5:00 am
including a look at the commute alternatives. we start with mike inouye with a look at the roads now. you're not alone outside if you head out. >> a lot of company sadly already. it's 5:00 in the morning. marla you showed interstate 80. heading to the bay bridge. as you drive along the east shore freeway a lot of lights. you are close to the limit. look at the backup for the cash lanes, fast track lanes are moving. we look at the map i talked about cash, more folks on the road because of that b.a.r.t. strike which is going on today and we see a smooth drive through the maze, more congestion will mean delays building. interstate 80, the east shore freeway expecting a lot of traffic and 24 action 680, 580 and oakland 880. back to you. >> thank you. 5:00 right now. there are a number of alternatives for b.a.r.t. riders to get you where you need to go. b.a.r.t. is offering limited
5:01 am
round trip bus service into san francisco from the nine stations you can see on the screen. the buses will be running from 5:00 this morning until 8:00 this morning. that is where "today in the bay's" bob redell is at one of those stations hanging out with a few people trying to get to work. good morning. >> reporter: good morning to you. here we are already the second bus has arrived. one load of 54 people left from hayward to the san francisco transbay terminal. the direct service going on. you have a second bus waiting to have it full before they take off. on friday at the walnut creek station they did run out of tickets around 7:00, these are free here at the hayward b.a.r.t. that does not appear that's going to be the case, they will have enough tickets. quick question. you are a commuter. how much earlier you have had to get up?
5:02 am
>> actually not much. i'm awake at the crack of dawn so. yeah. >> what would be your message to the b.a.r.t. management or union? >> let's get it straight. get it done. that's all i want. i want it resolved. hopefully we go back to normal business hours. >> best of luck. the stations offering the limited b.a.r.t. shuttle service again, west oakland, concord, walnut creek, lafayette, dublin/pleasanton, fremont and hayward we're at now, someone else getting one of those free tickets, the service between 5:00 and 8:00. this is limited service. on a normal day b.a.r.t. can handle 400,000. these free shuttle buses all in all, 6,000 so. you do the math, some of these might run out of tickets before the 8:00 time. they don't anticipate that here but did it happen friday at walnut creek. so just information if you are thinking about planning your commute. reporting live, bob redell,
5:03 am
"today in the bay." >> thank you very much for that. to help keep the traffic flowing caltrans extending carpool hours, lanes again running nonstop from 5:00 a.m. to 7:00 p.m. the extended hours on 80, 880 and 680, all toll bridges except the golden gate bridge will also be affected. >> there will be extra ferry service today. san francisco bay ferries first boat will leave from oakland about a half hour from now. operators say ridership has doubled the start of the strike. >> the board of directors plans to hold an emergency meeting to deal with the b.a.r.t. strike. as of now there are no new talks scheduled between the transit agency and its unions. christie smith is live at the lake merritt station in oakland with that side of the story. i know you have the picketers there. what are they telling you? >> reporter: well, you know, they are telling us that they are just waiting for word and holding the line. now and then we hear someone
5:04 am
drive by and honk in support of these b.a.r.t. workers who are on strike. that's about the only time we hear them get a little excited out here. it's kind of a silent strike. it's kind of understandable because they tell us that this is their second shift. some have been on the line since midnight. after the union presented a counter offer they are waiting for word. the last word from management they had not seen it yet and the workers are here holding the picket line at the lake merritt b.a.r.t. station where there are candles since the tragedy over the weekend where the two b.a.r.t. workers were killed. one of the sticking points was work rules. allowing new technology. they say that safety rules have to stay in flies protect workers from accidents. meantime for riders it's another day without trains and trying to understand this dispute. >> it seem as little excessive now and at this point you know,
5:05 am
