to a start. >> it sounded like a bunch of stuff hitting medal. >> reporter: scary moments for riders on the vortex in north carolina. police say at least five passengers were injured when the ride suddenly restarted. >> the ride had stopped and they were fixing to off load when it started off again. >> reporter: this is the first time this vortex ride has been at the state fair, seen here in a clip on youtube prior to last night's accident. rides are supposed to be checked three times a day and those inspections will now get a second look. >> they'll be looking at the diagnostics, all the safety systems and any piece of that ride to determine if it was, indeed, a malfunction of the ride. >> reporter: federal records show the incident happened 11 years to the day since a worker was killed by a ride at this fair. the victims who range in age from 14 to 39 were being treated at the wakemed medical campus in

raleigh. >> we'll do everything to make it safe so the families can come. >> reporter: two of the victims were released from the hospital this morning. the fair itself will open as scheduled. investigators try to figure out whether this was a mechanical or human error that caused the accident. savannah, carson, back to you. >> chris, thank you very much. the investigation into the murder of a beloved massachusetts teacher is ramping up this morning as her high school reopens. nbc's ron allen is there. ron, good morning. >> reporter: good morning to you, school is back in session. a town in mourning. but it's also a community determined to move on for the teacher they loss. that's why just a few days after the death of colleen ritzer, high school students here are going back to school. over a thousand parents arrived last night for a community

meeting in the school that's the scene of an unspeakable crime. >> it's hard for these kids knowing they were so close to a murder. >> reporter: many left feeling reassured. >> they talked about security and being there to support the kids. they're doing a fantastic job. >> reporter: just wednesday, police found the body of 24-year-old colleen ritzer in the woods near the school and charged 14-year-old philip chism with murder. he has pleaded not guilty. students say that day he asked ritzer to meet with him after class. >> she was smiling at me and he was staring at me. >> reporter: an nbc affiliate showed security cameras captured ritzer following her in the bathroom and exiting with blood on his clothes and he wheeled the body outside in a recycling bin and covered it with leaves. when police took him into custody he reportedly had ritzer's i.d. and used her credit card at a wendy's. in tennessee where they moved to

danvers from last summer, a former soccer coach said he never would have expected a quiet kid who loved to play the game so much to commit such a heinous crime. >> it makes no sense. i don't understand it. it certainly doesn't sound like him. but, who knows? i don't know if there's going to be a good answer of why. >> reporter: while back in danvers the community takes a huge step forward. >> we'll never recover from the loss of colleen but we want to get this community and this school back to some sort of normally. >> reporter: police said the bathroom, the crime scene where the teacher's blood, will remain sealed indefinitely. no word on what will happen to her classroom which we understand is just across the hall. savannah, carson. >> thank you very much. let's turn to natalie following a story of americans taken hostage by pirates. >> once again. that's right. two americans are at the center of drama on the high seas. they have been kidnapped by pirates off the coast of

nigeria. jim is at the pentagon with the very latest. >> reporter: good morning, natalie. there's no word on the condition or whereabouts of those two americans. their identities have not been released but the fact that their ship was flying an american flag made them an all too tempting target for pirates. in a brazen attack, pirates kidnapped the two americans off this u.s. flag ship, the c-retriever. they easily boarded the ship and then methodically singled out the americans, the u.s. captain and chief engineer and took them ashore as hostages. it all happened in the gulf of guinea off nigeria with a steady stream of cargo ships it's a prime hunting ground for pirates. the most memorable pirate attack on an american is now a hit movie. captain richard phillips was kidnapped by somali pirates

and held hostage for five days at seas before he was rescued by navy s.e.a.l.s but he worries the nigerian pirates hold a bigger threat. >> they'll usually bring them ashore and hide them so no rescue attempt can be made. you have to understand, it's dangerous out in the gulf of guinea. >> reporter: acts of piracy have decreased across the rest of the world but off the coast of nigeria they skyrocketed over 30% this year. >> this is not a hollywood movie plot. they threaten our economic security and put innocent lives at risk. >> reporter: defense officials here tell us that at this point it appears that it's highly unlikely there will be any kind of u.s. military rescue attempt and the way this worked almost all the times in the past, a ransom is paid and hostages are released and the shipping company writes it off as the cost of doing business but that

makes it no less terrifying for the hostages and their families. >> jim, thank you. there were some tense moments on capitol hill thursday during a congressional hearing over the troubled obama care website. they were grilled by lawmakers and they acknowledged their frustrations but things got even more heated when the new jersey congressman, a democrat, said republicans were trying to scare people to prevent them from enrolling in the program. take a listen to the following exchange. >> once again here we have my republican colleagues trying to scare everybody -- >> will the gentleman yield? >> no, i will not yield to this monkey court. or whatever this thing is. >> this is not a monkey court. >> i'm not yielding. >> meantime, contractors say that high user volumes and late changes my federal overseers contributed to the problem. we're getting our first look at the most adorable photos of prince george's christening in london. take a look at them.

