we can tell you occupy protesters gathering in oakland today holding the rally marking two years since their movement officially started. christie smith is live by the oakland marriott hotel with the warning the city is issuing out to residents. good morning. >> reporter: good morning to you. yes, they are issuing that morning because at 9:00 this morning when protesters plan to start gathering and protesting touds marriott hotel in downtown oakland. they are doing this because at the same time thousands of police officers from across the country are going to be here for a three-day training exercise. and inside that includes about 100 vendors marketing weapons, all of this on the second anniversary of the eviction of the occupy oakland campers out in front of the plaza at city hall about three blocks from where we are. the city administrator put out notice that although they don't anticipate trouble they are preparing for it. urban shield is designed to prepare first responders to

handle terrorist attacks and disasters but some demonstrators say it promotes the militarization of local neighborhoods, during the occupy movement there were a number of violent clashes that went on with police, businesses were vandalized downtown, there was tear gassing. some of the suggestions from the city, keep businesses well lit, turn on surveillance cameras, cover your door gaps with steel plates and leave the cash drawer empty. this is good advice any time of day. organizers say they hope not to have a repeat of the clashes two years ago but say they certainly won't back down to the threat of police violence if they see it. live in oakland, "today in the bay." >> thank you. two people are dead this morning on the peninsula after being hit by an out-of-control driver, this happened just before 7:00 last night near the corner of chilco street and constitution drive not far from bay front

expressway. police say the driver was taken to the hospital for her injuries and could face charges. bob, good morning. >> reporter: good morning to you. menlo park police tell us they have arrested marjorie reitzell on two counts of felony dui and also two counts of gross vehicular manslaughter while intoxicated. this is the scene, part of the mess she allegedly caused. for allegedly running over and killing a man and woman out walking their dog last night. this happened just before 7:00 in the evening on thursday, officers say a man and woman in their 50s were walking their dog on chilco west of constitution when reitzell's car allegedly hit and killed them. the police are looking into how fast she was driving but believe the pair did not see her coming. >> the vehicle came up behind them eastbound, struck them both, launching them in the air and killing them.

>> reporter: reitzell's car then allegedly jumped the center divide, hit another car, traveling in the opposite direction before upping to a stop. the four people in that car were not hurt. police tell us that reitzell complained of pain before being taken to stanford hospital. they could tell she had been drinking. tests on her blood will take a few weeks to confirm that. she will be booked in a jail once she is released from the hospital. there has been no i.d. on the man and woman and what their relationship was to each other. their dog did survive with minor injuries and is in the care of the humane society. reporting live in menlo park, bob redell, "today in the bay." >> it's 5:04. san jose police are looking for a hit-and-run driver that allegedly struck joel holgen jr. he died from his injuries a few days later. police are looking for a car which has a broken front window

and front end damage. >> another protest for the santa rosa boy shot and kill bid a sonoma county deputy will take place outside santa rosa city hall. last night hundreds of protesters marched to the growing memorial where andy lopez was killed. the 13-year-old was fatally shot tuesday by a sheriff's deputy who thought the replica ak-47 he was carrying was real. now the autopsy report shows lopez was hit by gunfire seven times. lieutenant henry says, quote, it's believed the deputy fired eight shots within ten seconds. the protest is planned for next week. the mexican consulate has hired a private agency to investigate. they were taking pictures yesterday. nbc bay area learned the agency is the same one hired bay los angeles family in 2010 when a 13-year-old named ryan gomez was shot by a los angeles police officer, in that case gomez was playing cops and robbers with

his friends outside his apartment building. police shot him thinking the replica firearm he was carrying was real. gomez was paralyzed. last year a jury awarded him $24 million. >> a subcontractor at the levi stadium project is in jail. police arrested the supervisor at the site. he stands accused of grand theft and two counts of burglary. police say he stole from his employer cupertino electric hired to work on the stadium. investigators at this point do not think he stole from the stadium construction site itself but they are looking into that case. >> b.a.r.t. unions are set to vote on a tentative agreement next friday. we're learning more about the details. if approved the bathrooms at b.a.r.t.'s 12 underground stations might reopen. these have been closed to riders for security reasons since the september 11 terror attacks.