we're all inconvenienced and it's hard to understand what's at issue anymore. >> reporter: b.a.r.t.'s board of directors as you said holding a special meeting at 3:00. that's closed swregs they are going to be discussing these labor negotiations, how to jump start them. b.a.r.t. is apparently been speaking with the mediator and the union as well. at this point no new talks scheduled. christie smith, "today in the bay." >> "today in the bay" will have continuing coverage all morning long with live reports throughout the "today" show. you can sign up for breaking news alerts on our website nbcbayarea.com, there you will find a list of commute alternatives and up to the minute traffic. search part strike resources. >> with the stoppage in day four we'll get a better idea if ac transit unions will be allowed to strike. a panel hearing arguments from
5:06 am
both sides will be reviewing the dispute and the impact could have on the public health, safety and welfare. governor brown stepped in and order add one-week cooling off period. he has the omgs of ordering another 60 day cooling off period. >> new this morning people in the east bay they woke up early with a magnitude 3 quake. that started 1:45 this morning south of blackhawk. we understand people felt a jolt nearby in dublin and in danville. so far no word on major jiryes or dodge. >> a 3 will do it. >> that's a pop. >> just like the cold air. that will make you up too. meteorologist christina loren good morning to you. >> good morning to you marla and
5:07 am
jon. of course to you at home. i want to make sure you're ready for the weather elements that changed. we started ourlt cle ed out nic. 53 degrees right now in san jose. we're at 43 in gilroy and 51 in livermore with really thick fog reducing visibility to about a half mile at the north day. the thickest is santa rosa, napa crept up to 3 miles but we were at half mile so these are going to go in and out. between about 6:00 and 8:00, we'll be tracking that every 15 minutes. i want to point out later on once that clears the sun will burn off all of the low clouds and a beautiful second half to the day. we'll bhit 76 in san jose. 68 in san francisco and 73 in oakland. a lot of people getting excited about halloween. i can tell you our pattern is
5:08 am
going to lift dramatically. read the go in my next report now. i want to check the roads, see how those are faring. >> it is changing dramatically. we're looking to the bay bridge and the backup for the cash lanes. heading there a good volume of traffic. there are more cars through the area and more cars ending up at that bay bridge. we'll look at the maps, this flow here and flowing from time to time coming out of richmond past that richmond/san rafael split. down 101 into san francisco though we don't see a disturbance we'll track those changes as well. speaking of the city getting into the city, we have an accident that talks about a stall past geneva. no big concerns. watching the lower deck getting out of the city. b.a.r.t. service out so use one
5:09 am
of the bridges. the san mateo bridge picks up volume a tad bit. that might be on edge so we'll follow this to see if that's the case with the data. south of san mateo bridge you're okay. we'll give you a live look through palo alto, 101, no problem for the flow here into san jose and mountain view. another shot this is san jose into mountain u. we're picking up the volume but nothing unusual. smith flow for traffic at the limit. low clouds you see making it murky at the top of the screen. so far drivers okay except in the far north bay and the coast. >> we don't want you on edge, mike. got to find your zen. >> you said smooth flow, going to saver that while we have it. coming up the 49ers aldon smith still in rehab.
5:10 am

we welcome you back with this live look at 880 in oakland. if you are driving in to work today be sure to allow extra time. the roads expected to be packed as we enter day four of the b.a.r.t. strike. here is a live look at the toll plaza. lines at the cash lane beginning to build as people leave early to get to work. mike inouye is watching the
5:13 am
roads. he will have a live report in about five minutes from now. >> with no signs of the b.a.r.t. strike ending some people are getting creative when it comes to commuting. for instance, meet emily. she posted this ad on craigslist offering rides from the east bay through san francisco to the peninsula with stops in between. she is asking passengers to chip in $10 to cover gas and her time. >> i don't have to be at work tomorrow. it's just me doing my part. i do work in public service. and i believe that b.a.r.t. is a public service and it's not serving the public so i will, i'm willing to do that. >> emily, you are a good samaritan. >> i like her. she plans on driving her minivan and taking advantage of the extended hours in the hov lanes, the municipal transit agency says when planning a carpool allow extra time. >> we need more emilies. 5:13 now.
