may have seen a woman in a hospital stairwell just days before she was found dead there. i'm christie smith. i'll have that story coming up. good morning to you. i'm meteorologist, christina loren. it is a cold start to the day. one of the coldest days of the season so far. nonetheless, we have a warmer afternoon, lots of sunshine headed our way. i have your halloween forecast. we are taking a look at the weekend numbers as well. traffic looking good here on this wednesday. anthony slaughter in the traffic center for mike inouye. we are going to get you outside on time and up to speed in just a few. >> the warriors getting ready to start their push for another appearance in the postseason. we will be taking inside oracle arena where the crews are all ready for the big-time tip-off. we want to take you outside. yes, it is a chilly start on this wednesday morning. bundle up. wrap yourself up before you head out the door. a lot of news ahead on this wednesday, october 30th. this is "today in the bay."

a very good morning to you. welcome back. i'm laura garcia cannon. >> i'm jon kelley. good morning. we can tell you san francisco police needing your help this morning trying to find the man that reported seeing the body of a missing patient in a stairwell at san francisco general hospital. "today in the bay's" christie smith live at the hospital. she has more details on the man the police are looking for. good morning. good morning, jon. another strange twist in this case that's already very unusual. investigators think that the man who reported seeing a woman laying in a stairwell here at sf general may have had on a u.c.s.f. name tag. they don't know a whole lot else about him. 57-year-old lynn spaulding was found in a locked stairwell at s.f. general hospital here in san francisco on october 8th, three weeks after she banished

from her room. she was here being treated for a bladder infection at the time. now, four days before she was discovered, a man told a hospital supervisor that he saw a woman in a stairwell. apparently, that supervisor looked but did not see anything. the hospital has told the family they asked deputies to look for her at least four times. details around this are somewhat sketchy. police think he could have worked for the hospital, maybe as a resident. right now, they don't have a sketch yet. there is a description of this man. he is described as an asian man in his 30s. 5'8". he was wearing a blue dress shirt and possibly had a tie on. any information about this man would be appreciated. if you know anything about him, you are asked to call san francisco police. reporting live, christie smith, "today in the bay." rescue teams will resume their search for a san jose man

last seen outside sacramento. 65-year-old walter stever left for a mining trip. when he didn't return as planned, he was reported missing. deputies found his car yesterday about 60 miles northeast of sacramento. good news here. violence in san jose on the decline this year. new numbers from the san jose police department shows gang-related murders, aggravated assault and robberies dropping by 15%. the numbers, they could go up. it often takes weeks, sometimes months after a death to determine whether it was, in fact, gang-related. 5:03. in a matter of days, the south bay city could have some of the strictest gun laws in the country. if it happens, sunnyvale could be slapped with a lawsuit by the nra. ma alatte yez with reaction for

both sides on the ballot is one controversial measure. measure c would make four big changes. it would require gun owners to lock up their weapons at home when away. stolen guns would need to be reported within 48 hours. detailed records of all ammo sales and it would ban the possession of magazines holding more than ten rounds. if voters pass measure "c," the national rifle association says it will susan ae sunnyvale. the mayor has been set on enacting change. you will hear from him first and then a gunshot owner. >> we need to do it and it needs to happen on the local level and

it a 13 connector. it is involving about 3-5 cars. chp report still coming in saying there were several cars that have been involved. debris on the roadway in a couple of the lanes. this is going to add to an already slow commute. there you can see it on the traffic maps. it calls for a slowdown. otherwise, the good news since it is not the heart of rush-hour. we are not seeing too bad of a slowdown. a couple lanes getting through on 80 westbound approaching the bay bridge toll plaza. 5:07 right now. we can tell you tonight tens of thousands of fans already amped up pouring into oracle arena. they are playing against the lakers. bob redell inside the oracle arena with a look at what fans can expect tonight. >> bob always ready. he has the jumper.

good morning to you there, laura and jon. what people can expect is a full house here at oracle arena. 19,596 seats have been sold out. i br i that up because this is the 39th straight sellout for the team. that includes the playoffs. everyone that comes here is going to get one of these lovely t-shirts. you can see them on the back of every seat here in the house. it has the map of the east bay and what does it say here on the back. protect warriors ground. right over there in the center of the court. 7:30 tonight will be tip-off against the los angeles lakers. now, this is also significant because it is who the team, the warriors met twice during preet season. video from earlier this month at the 2013 nba global games in which the warriors beat the lakers twice. there are many reasons why there is so much interest in this team, why they are selling out their first game.

