we have breaking news if you are just joining us. bart workers are on strike this morning. this means 400,000 riders who depend on bart every day will have to find another way to get to work this morning. >> it is a rough reality out there. we'll take a live look outside right now, but don't let that smooth taste fool you as that's expected to change over the next hours as more and more people head out the door where they need to go. it is 4:30 right now. i'm jon kelley. >> good morning, i'm marla tellez. laura is off this morning. mike inouye is tracking the conditions on the roadways, but first we want to check in with "today in the bay's" kristy

smith live at the lake beret station. we just heard from a union executive director there. good morning, kristy. >> reporter: good morning to you, marla. some of these workers were actually here before i got here at 2:15 this morning. they are walking the picket lines here at the lake meret bart station, which would normally be open about this time. we did here from the executive director of seiu, one of bart's largest unions on strike. and he's using words like poison pill for the concessions that were put out by bart just before those marathon talks that broke off yesterday triggering the strike that we are seeing out here this morning. it seems both sides agreed on economic issues, but as part's board president said yesterday, the union's position was to take the money but not the changes that were needed to move bart forward. change that is include d changig

practices the way they have always done, bart wanted to change those. bart says it would be simple changes to pay stubs and holiday schedules. there was talk of using binding arbitration, but that didn't work out either. >> on these work rule issues, which is a modification of the contract they wanted, we would agree to interest-based arbitration on those limited issues. we thought that's logical, because if you just said, the district says, let's just arbitrate everything, we are back to square one. there's no deal either. >> what happened is the union decided to take the money that was on the table but not the work rules that were on the table. and they forced us to a situation where we needed to put an offer on the table that was black and white that included the rights that we had set forward. >> reporter: now, bart had asked union leaders to let the membership vote on its offer, but that didn't happen. and here we are, no word on when

both sides might sit down again and get this whole thing solved. we are hoping to hear from bart again a little bit later this morning, but that's where things stand. once again, bart trains are not rolling. reporting live in oakland, kristy smith, "today in the bay." >> kristy, thank you very much. this is going to be a long drawn-out battle. we'll turn things over to "today in the bay's" chase cain. >> you are live where riders are already lining up. i'm sure the line is even longer at this point. >> reporter: yeah, i would say that the line is probably twice as long as when we came to you guys just 15 to 20 minutes ago. the buses don't even start rolling until 5:00, but check this out here at walnut creek. if you asked me to estimate, i would say at least 45 to 50 people in line. and it seems like a person is jumping in line every minute. this seems all too familiar for people because it was a few months ago we had the last bart strike with buses shuttling people into the city from

different east bay stations. the same thing will start again this morning at 5:00 a.m. and run until 8:00 a.m. if you're heading out the door, the stations to catch a bus are el so tree dough, west oakland, concord, walnut creek, lafayette, dublin, pleasanton, san leandro, hayward and the fremont station. the buses will take you to the san francisco bay tunnel and starting at 3:00 running until 7:00 the buses will return back to those bart stations, but just like we had a few months ago, the buses probably won't be enough to handle the capacity of people that typically ride bart on a daily basis. back here live at the walnut creek station, we just talked to a couple people and will let you hear from them in their own words at 5:00. we can tell you pretty much unanimous frustration. every person we talked to said we don't like this, they obviously wish they didn't have to be waking up early. one lady told us she was having to get up an extra hour and a half early to get out here to catch this bus. and every person we talked to

did not think that bart should be able to strike. saying that they are sort of on the lines of police and fire, that this is an essential service because this is how so many people get into work. no doubt a frustrating morning and frustrating days ahead if the strike is not wrapped up soon. that's the latest from walnut creek, chase cain, "today in the bay." for a lot of people who don't have the option to work from home, carpooling may be your best bet. the hours for hov lanes is extended from 5:00 a.m. to 7:00 p.m., and that's nonstop. that also means the carpool lane times will not expire at the usual 9:00 a.m. time. they are in effect for the entire day including portions of i-80, 880, 680 and all toll bridges except the golden gate bridge. bart hurts the bottom line after they were idle in july. the summertime ridership was low, but that july strike was a huge economic blow.

