good morning. 5:00, i'm marla tellez in for jon kelley. >> i'm laura garcia-cannon. we begin with a story you'll only see on nbc bay area. court proceedings begin today for one of six teens charged with killing an off-duty paramedic. now almost seven months after quinn boyers' murder his widow is speaking publicly. bob joins us where the couple worked together at an ambulance company. good morning, bob. >> reporter: yes. liz boyer and her husband quinn worked as paramedics. today one of the teens accused in her husband's murder will have a preliminary hearing. on april 2, while he was off duty helping his father with a doctor's appointment in oakland quinn boyer, 34, was shot in the head during an attempted carjacking. his wife who met up with him that day knew from the git-go it was bad. that's what she was telling us.

she, too, is a paramedic. two days later her husband was taken off life support. what liz boyer finds not only tragic but in her words ironic is that it is a group of boys, ages 13 to 16 years of age, who are charged in her husband's death. it's ironic because quinn, her husband, was very much interested in helping at-risk youth especially in oakland, the city where he grew up and loved. >> when i heard how young they are i just -- i felt sick to my stomach. i felt bad. it's senseless and it's loss all around for everyone. i don't get quinn back. i don't get to take the hurt away from anyone. >> reporter: six teens are charged with multiple felony charges in quinn boyer's murder, five charged as juveniles, one as an adult. that is christian b.a.r.t.en

police say pulled the trigger. >> the south bay ymca camp worker accused of molesting children in his care will be back in court to enter a plea on additional charges. 20-year-old nicolas is accused of molesting four young girls, one just 3 years old. all of the victims attended ymca daycare on the campus of pair a diz elementary school in morgan hill. if convicted he faces life in prison. >> jury deliberations will begin this afternoon for the marin county teen accused of stealing sheboyganly chef guy fieri's lamborghini. he confirmed he never gave anyone permission to drive the car. max wade is accused of stealing the car. he also is charged with shooting at a car carrying a girl he had a crush on. >> a man could spend the rest of his life in prison if he is convicted of trying to buy

surface-to-air missiles for iran. he was arrested last year but the indictment was just unsealed. it says after he was arrested he told u.s. officials he tried to get the weapons for iran in 2007 and he was working directly for the iranian government. officials say he tried to buy several hundred missiles from an undercover agent. he has dual u.s.-iranian citizenship. >> people will be heading to santa rosa to protest the death of a young teen by a sonoma county sheriff's deputy. christie smith is live in oakland where buses are going to shuttle people to the planned march. good morning. >> reporter: good morning. that's right. again hundreds expected to take to the streets of santa rosa in support of andy lopez. this time quite few people are going to gather in oakland, 14th and broadway, there are going to be buss that will take them there later this morning.

this provided by family and friends of another boy, a 16-year-old teen from stockton who was killed in an officer-involved shooting in 2010. a preliminary report shows that lopez was hit by gunfire seven times last week, shot by a sheriff's deputy. demonstrators will gather at two places. santa rosa junior college and the old court house square in a march to converge at the sheriff's department in the afternoon. on friday, demonstrators marched more that two miles to the same place. the department identified eric gelhouse as the 24-year-old veteran involved in the shooting. lopez had been carrying a pellet gun which resembled an automatic weapon at the time. be aware that hundreds of people, perhaps over 1,000, expected to gather in the area of the county administration building, and a mass at 5:00,

the buses expected to leave here about 8:00 this morning from oakland. reporting live in oakland, christie smith, "today in the bay." >> 5:06. a special meeting will be held tonight to help families displaced bay 6-alarm fire at a redwood city apartment building. it destroyed a good part of the 73-unit apartment building leaving about p 70 people homeless. the cause of the fire appears to be accidental but it spread quickly because the building did not have a sprinkler system. since it was older, sprinklers were not required by law. the meeting is at 7:00. >> owners of an apartment complex allegedly discriminating against tenants with children. owners of the woodland garden apartments in the glenmore neighborhood of fremont banned children from playing outside. the paper says the complex is owned by fred martin and managed

by fatema refera who reportedly sent out a letter saying kids are not allowed outside because they destroyed her plants, threw rocks in the pool, broke sprinklers and damaged the grass. several occasions she threatened to evict them if they let kids outside. >> stay off the lawn. let's check the forecast. kids like to run and play and parents like when they are out running and playing. >> good morning. it's still mild enough to where they can get out and run and play in the afternoon. pretty chilly this morning, you want to bundle them up. getting yourself ready to morning, you want to dress in layers. a nice finish to the day. 56 degrees in livermore, 52 in gilroy and 54 degrees to kick off a tuesday in san jose. blanket of a.m. clouds, then a sunny finish. wednesday looks good, the warming starts to kick in.

