minutes ago. what in the world is going on out there? >> reporter: the gates opened a little after 4:00, people were on the platform for 10 or 15 minutes then heard the announcements there is going to be no train service. the people had to leave the b.a.r.t. station. they pulled the gates closed and the people started to make their way to the charter bus staging area where people have been the past several days. one piece of confusion or i guess of several parts of confusion here is some of these people have not taken this charter bus service before. they thought they were coming back because they thought the train service would be on but that is not the case. b.a.r.t. is telling us they don't have the staffing because this decision came sort of late in the night. they didn't have time to guarantee how many people would be available to be at work this morning. one of the major b.a.r.t. unions atu 1555 tweeted out they apologized for this, that they are working to get people staffed. for now the advice is you should

plan on taking either the charter bus or the ferry service if you need to be across the bay this morning. we caught up with one woman who was here a moment ago, as the station was closed down and she said that news comes just too late for her. >> he don't know what time any train will be running. >> they just closed the gates behind us. >> just closed the gates. >> what do you do? >> i go get in my car and drive to san francisco. well, they tried. that's all i can say. it's not that easy but the charter buses won't do me any good and it won't do the people that's waiting at pittsburg no good because they need to be at work at 5:00. >> reporter: and the buses don't start running from the walnut creek station until 5:00 a.m. the line is still formed on the other side of the parking lot. so also some questions for the people, how many buses are going to be here, the bus start rolling at 5:00 because people

were planning on getting on trains at 4:00 a.m. the latest from b.a.r.t. they hope, they emphasize hope, to have train service back by 6:00 a.m. but you should not count on that. what you should count on is taking the bus or the ferry if you need to get across. hopefully the service will be up by the afternoon commute. that's the latest at the walnut creek station. >> crazy out there. so b.a.r.t. and its unions reached a tentative deal late last night. as of now no workers out there to run the trains. christie smith live at the lake merritt b.a.r.t. station. you got a look inside by accident this morning. right? >> reporter: yeah, good morning. riders tell us they got word last night there would be limited b.a.r.t. service this morning so a couple of them showed up about 4:15 thinking i'll be the first one to get on the train and get in to san francisco this morning. but what happened is that they tried all of the doors, they were locked except for one and they were able to go down to the

lake merritt station assuming it would be open but it wasn't. there was no station agent here at all until a couple minutes ago and the ticket machines saying out of service. the fare gates were standing wide open so really, an odd situation out here this morning. b.a.r.t. of course put out an advisory saying they are attempting to staff these positions. apparently not yet here totally at lake merritt station. that should be coming soon. of course after six months of talks and two rail shutdowns both sides reach a tentative deal last night and b.a.r.t. said it would try to mobilize 2300 workers, get the system back up. we ran into a disappointed rider moments ago. >> everything i got said that there would be service starting at 4:00 a.m. so i figured i could catch the first train at 4:00 a.m. apparently that's not the case. >> reporter: back to the deal itself, details not released but oakland mayor did release a

statement last night saying i am so pleased we're getting the trains rolling again for hundreds of thousands of b.a.r.t. riders putting people back to work and restoring their daily routines. of course that hasn't happened just yet. but the station agent as i said did just show up, and escalators are moving, one door is open here at the lake merritt station but at this point no service. i've seen a couple of people irritated walking around asking how they should get to work. i told them i don't know but probably if you are in a hurry use plan b. b.a.r.t. working to get the system up and running. christie smith, "today in the bay." >> thank you. kind of rough out there when riders are going to christie smith asking what should i do? wow. >> that's not a good scene. it appears that more than one person got the memo because the build-up at the bay bridge is impressive. >> there is an issue. more cars as that one lady we heard in chase's report she says i got to take my car.

b.a.r.t. employees over the weekend. national transportation board investigators say a trainee was operating the train that hit 58-year-old christopher sheppard and rail consultant 66-year-old lawrence daniels. both were veteran rail workers with more than 60 years experience combined. they were hit saturday afternoon while working on the tracks between the walnut creek and pleasant hill b.a.r.t. stations. >> a police officer now on administrative leave after shooting and killing an armed suspect. last night officers responding to a house on saturn way where they shot that suspect after he threatened them with a pipe. the suspect who is on parole and had a warrant out for resisting officers was taken to the hospital where he later died from injuries. that shooting being investigated now by both union city police and the alameda county district attorney's office. >> a former assistant principal at a south bay high school must register as a sex offender.

