overnight in the parking lot of an apartment complex in hayward. >> the other breaking story on 680 in milpitas where a construction worker is dead after a nissan veers off the road, pinning that worker between two cars. good morning to you. thanks for joining us. i'm laura garcia-cannon. >> and i'm marla tellez. jon is off today. we will have live coverage on both of these breaking stories, but we want to begin with damian trujillo live along interstate 680 near scott creek road where the crash scene turned into a crime scene. good morning. >> reporter: good morning. yes, this is now a crime scene investigation here. chp has opened two lanes of the three here along northbound highway 680 south of scott creek road. here's what we know so far. construction crew working for caltrans, not really caltrans but a contracted crew, they were picking up construction signs after emergency repair along 680. that's when a silver nissan

veered off the roadway and pinned one of the workers against his truck. that worker died here at the scene. another worker was also injured. he has moderate injuries at a local hospital. the driver of the nissan had to be extricated from his own car, he is now been upgraded to serious condition. he does have, however, major injuries. here is why the investigators say this has turned into the scope of this investigation has actually changed. >> at this point it becomes a crime scene. and once it's determined that dui was a factor in the collision, then we will collect the evidence that we need and do what we need do to make sure that we have everything we need for prosecution. >> reporter: chp tells me they did conduct some sort of field sobriety test and that's how they were able to determine that dui was possibly a determining factor in this accident here. the chp has called in from

vallejo a unit called the multidisciplinary accident investigation team, they are coming here from the north bay so it's going to take a while. it's going to be a while before they investigate this area so this one lane will be closed for a while. i'm looking at the northbound lanes, south of this area. it is really backed up along highway 680. damian trujillo, "today in the bay." >> definitely affecting the commute. thank you. >> let's now turn to bob redell with more breaking news this morning, this time in hayward. a woman is fighting for her life after she was shot overnight. bob, what's the latest? >> reporter: good morning to you, laura. hayward police, the problem they have with this case is that they don't have witnesses. so they don't have a suspect description, they do not know who they are looking for. this happened around 11:00 last night. there were many who called 911 to report hearing gun shots. the first officers on the scene, they found this woman lying on the ground in an apartment complex located near sleepy

hollow and 10 tenisson. she was left by herself. it's not like there was someone trying to help her. she has been in surgery, police tell us that her injuries are most likely life threatening. they hope she can pull through and talk to her. she is the only witness to her shooting. she may be able to give a lead who shot her and why. police know of no people who saw the shooting, just people who heard it. >> right now there's not a lot of leads for us to go on. our inspectors are currently working every angle they can and eventually we'll be able to get something from this. >> reporter: hayward police are also looking into whether or not there might have been an argument beforehand. reporting live at hayward police, bob redell, "today in the bay." at 6:03, fire crews mopping up after an early morning fire

in downtown san jose. it broke out about 5:00 this morning at a victorian style home near east st. john and north 12th street not far from san jose state university. san jose fire department tweeted throughout picture from the scene. the flames were shooting out of the roof of that victorian. the good news, crews were able to quickly knock down the flames. we're told the people inside, nine, made it out safely. >> 6:04. new this morning the fbi says it's scaling back its investigation into the shooting death of 13-year-old andy lopez. the press democrat reports the fbi will not conduct a full independent investigation. the agency is expected to offer local police support. meantime, the lawyer representing lopez's family has filed three claims against sonoma county. the attorney says the family will file a federal lawsuit in san francisco. >> the press democrat says the deputy who shot lopez has been

very emotion al. her client feels emotional about the loss after young man's life and the effect on the family. this comes in the midst of several heated protests, marches and emotional vigils demanding justice for the teen. the deputy shot lopez seven times last tuesday. he says he thought the replica ak-47 lopez was carrying was real. >> a health scare at stanford university has cleaning crews sanitizing dorms after more than 50 students have fallen ill. it's at the florence moore hall where it's in the southern portion of the campus not far from the lagunita. 52 florence in the hall came down with a norovirus type symptom, vomiting, headaches. this is a time of the year when norovirus outbreaks happen. it could be several days before they pinpoint a source. time to check that forecast. we're going to take you out and give you a trip to san francisco

all for free. look at that. what a gorgeous shot. the spark offing lights. dark skies as we wait for the sun. good morning to you. let's look at the forecast. a very clear start. >> you know at this time on monday we're actually going to have a little bit of that sunlight on our live cameras as you know it's a day light saving weekend, day light saving comes to a close through sunday at 2:00 a.m. it's chilly to start the day but temperatures are going to climb, in some cases by 40 degrees as we get to this afternoon. the warmest day of the week. temps drop off through saturday, we have a wind event to tell you about. i'm going to detail that in my next report. count on beezy to windy conditi. temperatures the low 80s. 75 bay side and at the coast 63. stick around, yoush seven-day forecast is coming up. we'll talk about that wind event and what you can expect for the first full week of november.