forecast coming up soon. 5:11. >> president obama will meet with house republicans today to try to get immigration legislation moved through congress. the legislation is stalled in the house. months ago the senate passed a comprehensive bill to tighten border security to provide a path for citizenship for the 11 million undocumented immigrants living in the u.s. most house republicans reject that comprehensive approach to immigration reform. >> the syrian hackers were able to change the meaning of some of the president's tweets overnight. scott mcgrew, a clever hack. >> this is again an attack from the so-called syrian electronic army. what they did was they gained access to the short code links used by the president's elections site. so take a look. this is an example tweet. i'm making this up. he might say hey, take a look at this important issue, and that would be him. then there is a link to a webpage he wants you to look at but it's shortened.

maine. the jersey shore was devastated when part of the famous boardwalk was washed away. lower manhattan was flooded. in all the super storm killed more than 180 people and caused threes 65 billion in damage. we know the boardwalk. it caught fire. they had a tough go. >> it's remarkable to see the difference between before and after. >> it really s. you know what, i hate to point this out but we're still in hurricane season. until november 30. though it has been a mild year. we only had one major hurricane, that was on the pacific coast. that fizzled out. we're not tracking anything in the tropics but i'll let you know as soon as we see anything develop. temperatures in the 50s, everything that i am reading and scientific research proves it's

of course a thumbs up because we like when there are no major accidents. keeps my job easy and your life as well. you can see 101 in san jose. a few more cars on the road but no accidents to report. >> thumbs up to you as well. 5:18. people in an idaho auto shop are forced to jump out of the way. check this out. state mess say the driver was getting tonight freeway when he lost control and fish tailed. two people luckily saw the truck coming and got out of the way. no one was hurt. >> the popular hot sauce placing a lawsuit accused of fouling up the air around the southern california factory. the city filed that suit asking a judge to stop production at the factory.

the suit claims a chili order is a nuisance. the company has not responded to the suit. it opened the plant outside of los angeles earlier this year. >> students and teachers are protesting a planned visit by new uc president janet napolitano. she is street speak later this week. organizers say they do not want her on campus and they are gathering signatures for a petition calling for her removal as uc president. they say her work as a former homeland security secretary makes her a poor fit for a system that has frequent student protests and enrolls undocumented immigrants. >> getting caught breaking the law is going to be extra pricey this week. the city has implemented a triple fine zone in the downtown area because of halloween. that means anyone caught breaking laws including walking with open containers, littering

funeral home. the weekly reports marissa meyer bought the 114-year-old roller and happgood funeral home. it's about a block east of meyer's home. sources told the paper they think meyer is going to use it for residential purposes. the funeral home will officially go out of business in two days on halloween. >> some boat owners on the california coast are finding a new way to keep sea lions from sun bathing on the deck. the harbor master has purchased nine of these air dancers. you see these inflatable tubes. the bright colors and strange movements seem to scare the sea lions away. if too many of them pile on the deck of a boat they can actually

this traffic tuesday. >> we'll take it. thanks. 5:24. hundreds of children in the east bay will get in the halloween spirit a little early thanks in part to the hayward police department. the department is holding its third annual halloween costume give away, this afternoon at city hall. hayward police say they picked more than 270 kids from eight elementary schools whose families do not have the extra cash this time of year to celebrate halloween. in past years it gave away more than 500 costumes to children in need. many of whom living in shelters in the county. >> that's fun for them. good. 5:25. in san francisco an old hotel is coming down to make way for a new hospital. california medical center is holding a ceremony this morning to celebrate the demolition of the former cathedral hill hotel. a new state of the art seismically safe hospital will take the place near the corner of van ness and geary.

ung teen recently shot and killed by a sonoma county sheriff's deputy. christie smith is live in oakland where buses will shuttle people to the march all the way in the north bay. good morning. >> reporter: good morning to you. that's right. they say they have been in this place before and that is the family and friends of a 16-year-old stockton boy who was shot and killed in an officer-involved shooting in 2010. they plan to bring a bus here to the plaza, 14th and broadway, about 8:00 this morning to bring supporters from oakland to the rally in santa rosa that starts later this morning. that protest, of course, over the shooting death of 13-year-old andy lopez, an officer-involved shooting. a deputy identified by the department as eric galhas. lopez was carrying a pellet gun that resembled an automatic weapon. a coroner's report shows that

lopez was struck seven times, two fatal. supporters took to the streets, many of them teenagers, today demonstrators will gather at the old court house square and santa rosa junior college. then they will gather and march to the sheriff's department for bigger rally. there are a number of facebook pages up expressing outrage over the shooting in lopez's name urging people to take to the streets, not the sidewalk. the buses that are being put together by family and friends of the teen, james rivera jr. will be here at 8:00 for anyone who needs a ride. a crowd will gather for a mass in lopez's name also in santa rosa. live in oakland, christie smith, "today in the bay." >> 5:31. the suspected drunk driver who killed a couple in menlo park is expected in court.