34-year-old joseph rigeto has pleaded guilty. the "mercury news" reports in 2011 he was an assistant principal at leland high school in san jose when he began exchanging text messages with a 16-year-old student. the relationship eventually led to a sexual act at a park near the school. he will be sentenced early next year. he faces up to three years in prison and must register as a sex offender. >> the family of a murdered berkeley man resolved its wrongful death lawsuit against the city. after calling police for help, peter kukor was killed outside of his home last year allegedly by a mentally disturbed intruder. his widow and two adult sons say a police dispatcher promised an officer would be responding. without admitting fault in connection with the suit the city has agreed to implement changes to its communication center to try and improve public

welcome back everybody. i want to give you a live look at the bay bridge toll plaza. getting thick out there early morning. mike inouye reporting there was an accident out there and a tow truck jammed that up. in addition to b.a.r.t. trains not running at this moment. b.a.r.t. still working on. going to be a thick one on the roads. we'll keep you updated trying to figure out what's going on and when the trains may be running. 5:13. one day after president obama acknowledges issues with the website designed to let people shop for health insurance we're learning that verizon has been asked to jump in and try to help things. "usa today" reporting that

health and human services hired verizon's division to try to help the health care.gov site. a lot of people could not log on. now some insurance companies are having trouble receiving applications. verizon working on several federal information technology contracts including the centers for medicare and medicaid services. >> how about this. the u.s. government is going to do something it has never ever done before. scott, they are going to release job numbers on a tuesday. >> weird to get excited about but jobs tuesday don't have the same ring. 5:30 our time the labor department which is back to work, will release the long overdue september jobs report, overdue because the government itself was out of work after the tea party-led government shutdown. a bit of trivia, we had delayed jobs numbers before because of government shutdowns. but even then they still chose a

rumors also point to improvements in the front and rear cameras and possibly the same fingerprint recognition technology found in the 5s. the ipad mini is expected to be upgraded to the retina display which exists in the regular ipad doubling its resolution. tim cook also expected to unveil details about the mac pro and the newest operating system for its desk top computers. the upgraded ipad according to one report could go on sale as early as next week before the start of the christmas shopping season. today's announcement assuming it's around the ipad coincide with microsoft's announcement and nokia's devices. >> in fact, microsoft started selling that surface 2 tablet. we have a picture of the nokia which was part of microsoft. this is the one bob was talking about. has a cell phone chip in it. no wi-fi option will set you

patches of fog. you might walk out the front door it's clear, then you hit the highway and that's when it becomes dangerous. taking the little ones to school give yourself extra time. it could be a dicey morning with the b.a.r.t. buses not running t trains are not running as of now. the buses are but a lot of people did not know that. so a lot more people are going to be driving to work. i want to show you noon, nice and clear across the greater bay area, looking really good there. as we head throughout day, temperatures are going to rise into mid-80s. 82 in concord, mid 70s today around the bay so looking comfortable there. into the weekend temperatures are going to drop off and we'll see changes. more clouds, may abstray shower. best chance late saturday into early sunday. we'll keep tabs on that. a cute off low. we may not get much of anything, just consider the fact we might have rain showers on that day. about a 20% shot.

we'll let you know. let's check your drive with mike inouye. >> we'll look out to the roadways, christina said the b.a.r.t. trains are not running. hopefully by 6:00 but a lot of folks hitting the road. that is their plan b. they didn't plan on the bus shuttles. the fast track lanes have cleared because all the crash activity that was there has cleared out of the area. we have a smooth flow for the fast track lanes. the cash lanes a bigger backup indicating there may be more folks who don't usually drive for the morning commute. we see that the approach is right as far as the maze and off of the berkeley curve. watching for this entire influence as folks from the walnut creek station where chase cain was reporting have to travel potentially across into the city if they don't plan some other route. so far no big surprises. one issue christina talking about is fog, we had a lot of

fog around here, the hayward side of the san mateo bridge. there are some low clouds throughout the area. let me show you the south bay quickly before i give you a couple of live shots. san mateo bridge, with a smooth drive. you do see the low clouds are impeding your view of the high rise. the drivers are doing fine. we'll watch to see if this develops into anything that's an issue along the peninsula. so far none. we'll end with the next shot fremont, traffic flows down into the south bay again without interruption. the low clouds are hovering. the north bay so far the only issue. back to you. >> thank you. it's 5:20. on the international scene news from india a school principal and her husband now charged with murder after 23 children die from eating toxic school lunches. investigators say the principal's husband stored pesticides at the school for use at his agricultural farm. the chef cooked it by mistake.