pain? >> it's not going to be a problem but women can be seen by multiple doctors getting the drugs and they're highly addictive and abused. they're looking for those that need them for long-term pain and those that use them and abuse them. right now the fda has been urged by the drug enforcement agency to make these tighter because it's so easy to get them and the fda has held off. but i expect now with the blessing of hhs, they are going to absolutely put in the new criteria which means right now you can get six prescriptions within a six-month span. they're not going to say no. you have to see your doctor every three months. right now i can call in a prescription to a pharmacy. from now on, you will have to have a written prescription to prove it's for you. >> but do you think the new rules will cut down on abuse? >> that's been the problem. they said no, it's going to put

the burden on the patient that need it and may not cut down. but last year over 450,000 emergency room visits for overdoses on this. it's the hydrocodone part. and the problem is they're really good medicines but they're also sort of stupid medicines to get addicted to because the one thing they do for anybody that's ever been on them after surgery is they make you constipated. so, i know that seems like a silly little thing. but you have a bowel system that doesn't work and you're addicted to these drugs. they're tough to get off. i don't think it's if it will happen. it's when it will happen. the fda will push this one through. >> thank you. the attorney general of maryland finds himself at the center of a controversy. a photo has emerged that shows him at a house party where underage drinking was taking place. pete williams picks up the story from there. pete, good morning to you. >> reporter: savannah, good

morning. this has become an issue not just because he is running for governor but he is also state attorney general and underage drinking is illegal. he now says perhaps he should have done more. there in the middle of what was apparently a party for recent high school graduates stands doug gantzler holding a cell phone reading a text message. he said he stopped by the beach house to tell his 19-year-old son about plans for the next day and although the party last june was in bethany beach, delaware, he said he should have done more than simply leave. >> perhaps i should have assumed there was drinking going on and i got that wrong. what i can tell you was that at no time while i was in the house did i see any teenager in any danger or any risk. >> reporter: gansler told the baltimore sun he didn't stop the party because he had no moral authority over other people's

children. some of the young people at the party say underaged drinking was going on. gansler says he doesn't know. >> there could be kool-aid but probably beer. >> reporter: the minimum drinking age is 21 including for wine and beer. he says gansler had a obligation to shut the party down. >> the fact that he would find himself in the middle and actually support an underage drinking party was law because it's breaking the law. >> reporter: it's especially embarrassing for gansler who lead campaigns against underaged drinking. >> it's never too early to talk to your kids about smart ways to say no. >> reporter: the incident touched off a national conversation. should parents control or prevent teen drinking. >> a third of the audience said the drinking is going to take place and the kids are better served meaning they're safer if there's parental involvement. >> reporter: gansler says the organizers of the party kept it inside the rented beach house

with adult chaperones on hand and he says, how much do you let them go? how much do you reign them in? savannah. >> pete williams in washington, thank you so much. now, to a revelation on concussions from one of football's biggest stars. craig melvin has details. >> good morning. brett farve is now joining in on the concussion discussion. he says he is already feeling the effects after playing the game for half his life. >> i think after 20 years, god only knows the toll. >> reporter: nfl great and former green bay packers quarterback brett farve doing an interview thursday admitting hits like this, the last one of his career, are part of the reason he won't play again. farve was knocked out. now, the 44-year-old grandfather worries about lasting effects. >> this was a little shocking to me that i couldn't remember my

daughter playing youth soccer. >> when a former quarterback comes forward and says i can't remember one of the summers where my daughter plays soccer and links that to his playing career, i think people listen. >> head injury leads to permanent problems with people. if their kid is going out and doing these things, they have very well-educated coaches. >> reporter: in august, in nfl and thousands of former players that sued the league for concussion damages reached a $765 million settlement. players claimed the league withheld the information it knew about the risks of head injuries in the game. >> the players, either retired or some of the few players who are either killing themselves or self-destructing, you know, studies have proven that some of this is because of concussions. >> reporter: a future hall-of-famer adding his voice to the chorus of parents and players questioning the long lasting effects of concussions. during that same interview,

the tragedy. >> and pirates have seized two americans off a commercial ship in nigeria's coast. and the trial of a doctor accused of killing his wife. the man's daughter on the stand against her father and why she says his behavior after her mom's death made her sick. >> and paul mccartney on why he's burying the hatchet with yoko ono after so many years. first, the death of jonbenet ramsey. an indictment against her parents is being released today. here is mike taibbi with the story. >> reporter: it was a crime that scraped a national nerve. a 6-year-old beauty queen named jonbenet found murdered in her home at christmas. her parents john and patsy ramsey were immediate suspects.

