a rally in the streets for the north bay teen killed by sheriff deputies in sonoma county. more protests and a vigil planned for today. >> we have new video of a massive overnight fire in an industrial area in the east bay. why firefighters are now having a hard time figuring out what caused a number of cars to go up in flames. >> what we are learning about a fire on a b.a.r.t. train that brought the evening commute to a stand still and why it could cause problems for the morning commute as well. >> a live look outside. look at the clouds. low hanging out there. that is san francisco buried deep inside those clouds on this

thursday, one day away from friday, october 24th, this is "today in the bay." it is 4:31. good morning. thank you for joining us. i'm jon kelley. >> i'm marla tellez in for laura garcia-cannon. let's talk about the fog. >> let's take a look at the fog. >> meteorologist christina loren, how are you? >> good. good morning to you. we have such a lovely second half of the day just like yesterday and the day before. it's going to be cooler today but what i can tell you is make sure you are prepared for a foggy start with temperatures right now mostly in the 50s, we have thick pockets of fog. we did have a dense fog advisory in place. the national weather service did cancel that so we're not expecting it to be pea soup thick but one of those mornings you don't want to mess around. make sure you have plenty of time so you don't have to rush out the door. let's check on the drive. >> speaking of rushing out the door i do that in the morning.

the bay bridge, low clouds and fog will be an issue, not quite as thick as yesterday perhaps but we still have a good amount and that may cause an issue. we have road crews there, road crews also south 880, here toward the san mateo bridge you have an easy drive. watching to see if changes. yesterday we lost a lot of this view but we'll track it and see how thick the fog develops. >> thank you. we start off with breaking news in concord. investigators right now looking into the cause of a massive overnight fire, this was at an industrial park which also houses propane tanks. when firefighters arrived they found a lot of cars already wrapped up in those flames. good news it didn't take long to put out the fire because the building is mostly made of metal. the fire started a little before 11:00 last night at a storage yard. that the point we're not hearing of injuries.

>> two more rallies are planned today and a vigil for the 13-year-old boy who was killed by sonoma county sheriff deputies. justice for andy lopez, they say, this is one of the rallies held yesterday. it started at a vigil in the field where lopez was shot by sheriff deputies. investigators say they thought the teen was carrying a real isalt rifle, not a replica. they held up to show the similarities. witnesses say they heard deputies tell lopez to drop the weapon. >> as the subject was turning toward him the barrel of the assault rifle was turning in his direction. the deputy fired several rounds at the subject, striking him at least one time. >> there has to abstatement that has to be put out, this ain't right. there has to be another way than excessive force. >> a vigil is planned at the

field tonight, then another friday at city hall. the topic of today's vigil we're told is racial profiling. >> the coroner's office says a woman was killed in a crash. investigators say maria anderson was driving on interstate 5, driving in button willow yesterday. they say for some reason she lost control and then it flipped. she died instantly at the scene. the four other people were also hurt. >> the b.a.r.t. train that caught fire yesterday is still stuck on the tracks at the orinda station and this could mean another rough day for riders. smoke pouring from under the train during last night's commute. firefighters say it was hard getting into the station and then to the fire as passengers rushed off the 10-car train toward fresh air. the fish stare started on the u side of the fifth car.

it's a 12 to 1500 pound vehicle. once the rails were shut down firefighters put out the flames. >> it was pretty dark and smelly, had that burnt rubber smell to it. it was picking up momentum when i passed under the bridge i could see red under the train so you could tell there was a fire going on under there. >> service was plart restored before 9:00 last night. >> the b.a.r.t. board holding its first meeting since two workers were killed working on tracks. that meeting set to take place at about 10:30 this morning, recognizing christopher sheppard and lawrence daniels. the two men were both killed after being hit by a train saturday while working on a stretch of track between lafayette and pleasant hill. the national transportation safety board board is trying to figure out why those workers did not hear or move when the train

approached. protesters are expected to be outside calling for criminal charges against b.a.r.t. managers and b.a.r.t. bosses. >> the board will hold a closed door meeting to talk about labor negotiations with its two largest unions. a tentative deal was reached earlier this week. according to the chronicle there would be a 15% pay increase over four years but contribute more to health insurance and pensions. leaders of both unions are double-checking the wording on the deal before presenting it to their members for a vote. also at today's meeting the board will hold a final vote whether to allow bikes on b.a.r.t. trains around the clock. they are banned during busy commute hours. test runs in march and august allowing riders to take bikes on board at any time of the day yielded few complaints from riders. the board has given initial approval to the plan so the