meanwhile, you want to get an update on the police activity in milpitas, here is mike inouye. >> good morning. we have all of this traffic jammed up. damian trujillo is on the scene. christina talked about police activity. we have a crash now a police investigation after earlier morning deadly crash, north 680 as you get up toward scott creek road. we still have one lane blocked. look at this traffic. we'll look at the map n is the area with the slowdown, from approaching 237 out of milpitas and may be as far back as montague, we've seen slowing as you head north. this is before you get to mission or dixon landing road. a cut over to the backup. you can use 880 around and then mission boulevard takes you back to 680 northbound and gets you around that. it's what we call counter commute. the bulk southbound 880 but again the distraction from all of this activity and the backup will cause a problem into milpitas out of fremont as well.

looking toward north 101, pretty predictable but we have a crash at tully on the 101 northbound and at the interchange 880 and 101 so expect more slowing. the rest of the south bay has a pretty gentle build typical after 6:00 on a friday. there it is for the south bay. the peninsula moves smoothly. we'll give a live look at palo alto with the head lines, all the way into san francisco. 280 no problem there is or along the coast. the northbound easy drive, picking up the volume so look to the east bay where we have a bump up. the tri-valley also has slowing through dublin and the castro valley in spots. the bay bridge toll plaza t backup for the cash lanes. no fast track backup yet. we'll see how things shape up.

>> we'll keep checking. thanks. it's 6:08. expect to save on your power bill. pg&e officials say they overestimated how much it was going to cost to upgreat pipelines and they are now passing on the savings to you. it was going to upgrade 185 miles of natural gas pipe line but only need to work on 145 miles and that's going to cost consumers $900 million, that's down from $1.1 billion. >> the third phase after plastic bag band, restaurants will no longer use plastic bags. customers kand bring their own reusable bag or no bag at all. the nord answer started with kros by stores in 2009 and extended in july. palo alto is the second peninsula city to ban restaurants from using plastic bags. >> coming up heightened security.

over the weekend. that information coming up in two minutes. >> we're looking at the 880 through fremont now. that's fine at the truck scales getting company but a slowdown on 680 coming into fremont out of milpitas because of that sigalert and investigation. we'll follow those with two reports coming up. here are today's top stories. police in hayward are looking for the gunman who shot a woman last night outside an apartment complex. on sleepy hollow. officers say she was shot multiple times. right now there are no suspects in this case. >> a crash scene now a crime scene in milpitas where chp officers say a suspected drunk driver crashed into a construction worker, killing him instantly. it happened about 2:30 this morning on northbound 680 near scott creek road. chp says drivers can expect major delays throughout the morning. >> people are camping out to get their hands on apple's new ipad

air. this is video from a store in new york city. the gadget went on sale on the east coast at 5:00 this morning and then will go on sale here in a couple hours. the new ipad air weighs one pound and the thinnest and lightest so far. the starting price, $499. >> attorneys are trying to delay the execution of a death row inmate in ohio while they gather evidence about a new lethal injection process never used before in the u.s. ohio plans to execute the convicted child killer ronald phillips by using a two-drug combination. anesthesiologists said it's a sedative and painkiller which would cause phillips to stop breathing. phillips will testify by video at a federal hearing today. >> as early as today more than a third of abortion clinics in texas could be closed. a federal appeals court says the state's tough new abortion restrictions are allowed to go into effect today while they are

challenged. right now there are 32 texas clinics that perform abortions, 12 of those don't have doctors who admitting privileges at nearby hospitals which is what the new law requires. >> this morning security will be tight along the route of one of the most prestigious running events, the new york city marathon. organizers are spent $1 million on security this year sparing no expense in the wake of the marathon bombing in boston. kathleen craig joins us along the route with a look. >> reporter: good morning from rainy central park, right here in the middle of new york city where already security is heightened right here and it is near the finish line of the new york city marathon already the nypd concrete barriers are set up. you have private security officers here, also city police. people we talked with feel comfortable what kind of security there will be on sunday and said everyone should feel safe too. marathon runners will again take over the streets this sunday as

the new york city marathon returns, the storm sandy forced the race to be canceled last year and the race comes months after the deadly destructive terror attack during the boston marathon. security has been heightened. >> i think new york city got their job done right. i really do. it's a good thing. >> runners should feel safe. spectators do. >> i think also be cautious. >> approximately 48,000 runners will take part in the race, at least two million are expected to watch along the route. bomb sniffing dogs and untsds cover officers will roam among the crowd. 100 mobile security cameras install affidavit the boston attack will be used. some of the major marathon security changes include additional bag checks, marathoners will not be allowed to use large water packs or strollers, cannot wear bulky costumes or masks.