but after an investigation, the d.a. said there was no case against anyone. >> if we do not have sufficient evidence to warrant the filing of charges against anyone. >> reporter: it turns out that garage had a motive to indict john and patsy ramsey for what happened in this house. signing off on a felony charge of child abuse resulting in death. craig silver man followed the case from the beginning. >> the boulder prosecutor, he misled the public. we were lead to believe that either the grand jury did not indict or were never asked to even vote. >> reporter: john and patsy ramsey proclaimed their innocence. >> i didn't kill my daughter. >> i didn't have anything to do with it. >> reporter: two years after patsy died in 2006, the district attorneys office exonerated both of them, saying new evidence pointed to an unknown male suspect. but reports filed suit about the public's right to know about the long ago indictment. >> one of the grand jurors said to me, with we know that both parents were in the house.

we know that something happened. >> reporter: while ramsey's attorney says release of unprosecuted indictment will only further defame ramsey and his late wife, the judge ruled it will be made public. >> the people of colorado need to know what happened. >> reporter: a notorious crime still making waves, still unsolved. for "today," mike taibbi, nbc news, boulder, colorado. >> let's get more on this from legal analyst, lisa bloom, who has followed this case for years. as we all have. good morning to you. >> good morning. >> you say we should look at this as more of a historical document. it bears repeating that they were exonerated in 2008. the ramseys were exonerated in 2008. now we will see an indictment that was never filed against them. what do you make of this? we se >> lawyers like to say a grand jury will indict a ham sandwich. it's a one sided procedure. the defense doesn't put on a

defense at all. ordinarily they do return an indictment but the district attorney said there isn't sufficient evidence to prosecute them. >> here's what i don't get. we all know that the grand jury will indict who ever. they're a tool of the prosecutors. that's the criticism. explain why they would present evidence against the ramseys in this grand jury and get it and not file it? >> they often look at it as an investigative tool. so all the witnesses come and testify and they review all the evidence as part of the investigation. but the district attorney did his own determination a but the district attorney did his own determination at the time after looking at all of the evidence. you know what, it's not there against these two. >> and in 2008 they exonerated the parents writing no innocent person should have to endure such an extensive trial in the court of public within. the ramsey's say it's unfair to release this now.

mississippi. as her health declined a heartless criminal moved in targeting her. >> it made me feel sick at my stomach. it didn't hit me that someone would be so low as to steal from a vulnerable adult. >> reporter: who was stealing from her? this woman, lee martin. the nursing home's bookkeeper in charge of the patients' trust accounts. martin was secretly raiding their money. >> in that three month period there were 12 or 15 cash withdrawals. we knew something was wrong. >> reporter: martin stole more than $100,000 from dozens of residents and went on a shopping spree at jcpenney, the gap and american eagle. in one case buying designer jeans and expensing them to an elderly resident with no legs. >> it's enormously easy for people to get away with this. >> reporter: it happened across the country. a usa today investigation

discovered more than 100 cases prosecuted since 2010 involving thousands of residents accounts. >> there are no audit requirements. the people doing the inspections aren't looking close at the books for the trust funds. >> reporter: there's another loopho loophole. in most states, there's no background checks for administrators. he is the mississippi attorney general. >> embezzlers are going to do it again. >> lee martin, convicted of the crime can go to another state and get the same exact job at another nursing home because most states don't require criminal background checks. >> that's correct. we ought to have mandatory background checks for anybody that works at a nursing facility. >> reporter: the industry says it supports regulations and this is rare. lee martin's facility fired her and returned her to police. >> she should be home. she's on house arrest after all. >> reporter: we tracked martin down after she pled guilty.

