next and whether there is a new deadline to reach agreement is still unclear. christie smith is live at caltrans headquarters in oakland where negotiations are taking center stage. any activity? >> reporter: now and then we see union members come out, have a smoke a break. they have no comment when we ask. both sides still negotiating even at this hour. about 1:00 this morning a federal mediator came out and said that b.a.r.t. trains would still be rolling, two hours later big bags of take-out food. well past the midnight strike deadline. yesterday b.a.r.t. put out a best and final offer. that upset many union members who said they thought that meant a sudden and surprising end to the negotiations going on. then late last night president of seiu, yoon of the unions, the unions made a counter proposal and b.a.r.t. was considering it.

in the middle 400,000 daily b.a.r.t. riders wondering how to get to work and they are angry too. then the federal mediator said the trains will roll and there was a sign of movement at the table. >> the parties have been actively engaged in bargaining. the bargaining has produced some constructive and productive progress. and i am authorized by the parties to say they are prepared to continue negotiations through the night. >> we did make movement and we want people to know we're still up there working and you know, we wish we had a deal. unfortunately we don't. >> reporter: well, not yet at least. timing it was 1:00 in the morning when b.a.r.t. sent out notice that the unions wouldn't strike and apology to the bay area to having to wait until the middle of the night to find out if trains would roll or not. then about an hour later they issued a second statement that this happened at the request of

9.5% pay increase over three years. it's the second time they voted down a tentative agreement. >> crews will return to work at levi stadium after a construction worker was killed on the job. bob redell is live where some employees already starting to arrive. >> reporter: they should be soon. good morning to you, terry. before construction resumes later this morning here at levi stadium, management will meet with the 900-plus workers to go over safety rules and field questions about what happened 24 hours earlier. yesterday morning edward lake jr., a 60-year-old man from vacaville was killed delivering a load of rebar on behalf of his employer out of napa. in this video from the construction site, this is above the site, you can see the delivery truck and large bundle of rebar on the ground next to it. we believe it's that bundle that came down and crushed him to

death. police say it was an accident. now it will be up to cal osha to investigate. the agency has deemed this work site safe. however, one civil engineering expert we sbok wonders if the fast pace of this played any role and another that killed a worker earlier this year. >> studies that show that with acceleration of the schedule and putting pressure on the schedule, labors and personnel on the site are more subject to accidents. >> is there a deadline pressure that you think could have played into this? >> no, ma'am. >> reporter: that was the co-director of the project denies that pressures had anything to do with the two deaths on this project. in june a 63-year-old worker was killed at one of the elevator shafts when he was struck by a counter weight. in that instance cal osha found

no violations and will not be issuing citations. bob redell, "today in the bay." >> a developing news out of the philippines, a major earthquake left at least 93 people dead and many more hurt. the 7.2 quake struck on the southern part of the country. it did not cause a tsunami. the quake collapsed buildings including churches. the commander recalling soldiers to help with relief efforts. >> here closer to home a series of small quakes shaking the east bay. did you feel them? the recent a 2.sthax hit about 2:15 this morning a few miles east of berkeley. and a few minutes earlier 2.7 hit in the same area. then around 1:00 a.m., the largest quake hit measuring 3.2. a number of people commented on our facebook page. one says it was a strong quick jolt.

another says it shook her out of sleep. new this morning a high risk fire fight in south san jose. crews battle a late night barn fire at the intersection of emado avenue and monterey road off 101. when crews arrived the barn was in flames and power lines causing a dangerous situation for firefighters. look at these pictures. they come to us from the san jose fire department. the cause of the fire under investigation. >> privacy concerns versus public safety. the city of fremont could decide install security familiar ras in low income neighborhoods. marianne is live at central park in fremont with more on this plan. good morning. >> reporter: good morning, marla. well, an effort to reduce crime fremont police are asking the city council to approve surveillance cameras. there is nothing new about surveillance cameras as a crime fighting tool but what is you? that the fremont police accident

asking they be put up in low to moderate income neighborhoods based on u.s. census data. the neighborhoods include the arden wood neighborhood, central downtown t south donedale and the niles district. the request is in response to an increase on home burglaries. it's part of a larger plan to put these cameras up around the entire city. they say there is proof these type of cameras do help solve crimes. the police department plans to pay for the cameras with grant money. the start-up cost for the system will run about $450,000 and police will have to find a way to fund it. some residents are voicing concerns that the surveillance cameras, how about feeling of big brother watching. they fear that the city could invade their privacy. the council is going to look at this at 7:00 tonight.