final vote is procedural. >> a total of three people under arrest after police in the east bay recover $250,000 of marijuana. police say they found about 100 pounds of pot growing in the backyard at the home on olympic drive near highway 680. the grow operation was discovered earlier this month after police received tips. mariana might be growing there. each person was charged with cultivation, possession and sale of marijuana. san francisco is living up to its reputation of being a fog city. >> the machine is on. i'm not sure they flipped the switch but they did it early. >> meteorologist christina loren, was it you? >> well, i can't take credit for that but hey, it's always a party at this time of the morning. if you do have to get out there this morning and get to work on time, be prepared to slow down with reduced visibility throughout the morning hours. what i can tell you now is it's not that cold this morning, not as cold as it has been.

up per 40s. we're not tracking as much fog. over the next couple hours we're going to see low clouds start to move all the way inland and filling in our inland valleys like bowls of soup. so get ready for that. it's going to abgray start but overall what's going to happen a weak disturbance comes through. this is going to mix up the atmosphere. we're not counting on foggy conditions tonight. what will happen, look at the temperatures today. much cool e 70 in san jose, 69 in santa teresa, the big news is we're so close to the weekend we've got a good looking weekend headed our way. i'll show you the seven-day forecast in a few moments. let's check on the drive. here is mike inouye. >> we're so close why don't we call it the weekend. no, not in my ear piece. the easy drive westbound, no problems. still a lot of company. on the maps i show you the approach to the maze and the bay

bridge looking good, over here we're talking about the continued b.a.r.t. issue at the orinda station. they are single tracking, there may be delays but so far right now the b.a.r.t. system reporting that the trains are on time. again, one has come through the station from what i understand so we're watching for more delays as work continues. the rest of that area that was heavily affected by the b.a.r.t. strike yesterday moves relatively smoothly and now we have no problems throughout that area. the entire bay showing light volume including the south bay. no delays here. a quick look at the peninsula, 101 north past university and willow, we see taillights, no problems though there are low clouds so be careful. we'll track it for you. back to you. >> thank you, mike. >> 4:39. coming up on "today in the bay," come on, it's not even halloween. >> one week. >> but the target now making new moves trying to get their hands all over your shopping money. >> affordable health care, the

welcome back. we take you live to washington, d.c. as we look at our nation's capital there. today a lot going on in washington. president obama, he's going to start his day pressing congress to pass immigration reform. the president will speak at the white house later on asking lawmakers to overhaul the immigration system by the end of the year. the senate passed a bipartisan wide ranging reform bill back in june. but the measure actually stalled in the house. most house republicans prefer to approach immigration piece by piece as opposed to supporting a sweeping bill. >> executives at some of the companies that built president obama's health care website will appear before a congressional committee. they will likely be grilled by the house energy and commerce committee why the website does not work like it is supposed to. it's supposed to let all americans shop and compare health insurance but since the beginning the site has been plagued with problems like not

letting people create accounts let alone sign up for insurance. >> the bay area's zynga set to let the world know how it's doing, one of a number of companies ready to report quarterly earnings. kayla tausche is live at cnbc head quarters with a look at what to expect throughout the day. good morning. >> good morning. u.s. stocks are poised to open higher this morning, the dow, s&p 5000 and nasdaq fell less than 1% yesterday. bank of america liable for fraud on claims to defective mortgages sold by its countrywide unit claiming it sold toxic home loans to fannie mae and freddie mac in a process called hustle. the judge will determine the fine. the case follows jpmorgan's deal to pay $13 billion in fines and payments to federal and local

warmth so it's not as frigid this morning as it was yesterday. throughout the day we're going to continue to see that low cloud cover, at least until about 1:00 p.m. in san francisco. temperatures are going to be cooler. 65 degrees there, 68 in redwood city and 70 degrees on the way to san jose, so feeling like fall as we get closer and closer to halloween which as marla pointed out is next thursday, coming on us quickly. i can tell you right now we're looking good for this weekend, temperatures comfortable, in the 80s. and then monday, tuesday and wednesday we are tracking an area of low pressure. right now it doesn't look like it's going to impact us that much. it's going to bring our temperatures down but we're not looking at showers. that could change. we'll keep you updated. 4:46. back to you. >> thank you so much. a new study out this morning finds the age of stroke victims worldwide is lower than ever before. while the number of stroke cases is higher than it's been.

