new, tough gun restrictions. it is cold enough for frost in parts of the bay area. officially now, the coldest day of the season so far. a nice rebound headed our way. your trick or treat numbers are coming up. traffic is starting to uld about across the bay bridge toll plaza. a live clear look across the city of san francisco, clear skies making a cold start to our day, wednesday, october 30th. this is "today in the bay." i am laura garcia-cannon. >> i'm jon kelley. >> want to update you on the breaking news we mentioned. firefighters calling more crews out to the scene of the fire, which appears to be at a commercial building called

caravan, bagels and pita. fire is now two-alarm and is happening on western avenue near alva rod doe, niles road and dacado road. there were employees inside of the building at the time of the fire. so far, we haven't gotten any reports of any injuries. we will keep you posted as more information comes in and this story progresses. a 5-year-old girl was taken to the hospital with major injuries. she was riding in a toyota that slammed into a jaguar. the driver of the jaguar was coming from the opposite direction and tried to pass other cars when he lost control, hitting the toyota. the jaguar passenger died and the toyota driver was hurt.

first, a missing woman found dead. now, a missing witness in in case. this morning, police asking for any kind of help finding the missing man who first reported seeing lynn spaulding's body in a san francisco hospital's stairwell not too long after she disappeared. christie smith is live at the hospital with new details about the man police are currently looking for. kristy, good morning. >> good morning to you, john. another strange twist in this story. this man apparently told a hospital supervisor here at sf general that he saw someone laying in a locked hospital stairwell. he made this report four days before lynn spaulding was actually found there. he disappeared before he could be questioned. now, investigators want to find him and talk with him. the body of 57-year-old lynn spaulding was discovered in a locked stairwell here on october 8th, three weeks after she disappeared from her room where she was being treated for a

bladder infection. the supervisor looked into that stairwell but didn't see anyone there. police say the info on this guy is somewhat confusing. they know that. so no sketch yet. they think he may have been wearing a ucsf naming ta. possibly, a hospital resident. he is described as an asian man in his 30th. about 5'8" tall wearing a blue dress shirt and possibly a tie and had hospital i.d. on. if you have any information on this man, you are asked to call san francisco police. reporting live, christie smith, "today in the bay." 6:03. bring on the lawsuit. that's what one south bay city says it is willing to risk as it fights to enact tougher gun safety standards. this is santa clara county court

comes under fire for not doing . two stories are linked to one controversial issue of gun control. good morning. >> we are going to start in sunnyvale where measure c is attracting all sorts of attention. if this proposal passes on tuesday, it will sue the city. measure c would make four big changes. number one, it would require gun owners to lock up their weapons at home when they are away. gun owners would need to report stolen guns within 48 hours. it would require detailed information of all sales. facing this lawsuit from the nra, the mayor of sunnyvale calls the organization a bully. tony spitalari says ever since the new town massacre, he has been set on enacting change. a gun shop owner thinks very

differently. first, the mayor. >> we need to do it. it needs to happen on the local level and go from ground up, not top down. top down is not happening. >> it is big government mentality on the small level. if laws are to be effective, they need to be statewide or countrywide for them to have a real impact. >> measure c goes before sunnyvale voters next tuesday, november 5th. another gun control story. a big audit just released shows many mentally ill people are armed. dozens of superior courts in santa clara are failing to report the names of these mentally ill people to law enforcement agencies as they are supposed to. happening right now, a hearing just getting started on capitol hill regarding problems

with the rollout of health care.org, the online health insurance marketplace. that is health and human services secretary, kathleen sebelius just taking her seat. she will be grilled today talking about where people can shop for health insurance. that website is for people in 36 different states which does not include people in california. as mentioned, sebelius will be testifying in front of the committee this morning. she will be facing questions about why the website could not handle the crush of users trying to access the site. she will also probably be asked about why the administration did not test the website out until the very last two weeks right before that rollout. "today in the bay's" tracie potts is monitoring this situation and the hearing from washington, d.c. she will be coming up with a live report coming up at 6:30. >> today, officials in alameda will release more details about the discovery of seniors left without enough care at a castro valley nursing home. over the weekend, deputies

removed 14 elderly patients from the valley springs manor facility. they have been left there with only three staff members for two days. the rest of the employees left after the state temporarily shut down the facility saying staff was not properly trained and the facility was dirty. the facility's owner's attorney says his client does not agree with the state's findings and the facility was properly staffed. 6:07 now. time to check out that weather. want to give you a live look outside in san jose. it kind of feels like the right look for halloween coming up tomorrow a little autumn chill in the air. i have a feeling someone will be dressed as jack frost this morning. >> much better than miley cyrus, a very popular costume this year. i have already seen too much of it. 50 degrees in oakland. jack frost is nipping up in the north bay.

