slaughter in for mike. >> things are quiet. we did notice construction on some of our roadways. 101 is littered with construction, paving of the roadways and even on 87 down to one lane this morning. as you head out, keep in mind we have overnight paving. right now, no accidents to report. back to you. we can tell you, there is another demonstration and vigil being planned for 13-year-old dane lopez in santa rosa. the rallies come after hundreds of people attended his funeral mass last night. for many, that grief was simply overwhelming as friends and family placed the boy's casket in the back of a hearst. the 13-year-old, shot and killed by a sun know ma county sheriff's deputy last week. the deputy thought lopez's replica rifle was a real ak-47. parents say the shooting sent a

wave of sadness and fear through the community in santa rosa. >> i have three kids too. i don't want that to happen with my kids. >> i don't want my daughter to have to grow up with this happening to her in the future. her friends, i don't want this to happen. things need to change in our community. >> mourners say they are standing with the lopez family, demanding justice for a shooting they say should never have happened. they are conducting an independent investigation a private funeral service will be held for the menlo park couple killed by a suspected driver. the couple was out walking their dog when they were hit and killed by marjorie retzel. she is expected to be arraigned in court again today. she was supposed to appear yesterday. her arraignment was pushed back for the second day in a row because of health issues. the san mateo district attorney says she complained of chest

pain and prosecutors are handling her situation day by day. while today's funeral service is private. a public memorial will be held tomorrow at the chapel of the chimes in a ward new details on a suspected dui crash in sun know ma county that kills one person and injuries three others, including a little girl. that 5-year-old girl recovering from an oakland hospital after suffering some major injuries. she was riding in a toyota that slammed into a jaguar on state highway 121 last night near the sonoma raceway. they say the driver of the jaguar was coming from the opposite direction trying to pass other cars when he lost control hitting that toyota head on. the jaguar's passenger died. the driver was seriously hurt. investigators say he has been drinking. the driver of the toyota was taken to the hoital, suffering minor injuries. following up on an nbc bay

area exclusive. a teenager accused of killing a santa clara paramedic. the murder of quinn boyer, shot in the head during an attempted carjacking in oakland in early april. he was taken off life support two days later. yesterday, a judge ruled, there is enough evidence for 16-year-old kristen burton to stand trial. the courtroom was packed with boyer's friends, coworkers and family, including his widow. >> why. a lot of times it feels like a very pointless question when you are talking about someone who should still be here, who wasn't done yet, who had a lot left to offer, not just us, but the world at-large. >> burton is being tried as an adult. oakland police think he and five other teens, as young as 13 years old, were on a crime spree when they targeted boyer. the other boys have been charged

in juvenile court officials in alameda releasing more information about the discovery of more than a dozen seniors found without adequate care as a castro valley nursing home. deputies removing 14 elderly patients from the valley spring manner care facility. they say the patients had been left there with only three staff members for two days. the rest of the employees left after the state temporarily shut down the facility saying staff was not properly trained and the facility simply was dirty. the facility's owners, attorneys, say his client does not agree with the state's findings and the facility was, in fact, properly staffed. >> updating that deadly bart crash, the state legislature now looking into workers safety, a special oversight hearing will take place some time next week. the hearing happening after that crash killing both a b.a.r.t. worker and a contractor on october 19th. a train by a trainee hit and

killed those two men along the tracks in walnut creek. the ntsb conducting its own investigation. >> 4:36. this morning, levi stadium in santa clara getting the green light to step up security. they approved spending $200,000 on background checks for new police officers to heppa troll the new stadium. the city says it plans to hire more than 100 officers for shifts during 49ers games and concerts. those officers will earn $55 an hour. to apply, candidates have to either be a current or a retired police officer. off duty santa clara p.d. will dpet first choice for eligible shifts the police are hoping newly released video will help them catch a suspected gunman. these men highlighted in the video were involved in saturday's shooting at "the spot nightclub." a club employee told the group to turn down their music in the

parking lot and one of the men shot the employee. the 33-year-old victim is still recovering from the hospital. if you rec nids anyone in this video, you are asked to call the campbell police department people living in the normally peaceful mountains of los gatos, banning together to fight a crime hitting too close to home. more than 200 people showed up with this meeting with the sheriff's department. this meeting happening last night. at least nine homes have been broken into in the past month. dep it is telling that crowd, it is very important to talk to their neighbors and look out for one another. >> education is key. if we can tell them what to look fr and how to protect themselves, it makes a better chance to protect themselves in the future. >> an effort by the neighbor thood keep an eye out and help the police track these people down. >> some of those people attended the meeting. they say they are planning to get together in smaller groups to talk about the ongoing issue and to get to know their

it will be a big day out on capitol hill. the health and human services secretary in the hot seat as house republicans continue hammering the new health care law. kathleen sebelius testifying in front of the house emergency and commerce committee today. a growing number of republicans calling for her to step down or potentially be fired. the new health care website has major problems since it rolled out at the beginning of this month. the white house says it expects all those problems to be fixed by the end of next month. 4:45. this afternoon, federal chairman, ben bernanke will
