b.a.r.t. one

more day to come up with a proposal that works. they agreed to keep talking while this goes on but b.a.r.t. says gm, she made it clear the transit agency laid out its best last and final offer on the table. b.a.r.t. workers will have two weeks to decide whether to take or leave it. the talks went way past the midnight deadline stated with state lawmakers asking workers to stay put and b.a.r.t. to pull back that offer. what it does is basically allow b.a.r.t. to declare an impasse or even impose a contract if they decide to. so here's the offer on the table according to b.a.r.t.'s general manager. 3% increase per year, amounts to 12% total, 4% pension and 9.5% going toward medical contributions. the early optimism faded quickly. >> that was the last one. we have done everything we can, we have given the district at least four extensions trying to

get this deal done. at some point you have to say enough is enough. >> i really hope that they are going to take it seriously and look at it. we're open to any ideas over the two weeks they might have. we'll try and keep the conversation open. it's time to bring this to a close. the bay area is tired of going to bed at night not knowing if sbart open or not and we need to bring this to a close. it's long enough. >> reporter: the unions say there are concessions in all of this too but b.a.r.t.'s lead negotiator says he is frustrated because this was offered at 4:00 p.m. and when he left overnight that they had not looked at it. last week in a similar position the union wanted to focus on the offer they had in front of sthom that's where things stand. both sides expected back here today. christie smith, "today in the bay." >> thank you. >> let's check in in with jod hernandez at the walnut creek b.a.r.t. station. how are commuters reacting?

>> this has been very tough on commuters as you can imagine, while folks are happy to see the train stations open and the trains rolling they are tired of not knowing what tomorrow will bring. again, while the trains are rolling today t unions say a strike is now possible for tomorrow. riders say they don't think b.a.r.t. and its unions are really thinking about how this is impacting the everyday commuter. folks say they can't rest well not knowing how they will get to work in the days to come. they say both sides need to settle on a contract once and for all so commuters can stop worrying. >> it's unknown. an unknown is kind of tricky because you don't know if you're going to have to make these changes, because if i have to catch the ferry then my wife has to pick me up, she hasto change her schedule. it's the unknown and it's hard to have a nice weekend when you don't know monday is there going to be a strike. >> we're here to help people, give them as much information as

you're at 54 in oakland. it's a cold start to the day, bundle up. if the little ones are back to school good idea to dress them in layers this morning. 82 degrees inland in the heat of the day. 77 bay side and 74 degrees at the coast. really comfortable conditions for columbus day. as we head throughout the next couple days that's when the warm-up kicks in. we're going to talk about the cities that have the best chance for seeing the elevated fire danger and when it will get out of here. we have a cooling trend toward the end of the week. first, i want to check on your drive, see how that's shaping up. >> good morning. first of all get this out of the way the b.a.r.t. trains as we're telling you are running, but some folks have planned or are just driving in because they had planned to do so. we're looking at the cash lanes backed up. the fast track lanes showing the nice stream through the area. no metering lights yet but we should see those in a few minutes. the east shore freeway is moving. so let's show you the maps.

we see the approach. the bay bridge, the maze, slowing down the berkeley curve. slowing at the caldecott tunnel. not as bad as sometimes especially when there are rumors of a b.a.r.t. strike. the b.a.r.t. trains are running and traffic is flowing toward the bay bridge. a crash at west 80 at carlton cleared to the shoulder. now a stall on the eastbound direction in the same area. so enough of a distraction. north on the upper side of this map. golden gate field. a look at speeds, the tri-valley we see we're slowing for 58 out of the alta mont pass no. surprise for 84 or 680. a smooth drive through the south bay. a look at palo alto. no problems here it university. there is a report of at least a stall if not a crash around marshall. i swung the familicamera around.

we don't see interruptions. >> thank you much. 6:09. 72-year-old man from the bay area lost in the wilderness for 19 days is: alive and recoverin this morning. gene penaflor vanished in the mendocino forest on a hunting trip. he says he fell, hit his head and was knock understood conscious. when he woke up he was in a fog bank, lost track of where he was. the sheriff's office searched the area for four days before they called it off due to inclement weather. the san francisco native doing everything to stay alive. >> he ate squirrels, lizards, frogs, snakes, whatever he needed to survive. >> his son says his dad reads a lot of wilderness survival books and watches wilderness survivor

880, the southbound direction with all of these headlights starting to pick up. through the south bay, no big surprises but a couple of incidents to report. of course we let you know as traffic flow despite the fact that b.a.r.t. is running we have a little bit of a different flow throughout the east bay. >> it's 6:14. today's top stories, a b.a.r.t. strike was avoided today but a possible shutdown looms for tomorrow. no deal was reached after negotiations went well into the early morning hours. both sides will be back at the table later today. >> at least 115 are dead after a stampede on a bridge in central india where a hindu pilgrimage was under way. some crushed to death. others jumped off the bridge to escape, then drown. they were on the way to visit a temple honoring the hindu goddess. >> the winners of the nobel prize in economics, for analysis

of asset prices. the three are splitting the $1.2 million prize. >> there are now hours until the united states defaults on its debt. talks in washington and a vote went nowhere over the weekend. the treasury estimates the government will default on its debt payments no later than thursday. putting the full faith and credit of the united states on the line for the first time in the nation's history. wall street's going to be excited today. it's going to take a real look at the shutdown, the real looming debt ceiling and decide if it got way too far ahead of itself. the dow was up, remember, better than 300 points in a single day last week on the expectation that we would not get this far. the treasury again says we'll be in default no later than thursday. >> other business news, we're back in earning season, a time we get to see how bay area companies are doing. google and intel will kick us off with earning reports later