she wouldn't talk to us but her dad did. >> why did she do it? she took advantage of these elderly, sick people that were helpless and the most vulnerable victims. >> she wasn't brought up like that. >> you didn't bring her up like that? >> no. >> reporter: the nursing home reimbursed the residents and implemented additional management controls to stop the fraud. but phyllis and leo foster say until the government cracks down at all homes, there will be more elderly victims. >> it would protect every person in the nursing home. people that can't help themselves. people that can't protect themselves. >> so how do you protect your family? here's the takeaway for you. ask the nursing home for a monthly statement you can check for yourself. that's how the fosters realized their mother was victimized. even better, request the actual receipts for any purchases made for your loved one. that way you can spot anything used shady. good news, victims often get their money back. nursing homes are required to

good morning. it's 7:56. i'm jon kelley. today marking two years since the occupy oakland movement started up in the city now gearing up for its new protest this morning. protesters, they are expected to gather outside the marriott in oakland at 9:00 to protest the urban shield disaster drill training in alameda county. at 5:00 protesters will march to oakland city hall. oakland police are expected to meet the protesters and they want the protesters to be peaceful but they are ready just in case. the city's new tools of violence law is in effect, that means they are banning hammers, spray paint, sling shots and wrenches during demonstrations and protests. the law came about in response to all of the vandalism caused by splinter groups during the occupy protests. police, they are telling business owners to be smart and very prepared.

several things wrong already. she did not wash her hands which is the key thing. wash your hands before you wash your face because you want to be sure that the germs and bacteria are off of your face. she also didn't remove her make up before. she has a full face of eye make up. >> i thought what's why you wash your face. >> you'll end up with eye make up all over your face. not washing it is probably a big issue for her. >> you're saying if somebody has make up wipes, you take off the make up and then go to the cleanser. >> that's right. especially if you're wearing mascara or a lot of foundation. you need to do that before. >> i think you're doing a great job. now, andy, we have a guy doing his face wash. do your thing. presumably guys wash their faces differently than women do. >> often they do. so -- andy is pumping out a huge amount of cleanser on to his face and he is using a product there that has things in it and

they're going to leave a film on his skin and increase the risk he's going to get irritated from the product. >> it's not more cleanser cleaner face? >> no, the more you use it doesn't make a difference. you only need about the size of a dime and if you use more than that, you'll increase the risk for irritation. >> how often should you wash your face in a day. >> some people say once a day. some people say twice a day. i'm a big believer that twice a day is a good thing. just don't use abrasive cleaners both time. >> how about his patting technique. >> patting is important. that's great. you don't want to rub or scrub your face after you washed. >> okay. >> he's doing a great job there. >> good. let's move on to miss rachel. she is using bar soap. >> she is using dove which is not a bar soap but a cleansing bar. when you use a cleansing bar, that's fine to use. rachel is washing her face and the key is she is scrubbing. some people are aggressive

all right. we are back now at 8:42 and some of the funniest comedians in the world have come together for an interesting project where they don't speak a word. it's all thanks to matt hoyle who has a new book out called comic genius, portraits of funny people. this is great. there's so many photos in it. where did the idea start from? >> i'm a celebrity photographer and i do familiar faces but the funny ones stood out to me. if i could get as many in front of my camera as possible, that's what i was going to do. >> it was like if i could just get mel brooks, if you could land somebody everybody else would come to the table. did it work like that? yeah, a lot of people go who is

going to be in this book? how many people do you you have? once we had him in it everybody said we can do it. it got easier. >> how do you work? did you come up with about a dozen ideas and go to the comedians and say here's what i'm thinking or did they come to you and say this is what i'd like to do? >> i actually did present them ideas and people said you're presenting comedians how to be funny. what are you doing? but i got lucky and presented them with ten ideas. we collaborated and got one or two ideas we thought would be good to depict the humor we wanted for the book. >> who was at the top of the list? >> the cover of the book, steve martin. >> right. >> throughout my life, from mork and mindy, robin williams and jonathan winters. i was lucky enough to get the last shoot with him and spend a morning with him and it was magic. this is a who's who of who made

me laugh. >> what did you say to steve martin? what was the creative pitch there. >> i knew he was an art collector and i said i want to do something surreal and he agreed. >> carol burnett was known on tugging on her ear. you had fun with that. >> that was her idea. she said i had my ear measured after we did the show and she said it's actually a little bit bigger. what if we extended it a little bit more and i thought okay, let's do it. that's the photo. >> some got two pictures and some got one. tina fey got two pictures. good timing. she will be hosting the golden globe with amy. >> right. it was just looking at what idea works. sometimes they only had time for one but it wasn't to do with any sort of importance or whatever. >> tell me more about the morning with jonathan winters. what was that like? >> well, he basically went through his entire life story before he, you know, let us take

the photo which was pretty magical and, you know, to hear him retell it and his facial expressions. it was an experience that, you know, that doing this book allowed me. it was magic. >> are you going to do it again? >> more funny people. >> creative genius. i want to shoot people that inspire us and do the biggest book of its kind. >> it's great. great pictures and great thought behind it. >> thank you. >> the book is called comic genius. thank you. >> thank you. >> coming up, a touching story. the football star making a big difference in the live of military families. but first, this is "today" on nbc.

