damian trujillo is live in milpitas with why this crash scene may turn into a crime scene very soon. dami damian, good morning. >> reporter: they are still investigating. two lanes ever 680 here south of scott creek road remain closed. we're hearing about 6:00 is when they might even begin to reopen it. here is what happened. construction crew was picking up construction signs here, they were doing emergency road repairs. the chp says a silver nissan veered off the road and pinned the worker against his truck. that worker unfortunately died here at the scene. another construction worker was moderately injured. he is at the hospital as well. the driver of that nissan had to be extricated from his car. he is facing life threatening injuries at local hospital. here's why police say this might turn into a crime scene. >> at this point we're going to try to determine the reason for the collision, why the silver

nissan left the roadway and collided with the contract workers and the vehicle and to find out if dui was a factor in this collision. >> reporter: if this does turn into a crime scene these lanes might be closed for the foreseeable future. that's why the chp says it's very important to pay attention to those warning signs that say workers ahead or construction ahead. in other words, slow for the cone zone is what the chp is saying. and mike inouye, our traffic reporter again, mike, they tell us about 6:00 is when they will start possibly reopening the lanes but they are not sure. >> thank you. damian continues to follow that situation. a tragedy there as far as your morning commute so far there's also an impact determined to be a sigalert. probably an hour and maybe more depending on the circumstances. get you located where this is relative, here is the bay area. south bay at the bottom. coming out of san jose, milpitas and up to fremont.

scott creek road. you see orange sensors that it slowed. approaching damian's area. that's when the commute is getting started. traditionally counter commute. the bulk coming south out of fremont and into milpitas. but we do have slowing past that scene. use northbound 880, cross over at mission boulevard which is clear but we do see a little bit of traffic flow starting to build in the last few minutes. so people aren't already thinking about the alternate, follow this because it will be at least 6:00, maybe longer. we'll get those from damian and follow the effects on your commute. >> we have an update to breaking news out of the east bay. police in hayward investigating a shooting, a woman was shot and left in a parking lot of an apartment complex in hayward. it happened after 11:00 an sleepy hollow street near west tenn tennison road. good morning, bob. >> reporter: good morning. right now the problem is police

do not have a suspect info action description, because their only witness has been in surgery, that's the woman who was shot. it was around 11:00 last night someone called, actually a lot of people called 911, police tell us, to report hearing lots of season shots. the first on the scene found this woman lying on the ground at this apartment complex. she had been shot multiple times. she was by herself. she had been in surgery as i mentioned. police tell us her injuries are most likely life threatening. they hope they are eventually able to talk to her because right now as i mentioned she is the only witness to her shooting. she may be able to give a lead who shot her and why so. far police know of people who heard the shooting but not anybody who witnessed it. >> there's not a lot of leads for tuesday go on. our inspectors are currently working every angle they can. and eventually we'll be able to

get something from this. >> reporter: when we spoke with p.d. an hour or two ago at the time they had not had an i.d. yet on the woman. we will look into whether there was some sort of argument beforehand. reporting live, bob redell, "today in the bay." >> two young children are recovering after they were hit by a car while trick-or-treating. this happened in the north bay. the 12 and 13-year-old boys were hit while in a crosswalk in the town of cloverdale. police say the driver is a 75-year-old man and he is cooperating with the investigation. officers do not think he was drinking, speeding or even using his cell phone. the boys were taken to the hospital. their conditions are not known. >> the sonoma county supervisor accused of trying to break into a santa rosa home will be in court. 32-year-old was arrested back in july after a woman called police saying someone was trying to break in through her bedroom

window. while police were on the way he knocked at the front door, identified himself as a neighbor and then ran away. he's charged with one misdemeanor count of peeking. >> a south bay father is in fail facing child endangerment charges after police say he left his kids 18 an suv for 15 hours. julio reyes parked his car about 10:00 tuesday night. he then went off to meet a friend. neighbors reported the car to police around 1:00 the following afternoon. inside police found reyes' 8-year-old son and 10-year-old daughter alone with the doors unlocked. the kids were immediately taken into protective custody. reyes did not report his children or suv missing until late wednesday night. >> it's 5:05. this morning police are still trying to track down the owners of two pit bull mixes that attacked people in antioch. a man was walking his dog when's

interstate 680 where a contract worker for caltrans died after a car hit him. damian trujillo is live in milpitas with the latest on this investigation. good morning. >> reporter: good morning, laura. chp opened the middle lane of northbound 680 but the lane closest to the edge of the highway remains closed and will remain closed for the foreseeable future. chp tells me they may bring in its multiaccident investigation team which means that this might be closed for the foreseeable future again. here's what we know so far. the crew was doing emergency repair work along highway 680 when a silver nissan veered off the roadway. that nissan pinned one of the construction workers against this truck, the worker died at the scene. a second worker was also injured. he has moderate injuries, he's at the hospital. the driver of the nissan had to be extricated. he, too, is at the hospital with life threatening injuries and

bay and north, out of milpitas into fremont, north, see the traffic stacking up all the way up to scott creek road. you travel in that northbound direction. now he said one more lane has opened so now there's just your slow lane blocked. all of the crews including ours and other media crews and the investigation that continues, a lot of light there causing dix traction northbound. that's unexpected. you see north 880 a little fwit the left starting with a slowdown as the volume starts to build. use that as your alternate, things are going to get more crowded over the commute. 237 will also connect you to 880. the rest of the commute looking pretty good into the area. we'll cover that later. back to you for now. >> thanks. 5:31. overnight shooting has police in hayward looking for answers this morning. they say someone shot a woman more than once late last night,