reporting live, "today in the bay." >> thank you. >> meteorologist christina loren joins us from the weather center with pleasant temperatures in the forecast. >> and clear skies to go around. good morning to you, terry and marla. it is a pretty start to the day. starting to see a little sliver of sunlight. you have to wait for it this time of year. we don't see the sky lit up until about 7:00 a.m. 51 degrees in san jose and 42 degrees in gilroy. we're looking good as we head throughout this afternoon. temperatures are going to climb from the cold start where we are now, into the 80s so. about a 40-degree jump in temperatures especially in the north bay. i want to show you what's happening. offshore flow is picking up. this is keeping our sky clear. pushing the marine layer out to sea. throughout day it's going to be warm in san francisco as it will be in san jose. i'm forecasting about 83 degrees

capitol hill lawmakers say they are close to a deal to end the partial government shutdown and pay america's bills. they are reportedly talking about raising the debt s.e.a.l.ing so the treasury can borrow money until at least mid february and reopen the government. lawmakers have until thursday to come up with a deal.

scott, last time america's credit rating was downgraded. >> right. so far terry, nothing from standard and poor this is time around, not yet. wall street, too, is not taking much action. a reminder on this raising the debt ceiling doesn't exspant america's ability to buy. it expands america's ability to pay for things we bought. not raising the debt ceiling is deciding it new pay the bill after it shows up. speaking of the threat of shutdown, blackberry. the canadian phone maker will publish full page ads reassuring consumers it's not exiting the consumer market. and asking them to stick with blackberry. so the senate seems to be in harmony. it's house music we need to be worried about with. what does wall try think? bertha coombs is live. good morning. >> good morning, scott.

yesterday was a real indicator of how closely wall street is watching washington. we were down much of the day when it looked like there was a stalemate. but then things reversed late in the day and we ended at the highs of the session. investors optimistic on word that senate leaders could be closing in on a deal to end the shutdown and raise the debt ceiling. that deadline is thursday when we would go into possible default. no major economic data because of the shutdown. we were supposed to get inflation data. we do get earnings from citigroup korks ka cola matched expectations, we'll hear from johnson & johnson. the dow starts at 15,301 after rising 64 points, the nasdaq at 3815 after adding 23. we'll hear earnings from yahoo! this afternoon, marissa meyer making lots of changes there. and we've got the futures now

clear cold start tomorrow morning. you want to keep that in mind. temperatures climbing into the mid to upper 80s. on thursday a little on shore flow, more of that coastal cooling with fog to kick off. mostly clear conditions like we've had the past couple days. 76 degrees in san francisco, 81 redwood city. friday temperatures creep up a touch. if you want to hit the beach on saturday feel free to do so. it's going to be warm throughout with temperatures at the coast this weekend in the upper 60s to low 70s. by monday, like, those temperatures will tumble. >> cooler temperature, i'm cool with that. if it's rain we don't want. but we're looking at the festival. talking about between half moon bay and 280. that stretch may get crowded. now through halloween a lot

including that pumpkin festival. a slower drive. the rest of the bay, let's get over as you come west 205 out of tracy and toward 580. most of our viewers. in the altamont pass, one of those delays. the rest of the tri-valley moving and no problems for 680 or 880 into the south bay. your northbound route your commute direction, looking at the limit here, a little slowing and there was a brush fire reported. so far no lanes, we don't have confirmation of a fire but a little smoke. there is a theme bend that might be distracting folks. an easy drive through palo alto. smooth into and out of the city. >> thanks. bad smell caused a big scare in san jose.

