and welcome to "today" on a thursday morning. i'm savannah guthrie. >> and i'm matt lauer. you had a fun job yesterday. >> great group of kids. really enjoyed it. >> you made that mascot head look really good. >> i still have it in my dressing room. >> good to you back. >> we have a lot of stories this morning. an 11-year-old arrested accused of bringing a gun and 400 rounds of ammunition to his school. what was he planning? we'll have more on that coming up. >> let us begin on a thursday morning with our top story. a tragic murder of a popular teacher in massachusetts. the 14-year-old now in police custody. ran allen has the latest on this. >> reporter: good morning to you, matt.

no classes here this morning although grief counselors are on hand to help the community as they try to deal with what happened here. the body of the teacher colleen ritzer was found on the edge of the school grounds. a freshman new to the community has been charged with her murder. hundreds came together to remember colleen ritzer, a beloved math teacher in just her second year here now suddenly gone. >> she cared about all of her students equally. it was a shame. >> she was a nice teacher. >> reporter: the boston red sox also honored ritzer with a moment of silence before last night's world series game at fenway. 14-year-old philip chism who recently moved to the area from tennessee has been charged with her murder. the criminal complaint says he was arrested after being interviewed and based on video surveillance footage recovered at the school.

no motive has been given. >> she was always making everyone else's day better than hers. >> reporter: ritzer's personality shined through on her twitter page describing herself as a math teacher often too excited about the topics. >> to be taken so tragically is awful. >> reporter: just out of college and attending grad school, she still lived with her parents in andover. her hopes for the future shown on pinterest. to have a daughter and name her after my grandmother. >> she made such a big impact on so many children's lives. >> reporter: from boston area poet ralph waldo emerson, to know one life has breathed easier because you have lived. it was after the grief and

emotion here, hundreds of people expressing their feelings about this beloved teacher. as for the student facing murder, he's being treated as an adult. >> all right. ron allen in massachusetts on this story this morning. thank you very much. >> three of colleen ritzer's closest friends are with us right here. good morning to all of you. >> good morning. >> this is such a sad story. the more we learn about colleen, the more we know the world has lost a really wonderful person. you've known her since kindergarten, jennifer. what would you want people to know about her? >> i just want people to know how special of a person she was. she was my best friend in the whole world. and knowing her made my life so much better. she made everyone's life better. >> dan, this is such a shock. had you ever heard her talk about any problems with a

student at school, any worries at school? >> no. you know, of everyone i've ever known in my life, she is the last person i would think something like this could happen to. every report and every story you read about how kind and gentle and caring she was was absolutely true. it wasn't just painting a picture. that's who colleen was. and it broke my heart to know that this was -- that this could happen to her of all people. >> meredith, i know you've known her since high school. we're learning she was an extraordinary dedicated and energetic teacher. was this something she always wanted to do? >> yes. i remember high school always when we were going through college applications and deciding which schools we wanted to apply to, she knew from day one she wanted to be a teacher. she wanted to go to assumption

college. she was such an inspirational person. >> we're learning more and more about your friend by looking at some of the things she posted on social media. she seemed to have a wisdom beyond her years. she wrote being good to people is a wonderful legacy to leave behind. was she the kind of girl that liked to reflect? >> oh, definitely. i mean, i don't think she ever found a quote she didn't like and didn't want to share with people. she was that person. she wanted not just to have that positivity for herself and for people closest to her, but she wanted to share that with as many people she could. >> and jennifer, she had posted this bucket list online. it just breaks your heart to read. she wanted to experience christmas in newark, throw a dart at a map and travel there, marry the love of my life and name my daughter after my grandmother. she seemed to really savor life.

massive document leak from former national security adviser edward snowden, of course. now putting the white house in an awkward position. the white house is waking up this morning to another ally angry over u.s. spying. courtesy once again of edward snowden. >> people all over the world are realizing these programs don't make us more safe. >> reporter: overnight the german foreign minister addressed claims that the u.s. monitored calls of angela merkel who called president obama on wednesday asking for an explanation. >> united states is monitoring and will not monitor communications with chancellor. >> reporter: germany is not alone in its concern. on monday the president made his own call to the french president after it was reported 70 million phone calls from its citizens were collected by the u.s. spy agency. and angrily lashed out

suggesting the nsa hacked the personal e-mail account of the former mexican president. even the brazilian president said she was postponed trips to the u.s. after it was reported the u.s. spied on her. we just checked in that meeting, it's expected to take place later this afternoon. the white house insists it will not monitor merkel's calls but did not say they were never monitored in the past. >> all right. peter al exander at the white house. thank you very much. hard to believe and a scary situation now. a boy in jail now on attempted murder charges when police say he showed up with 400 rounds of ammunition. a vancouver middle school was put into lockdown when they found the ammunition with multiple knives. the 11-year-old is scheduled to go before a judge later today.