marjorie reitzell was to appear yesterday but was a no show due to health. prosecutors say she rammed down balbir and kamal singh as they walked their dog. reitzell's brother tells us he has no idea what happened that night. he does say reitzell is bipolar. court documents show she had 30 criminal cases against her including dui and drug charges. she faces vehicular manslaughter charges in this case. >> this is a follow-up to a story we brought you yesterday. south bay woman is behind bars facing vehicular manslaughter charges for allegedly killing her friend. police say monica johnson of campbell was driving drunk yesterday when she hit and killed cassandra buck. police say johnson backed into buck and pinned her against a garage door. police believe the two were in the car together before the crash happened.

paramedic rushed over to the e.r., a place she was familiar with and knew her husband's situation was not good. >> did a quick check of when's the last time i told him i love him, when is the last time we had a laugh. what did we do yesterday. >> reporter: quinn boyer was taken off life support two days later weeks shy of the couple's one-year wedding anniversary. there are six teen boys charged with multiple felonies, in quinn boyer's murder. five as juveniles. they range from 13 to 16. the 16-year-old is the only one charged as an adult, his name is christian burton. police suspect he is the one who pulled the trigger. he pled not guilty. bob redell, santa barbara. >> today the berkeley city council will hear from tenants of an apartment that say their landlord's negligence could have killed them. the complex burned down last year and the owner wants to

rebuild. the tenant who is used to live at the complex says the owner disconducted fire alarms and improperly installed a water heater in the days leading up to this fire. the building was destroyed and a couple people hurt. they need to see evidence suggesting that the owner was negligent before they make a decision. >> someone is breaking into homes in the los gatos mountains. law enforcement officials will meet with members of the community to discuss what to do about it. deputies from santa cruz plan to update the community about crimes in the area. according to the patch signs have been posted on some roads in the mountains warning people about the recent bash of burglaries. the others including dogs beaten have been reported. officials will give advice on how to avoid becoming a victim. >> you notice our bob redell, they are throughout bundled up. >> we're still in fall though.

lawmakers will look for answers to whether the u.s. has been snooping on allies, for how long and who knew. one of the key witnesses is the head of the national security agency. tracie potts live on capitol hill this morning with more on that, and what the president is doing. good morning. >> reporter: good morning. the president's meeting with his cyber security team today but his intelligence officials, the director of national intelligence, the head of the nsa, general alexander and others the justice department, they are headed to capitol hill to brief lawmakers on these intelligence programs and we keep learning more and more about via edward snowden and some of the publications he has

been talking to. there were allegations that we spied on millions of people in spain. individuals, civilians, not government officials. that we've been spying on at least 35 world leaders including germany's angela merkel. they want some answers. some of those may come at the house intelligence committee hearing today. senator dianne feinstein, senate intelligence said she doesn't think there is any reason why we should be spying on world leaders especially from our allies from friendly countries. >> now that it's out in the open are they making changes, are we going to stop spying on some of these leaders? >> there is indication that's already happening. the white house has this under review, reviewing it since summer a. senior official says there is no final decision but it looks like they may at least stop that part of the program where they are tapping the phone

like angela merkel. >> while some are commemorating the lives lost in hurricane sandy there is a lot of work to be done. the storm killed 180 and caused more than $62 billion in damage. new jersey was hit hard and reeds beach, wrecked homes and businesses stretch for miles. near atlantic city the storm washed away a portion of the board walk. last month a massive fire destroyed 50 businesses on the recently rebuilt boardwalk. the fire was caused by wiring damaged during the storm. >> snow is expected to fall again in the sierra. this is what truckee looked like last night. the sierra got 1 to 3 inches overnight. and we checked and as of now snow chains not required on 80

or highway 50. the snow has some resorts excited and skiers as well. boreal making snow this morning t resort says if it keeps falling it's hoping to open. others hope to open in november a. big boost to the economy as well. >> the tourists are going to head that way. >> they will and the people lucky enough to get up there regularly. how nice is it. let me take to you the radar, show you what we're working with. it's not snow at this point. we're talking about light showers around south lake tahoe. temperatures are mild, and we lost that cold blast of air so we don't know for sure whether boreal will open up. if they were expecting more snow unfortunately no longer coming down as the white powder. that precipitation there, that's rain. temperatures are looking good. kind of cool out there, you want to make sure you're ready for

today electronic arts in redwood city releases battlefield force. presumably each of the people who buy a copy is buying a copy to run on the old x box. they are unlikely to buy another for the next device if they buy the next device at all. writing in the journal suggesting that parents limit children's screen time. they are not anti-media. but say parents should prohibit elincoln tronic devices at the dinner table or at night in bed after bedtime. i would like to see a kid try to bring an electronic device to my dinner table. that said, on a friday night if i'm super tired i will hand in the ipad and say why don't you watch a movie, i'm going to bed. >> let it be the babysitter. >> i think we all need to limit our electronic -- >> give me that phone. >> my mom is like sure.