when the first time in six years and only the second time in 19 years, the warriors advance the western conference semifinals. you have steph curry who depending on which sports publication you believe, is ranked anywhere from the top sixth player to the top 15. david lee, the first warriors player to appear in the nba all-star game for the first time since '97 and andre igudala. they picked the warriors as the most exciting team to watch. as i mentioned, this is a sold-out game. you can go to those offline ticket brokers like stubhub. i checked there this morning. there are seats available. >> how much you want to give me to do what? >> how about this? you make it, we'll pay you $50. you miss it, you pay me $50.

scratch fever on social media after uber's plan to give away free felines didn't go so well. offering kittens on demand in san francisco, seattle and new york. for $20, they would deliver a nice, furry little cat to do whatever you like, maybe snug thele. one major problem, not enough cats to go around. very upset, uber users jumped into action unloading on twitter. no kittens available, your dead to me, uber. one new yorker posted this uber kitten shortage is really harshin'. >> it seems odd to give away a living thing. we continue our cat coverage with technology. scott mcgrew, some dell computer users getting the wrong end of the cat. >> good morning. i never thought i would talk to you about computers smelling

like cat europeaurine. i think we are even. the support forums for dell computers filled with complaint that a certain new model of dell smelled strongly of cat european. one user says he gave his cat away, because he assumed the cass was using the keyboard as a litter box. dell does acknowledge the problem. says it is not the cat's fault. there is something odd with manufacturing. apple acknowledging they are having some trouble with some iphone 5 batteries. the company tells "the new york times" it is offering to replace the phones where batteries run down too quickly. looking ahead, the head of health and human services will be on capitol hill trying to explain what went wrong with the affordable health care website. >> let's look ahead to seema mody. good morning. good morning, scott. futures right now are looking higher indicating a higher open

when the markets open after the dow hit a record high on tuesday. investors are anticipating that the fed will hold off on reducing its stimulus programs when it wraps up its meeting amid concerns about the economy and the budget fight in washington. we also get data out on private sector job growth that just took place. the dow jumping 111 points, rising about i 12 to close at 3952. you have to take a look at the nasdaq. it is approaching 4,000. facebook reporting profits after the end of the trading day today. linked in opened the books tuesday afternoon turning in great numbers. the company's growth has been so phenomenal, analysts are concerned it is slowing. linked in is going from awesome to amazing. that's disappointing some people. their stock is up about 125%

this year. >> you guys are always awesome so it doesn't matter. thanks a lot, scott. thank you. a brazilian surfer a real life hero after saving a woman's life and break ag world record in the same day it happened. it happened monday off the coast of portugal. a surfer wiped out and was unable to recover as violent waves pounded her. carlos berlay jumped into action and rode out and saved her life. he leapt off that jet ski and carried her back to the beach. she suffered a broken ankle but we are happy to report she is recovering well. on that very same day, berlay recording a record wave thought to be more than 100 feet high. you talk about suffering to the extreme. the guinness world record working hard to see if he set a

brand new world record for riding the highest wave ever. 100 feet and coming out of its smooth at the end. >> and then saving lives. >> the guy should have a bill "s" tattooed on his chest. he doesn't have to dress up for halloween. >> talk about a good day. we have a pretty good day. not quite to that level but it is going to be pretty nice around here, specially if it was too cold for you yesterday and a lot of people were talking on facebook and twitter about the cold. i want to start with a live look here. san francisco, over the finance district. you can see the trance america pyramid there looking pretty good for this morning. we don't have a lot of fog to show you. we do have low clouds creeping in. right now, the coastal mountains still holding back the fog, at least for the time being. we could see some development that could force us out of sfo as we head throughout the morning. the big story in the weather department is the very cold air that has settled in. jack frost is back in the mix. look at, we're getting close to