again, the deal must be approved by union members. >> a high school staple and a classic fundraiser could be gone from the south bay for good. according to the "mercury news" san jose's environmental services department has banned lincoln high school students from holding those car washes in the hoover middle skoochool's parking lot. the water discharge laws, soapy water flows into the storm drain. the paper says the department told the school it was welcome to have the car washes on grass or gravel but the cheerleaders sent out an e-mail, school supporters saying they had to cancel all future car washes. >> that is a shame. how many did you do? >> a ton of them. i love going to them. good way to get car cleaned and raise money for the kids. >> the weekend is here, and it's going to be relatively nice. >> yeah, good time to wash your car by hand. we're not expecting significant charges for rain in the near

future. good morning to you. i want to start with this live picture. this is the bay bridge which you can actually see from top to bottom this morning, a great sign. we have low clouds but we don't have fog to report in this immediate area. fog is a low cloud that touches the ground so we're not seeing reduced visibilities near where we were this time yesterday. you will notice everything the shading where the low clouds are starting to settle in. all the way to santa rosa and san francisco. we're mostly clear even in san jose. we have light know cloud cover to start the day. throughout the morning temperatures are going to be comfortable by lunch time around 72, 78 degrees in the heat of the day, 74 bay side and 69 degrees at the coast with a big bay area weekend ahead. a lot happening here. we'll take through some of the events, maybe get your mind going, help you make plans. first, work for the weekend. here is mike. >> a lot of folks starting to work toward the fremont truck scales. so as those open for business we

here's a story about what guys with a lot of money like to do. billionaire carl icahn making netflix the center after bet with his son. you might remember earlier icahn sold his 10% in netflix for $800 million. yahoo! finance reporting that his son brett thinks the company has more to offer. brett managed a portfolio in the company and based on the argument the elder icahn has

altered his agreement. a gentleman's agreement with his son. if the netflix continues to grow through 2016, brett stands to gain the profits, if it fails, he will lose that money. >> twitter may hit the stock market as soon as november 7. scott, the first step is for the company to hit the road. >> the road show. that starts today when twitter executives go around essentially selling big investors on the idea of twitter, the way that salesmen used to sell encyclopedias. those will be the initial buyers of twitter. that's the initial public offering or ipo that should happen november 6. then we should see the shares hit the market the next day. the big question is price. if twitter goes door to door asking too high a price the buyers may balling and then like facebook have to lower their price and that's embarrassing. so twitter is reportedly looking at a slightly lower price than

he opened fire barely missing the officers. police say the gunman let the hostage goes before surrendering. also in north carolina a total of five people hurt, two seriously overnight after a carnival ride at the state fair malfunctioned. you can see the ride inspectors there trying to figure out why it started up again after riders were getting off. witnesses report hearing a crashing sound just before seeing the people lying on the floor. the injuries -- thod fired are between the age of 14 to 39. among them is the operator who was helping people offload. >> demolition continue tons connecticut elementary school that was caught in a deadly shooting rampage. workers are removing sandy hook elementary piece by piece and it could take several weeks. new town officials say a

wrecking ball will not be used to make sure every piece is accounted for to deversa venger hunters. sandy hook was the scene of the shooting massacre where a gunman killed 20 children and six adults. >> the national park service wants to honor with a new state park. the chavez park will stretch from arizona to the san joaquin valley and include the cesar chavez national monument in keen california along with 58 in kern county. the park unlike the monument would need congressional action where others are still awaiting approval. park officials, they estimate it will cost 1 to $3 million per year to run the park. >> the niners continue their

>> reporter: good morning to you, marla. this is where that suspected drunk driver's path of destruction ended, through these trees into the edge of that parking lot there when menlo park police found marjorie reitzell in her wrecked car they say they could tell she had been drinking. as a result they arrested this 54-year-old woman on two charges of gross vehicular manslaughter while intoxicated and two more charges of felony dui. p.d. tell us she was driving down chilco last night when she allegedly ran down a man and woman both in their 50s, who were out walking their dog. both they tell us were hit from behind, launched into the air and police believe killed instantly. if you are not familiar with this road it's commercial, it's a commercial area, there are no sidewalks, just bike lanes which is where the pair had been walking. reitzell then allegedly hit the center divide, crossed over into oncoming traffic, hit a car,

none of the four people in that vehicle were hurt, then police say reitzell's car came to a rest here. she will be booked into jail once she is released from the hospital where she is being treated. police have not identified the man and woman killed. as far as the dog is concerned, the humane society is taking care of the animal who suffered slight injuries. reporting live in menlo park, bob redell, "today in the bay." >> a protest for today in santa rosa as anger continues over the killing of 13-year-old andy lopez. people gathering at noon before marching over to the sheriff's office. lopez was shot seven times by a sonoma county sheriff's deputy. the deputy thought the replica ak-47 a toy gun that lopez was carrying, the deputy thought it was real. protesters taking to the streets, many of them ended up at a growing memorial at the location where lopez was killed.