as you know, our cold months are headed our way. they will be here before you know it. 54 in oakland, 50, san jose, 41 degrees in gilroy. we're going to see our offshore wind increase throughout the day. you see we're starting to pick up yellows. you notice on the key that's 20 to 30 miles per hour wind gusts, as we head throughout this evening and they will be offshore winds so that's going to lead to a warm day in places like livermore. 82 degrees, the average high for this time of year is about 77 degrees. we are going to be in the mid to upper 80s by the end of the week. as that warm-up continues. but we've got a good looking columbus day. if you are lucky to have the day off the beach will be perfect, 76 degrees in santa cruz and 73 degrees in san francisco. we're starting out clear already in half moon bay, pacifica and ocean beach. this is where we're headed. it's going to be cold. if b.a.r.t. strikes you want to bring that heavy coat and a lot of people will be on bikes so i want to make sure you're ready

for really cold temperatures tomorrow morning. good idea for a hawaii 83 degrees tuesday into wednesday. temperatures at the warmest and then slowly starting to cool you off as we get to this weekend. let's check on the drive. here's mike. >> we're looking at a smooth drive. we have have to turn the camera north. 101 north past willow up to marsh. we don't see a lot of slowing but you might find a bit as there is a crash headed north out of menlo park. we're watching that. the southbound commute starting to build. let's look at the maps. peninsula side, 92 heading to half moon bay, bob is there and that pumpkin festival. 92 across san mateo, the dumbarton bridge, easy flow. look at that. breathe in all of the well, the exhaust. a smooth drive northbound past 680 and 880. no problems for 87 or 85. a gentle build.

the tri-valley shows a good flow 580, a little bogging down toward the upper 40s now. a little build for sunol, 84, tri-valley looking pretty good. no big issues toward castro valley, the maze. the east shore shows slowing. there is a crash westbound at carlton, sounds like a motorcycle in the center divide so. be careful. move over to the right if you can. look at the bay bridge toll plaza. a different flow here. the metering lights are turned on. we don't see the backup yet. the cash lanes are stacked up. they started early. that's usually an indicate like fridays when folks who don't always drive in they are taking the car, that might be what happens in anticipation of the b.a.r.t. strike. b.a.r.t. trains are running but there might be a different flow right here at the bay bridge toll plaza.

reacting. >> we're also headed into our 14th day of the government shutdown, and the country barreling toward a debt limit crunch. tracie potts is live at capitol hill this morning. the focus now shifting to the senate. >> reporter: exactly. and if you are wondering how frustrated people are now in week two of the shutdown look at what happened over the weekend. in d.c., veterans and conservative lawmakers at the world war ii memorial which has been closed as a result of the shutdown. they took the barriers and dumped them in front of the white house. that prompted a confrontation with authorities there. nothing that got violent but goes to show the level of frustration. what's happening today. the senate, there is a small group of lawmakers, six democrats, six republicans, they are going to try to work thissous. house republicans are on the sidelines. they couldn't work anything out. all eyes on the six lawmakers to see if they can come wake-up a

temporary budget to get people back to work, maybe a couple of months, and perhaps more important hi prevent what could be an historic default if in fact we can't pay our bills after thursday. scott. >> tracie potts live in washington. thank you much this morning. >> new details on that explosion that caused delays at l.a.x., this morning it is business as usual. several flights were delayed after reports of an explosion in an employee bathroom. officials found evidence of a plastic bottle with dry ice. that a chemical reaction caused the blast. screening was temporarily halted but as police investigated the area no. one was hurt no no. arrests have been made. >> 6:32. looks like a beautiful day ahead. >> good morning. check throughout sunrise. isn't this pretty over the bay bridge. gorgeous start to the day. a few ripples out on the bay because we do have winds moving in and they are starting to pick

up. right at the coast, offshore flow. a clear coastline. 43 degrees, in napa now, as 40 degrees it's chilly out there. bundle up even at 50 in san jose expected to fall for the next hour, hour and a half as we head throughout the next time period. our hour 1/2. by this afternoon beautiful rebound, 2 to 3 warmer than yesterday. it's going to kick in for tuesday and wednesday. and that means we'll see elevated fire danger, warmer temps with the dry northerly breezes. not great news when it comes to fire season which we're in the peak. a blastch summer heat continues all the way through about thursday. then we'll drop off. i'll show you how it looks in a few moments. for thod, happy columbus day. 28 degrees inland. bay side 77 and 74 at the coast. we'll take a look at the seven-day in a few moments.

one union representative said if they reject that best last and final offer they will keep on negotiating in good faith. they will be optimistic but this doesn't sound likely. >> at the moment we're not optimistic. we would advise the riding public to take precautions and make sure they have alternative transportation. >> it's time to bring this to a close t bay area is tired of going to bed at night not knowing. it's been long enough. >> reporter: the unions say what they saw was regressive but according to b.a.r.t.'s gm their latest offer includes a 3% increase, 12% total, 4% to pension and 9.5% to medical. this is the sixth strike deed line in four months. and both sides expected to be back at it again today. reporting live in oakland, christie smith, "today in the bay." >> thank you much.

6:45. >> we want to check in with jodi hernandez. the question is how are commuters reacting this morning? i bet they are frustrated. >> reporter: that is an understatement. commuters are fed up. of course they are happy that the b.a.r.t. stations are up and running today. now they have to worry about tomorrow. they say it's not fair. the train started rolling this morning on schedule after the unions announced they will delay a possible strike by one more day, giving negotiators 24 hours to reach a deal. commuters say this has dragged on for too long. they are tired of not knowing what tomorrow will bring. constantly monitoring the news to try to figure out if they have to find an alternate way to work. some folks are out at b.a.r.t. stations this morning passing out flyer, helping people come up with a plan b if there is a