get the kids ready to get out the door. sun sets at 6:15. we have the time change. daylight savings time comes to an end. an extra hour of sleep. as a result, your new sunrise will be at 6:31. it is going to be early at 5:15 in the evening. let's talk about your seven-day forecast. up to 79 by friday. saturday into sunday, staying pretty comfortable. if you want to hit the beach on saturday, 65 degrees. a little bit on the cool side. a little overcast to start. still, getting a nice sunny finish out there. ocean beach, pacifica, half moon beach looking good for you. sunday into monday, things start to change a little bit. another area of low pressure is going to drop our temps. overall, nothing heavy in the forecast. no major rain. 5:20. let's check that drive. see if there is anything going on with anthony slaughter. >> we don't have any major accidents. we are seeing traffic start to pile in across the bay bridge toll plaza. you can see a few more cars on the road right now. let's switch gears and show you what's happening on the

eastshore freeway. we had an earlier accident on the 80 westbound coming in. there are a couple cars involved with this accident and debris left on the roadway. you can see that denoted with our red markers. from university to 13, that's where things are slow. once you get passed that, things start to improve, specially headed over towards the bay bridge approach. off towards the altamont pass. things are quiet. even through the peninsula. quiet down into palo alto and sunnyvale and san jose. we'll be keeping an eye on the altamont pass because of the accidents we saw yesterday. guys, back over to you z. >> an east bay teen will face trial in the shooting death of santa clara paramedic, quinn boyer. investigators say 16-year-old

chris burton shot him in the head after an attempted carjacking. he was later taken off life support. burton will be tried as an adult. police think he and five other teens were on a crime spree when they targeted boyer. the other boys will be tried as juveniles legislature has announced a special oversight hearing that will take place next week to look into the deadly b.a.r.t. crash. the hearing will look at the october 19th crash that killed a b.a.r.t. worker and a contractor working on the tracks. the ntsb is conducting its own investigation. >> monumental news for an nfl hall-of-famer. he is finally getting his stolen super bowl ring back. >> that man is lance allworth. the san diego county sheriff office says he found his 1972 super bowl ring that he won with the cowboys. it was scheduled to be sold at an auction house in november. it was ripped off back in 1992 from a san diego bar that displayed sports memorabilia.

and under. they must wear costume. an adult over 21 must accompany them and halloween ends at 8:00 p.m. you can't stop halloween. the city says -- it hasn't said what will happen to people if they break those rules but it is not a law. more like a regulation. >> when it comes to trick-or-treating, there are a few candies that will be in high demand. the national confession ners association says in the past year, reeces was the most perfect candy in america, reese's followed by m&ms, snickers and hershey's. >> all five are winners in my book. 5:26. a young girl hospitalized after a suspected dui crash that happened in the north bay lat last night. another person killed in that very same crash. we will let you know what

mentally ill component of what's wrong because it directly affects our business. >> he is also worried about his business, because measure c will drive sales out of sunnyvale. voters will decide on tuesday, may 5th. a report just released shows many mentally ill people are getting their hands on guns primarily because dozens of superior courts in california are failing to report the names of these mentally ill people to law enforcement agencies. as these courts are required to do by law. if you can believe it, estimates show more than 20,000 mentally ill people, and felons, are armed when they don't have the right to be. amazing numbers. thank you for that report a suspected dui killed one person and injuries three others, including a little girl. that 5-year-old now recovering in an oakland hospital after suffering some major injuries.

she was riding in a toyota when it slammed into a jaguar last night. investigators say the driver of the jaguar was coming from the opposite direction trying to pass other cars when he lost control hitting that toyota head on. the jaguar's passenger died. the driver was seriously hurt. investigators think he may have been drinking at the time. the driver of the toyota was also taken to the hospital suffering major injuries 5:33. a private funeral service will be held for the menlo park couple killed by a suspected drunk driver. police say the couple was out walking their dog when they were hit and killed by marjorie retzeh. she is expected to be arraigned in court today. she was supposed to appear yesterday. her arraignment was pushed back for the second day in a row because of health issues. the san mateo district attorney says she complained of chest

pain and they are handling her situation day by day. today's funeral service is private. a public memorial will be held tomorrow at the chapel of the chimes in hayward the search is ramping up for a man that first reported seeing the body of a missing pash glunt a stairwell at san francisco general hospital. after telling a supervisor, that man disappeared. "today in the bay's" christie smith live at san francisco general with an update on this ongoing and kind of strange investigation. good morning, kristy. >> reporter: good morning, jon. how could a man report seeing someone in a stairwell but the body wasn't found until four days after that report in the very same spot. the body of 57-year-old lynn spaulding was discovered in a locked stairwell at sf general hospital on october 8th. at 7:00 in the morning on october 4th, the man told the hospital supervisor that he saw someone laying there.