5:14 am
micro solve and apple revamping tablets. scott, the future of computers almost entirely tablets. >> let's start with microsoft which tonight will start selling an update to its surface tablets. the surface 2, in san francisco, will stay open late tonight t new surface fixes some of the disappointments of the old but it sort of exacerbates one of microsoft's problems, it's got too many things in the market with similar names. surface, surface pro, surface 2. pro 2, windows surface or rt and which one do you want? you probably want an ipad. and there are lots of those too. apple will announce a new ipad or possibly two tomorrow morning. turning to wall street no government shutdown and traders don't take b.a.r.t. so relatively normal day expected ahead. kayla tausche is live. >> that's helping the futures to
5:15 am
be flat. the markets coming off a positiveweek. the government shutdown sending. not sure how much b.a.r.t. has effect but the s&p 500 hit a new high and google shares are topping $1,000. it's a busy week for data as we play catch up with reports delayed by the shutdown. september's jobs report is out tomorrow. today we get news on existing home sales. the dow rose to 15,400, the nasdaq adding 51 to 3914. here's hoping we can stay in the green this week. >> let's talk about google. $1,000 a share. that stock has been one of the best performing in silicon valley history. up more than 1,000%. google gained 13% friday alone after reporting quarterly profits. crossing $1,000 certainly a feather in the company cap but generally speaking companies don't want a stock price the
5:16 am
average person can't afford. you can solve this by splitting the stock. you make a single share worth two at half the value. google is in the midst of this. this will happen so i can say with certainty google won't stay at 1,000 but will be the same value. >> he always makes it clear. wish we could jump into a time machine and go back and buy a bunch of that. 5:16. we have plenty of good stock when it comes to weather. today may be rain. >> drizzle out there this morning, thick low clouds even in san jose. somewhere we don't often get reduced pockets of visibility. throughout day today we're going to continue to see that as we led to about 9:00 a.m. after which time the sun will be out in full force burning off the fog between 10 and 12, then temperatures will warm. we have showers on the way toward the end of the week and we'll show you when those come
5:17 am
in. right now santa rosa tracking thick pockets. of we could drop off to a quarter mile throughout the next couple hours and even in campbell i had to use my windshield wipers, there is thick fog. we don't get that this time of year down south. keep that in mind. looking good for the second half of the day. temperatures are chilly. if you have to wait for a bus or taking a bike make sure you're prepare forward the cold start to the day and if you're going to be riding a bike turpt travel cautiously with that reduced visibility. as we head throughout day at 8:00 a.m. 55 degrees, this is the temperature in san francisco it's going to be chilly to start the day. make sure you bundle up. in the evening as you wait for to the get home after a long day's work temperatures comfortable. seeing a nice finish to the day, all along the coastline. 69 degrees in santa cruz, 77 in los gatos, 77 on the way to san

jose with good changes. getting into the fall-like pattern as we head through thursday, friday, saturday. actually looking toward slight chances for rain every day and thursday through sunday as the jet stream starts to take a dip to the south. overall, though, we could be in the pattern all the way through next thursday. halloween so. make sure you're ready for that. we'll keep you updated. scary on the roads this morning, mike. >> there is fog throughout. setting the mood in spots. overall we're looking at heavier volume. let me show you what is unusual. we noticed here in the south bay i wanted to let folks know we're checking on the bay area. nothing unusual. not affected by the b.a.r.t. strike though more commuters ghit to south bay offices. we'll track that. there is a volume into livermore. this line along the dublin/pleasanton line not working. none of the b.a.r.t. trains are running. 680 and 24 we're not seeing a lot of slowdowns.
5:19 am
that might be because the sensors haven't changed. we have buses from these areas. look at this, antioch, we don't see the slamdown we often see. so we'll track it over the next ten minutes. the not we might have some folks staving off the commute. here we do see this red developing close to the maze, west 580 slow as you approach this 24 interchange. more folks heading across down into san francisco. this is a different flow and the bay bridge, let's look. oakland coming up toward bay bridge. nothing unusual. then the toll plaza we have all of the cash lanes, the fast track, use cash, that's what we're seeing. back to you. >> thank you. a preview of an exclusive investigative unit report.