prosecutors say that the principal told her to serve that food anyway. of course that led to the death of the 23 children. if convicted the couple could face the death penalty. >> a federal agency is refusing to release sea world's new safety protocols for trainer interactions with killer whales. osha says it's worried it could be held criminally liable for releasing trade secrets, the safety protocols follows the death of a trainer when a six-ton whale pull heard into a pool three years ago. >> police say google earth has helped catch a criminal. the grants pass daily courier reports police received a tip 50-year-old curtis croft was bragging about his pot grow so they went on google earth to check things out and reportedly found a satellite image dozens of rows of plants growing, croft was registered to grow about 30

off because there would be no train service at least not yet. you see there are a couple of commuters standing and waiting. i can pretty much assure you they are hoping that this train station will be back open by 6:00 a.m. that is what we're told. there is a station agent there in the booth. he has been making announcements saying they hope to have train service up and running by 6:00 a.m. for now people are across the parking lot lining up for those charter buses. that's the drill for the past several days. the buses began running a little over a half hour ago. people were pretty frustrated because they thought they were getting on a train at 4:00 a.m. and they said no, no train, they had to wait another hour for the buses at 5:00 a.m. b.a.r.t. is saying if you need to get to work quickly the best bet is get on one of the charter buses or take a ferry aoss the bay. that is not sitting well commuters who are frustrated to say the least. >> what's that b.a.r.t. website

minutes the trains will roll. we'll keep you updated on that. that's the latest live in walnut creek. >> thank you, chase. a september jobs report released 2 1/2 weeks late. business and tech reporter scott mcgrew sin the newsroom. what's the sfwherd >> the word is sort of mediocre. here's the numbers. 148,000 jobs, added in the month of september. the unemployment rate remains at 7.2%. this is a standard sort of number that's not going to cause a lot of excitement on wall street one of the reasons they release this on fridays is bring the freak-out level down if there is a strange number. friday there is less time to do anything about it. this is the first time on tuesday and as you mentioned because of the government shutdown. our october numbers which will come later will be delayed as well though those will come out on a friday. you're sort of in economics and

ntsb officials plan to question more people about the accident that killed two b.a.r.t. workers. yesterday investigators saying a trainee was operating the train that killed -- hit and killed the two b.a.r.t. workers. it happened between the walnut creek and pleasant hill b.a.r.t. stations. the two workers have been identified as 58-year-old christopher sheppard and rail consultant 66-year-old lawrence daniels. >> what a sad scene there. thanks to the b.a.r.t. extension project a lot of people near the great mall in milpitas are likely waking up tired because overnight work on the new b.a.r.t. line to san jose along montague expressway has been deeping them awake. the contractor building the line permitted to work throughout the night during this phase. furthermorelies say all of the clanking has become nothing

welcome back. breaking news this morning a tough one out there on the roads. a live look at the bay bridge toll plaza. it's tough because well, in part, b.a.r.t. had promised to have trains up and running by 4:00 a.m. that promise slipped away as they tried to get workers in place. they have a deal in place ending the strike but trains not running this morning. they hope again hoping to have some up and running by about 6:00. we'll keep you posted on what's happening with b.a.r.t. and on the roads with mike telling you ways to hopefully get around that. it's 5:46. in other news, this morning kind of tough to listen to. we're hearing the frantic calls for the first time for help after a student opens fire in a middle school near reno. >> they shot the teacher. >> the teacher's down? >> yes. >> 911 operators say they received dozens of calls from terrified students and teachers