the attorney for jailed kennedy cousin skakel was granted a new trial for the murder. his trial lawyer did not adequately represent him when he was convicted in 2002. we'll have an interview with robert kennedy jr. live coming up a little bit later on this morning. big problems in florida overnight after some passengers waiting for a spirit airlines flight became unruly. mark potter is there to tell us what happened. >> reporter: good morning. passengers were furious here at the fort lauderdale international airport complaining that spirit airlines grounded them overnight. at least four flights were delayed all night long here. another nine this morning. spirit airlines issued a statement saying following the engine failure on one of our

aircraft last week and reviews maintenance procedures, we are completing a proactive and voluntary check on our aircraft engines overnight as a precautionary measure. they went on to apologize for delays that forced passengers to sleep at the airport last night. >> thanks so much. the house energy and commerce committee will hold a hearing about the new health care website. it's had several technical issues since its launched. many people have not been able up for the health insurance exchanges. they have announced a major effort to fix the site. meanwhile the february deadline is now being pushed back by as much as six weeks. it was an historic day in london wednesday. prince george was crihristechri. only 22 guests were invited. only the second public appearance since his birth. game one of the world series is in the books now.

this one went to the boston red sox. but it was a play in the second inning that has everyone talking this morning. david ortiz hit that ball deep into right field off adam wainwright. it looked like it was gone, but beltran made that big catch. he ended up hurting his ribs, but later ortiz would get his revenge getting a big home run in the seventh inning. boston wins this one 8-1. big papi delivering there. now just one week to go before halloween. there's a costume getting a lot of buzz on the internet. this was made from l. e.d. lights. they made it for their daughter. this video has more than a million hits on youtube. he says he plans to put together a video on how to build one. that is amazing. parents all over the country are like don't do that.

first, katie has the details. >> reporter: good morning, matt. michael skakel has been in jail for ten years following his conviction. since then, he has appealed the decision. now, a judge ruled if his favor. meaning he could get out of jail in a matter of days. in the decision, the judge threw out his conviction on the grounds his defense attorney at the time was constitutionally deficient, writing the defense of a serious felony prosecution requires attention to detail, an energetic investigation and a coherent plan of defense executed. the trial counsel's failures in each of these areas of representation were significant and, ultimately, fatal to a constitutionally adequate defense. >> this is the most devastating critique of a trial lawyer i have ever read t. court said nicky sherman handled everything

wrong in this trial. >> 15-year-old martha moxley was beaten to death with a golf club. once reopened in the '90s, the case centered around moxley's next door neighbor and member of the kennedy family. in his latest ahearing, skakel argued his former lawyer was less focused on the defense and more focused on getting himself on tv. >> he said he was a media wrore. >> in a statement to nbc news, he wrote, i have always believed in michael skakel's innocence and am very happy that he will see freedom after all of these years. speaking by intercom at her home, martha moxley's mother could not disagree more. >> if there is a new trial, i have always felt as i have always felt, michael skakel is very, very guilty. so i know he is. >> reporter: the state appeal

figure decision. in the meantime, skakel could be released on bail potentially as early as tomorrow. his attorney plans to file a motion on that today. it remains to be seen whether the state will go forward with another frooil trial if their appeal is not granted. >> katie, thank you very much. robert f. kennedy, jr. has long maintained his cousin's innocence. he is with us now from san francisco. good to see you. >> good morning, thanks, for having me. >> a lot of people are stunned. a lot of defendants have tried to get convictions overturned based on the incompetence of the defense attorney. it almost never works. what is your reaction to this rule something. >> we are thrilled with the ruling and i think that judge bishop was right. he wrote a very long, lengthy opinion which, and he is a very respected judge. michael skakel is innocent. michael skakel is 11 miles away with five eyewitnesses when this

mour this murder occurred. one problem is his crime is he had very, very poor representation and nicky, unfortunately, did not call those witness, that's one mistake. another critical mistang. he made many, many others, one critical mistake is that one witness against michael who said that michael had confessed to him was a man named gregory coleman two actually died of a heroin overdose before trial. he claimed in the evidentiary hearing that there were three witnesses at the time that michael confessed. nicky sherman never bothered to call those people or to make any efforts to find them when michael's new attorneys, his appeal attorneys tried to find them. they found them within two days and all three of them said that what gregory coleman said was a

total lie, that gregory coleman was a pathological liar and he was a heroin addict and that he was, that the only reason that he was saying, making these statements was to collect the award. >> robert, you have long held that your cousin is innocent. you wrote a lengthy article the year after his conviction. you have been asked over the years, many times, are you doing this simply bus of family ties and your answer to that is absolutely not. you said many people ask me why i would publicly defend him to enhance my representation. i am certain he is innocent. this ruling, of course, leaves us with the question, if your cousin is innocent, who killed martha moxley? >> well, that is a good question and there were at the time of the trial many suspects, but sense i wrote that article following that article, i was

