>> we take you out to give you these live looks. traffic running pretty smoothly at this hour but you know what, that will change in the next probably hour as more and more people head out the door this morning. we'll show you what you need to know to get around. >> and as the b.a.r.t. strike continues, so does the investigation into the death of two workers killed right on the tracks. we have new details we're learning and whether that tragic accident is now putting more pressure on b.a.r.t. and its unions to get this deal done. good morning. it is 4:30. i'm jon kelley. >> i'm marla tellez. laura is off today. we have real time traffic updates and transit alternatives across the screen all morning long. here is where things stand between b.a.r.t. and the unions. the unions say they sent a new proposal to b.a.r.t. in hopes of bringing both sides back to the bargaining table. as of last night b.a.r.t. says it has yet to see that proposal and as of right now no new talks are scheduled. this afternoon b.a.r.t.'s board

of directors will hold an emergency closed-door meeting to talk about labor negotiations. the key sticking points continue to be wages and work rule changes. >> to help you figure out how to get around we have team coverage. mike inouye right now watching the roads from the traffic center but we'll start off with bob redell at the hayward station where b.a.r.t. riders are starting to line up to catch buses. good morning. >> reporter: good morning to you, jon. so if you don't have the option of working from home and you don't want to risk getting stuck in what could be a monstrous commute on the roads b.a.r.t. is offering like on friday free charter bus service from a number of stations throughout the bay including hayward where we're at now. if you want to look here are the others that will be having this free charter bus service.

this starting at 5:00 a.m. this morning. it's running from 5:00 to 8:00 but as i mentioned it's very limited. just to give you an idea on a normal day b.a.r.t. handles around 400,000. these buses handle 6,000. so you can do the math and you can look at what happened friday. this is from walnut creek where they ran out of free tickets at 7:00 in the morning. not everyone was able to get on. the buses leaving those stations with the direct service to the transbay terminal in san francisco. there is already about a dozen people out here trying to figure out where these buses are going to do pickups from. can i ask you a quick question. this is your first during the strichblth how is it changed your routine? >> well, i've been up since 3:00. >> normally what time? >> like 6:00. >> a few hours earlier. >> yeah. you know, just the hassle of going and waiting for a bus and

hoping you get a ticket, just extra hours going to your commute. and leaving work early because i heard that they leave from 37. yeah. >> has work been understanding? >> we'll see today. >> what will be your message to b.a.r.t. managers, union? >> it's ridiculous. i think we should try to meet in the middle. there's half a million passengers that use it every day. i think the way the commute's going to be forev everyone. >> best of luck to you. have a safe ride into the city. the buses starting to leave at 5:00 this morning as i mentioned, very limited. these people are out here since 4:00. if you are home watches and thinking about taking one of these you might want to get out that door and get to one of those stations. reporting live in hayward, bob redell, "today in the bay." >> thank you.

b.a.r.t. riders frustrated and helpless. >> everyone seems to agree that in their words it's ridiculous. heard that a lot. mike, you're checking the roads, you are a busy man. >> so far let's say we're going all right. status quo on the roads. at berkeley area, this is westbound 80. the east shore freeway a light volume but we should see things change over the next 20 to 30 minutes. we see the folks at the bus stations bob is talking to folks in hayward. easy to find someone to interview. we have a nice flow but we're watching this area. the east shore freeway, 680, 24, folks leave walnut creek, 880 northbound, the nimitz will be packed from san leandro to the maze what we saw on a friday, that means 580 westbound will be packed in. we talked about concord, walnut creek. we'll see that 680 and 24

interchange pack in and the last time we had this b.a.r.t. strike during a regular commute day we saw traffic backed up toward the 680-24 interchange and over to the maze. we'll watch for congestion 580 through livermore. probably stead sbee castro valley. the south bay not a problem right now but we'll keep checking because anything different for the commute causes the ripple effect. the san mateo bridge, a live look here, traffic very light across 92 but 92 an alternate to the bay bridge. folks between san mateo and san francisco 0101 very crowded. everybody is adjusting. back to you for now. >> as mentioned it is day four of that b.a.r.t. workers strike no. talks are scheduled for today t unions say there is a new offer which could bring both sides back to the table. christie smith live by the lake merritt b.a.r.t. station with the latest. good morning.