then left her body near a popular apartment complex not far from trick-or-treaters knocking on doors. bob spoke with police and he is live in hayward now with his new information about the case. good morning. >> reporter: good morning. it should be noted this shooting took place after most other trick-or-treating happened around 11:00 last night. so it's most likely not the case that there were kids out and with when this happened. this woman was not wearing a costume, by the way. hayward p.d. tells us they don't know if she lives in the complex or visiting. the problem is they don't know who they are looking for. in terms of suspects or suspect. it was around 11:00 last night someone called 911, had a lot calling in reporting gun shots. the first officers found this woman on the ground in an apartment complex. she had been shot multiple times, left by herself. it's not like they showed up and someone tending to her.

she has been in surgery. police tell us her injuries are most likely life threatening. they hope that she recovers so they can speak with her, obviously. because right now she is the only witness to her shooting. she might be able to give the investigator some sort of lead as to who shot her and why. so far police know people who heard the shooting but anybody that might have witnessed it. p.d. also looking into some sort of argument. as far as the identity of the woman they haven't figured that out as well. bob redell, "today in the bay." >> a health scare at stanford university has employees sanitizing dorms after more than 50 students have gotten sick. the university's health department is running tests but they think the norovirus is to blame. this week 52 students in the same dorm came down with a norovirus type symptoms. vomiting, stomach pains and headache and diarrhea. this is a time of year when

norovirus outbreaks happen it could be receiver days before they pinpoint a source. overnight crews cleaned the dining hall. >> a family from brazil is searching for a missing loved one. anna and her mother flew in after paulo netto called family monday night. he said he was in trouble and someone was trying to hurt him. his phone's location was on shotwell in the mission district. no one has heard from him since those calls. >>ly is a nice boy. he was not the type of troublemaker boy. he's really intelligent. he speaks four languages. >> rodriguez says it's very unusual for netto not to be in touch. he was supposed to take a bus back to los angeles on sunday but never boarded. his family filed a missing persons report with san francisco police. they are replacing his steps hoping for clues that lead them to netto.

bike path. they implemented specific hours when daylight saving time ends sunday and it starts getting darker earlier. a spokesman says if you want to walk or bike the bridge get there before 4:00 p.m. to give yourself enough time to walk the 40-plus mile route. the new hours will be in effect until march. >> and starting tonight once that sun goes down the lights on the bay bridge will light up. since it was put back up or put on rather in march, the lights have been on every day from 2:00 a.m. until dawn. but illuminates the arts, the group that installed the project, got the time extended to dusk to dawn. so when it's dark out, the lights on the bay bridge will sparkle. as i said, the l.e.d. light sculpture was by the group illuminate the arts. there is a celebration tomorrow. >> it's always pretty. that will be great to see it on especially in the early morning hours.

5:41, just in germany's top securi security, german investigators want to talk to snowden about the national security agency's alleged monitoring of german chancellor angela merkel. germany's top security official wants clarification and further information, snowden could be asked to testify at the german parliament hearing later this month. >> starting today millions of families may not have enough food. food stamps are being cut because the stimulus money that boosted the benefits for last

four years it's run out. tracie potts live on capitol hill this morning and tracie, we can anticipate more cuts? >> reporter: right. in addition to the money that ran out and will have an immediate impact congress is looking at even deeper cuts to scale down this program that really mushroomed over the last several years, as a result of the recession. there was a deep recession, people weren't working, there weren't jobs and so people didn't have money for food and we had a lot more people on snap as they call it in d.c., the supplemental nutrition assistance program. they are trying to pull that back. the stimulus money that was included that raised benefits during the recession, that ran out last night. so, that's going to have an immediate impact. the benefit now averaging in california $147 per person per month. that's going to drop on average by $11 per person, $36 for a family of four. in addition to that democrats

and republicans both say they need to make cuts in this program. but there is a big difference in how much. democrats want to cut 4.5 billion, republicans ten times that and tie to the work status f. you are working less than 20 hours a week, if you are not in job training, the most you would be able to get under their plan are three months of benefits over a three-year period. they are still working that out. >> one we'll continue to watch. tracie potts live from washington. 5:43. the the new york city marathon is set to resume after being postponed by superstorm sandy. 45,000 runners expected to lace up the shoes and cross the finish line in central park. many of them not even phased by the boston marathon bombing. they aren't worried. but as a precaution extra security has been added and for the first time a security check point, last spring two bombs exploded near the finish line in boston, killing three and

injuring hundreds. the fbi is now investigating a security threat that targets a plane that flew out of sfo yesterday. the united express flight was headed to san antonio a7 when was diverted to phoenix. all 42 passengers were safely evacuated and nothing suspicious found on board. the fbi is not confirming the nature of this threat. >> holiday travel expected to be nicer now that the federal aviation administration has changed some of its electronic device policies. while airlines must still apply to the faa before they ease restrictions, many say they will do it in time for holiday travel. here are the rules. tablets, mp 3 players and electronic toys can be on the whole flight. cell phones can be used as long as they are in airplane mode which means no calling or texting during your flight. and keep in mind lap tops and other heavy devices you got to stow them during take-off and landing. >> i have to admit that most important part about the