researchers in london found the number of people having strokes has jumped by 25% in people between 20 and 64 years old. those patients make up almost a third of the total number. there are risk factors including obesity and high blood pressure. >> a new report by the fda and the u.s. department of agriculture says that putting nutrition labels on store shelves right in front of consumers will help them make healthier choices. since 2006 stores have placed the ratings on labels on shelves. researchers say the system helps steer shoppers to nutritious food. >> how about this one, a marijuana breathalyzer test. that may be done down the road for california drivers, some

police officers say would be necessary if the state legalizes pot. officers say they would need some way to test drivers who may be marijuana intoxicated. right now there is no legal limit on the books like for dui. marijuana advocates say at this point it's impossible to test for marijuana and determine an appropriate limit. police say law enforcement would simply turn to sacramento for answe answers. >> it won't be as effective in determining eknee briation. >> that woulding up to the legislature based on scientific research they would have to take into consideration to determine is there a base level in a person's breath under the influence of marijuana that would warrant driving under the influence conviction. >> by 2016 california may see legalizing marijuana on that year's ballots. right now lieutenant governor

gavin newsom leading a panel planning to look into the issue. >> coming up a new update on the condition of dan boyle. >> we'll tell you why a peninsula man has filed a lawsuit against the company behind the chasing mavericks movie. >> i told the folks who operate the camera i would like to see more roadway. they showed a lot of the golden gate bridge. there is one truck. there are some flashing lights. we'll watch as things start to change.

monster waves near half moon bay. >> good news for the sharks, dan boyle is expected to practice with the team this morning before tonight's game against the boston bruins. boyle has not played since october 15 when he was hurt in this play along the boards against the st. louis blues. he was knocked unconscious and carted off the ice. the team has not said what his injury is but he was placed on injured reserve. it's not likely he will play tonight but a good sign he is rejoining the team on the road. >> the 49ers up and getting down to business. putting in the game plan for sunday's game against the jaguars. that's because they are in london, i guess they were there for the christening of the baby, right. baby george. actually they are working out playing some football. almost afternoon time there in london now so it's not too early for those guys. colin kaepernick says despite the change in scenery it's business as usual.

the team plays sunday morning at wembley stadium. >> i hope i'm not going to screw up the name. while he may not take the field it is a piece of his family history. in 1948 his grandfather represented the u.s. in the london summer olympics, he took the field at the old stadium and won the gold medal in shot put. he remembers the family stories about that day. cool. >> a rich athletic history. >> speaking of baby george, we need to get him to kaepernick. he can do the wave. >> then it's the guns. >> i think so. >> tattoos optional. 4:54. let's find out what's happening. >> work on that while we get that campaign going. we're starting with the golden gate bridge. we have crews across the bridge but that's all right. we're looking at the maps.

talking about the tri-valley. way back over across, san francisco is not a problem. at the bay bridge a slower drive as we have some heading to the richmond/san rafael bridge. the crews are starting to move out of the way. we have another issue, upper east shore freeway. tough to see there. there is a report of a small brush fire off interstate 80 that may cause smoke through the area though the last few minutes haven't seen a lot of activity. we'll track this again but no winds are blocked. west 4 a tiny slowing starts, this is about a half hour before we see that sudden slowing through antioch. the beginning of a morning commute as well as the tri-valley. it's green through livermore, dublin and pleasanton. out of the pass we have mild slowing, 205 and 580 merge

together and head in out of the altamont pass. over the bay the san mateo bridge moves smoothly. you can see the high rise on the upper left. but from time to time yesterday we lost sight of that. we'll watch for the effects of low clouds. the east bay shows a smooth flow. this is fremont, southbound 880, and the truck scales although. here is san jose northbound 101. look, the low clouds are there, not a problem for the drivers. that's good news. back to you. >> oh. >> you love these furry friends. >> a new baby panda is resting but that wasn't the case in a doctor's check-up. >> what is he screaming about? >> the female cub getting her first vaccination. she is healthy now six weeks