>> reporter: good morning to you, jon. these b.a.r.t. workers have been holding the picket lines since midnight. they say their shift is from midnight 5:00 a.m. so they are tired but still doing it. these are members of seiu local 1021. they were working they tell me you would see them doing things like fixing the ticket machines and the change machines downstairs instead of course they are up here again. they say they are waiting for word on a counter proposal that they sent to b.a.r.t. this allows for the use of new technology. b.a.r.t. would basically have to sign off on this but they haven't seen it yet. what it would do according to unions is protect workers from unsafe conditions and accidents of course like the tragedy we saw over the weekend. it's clear, though, that might change the tone of the talks but we're waiting to see how. b.a.r.t. had not seen the counter offer but they are waiting to get it. that's the last word we had.

both sides have spoke within a mediator and each other. under the union proposal both sides say they would look into dropping other proposals on the table. b.a.r.t. asked the unions to vote on its final proposal but it's unclear if that will happen. there is a deadline approaching for how long it will be on the table. b.a.r.t.'s board holding a special closed-door meeting to discuss the labor negotiations, where they stand and how they could jump start them as you have been saying, though, no new talks scheduled. reporting live in oakland, christie smith. >> thank you. we'll chaek back with you many times. >> if you are about to head out the door. check our website before you go. there is a b.a.r.t. resources page. at the top of the page there is a tab called b.a.r.t. strike resources. it will take you to a map with

commute options and real time tweets from transit agencies. we have transit alternatives running at the bottom of the screen all morning long. as the b.a.r.t. strike drags on the investigation into how two workers were killed on the b.a.r.t. tracks over the weekend. this is just beginning. this morning federal officials say they hope to interview the person behind the controls of the train. damian trujillo is live in walnut creek. good morning. >> reporter: good morning, marla. still a lot of unanswered questions here at walnut creek, the accident happened not too far from the walnut creek station. a tragedy on the minds of many waiting to jump on shuttle buses to head to the city. the co-workers held as you mentioned a memorial last night in memory of chris sheppard and larry daniels. both men were veterans of b.a.r.t., they were inspecting the tracks on saturday when a b.a.r.t. train collided with them.

trains have been making runs during the strike to keep the system functional. the investigators arrived yesterday and will be here looking for answers. they are scheduled to interview as you mentioned the train operator to find out what happened. b.a.r.t. says he was an experienced operator, b.a.r.t. union workers say he was a manager who was training to run the trains during the strike. he had not operated a train in years. b.a.r.t. is no longer taking questions about the accident. instead they are referring all questions to the ntsb and the feds will begin their probe early this morning. >> basic questions on what he was doing that evening, what his job assignment was, how he goes about doing his job. >> reporter: talking of course about the train operator. the ntsb should be here through the week. the the report may not come back for 6 months to one year. they will look at all of the

data on the train as well as footage from the camera in the train. that camera is pointed inward so the only thing you can see is who was operating that train. a lot of unanswered questions still. damian trujillo, "today in the bay." >> thank you. >> 4:40 now. day one of the work week getting jump started and christina loren telling us look likes there is going to be some moisture. >> there is. good morning to you, jon and marla. good morning to you at home. mondays can be tough, the weather not really on our side this morning. it's cold throughout and we have a return of the low clouds. you can see that here from san bruno, very thick low cloud cover here. you're going to find reduced visibility in the south bay. we're going to continue to drop off throughout the next couple hours. we'll be tracking those for you every 10 to 15 minutes. temperatures will also fall for the next couple hours until sun

headlights, everyone is on their way to the bay bridge at this very early hour. we have many people in place checking the morning commute for you. it's 4:45. apple is expected to unveil two new ipads at an event in san francisco tomorrow. invites say only, quote, we still have a lot to cover. despite the cryptic message tech insiders say we can expect apple to launch a fifth generation ipad as well as a follow-up version of the ipad mini it released a year ago. there is speculation the new ipad will feature a fingerprint sensor. both will reportedly be available in new gold models. >> this month some federal workers may get paid two times thanks in part to the government shutdown. for that and rest of the news before the bell kayla tausche is live at cnbc world headquarters. >> good morning. futures as the markets come off after positive week thanks to the government shutdown ending, the s&p 500 hitting a new high

and google shares topping $1,000. it's business fordata was we play catch up with the reports delayed. most importantly september's jobs report which is out tomorrow. today we get news on existing home sales and earnings from mcdonald es. the dow rose to 15,400 t nasdaq to 3914. and some federal workers in a twist of fate may be allowed to double dip. several states are expected to let workers who collected unemployment to keep both those benefits and the back pay they are set to receive. that could add to the shutdowns untallied cost to taxpayer, economists estimate that could be as much as $24 billion. and renters are on the rise. government data showed 20% of single family homes in several areas were rentals. the increase represent changes and the recession.

lots were forced to rent after losing homes to foreclosure. many have put off jumping into the market. we'll send it back to you. >> thank you very much. it is 4:47 now. the old school move is out of the way. the days of the incandescent light bulb are coming to and end. >> you'll have to swap out for a more energy efficient one. on january 1, the inefficient lighting will stop. congress and president bush started this process back in 2007. some of the alternatives include cfl or led bulbs but consumer reports ratd the led. >> they come on instantly. they last much longer. so that's why they save so much more energy. they don't contain mercury. >> l.e.d. can cost 10 to $30 a