the business area calls the bay area council lost about $73 million a day in lost productivity and commerce. the impact is expected to be even bigger this time around. >> wow, $73 million a day. that is painful. we'll see what kind of pain they are feeling as it is early, 4:36 out there, how are the roads? i'm sure the roads are seeing different traffic for a friday, but the bay bridge toll plaza is pretty average. we'll look at the span itself as well and we are seeing a smooth drive as far as the speed sensors go. the entire bay area off to a pretty typical start, but chase cain already saw people lining up at the bus stations in walnut creek, so people are prepared to make alternate plans. being a fridayers that's unexpectedly heavy traffic for the east shore freeway with the arrow marked here. also a concern is highway 24 coming off the walnut creek interchange all the way through here that has two westbound

areas heading to the congestion. 680 also seeing a heavier flow of traffic, so we'll see things move from concord down to danville. this is one of the areas with the hov lanes in service all day. what that means is if you have two or more, you get a bit of a break. if you have one sole driver, you cannot get in the hov lanes. we are looking at north 880 past the coliseum. a light flow of traffic right now. nothing unusual from the shot there. a smooth flow from 580. one crash clearing from grant road. no other problems throughout the south bay. very clear. probably unaffected, but we are looking to the north bay as well as bob redell is out there. we are talking about hov lanes and different bus routes, but you have another solution possible as an alternate today. >> reporter: am i tossing back to mike? well, you have the san francisco

bay ferry, which, of course, is increasing service in terms of the number of boats they will be running between oakland and san francisco where we are at right now, and they are starting the ferries earlier. the first one leaving at 5:30 instead of the normal 6:00 departure time. this gentleman right here, you learned in july during the bart strike that you had to take the ferry to get to s.f., give me an idea of what your normal day would be like as far as when you get up compared to what you are doing this morning. >> well, the normal day is not today for a variety of reasons, including i have a 7:30 teleconference call. so i have to be to work by then. >> reporter: normally you would get into bart? >> normally i get in from 8:30 or so, but today -- today i have to make the 5:30 ferry or the 6:15 or i'm toast. >> reporter: that's the reason you are here an hour early. so how much earlier did you have to get up this morning? >> well, again, i would have been up earlier anyway, but from normal, oh, god, three hours. >> reporter: oh, boy.

what's your message to bart or the unions or management or whoever? >> i just hope they resolve it quickly. that's it. >> reporter: best of luck to you. enjoy the ferry ride. he still has about a 15-minute wait. now, last july when bart went on strike, just so you can see here, you see this standing line here, this was all the way lined up to the back and down around the corner there. i will tell you, the ferry service did run these people through pretty fast, but if you do have to make a meeting and you are thinking that you need to get here early to get the 5:30 ferry, you definitely want to consider that. it is a friday, so there could be a lesser amount of people, we are not sure about that, so you may want to be prudent with that. as i mentioned, they are increasing service instead of having the normal eight ferries. they hav added four so we'll have a total of 12. they are also starting service earlier, so for example here in oakland, instead of the first ferry leaving at 6:00, it will

depart at 5:30. once you arrive at the ferry building in s.f., you have access to another landing dock to ease the foot traffic congestion. so with all those added boats and service, s.f. bay ferry says it will handle more than trip tell passenger load on a normal weekday. so instead of just 6,000 passengers, today they can handle anywhere from 19,000 to 20,000 passengers. if you are trying to get from oakland to the east bay to san francisco, there's a ferry leaving at 5:30 this morning. if you want to make a meeting and think there's any chance you might be late, you may want to get here earlier. it is an inconvenience, but bet tore be prudent. i'm bob redell, "today in the bay." >> leave early or be late. that's true today. thank you, bob. you can get the latest information any time on the bart strike on our website, nbcbayarea.com. at the top of the page there's a tab called bart strike resources

concord. 47 degrees. walnut creek at 8:00 a.m., 46 degrees. so chilly conditions out there in morning as you wait. but by noon temperatures are going to climb into the mid-70s inland. we'll be about 74 degrees. almost a 40-degree jump in temperatures from this morning as to what we are expecting for the afternoon. 80 degrees for the bay and 75 degrees for the coast. a couple things happening in the north bay, the half-moon bay pumpkin festival and octoberfest in campbell. we'll get you through the forecasts in a little bit, but right now i'll send that back to you. thank you very much. still to come on "today in the bay," two convicted murderers accidentally let out of prison? we'll tell you how they were released and the latest for these two men on the run. also, a major recall if you own a toyota. you have to heed this call. this morning the problem with hundreds of thousands of cars.