the supervisor looked but didn't see anyone. spaulding disappeared on september 21st, two days after being admitted for a bladder infection. the hospital says that sheriff's deputies were asked to look for her four times. exactly what that entailed is unclear. now, the question, of course, is, who is this man. he disappeared before he could be questioned. he is described as an asian man in his 30th, about 5'8" tall and bearing a blue dress shirt and a tie. he had some sort of hospital i.d. on, maybe a ucsf name tag. possibly investigators are thinking he may have been a resident. they are asking anyone who has any information about this man to please call san francisco police. reporting live, christie smith, "today in the bay." >> thank you, kristy. 5:35. another demonstration and vingi being planned for andy lopez.

hundreds attended his funeral mass. for many, the grief was squoe overwhelming. the 13-year-old was shot and killed by a sonoma county sheriff's deputy last week. he thought the replica rifle was a real ak-47. parents say the shooting sent a wave of sadness and fear through the community in santa rosa. >> i have three kids too. i don't want that to happen with my kids. >> i don't want my daughter to grow up thinking this could happen to her in the future. things need to change in our community. >> mourners say they are standing with the lopez family demanding justice for a shooting they say should have never happened. the fbi is conducting an independent investigation into that shooting. >> a heartbreaking tragedy there. time to check out the weather at 5:36. christina loren is back to tell us if you like cool and you like

breaking news. a one-alarm fire happening in union city. an industrial fire near the intersection of niles road and decado road. no word on injuries to be reported. we are in touch with the fire department. our chopper heading to that scene. we will bring you live pictures and more information as soon as we get there. >> the woman in charge of health care.gov will be in the hospital seat at a congressional hearing. tracie potts live on capitol hill with a preview of what health and human services secretary is expected to say this morning at today's hearing. good morning. >> hi, there, laura. good morning, everyone. kathleen sebelius, her eight-page opening statement that she will will start to deliver in half an hour or so. that hearing starts in 15 minutes. in it, she says that there have been 20 million hits on this website and that 700,000 people

between the federal and the state sides have tried to apply for health insurance. tried. what she doesn't say is how many have been successful. the administration says they won't have those numbers available until the middle of november. she is certain to get grilled by republican and democrats. republicans are saying this simply isn't working. they are going to ask to close up shop and start again. she will likely be asked about the cost of these plans that a lot of americans are being forced to get. that takes us to the other thing that's happening today. president obama in boston trying to highlight how health reform works but also under fire for saying repeatedly over the last few years, if you like your plan, you can hold on to t now, 2 million people have already gotten notices that their plans are being canceled, because they don't meet the minimum

requirements. they are now having to shop around. >> it will certainly be one to watch today. tracie potts, thank you very much. today, officials in alameda releasing more information about the discovery of more than a dozen seniors found without adequate care at a castro valley nursing home. removing 14 elderly patients from the valley spring manor care facility. the patients have been left there with only three staff members for two days. the rest of plothe employees le after they shut down that facility. the facility was dirt. the facility's owner and attorneys say his client does not agree with the state's finding. the facility was, in fact, properly staffed. in the meantime, an advocate for the elderly suing the state for putting the elderly at risk. the sacramento bee reporting that the suit filed by the sacramento-based foundation,

we want to remind everybody this is now officially the coldest morning of the season so far as we have dipped into the 30s up in napa and santa rosa. this isn't the first time we have seen the 30s. 37 is the coolest it has been. i am expecting these numbers to continue to fall as we head through the next couple of hours. 44 degrees in santa cruz, a cold start by the ocean. look at where we are headed. i want to give you an idea of this warmup we have. 62 was the high yesterday. we will be at 68 degrees this afternoon, up to 72 right here in the south bay by thursday. then, we'll peak on friday, warmest day of the week. great day for your outdoor plans. 76 degrees, still comfortable. a little bit above average, as a matter of fact as we get into friday. for today, temperatures will creep up. yesterday was kind of a cool day. you have your heater going in your home right now, because it is chilly out there. you can turn it off. 71, later today in livermore. 68, santa cre teresa and 66 deg