hazmat teams were called to the area about 8:00 last night to investigate a possible ammonia leak. the area was closed for several hourses until the all clear. they are still not sure but ammonia has been ruled out. >> penalties handed down to st. mary's men's basketball deem tour recruiting violations will stand. the stool learned appeal failed as a result head coach randy been net will serve a five-game suspension and not able to recruit off season. two of the nhl's undefeated teams will square off. the sharks tomas hertl is expected to play. despite leaving saturday's game with an injury. he was named the first star. tonight's zbam on the nbc sports

pacific leather-backed turtle conservation day. they are on both the state and federal lists of threatened species. and 2012 a bill signed by governor brown named the turtles the official state marine reptile. the bill encourages schools to add the reptile to their curriculum. there is a special sum night try to preserve the leatherbacks. >> a former alcatraz prisoner will give tourists a special look. bill baker will be aboard guardians of the gate san francisco bay cruises talking to tourists as they sirk tl island. alcatraz is closed but the park service gave baker special permission to spend the night in his old cell. the 80-year-old was 24 when he was transferred to the rock. his crime, cashing fraudulent checks. during the visit baker got to walk the halls and grounds.

hunt for red october. >> there you go. >> it's tuesday, october 15 and this is "today in the bay." good morning. it is 5:30. i'm marla tellez. >> i'm terry mcsweeney. an update to a developing story. we want to let you know b.a.r.t. trains are running. but the marathon negotiation between b.a.r.t. and its unions still going on now. both sides have been at the bargaining table all night. the unions chose not to strike today. what happens next whrks it's a new deadline to reach an agreement unclear. christie smith is live at caltrans in oakland. these negotiations are taking center stage and still going on now? >> yeah, believe it or not. they are giving it their all in terms of timing. we keep an eye on these doors, that's where we've seen union workers coming in and out.

we asked them how it's going. they could only tell us that it's happening but how it's going, no comment on that. about 3:00 bags of takeout food were delivered. overnight a federal mediator announced both sides made substantial progress. that's the bargaining produced productive and constructive bargaining, going past the deadline the unions refused b.a.r.t.'s best and last offer, one describing it as a deal breaker. 12% over four years with increases to pension and health contributions. indian union leaders would make less money, than a counter proposal of their own that b.a.r.t. is considering. the president said they wouldn't cave on some issues. >> i am authorized by the parties to say they are prepared

strike resources, you'll find your latest commute information. if there is a strike. we'll start at 4:00 a.m. >> if you plan on using ac transit you might be out of luck come thursday. the bus drivers and other workers issue add 72-hour strike notice yesterday. they will balk off the job at 12:0 within thursday if an agreement is not reached. workers are looking for better pay. it's increasing the health care contribution by $50 a month. >> in this contract i would like to see agreement that our members feel comfortable rad fiing that would bring our members to a place where they feel they are being respected and their work is valued. >> about 100,000 use ac transit

new hope this morning washington may avoid hitting the debt ceiling. a deal appears in the works but there is a ways to go to prevent an historic default. tracie potts live on capitol hill with the latest. what is the latest? this is going on for a while now. >> reporter: it has. hopefully it's coming to an end. we have the deadline on thursday where we won't be able to borrow more money. a possible default following that. this time it looks like senators, democrats and republicans, an idea to bring the government workers back to put in place a budget that would last until mid january, to give the administration borrowing authority through early february, but then lawmakers

would have to sit down and hammer outpermanent budget before the end of the year. that's where they are. looks like the senate will get details today. some lawmakers in the house have said that they are willing to hold off until we see what the senate has to offer. >> thanks very much. a deal to end the shutdown is not soon enough for lawrence livermore lab employees. the employees at the lab will begin shutdown operations. the lab is one of the leading research centers in nuclear science. more than 6,000 work there, the second largest employer in alameda behind uc-berkeley. most of the lab will be closed end of day tomorrow. >> the u.s. supreme court will again take you up the issue of affirmative action and its role in college admissions. the justices will hear a michigan case in a dispute with the university of texas. unlike the texas case that said colleges can use race for