it was on 80 westbound at university. it has been cleared. a lot of cars still piling through the area. those metering lights have been turned on as well. you can see, it is stop and go once you get through the toll plaza. otherwise, we have an accident on 4 coming through antioch. that's going to continue to slow an already slow commute and even through the altamont pass. in fremont, more cars on the roadway headed in the southbound direction. no accidents on 880 right now. that's good. also, switching gears coming into the south bay on 101 headed in the northbound direction. you can see more cars. again, this is a very slow commute. the good news right now, because we don't have any accidents, it is moving right along. back to you guys. always looking for the silver lining. thank you. >> it is 6:09. coming up, uniforms revealed for the olympic games in sochi is it. some say they represent the

fire. we were getting reports as well that employees were inside the building at the time of the fire but so far no injuries have been reported. no doubt fire engines and officials will be out there for some time making sure the scene is completely clear as they attempt to bring it up. want to get you to the day's other top stories. san francisco police are asking for the public's help trying to track down a witness. they are looking for the man that reportedly told staff at sf general hospital he saw a woman's body lying in a stairwell. that was the body of missing patient, lynn spaulding, who was found inside the stairwell several days later. >> the nra says it will sue the city of sunnyvale if voters pass a measure enacting some of the strictest gun laws in the country. measure c will require gun owners to lock up their weapons at home when they are away and

report a stolen gun within 48 hours. the measure goes before voters next tuesday health and human services secretary, kathleen sebelius, is testifying live on capitol hill facing questions about the ongoing problems with that new health care website. controversy still swirling this morning over who knew what and when, when it comes to signs. >> scott mcgrew says the white house knew all along. >> director of national intelligence, james clapper, testified to congress and said the white house was fully aware the nsa was spying on the heads of state of allied countries. he stopped short of saying the president himself knew. now, clapper is trying to do some damage control here. many in congress see the nsa as a rogue agency. the point of these hearings was to reign the spy agency in. also, do keep in mind the last time clapper talked to congress, he was not entirely honest about facts. in march, senator rob widen

asked clapper, does the nsa collect any type of data at all on millions or hundreds of millions of americans? clapper said, no, sir, it does not, not wittingly. there are cases where they could inadvertently collect but not wittingly. the nsa said the government does collect data about your phone calls every time you make one. twitter looks different this morning. you know see pictures in the timeline. dave evans is in my timeline, a great guy at sisco. he is posting tons of pictures. some people not entirely thrilled with this improvement. you can turn it off on the phone, not on the desktop version. twitter going public. it is interesting they are making changes so late. reviewers have started to turn

the hearing. she joins us live with an update now. tracie? >> reporter: we are watching that right now. she talks about how much money she spent on this website not working $174 million on the site and i.d. to support the site and get it working for millions of americans that need health insurance. earlier in an opening statement, and, by the way, she went off script. she didn't really talk about what she said she was going to talk about in an eight-page prepared statement. in a shorter version, she did apologize we didn't see that in an earlier statement. i apologize. i am accountable to you for fixing these problems. she talked about the improvement that they have made. she said that health care.gov can now accommodate 17,000 people signing up for accounts. what she has yet to say is how many people have actually

successfully been able to use this site so far. the government has said they are not going to release those numbers or they are not going to have those numbers until the middle of november. we watch now as she is grilled not just about the website but also the first line of questioning this morning was about what the president has said and is now under fire for. the fact that he told americans they could keep their inshusura if they like it. millions have received cancellation notices. secretary sebelius says it is a law that the americans be able to get new insurance. the question becomes, how much is it going to cost. >> we also also point out, health care.gov is available for people in 36 states that does not include california. they have their own health insurance website. it is called covered california. so far, more than 179,000 applications for insurance have been started on cover

earlier, an accident at petaluma. coming up in the north bay. keeping things slow all the way bablg in back into santa rosa. moving along smoothly. no dense fog to deal with. lots of cars coming in. pg&e will spend the next couple of months updating lines that move between hayward. most of the work will be done by air. a live view of the san mateo bridge. if all goes as planned, the project won't impact bridge traffic at all. through december, workers will dangle from pg&e helicopters to remove the old lines and install new ones. utility officials say the upgrades will make service to homes and businesses on the peninsula, more reliable. levi stadium now getting the

green light to step up security. the santa clara city council approving to spend money on background checks for police officers to heppa troll the new stadium. the city plans to hire more than 100 officers for shifts during 49ers games and concerts when the stadium officially opens up next year. those officers will be earning $55 per hour. to apply, candidates have to be a current or retired police officer. off-duty santa clara p.d. will be given first choice for all eligible shifts. sleeping passengers trapped and burned inside a bus overnight. new information about the deadly crash in india just ahead. >> we will tell you about overnight arrests in the deadly crash now being called an act of terror in ten amen square. new details coming up next. continuing coverage of fire now knocked down and under control at an industrial building that appears to belong

at 6:39. new this morning, at least 42 people died when a bus crashed into a roadside barrier and burst into flames in southern india. it happened early this morning. many of the passengers were trapped inside the bus.