on sparks middle school. mrs. say a student showed up with a gun and opened fire in a math class, killing the teacher and shooting two other students before turning the gun on himself. this was a 12-year-old. a 12-year-old student. the shooter died at the scene. the two other students wounded in this attack, good news they are expected to survive. >> it's 5:47. the man accused of killing3swis cousin known as baby hope 22 years ago has been indicted. he will be back in manhattan criminal court today. the 52-year-old claims his confession to sexually assaulting and killing 4-year-old angelica castillo was coerced by detectives. he admitted to helping his sister dispose of the child's body. >> new this morning the chinese government announcing a new plan to deal with severe something smog. emergency measures will kick in

when air pollution levels just get too high. the measures will force factories to temporarily shut down and implement traffic restrictions. the measures they will only apply in beijing even though up to 60% of the air pollution drifts in from other provinces. >> air pollution not our problem in the bay area. but some severe fog out there today. >> we had really dangerous fog. we usually don't see a dense fog advisory go up unless the fog could impact your morning drive. that is the case this morning especially in the north bay but up and down the peninsula you'll find pockets. i want to show you what it looks like now on the golden gate bridge. we can't pick up anything from our san francisco camera. let's talk about where we're seeing the densest fog. you have a half mile visibility in santa rosa. these numbers are going up and down, they will continue to as we head throughout the morning. you might walk out the door, it's clear and then you run into a thick patch of fog, you can't

see anything beyond 200 feet. keep in mind it's one of those mornings also with the b.a.r.t. trains not starting on time it could be really rough. we're going to check in with mike to see how things are changing on the roads. count on a very cold start to the day. just like yesterday we're starting out in the 40s, actually colder this morning than it was yesterday so layer up. you could have a long wait out there. and if you are going to run the heater in your car, just make sure it is running right. we have to tell you the ferries, if you are planning on taking a ferry, cold conditions over the bay. you're not going to see much on the ferry because it's so foggy. temperatures in the upper 40s at 8:00 a.m. by the time you make your way home the 60s so good day for a nice heavy coat, something to peel off later on. a really good looking day shaping up. look at these numbers. 84 in livermore. 82 in concord. 84 in gilroy so outlying inland cities seeing comfortable temperatures. still warmer than average.

77 in san jose and 68 degrees in san francisco. but things will change. we'll hit the averages as we head through friday into the weekend. with a storm system off shore that could bring us showers right now. the best chance looks like at the coast. but everything could change. a cute off low will be detached. we'll have nothing to push it inland so it's going to end up where the storm ends up is going to dictate how much rain we see. we're watching. mike is all over your morning drive. good morning sir. >> good morning. still on top of it. we got this over twitter. b.a.r.t. twitter account says limited service being restored to the b.a.r.t. trains so b.a.r.t. trains are running a few of them. we'll get more details. christie smith is out there, chase cain. they will get you the information what you will experience at those stations. at the bay bridge you're going to experience a backup being traffic tuesday and with unexpected b.a.r.t. outage, all of these lanes are filled in. metering lights are on. we see the backup on the approach. and now the slow drive down the east shore freeway.

welcome back. as we're following this breaking news we give you a live look at the walnut creek b.a.r.t. station and a little bit of better news for you. b.a.r.t. just saying that limited service is now up and running so some trains are running. we're also being told to expect 30 to 45 minute delays systemwide. so b.a.r.t. may not be your best option for your morning commute. but the b.a.r.t. spokesman telling us he expects full service by this afternoon. by the evening commute. right now it's 5:54. >> from now on at&t park will holtd a special place in the heart of kim kardashian. that's because the reality tv star got engaged there. look at this. this photo was given to e news. >> she doesn't want to miss a chance.

our stock price too high it says. the company took the odd step yesterday afternoon of both delighting investors with tremendously good news and asking investors not to get ahead of themselves or the company. netflix says it has more than 40 million subscribers. this is a volatile stock on a good day. it jumped 10% on a great day with great earnings, and is up better than 400% for the year. though admittedly from a depressed price. but still. just a short time ago got the monthly job numbers, something that happens first friday of the month. because of the government shutdown it was delayed. the latest figures say 148,000 jobs gained in september, not a particularly good number. i said that the unemployment rate stayed steady in fact it fell. the shutdown is not factored in. these reflect a time back before the shutdown. back to you.