korea, nam. i'm terrified of him. he can still beat me up. >> reporter: while he didn't join the military, he did join a uso tour to iraq in 2009. it changed his life. >> it changed everything for me. >> reporter: humbled by the sacrifice he knew he had to do something. he started jared allen's home for wounded warriors. >> where do i feel the safest at my weakest moment? where can i come, good day, bad day? it's your home. >> reporter: but what wounded veterans were coming home to were houses that couldn't accommodate their disabilities. he lost both his legs in iraq. >> what's going to make the biggest difference for you? >> the ability to get where i need to be and not have to worry about getting caught up on walls or corners. >> reporter: now allen's charity is retrofitting his house. >> i didn't have the funds to expand outwards. so this will become the bathroom. >> reporter: later this month homes for wounded warriors will

break ground on a new home for colin who lost his leg and, with it, his independence. >> no 22-year-old giuy that's been on their own for the last four years want to rely on mom or dad. i'll have 100% independence. it's a huge step. >> he has dreamed of a house like this ever since he could walk and honestly when he got injured we all thought that dream went away. and thanks to jared allen, the dream is going to come true. >> reporter: for allen, it's his dream coming true too. a chance to give back for all he has been given. >> we have a much bigger responsibility than just being football players in this world. >> by the end of the year he hopes to finish seven houses. the interesting thing, none of the wounded warriors thought they deserved this. they didn't think they were heros and allen doesn't think he is. i think they all are. >> they all are. >> thank you so much.

a political activist was traveling from washington yesterday. he overheard what should have been, i guess, a confidential conversation between a reporter and the former director of the nsa and cia retired general michael haden. the political activist live tweeted the whole conversation. he said i'm sitting in a public space here on the train. i heard it and he put it out on twitter. >> it was supposed to be an off the record conversation as well. but yet he is live tweeting it and of course if you're on the phone in a public place and you're revealing nsa secrets -- >> not a good idea. >> not exactly the most confidential place. >> maybe he should have sat in the quite car. >> he said listening to former nsa spy boss michael hayden give "off the record" interviews. i feel like i'm in the nsa except i'm in public. phone ringing. i think the jig s'up. maybe somebody is telling him i'm here. do i hide?

police say he stole from his employer cupertino electric, that was hired to work on the new stadium. investigators do not think stole from the stadium construction site, but they are still looking into the case. fremont police are asking for the public's help after a road rage shooting yesterday morning along interstate 680. police say one driver shot at the car -- at the other car after exiting the freeway near mission boulevard because a driver was apparently going too slowly. the victim is a 59-year-old man from pleasanton. he was hit three times, but he is expected to survive. the shooter took off and is still on the run. hey, thank you, marla. still have clouds lingering over the south bay. overall we're nice and clear. right at room temperature right here in san jose. 82 degrees between 3:30 and 4:00

capacity at age 9 and more aggression. >> dr. horn, do you think there are certain behaviors that require a parent or parent should think about spanking their child? >> i don't think there is a behavior that requires a parent to consider spanking. i don't want parents -- if i say to parents absolutely if you tell me you're spanking then we have a problem. then they won't come to me when there is really an issue. >> right. >> as a pediatrician, i want them to have that conversation to talk about this thing that is underlying why they feel like they have to spank their child. therein lies the problem and the concern. what's going on with this parent and the parent-child dynamic that the parent feels like they need to spank their child. >> this is about frequency though f you're doing it every other day, there is an issue. if you do it every now and then when there's a big problem, that's different. >> a lot of parents are using this not as a backup tool but as their go-to method. this is what they use and rely on exclusively. >> but more and more we're living in a world where we're letting television raise our children or video games raise

our children, technology. we have become a post human society. we're more comfortable with machine thanksgiving hus than h. is that part of the problem? kids so much aggressiveness in the media? i certainly had as a child growing up. could that be part of what is going on here? >> i think what we're really talking about here is the aggression that kids see with their parents and their interaction with parents. and then that leading to aggressive behavior in the future. >> one of you said that you didn't think that time-outs work either. so what do you do with a small child? >> like don't he'd the tide. >> this is where families dismiss. they see the other academics who don't get what it's like in the trenches with the kids. and they dismiss it. people don't interpret what happened to them as abuse. so when people are say this is abuse, they tune it out. the reality is that no one spends a lot of time work with a kid say can you reason or negotiate. >> it's impossible.