a burned metal frame. that was the last of the bus after the flames were put out. only the bus driver and six passengers managed to is scape through a window. many of them suffering burns. the crash happened after the driver tried to pass another vehicle. on the international scene, china state-run news agency reporting five people have been arrested in connection to a suicide car attack in ten aman square. that is back open to security. a jeep carrying five people blew past hebertier into that square, crashed and burst into flames. three passengers and two tourists were killed. the chinese news agency reporting, three passengers were related, the husband, wife, and

right now, i want to get you updated into breaking news in union city where firefighters are keeping an eye out for any possible hotspots after a fire at a commercial building called caravan bagles and pita. crews did manage to control the flames about 30 minutes ago. this one, happening on western avenue near the intersection of alvarado and niles road and dakota road. there were reports employees were inside of the building at the time of the fire. so far, no injuries have been reported

san francisco police are asking for your help to solve a mystery. a man that reported seeing the body of a missing patient in the stairwell at san francisco general hospital. after telling the supervisor, the man disappeared. christie smith is live with an update. >> reporter: this man apparently told a hospital supervisor that he saw someone laying in a locked stairwell here at sf general. this report made four days before lynn sfaupaulding was fo there. now, san francisco police were putting out the word to the public. they are trying to find him. he is described as an asian male in his 30s, about 5'8" tall. the body of 57-year-old lynn spaulding was discovered on october 8th in a locked stairwell here at sf general. four days earlier, that man-made his report to the supervisor.

future. 6:48. let's check on the drive. we know it is taken up right about now. it is taken up across the board. right now in the east bay, we are seeing the heaviest of traffic approaching the bay bridge toll plaza. coming through, we still have an accident. this is right to the 101 in petaluma. keeping things slow coming into santa rosa into san francisco. through the altamont pass. this is a slow spot. we have an accident at isabelle keeping things slow there. down to 680. the unfortunate thing is that we still have quite a bit of traffic filling in from the south bay. you can see on the 101, this is a slow spot that's going to continue to remain slow as we head through the next couple of hours coming through san jose. you can see outside, cars piling in on 101 northbound.

that's all those cars coming in. it thins out as we head through palo alto. that's where you can see traffic moving smoothly. 6:50 right now. rescue teams resuming their search for i asa san jose man l seen outside sacramento. he didn't return over the weekend and was reported missing. deputies found his car yesterday in nevada city, about six miles northeast of sacramento. the state legislature has announced a special oversight hearing that will take place in a week to look into a crash that killed two workers on b.a.r.t. tracks. moments before a train collided with two men, the stretch of track between walnut creek and the pleasant hills station. they are conducting their own separate investigation. they are hoping newly released surveillance video will help

them catch a sused gunman. these men highlighted in the video. they were involved in saturday's shooting at the spot nightclub. officers say the club employee told them to turn their music down. the 43-year-old victim still recovering from the hospital. if you recognize anybody in the video, call campbell police department. gang-related crime in san jose is going down. the san jose police department says, gang-related murders, assaults and robberies have dropped more than 15%. that's compared to last year. the numbers could go up. it often takes weeks, sometimes months after a death to determine whether it was gang-related. also, this morning, a south bay city says it is willing to risk lawsuits. this is santa clara county courts come under fire for not doing enough to keep guns out of the hands of the mentally ill. today in the bay's marla tay yes

joining us from the newsroom with two separate stories in the south bay linked to one controversial issue, that being gun control. election day is coming up on tuesday, november 5th. on the ballot is the controversial measure c. so controversial, it says that if it passes, the nra will sue the city of sunnyvale. these are the four points of measure c. it would require gun owners to lock up their weapons at home when they are away from home. gun owners would need to report a stolen gun within 48 hours. it would would also require detailed records on ammo sales and would ban all magazines holding more than ten rounds. a sunnyvale major says stricter gun control has been on his mind ever since the mass shooting in newtown, connecticut almost a year ago. i got angry. i said, that's enough. when do we stop?