5:20 am
the unit digging deeper, the question, did 49ers superstar aldon smith receive preferential treatment during his run-in with the law and did the sheriff of santa clara county make a serious mistake in judgment while the department investigated the linebacker for felony crimes? tonight at 11:00 on nbc bay area chief reporter tony kovaleski explorg what happened in the county jail on the morning that aldon smith was arrested for driving under the influence of alcohol. there are concerns about smith's invitation to this location, the sheriff shooting range. >> is that a conflict of interest? >> i believe it is. if someone is under investigation i don't think it's wise or justifiable to bring them to use county guns and ammunition. >> did the sheriff make a mistake by allowing aldon smith to come to this event to shoot
5:21 am
her weapons to fly in her hospital center. >> based on what we know it sounds like she made a mistake. it's a mistake in judgment or a mistake in public perception. yeah. she probably thinks she made a mistake too. >> did aldon smith receive preferential treatment? >> he desired not receive preferential treatment. >> the unit holding the powerful accountable asking the kind of questions around the arrest and criminal investigation of aldon smith. >> we are getting a better idea of when smith could return to the 49ers. the 49ers could meet with smith after they return from sunday's game in london. it's the bye week. the team told csn smith must show significant progress to return this season. the head coach confirmed the report saying he thinks it will happen at some point in the next

5:33 am
looking throughout? >> reporter: it's actually looking okay right now. good morning. we're heading northbound 880, we passed the marina boulevard exit here in san leandrleandro. speed is at the limit. we're looking at more traffic in that direction right now. but as soon as we get closer to the sol see yum we suspect it will be slow. it's 5:30 in the morning. we're seeing heavy traffic isn't the worst thing we have seen but our goal is to get to the bay bridge. may see what that's like, yetting heavier than normal. given the fact that you've got potentially 400,000 people -- on the roads or through other means. so we'll find out in a bit. as far as what we're looking at
5:34 am
throughout bay area over to mike inouye. >> all right, bobby. let's take a look out there if we can. we'll take a look at the maps i guess. see how things are saping up as we look at the san mateo bridge for starts. also the san mateo bridge is an alternate south of what's going on here as far as the traffic. on the shoulder, anything south of that is okay. we travel across the east bay. heading to the bay bridge. they doesn't see anything unusual. looking at a smooth flow. heavier volume, one of the big issues 580 westbound and north 880 where job is, is going to get crowded over the next half hour. but we're starting to see look that the slowing for west 24 as traffic slows out of the
5:35 am
caldecott and you saw the sensors change. so more volume through the maze through that route and again t northbound nimitz. moving down the east shore you're doing already. not a big deal as far as the traffic. folks changing their commute could mean some heading to the south bay afs if this is an option. for the south bay we saw thim around earlier. what do you have for the forecast? >> mike, good job. we know it's a tough morning. what i can tell you that jog is not going to help especially in the south bay. we have the delouds and visibility add about a half mile in spots. if you are waiting for a bus or commuting to work, the like or walking, make sure you're ready. 46 in dublin, throughout day temperatures are going to be

5:37 am
behind the controls. there is activity at the scene of this investigation. good morning. what's the latest? >> reporter: good morning. well, the investigators were up on the part track. the tracks, just to give you a kmenks point, that is where the investigators were. they have since come down and looks like they came back down with a couple of bags of what would be considered evidence. they are making their way back to our location. last flight was a candlelight vigil in memory of chris sheppard and larry daniels. the two were on the tracks when an approaching train hit them.
5:38 am
b.a.r.t. says the train operator was an experienced driver but the union says he was a manager drining to run trains during the trike. he had not operate add train in years. it's up to the investigators to sort everything out. they will look at the camera footage from inside the train. the camera can only dem stlit was at the controls at the time of the accident. they piece together what happened and who if anybody was to plame. >> we were at the start of this investigation. they take time to investigate. >> reporter: it's going to take the ntsb from six months to one year to issue a report on the accident. the investigators will be here for about a week gathering as much evidence as they can. again they finished looks like
5:39 am
they finished their evidence gathering on the actual b.a.r.t. tracks at the season of the accident. i still see them in what's -- collecting evidence so a point we're trying to get to information as soon as it becomes available. damian trujillo, "today in the bay." >> thank you for that report. it's not just part, there is another transit strike that is looming. this morning ac transit and its largest union planning to state its case. governor crown is brown issued k cooling off period. ac transit for the record carries about 100,000 riders each day in alameda and contra costa counties. >> a major work stoppage by truckers at the port of oakland