approached by somebody who asked me to call a man named tobiy bryant, who is the cousin of basketball player kobe broivenlt when i tauld toby bryant. he said to me in florida, he said i have been waiting for this call for 27 years. and he told me that he had been there the night that martha moxley was could and he brought with him from new york city two boys who were gangster-type kids, one of them was very, very big. >> let me just say in fairness, robert, in october of that year, a supreme court judge denied request for a new trial saying, in part the testimony of this man you are talking about was not credible. >> well, he never heard the testimony of that man. there were many, many appeals and i think that the rulings in those appeals were probably

wrong, but, you know, the justice system once there is a conviction is very, very reluctant to reverse that conviction. there is a huge barrier to reversing a conviction in a jury trial in which so much work has been done to achieve that convex. in this case, the initial conviction was wrong and it was wrong because michael had a -- had very, very poor representation and as judge bishop outlines in 136 page opinion, those are just two of the many mistakes. >> let's end on something es you wrote in that article, michael skakel me cousin, helped me get sobener 1983, we attended hundreds of alcohol recovery meeting itself together, in that context and others, we shared our deepest feelings, i sometimes spend two or three

weekends in his company, like everyone else that knows him, i love him. if he were guilty i would have testified against him. he is not. do you think he would eventually be freed in this case? >> i know if he gets into the trial, he will definitely be freed. he should have been freed in the first trial t. evidence against him and the police work. it was just, there was no credible evidence against him that couldn't have been challenged by much stronger evidence and if he gets another trial, he's got good lawyers now. there is no way in the world he will be convicted. >> robert f. kennedy, jr. nice to see you. thanks, for your time, i appreciate it. >> i can't imagine this case continues more than three decades after she died. this happened in 1975 in greenwich, connecticut. i graduated high school in 1975 and knew some of the people involved here. this was a major story. it continues today.

then we've got a one-armed basketball star taking his game to a very unexpected place. but first, his stunning confession made headlines all across the country. today matthew cordle is beginning his first day of his prison sentence. we're going to talk to him in a moment, first details of his sentencing day. >> it should have been me that night, the guilty party, instead of an innocent man. >> reporter: matthew cordle in court talking about the night he killed vincent canzani. cordle was speeding, drunk, driving the wrong way. the regret he expressed in court the echo of an emotional video he posted online last month. >> when i get charged i'll plead guilty and take full responsibility for everything i've done to vince and his family. >> reporter: that video was viewed more than 2 million times and the judge played it in court during cordle's sentencing hearing. but the victim's daughter spoke out calling the video

have so many different opinions on it. everyone is entitled to their opinion. i was actually being investigated for it. the video was not meant to be a confession. it was meant to prevent drinking and driving and hopefully prevent the senseless loss of lives. >> but it wasn't an apparent attempt to try to get a lighter sentence? >> no, i believe any lawyers including my own will tell you that abandoning your defense and pleading guilty is not a way to get a lighter sentence. >> let me talk to you about what mr. canzani's daughter angela said before you were sentenced. she said 8 1/2 years is nothing. when you get out of jail, you'll have your whole life ahead of you and he'll never get his life back. what was it like to stand in court and hear those words? >> heartbreaking because every word she said is true. in the scheme of things, 2 to 8 years is nothing for taking someone's life. you know, he won't have any years left.

a 78-year-old bicyclist was hit and killed by the bus on friday. the chronicle reports the bus did not have a "people camper" in front of its rear tires. the plastic bumper-like device is designed to push people who fall under the bus out of the path of its wheels. the bus did have the mounting equipment for the guard, but it's still unclear exactly why the people catcher was missing. we'll take a look at the forecast and traffic after the break.

lopez. investigators say deputies thought he was carrying a real assault rifle when, in fact, it was a replica. witnesses say they heard at least one of the deputies ask lopez twice to put down his weapon. only one of the deputies shot the boy, firing his weapon seven times. lopez died at the scene. the investigation is being handled by the santa rosa police department. this morning livermore police are on the lookout for this white gmc pickup truck. they say this truck was involved in a hit-and-run crash yesterday morning at the intersection of second and south l streets. the driver of the pickup just took off. no one was hurt. police say the truck will likely have significant damage on the passenger side and also the right brake light is said to be out. if you are wondering when all this -- these clouds are going to clear, let's check the forecast with meteorologist christine loren. >> hey, thank you, marla. we have fog lingering out there. low clouds kind of hovering around most of the bay area. that will be the case. we're expecting clearing, though, between about 11:00 a.m. and 1:00 p.m.