bulb. you can go with the cfl which costs about $1 but they don't turn on instantly and most are not dimmable. it could save the home about $143 a year. >> i want to let you know i was way ahead. i just have a disco ball. >> perfect. >> keeps the party vibe going. solar powered disco bulb. >> green. >> so it goes off when the sun goes down. we've got these shorter days and as a result our mornings are colder. a lot of people are up early in preparation for what could be a tough commute. we have you back on nbc, mike will have an update. i'm monitoring your weather cameras and we're noticing quite a bit of fog this morning especially down in the south bay so one of the places we don't get that, this is san jose,

believe it or not. we have just as much fog over san francisco and oak town. keep that in mind. stay alert if you are taking your bike because of those reduced visibility also it's going to be cold. 50 degrees in concord, we're at 52 in livermore. and the thickest fog is up in the north bay. we're going to see the dense clouds settle in throughout the next hour or so. you want to keep that in mind. 10:00 a.m., still low clouds over the bay. between about 10:00 and noon a good amount of clearing, lots of sunshine in the second half of the day and temperatures will be nice and warm. we're going to hit 67 degrees at 3:00 p.m. in san francisco, so you want to keep in mind if you will be waiting for the ferry, chilly conditions and a nice warm start. this morning temps in the 50s across the board. richmond at about 49 degrees. and as we continue throughout day temperatures will rebound nicely but not until we lose the fog at about 10:00 a.m. 10 and noon, temperatures jump.

84 in livermore. and temperatures comfortable. then things change. we're tracking showers, actually a 10% to 20% shot starting on thursday that goes from friday and saturday as well. it's not looking that promising now but things could change. we'll be tracking the jet stream for you and let you know if the chance gets better. starting to feel like fall. >> thank you very much. happening now, an international search under way to find the parents after 4-year-old girl. maria is now being called the blond angel and officials, they were searching for drugs in this roman gypsy camp when they spotted this blond girl peeking out from under a blanket. police say this point they could tell there was no resemblance to her supposed parents and a dna test proving there is no biological relationship. the couple being charged with abduction, authorities, they are

investigating whether she is the victim of a child trafficking network. >> she was living in a very bad conditions and she was neglected. >> we can tell you a charity is now caring for maria, they have thousands of calls from people trying to offer clues or possibly looking for their own missing child. >> good thing she is now in loving hands. >> very important. >> it's 4:51. b.a.r.t. workers still on strike leaving 400,000 people searching for another way to get to work. how are the roads? >> we're looking all right. here is the berkeley curve. you see it flowing but we expect this to be one of your major hot spots. we'll give you a forecast and look around at the situation coming up.

>>. >> we continue coverage now day four of the b.a.r.t. strike. giving you a shot of 880 through oakland. starting to fill up a little bit. still very early but expecting to get snarled up out there on the roads. >> let's check in with mike inouye tracking the traffic all morning long. getting busy. >> it is a little early here at the bay bridge. look at this not even 5:00 and we have all of your cash lanes with at least a little backup to the mid parking lot area for most. the fast track lanes are moving, cash lanes usually indicate

folks who are not regular commuters and we're seeing heavier volume as we expected. we'll look to the golden gate bridge. there are other factors including also fog in the area. maybe we can't get the golden gate bridge shot. there it is. we have some fog there. you can see the glow to the lights. a light volume here but let's talk about why we're concerned. coming out of the north bay off of the richmond/san rafael bridge. 580 there. more folks crossing from the east bay down 101 into san francisco to avoid the bay bridge. i showed you the backup forming. now more down the east shore freeway. this is west 80. so far at the limit until you come back down to west grand avenue where you see all of the slowing and the backup forming. more throughout this east bay portion. this corner of the bay will have folks over to the bay bridge for interstate 80. west 24, south 680, also north 880 and west 580. areas through oakland will be crowded. the nimitz starting to show a

heavier flow with the live shot. more cars than we see about this time. more traffic also across the san mateo bridge. nothing dramatic. south no big deal right now. back to you. >> thank you, mike. >> maybe you heard of underwater basket weaving. one of my favorites in college, also underwater weddings. we're going to give you a little under water pumpkin carving. >> this is in floxt. 30 divers suited up and went to work in an unts water pumpkin carving contest. they had to work against the natural buoyancy of the pumpkins. the winner featured a retainer wearing smile. the diver brought down an oversized tooth brush to give the teeth a cleaning. mae that person is a dentist. >> that had to be one of the happiest pumpkins i've seen. no plaque build-up too. >> 4:56.

including a look at the commute alternatives. we start with mike inouye with a look at the roads now. you're not alone outside if you head out. >> a lot of company sadly already. it's 5:00 in the morning. marla you showed interstate 80. heading to the bay bridge. as you drive along the east shore freeway a lot of lights. you are close to the limit. look at the backup for the cash lanes, fast track lanes are moving. we look at the map i talked about cash, more folks on the road because of that b.a.r.t. strike which is going on today and we see a smooth drive through the maze, more congestion will mean delays building. interstate 80, the east shore freeway expecting a lot of traffic and 24 action 680, 580 and oakland 880. back to you. >> thank you. 5:00 right now. there are a number of alternatives for b.a.r.t. riders to get you where you need to go