day here at 9:00 this morning. this is on 11th and broadway, the marriott hotel where this training is happening. what upset some of these demonstrators is at least 100 vendors will be here showing off the latest technology in weapons. demonstrator who is plan to rally at the plaza three blocks away this evening. they are arguing that the weapons symbolize urban shield training and trent militarization and contribute to the violent clashes before when campers were ejected two years ago. there was vandalism and violence in the street, tear gas, windows busted. the city's message now, get ready. keep businesses well lit, turn on surveillance cameras, cover door gaps with a steel plate and leave the cash drawer empty. given how protests have turned

out in the past, they will assign extra police officers downtown. they are mandating overtime and say they are ready. christie smith, "today in the bay." >> 5:36. families and sur vivgers of the deadly fire on the san mateo bridge filing a wrongful death and personal injury law suit. nine women were on the way to a wedding celebration when the limo burst into flames, five of them died in the fire. four others survived. in august, investigators determine the fire began when the rear suspension failed. the family attorney says the open responsible for modification and maintenance of the limousine were at fault. they are going after the limo manufacturer, operator and limo repair company. >> california's secretary of agriculture sending a team out to help deal with a fruit fly problem in the south bay that will be happening today. two oriental flies were trapped

good morning. it's 5:41. whistle-blower ed snowden has again put the obama administration on defense after a new report that accuses the u.s. of mass government snooping. but this time it's on our allies. tracie potts is live on capitol hill with more on these allegations and also the protest plan forward this weekend. good morning. >> reporter: hi, good morning. it's that protest that has some here in washington wondering if this is ever going to go away, the group is called stop watching us and they are coming to talk today to lawmakers and tomorrow to demonstrate here on the national mall, trying to get lawmakers to take another look at how much power the nsa has to collect information of ordinary americans. but it's that report in the guardian newspaper that you referred to that has the white house on defense now. the report says that the u.s. snooped on the phone calls of at least 35 world leaders, germany, mexico, a number of european nations very upset by this.

the response from the white house is like every other country, our intelligence authorities spy on other countries, collect information, gather foreign intelligence when it's related to the u.s. but they are not giving specifics about any reports like the one in the guardian. >> thank you so much. today we could get some idea of what led to the indictment against john and patsy ramsey in the death of their young daughter jonbenet and why it never went anywhere. the indictment will be released in response to a lawsuit file bid a boulder daily camera reporter and the group reporters committee for freedom of the press. the indictment has been sealed since back in 1999. john ramsey objected but a judge ruled for the release. the couple was suspected of killing their 6-year-old daughter in 1996. but no charges were filed.

>> a homeless man in san francisco trying to get his chihuahua back. he was accused, jailed and then acquitted on animal abuse charges. but he now faces an uphill battle. while he was in jail his dog was adopted by the man who accused him of abusing it in the first place. morris variousian is the ban on the left in the dark jacket. that's his economy wau wau aubrey. the guard called the police claiming that verian threw the dog against a wall. he was arrested and charged. verian says he was carrying the dog and some of his belongings in a plastic bag. the dog jumped out into traffic and was scooped up. he says what the security guard thought was abuse was verian scolding the dog for running off. people made assumptions about her client that weren't true. >> the key thing i think he was stereotyped. mr. verian as you'll see had aubrey in a plastic bag.

we have a really beautiful forecast headed our way. even if you have been concerned about the fog, it's not going to stick around. as of this morning it's sliced in half from what we had to deal with yesterday. the day before that was even worse, but this morning we've got visibilities down to a half mile in santa rosa, elsewhere we're above one mile. that's san jose. you can see low cloud covering but nothing too heavy yet. we're going to watch that. 68 degrees in san francisco. 71 degrees in redwood city. you'll hit room temperature at 72 degrees later on. 78 for livermore and 77 degrees in gilroy. i can tell you now next squeak looking a lot cooler. so if you want to make the outdoor plans we're getting into that time of year where our days get shorter and temperatures start to cool off. if you want to hit tahoe this is what we're talking about. jon kelley knows he's got this number. 62 on saturday. 61 on sunday. we're going to see a chance for snow in tahoe come monday so. that gives you an indication.

things have sorted out. this is what we expect. the tri-valley slowing both directions for 580 toward the dublin interchange. a wrong way driver reported to chp eastbound at isabelle but no further updates so we're going to track this. no activity for about 10 minutes. we don't want problems with the freeways through the area. a little build down out of castro valley y, oakland watch that 6:00 concert start. about 4 to 5:00 a lot of crowds heading to the area. we'll get a look at the bay bridge toll plaza. the cash lanes starting a few cars for those wait. >> 5:48. officials will talk about a possible toll increase at the golden gate bridge. the golden gate bridge highway and transportation district has to figure out a way to erase $142 million deficit over the next five years. one of the things the board is

looking at is making it more expensive to cross the bridge. likely increasing the toll by $1. it cost $5 for fast track and $6 for everyone else. that's more than any other bridge in the bay area. >> sharks defenseman dan boyle still on injured reserve. he is talking about the day he took that big time nasty hit. boyle says at this point he is not ready to forgive max lapierre for that cheap shot back on october 15. boyle says lapierre did leave him a message on his phone but he did not take the call. he tells the "mercury news" he remembers the start of the game and warm-ups, but he does not remember the game, that hit or being carried off the ice. he started to get his memory back in the ambulance. boyl he did practice with the sharks yesterday but at this point there is no word on when he will return to play a game.