apple will regain the top spot in the fourth quarter. if you own a toyota, there's a major recall affecting hundreds of thousands of drivers. for that and the news before the bell, we go to bertha coombs live at cnbc world headquarters. happy friday to you, bertha. >> happy friday to you, marla. that's a redundant phrase. we are always happy about it being friday. and the futures are taking a happier tone with a higher start after mixed closings. the s&p hit a new record high and the nasdaq closed at a 13-year high, which will still take a long time to get back to the record. the dow ended near a flat line after disappointing earnings from gold man sacks and united health group. investigators are going to be listening to federal reserve officials and we have gotten earnings from ge and morgan stanley that both beat estimates, so that points to a

bullish start. the dow will start the day at 15,372 after slipping a few points. the nasdaq at 3863 after rising 24. and if you have a toyota vehicle, this is very important for you to listen to. the toyota company is recalling 803,000 vehicles in the u.s. because their air bags and power steering could fail. the recall affects the 2013 and 2012 models of the toyota camry, camry hybrid, avalon, avalon hybrid and venza. water from the air-conditioning system can lead on to the air bag controls causing a short circuit and the power steering feature becomes disabled if the air bags are damaged making it harder to steer. so far they have not had complaints about this but they are being proactivement call your dealing so see if you can come in to get that fixed. >> better safe than sorry. thank you so much, bertha. well, now to the 16-day

partial government shutdown has ended, the smithsonian zoo will welcome back visitors. the national zoo needed an extra day to get ready for guests. they encouraged the crowds to return by offering a 10% discount on food and merchandise through sunday. but a favorite attraction now open is this, the panda cam everyone is loving. i can't get enough! people can't stop watching the panda and her cub. it is so popular that some viewers may have difficulty streaming the cams. i am one who had difficulty yesterday. i tried to log on the to the panda cam and it just wouldn't let me. >> now you get it as much as you want. the other danger of watching too much is your mouth gets sore from smiling. the joy and euphoria, i just love watching you. i love watching her watch the pandas. very fun in her natural habitat.

been out there before. good time for the family with new eats out there. 63 degrees at 9:00 a.m. at half-moon bay. more sunshine on saturday over sunday if you are headed to the pumpkin festival. overall, we are looking pretty mild for today, tomorrow and then temperatures drop like a rock. getting into sunday and next week, we'll return to our seasonal averages. we'll be done with the summertime highs starting on sunday. temperatures leveling off monday to tuesday. staying nice and comfortable, even at the beach, in the upper 60s. we'll be done with the 70-degree days in san francisco after saturday. back to you, actually, let's go to mike. >> actually, i think we are going to send it over to me. i got it. 4:51. thank you, christina. authorities in florida are on the hunt for two convicted murderers this morning after they were mistakenly released from prison. charles walker and joseph jenkins were released after officials said they received forged documents indicating the

men's sentences had been reduced. it's unclear who forged the paperwork or how officials discovered the error. jenkins was released on september 27th and walker was freed on october 8th. both men were serving life sentences. that is a mistake that should never, ever happen. >> wow. shady tactics. still to come on "today in the bay," bart workers go on strike, and that means not a single train is running this morning. we'll go to mike inouye and how are the roads locking? oakland and 880 are moving smoothly, but this could be a problem for the east shore freeway. we'll see how things are shaping up this morning without the bart trains coming up.

we will continue with breaking news on this friday. people in walnut creek or anywhere else are waiting for buses. this is not a feel-good situation. the lines are already growing and growing. mass quantifies of people waiting, forced to do this because no trains are running. we'll continue to update you on this ongoing situation. people are trying to get the trains back in action. we'll check in with people all over the bay wrar to find out how tough the whole commute will be. >> the first bus will leave in five minutes from now and run through 8:00 a.m. so a lot more buses on the roads this morning, mike, along with more cars. >> yeah, but you know what?

even though we have more buses, not nearly enough. this will not carry the load that bart typically does. but it is a friday and folks have had time to come up with a contingency plan. so hopefully we'll see things relatively smooth. the bay bridge is moving smoothly into san francisco. the upper decks and headlights you see, no interruption there at the toll plaza, but we'll watch the flow of traffic as we see more drivers that we usually do on a friday. that will build over the next half hour to give us and idea how things are shaping up. the maps will tell you how the entire bay area is shaping up. i'll use the map to show you the green colors here. we are going to focus here on the east shore freeway where we are watching for the build. early off hercules in richmond. highway 24 out of lafayette, a smooth drive there to the tunnel, but that's coming out of walnut creek. we just showed you live pictures of people waiting for the buses, so people heading into work from that area still have to get there. so buses and a lot more cars we