organizers will fence off near the finish line, it used to be open from 59th to 85th street on sunday. the area will be limited to 59th to sikts 6th street. the two brothers accused of the boston bombing, three people died, 260 were injured. marathon organizers tell us this will be like stadium security, there will only be certain points of entrance in this area near the finish line, also bags will be checked and security will be intense. reporting from central park in new york city, catherine craig for "today in the bay." >> such a popular event there. thank you. >> it's going to be a nice weekend if you want to go out for a run. that's for sure. >> it is going to be nice. would you have changes, some wind. if you're in the south bay,

yeah. >> you saw the showers coming down and the new york area and that is forcing some flight delays a. system of low pressure headed that way. make sure you check ahead. 41 in gilroy, 48 in san jose. we have a system with low pressure headed our way but more wind than anything. maybe a little light rainfall up to sonoma county. i wanted to show you your lunch time temperatures because this will be the warmest day of the week. and temperatures are going to climb into the mid-60s in some cities as of noon today. that's livermore,ant wok looking good for the 70s across the bay area. 74 in santa cruz and 81 degrees for the first day of november in livermore. so let's get to the weekend changes. i want to show you a couple things. we stop the clock on futurecast. it's behind this front we're going to see the gusty winds. let's take to the futurecast for

wind. this is going to be the big concern throughout the weekend. if you are waking up along the coastline or the north bay that's where we expect the strongest wind gusts. about 6:00 p.m. winds whip through the north bay. the warmer colors that's the fiercest wind. getting into early sunday the winds crank for most of the bay area. here in san jose we'll be in the yellow. that's 20 to 30 miles per hour wind gusts. all the way through the north bay we're going to see 50 mile per hour gusts at times. you want to make plans, saturday looks to be the best. behind the front we're going to see cool air on sunday. 69 degrees. we'll climb monday into tuesday. and temperatures overall looking pretty good. that's our one and only chance for hower activity throughout the next five days. we might get another chance. we're tracking that. tracking your drive, there's a lot going on. >> friday usually lighter but

the south bay, tri-valley. overall this doesn't look too unusual until i clear this area. we're looking here north 680 up toward scott creek road, we do have traffic starting to recover. before you get to the off ramp we have one of the lanes blocked by the investigation. that's causing things to bag down. you expect slowing toward calaveras. that's your work around to get around that scene. we should see slowing if you head southbound past the scene because of the distraction but the later build for the commute direction down into the area out of this tri-valley and the east bay for 880 and 680. we show the drive through the area we're going to move on to rest of our wider view and north 101. we have another crash there. adding to a slowdown but the

rest of the south bay not a major problem. we'll skip to where we see slowing. emeryville, the camera shows a slowdown through berkeley and we see the volume building. that's where the speeds dip, there is university avenue. we saw the cash lanes back up and now the fast track lane which is should build over to the metering lights which are not yet on. we're southbound 101 through the east bay. no surprises, slowing around highway 37. easy drive across the colden gate bridge. back to you. >> 6:21. coming up southern california town says a ser rachy factory is too much to handle. what it means for the future of the hot sauce in our state. >> and you thought your halloween decorations were cool. do they stack up this this

6:24. >> a follow-up to a story we're reporting all week. southern california factory that makes a sriracha sauce will not have to stop. a judge ruled he did not have time to review the case and refused to order a halt. the city of irwindale sued saying the hot sauce maker stinks up the city and that the smell burns their eyes and throats. the judge scheduled a hearing for later this month. th candy hangover. next week lays is rolling out wavy potato chips dipped in milk chocolate. the chips, they are only going to be sold at target stores. only available through the holidays but they say not surprisingly if the chips are a hit they could become a permanent fixture on store shelves and perhaps in your mouth. >> those chips are a sweet treat but check out this sweet trick

crime scene. the chp says the suspected drunk driver crashed into a construction worker killing him. that driver is now in the hospital but the person's condition has not been released. we will have live reports on both of these breaking stories coming up in the next 15 minutes. >> the fbi is investigating a security threat that targeted a plane that flew out of sfo yesterday. the united express flight was headed to san antonio last night when it was diverted to phoenix. all 42 passengers were safely evacuated and nothing suspicious was found on board. the fbi meantime is not confirming the nature of the threat. today more than 47 million americans who get food stamps will have reduced benefits. a family of four will receive $36 less each month that adds up to more than $400 less a year. the reason t 2009 economic stimulus is ending.

it helped to temporarily boost food stamp dollars, one in seven americans receive food stamps. >> a change could be in store for your health. if your health insurance includes a use or lose rule for the flex plan. tracie potts joins us on capitol hill with a look at how the treasury department and the irs are modifying the plan. good morning. >> reporter: good morning. that rule was so frustrating for people who would end up losing money at the end of the year. now the flex plans are going to be a lot more flexible. take a look. instead of use it or lose it, they are changing the rules so that employers can actually let participants hold on to $500 a year at the end of the year and carry that over to the next year to use those unused funds. currently most people are forfeiting less than $500 so this is going to benefit a lot of the 14 million people who the u.s. treasury department says are already using these flex plans. they became popular sponsored by employers so you can set money

aside tax free. as long as you can pinpoint at the beginning of the year how much you think you'll spend in medical bills throughout the year. a lot of people didn't do that well and that's why there was leftover money at the end and the trush use it up before the end of december. now the government announced it's relaxing the rules. let people carry over $500 or give them 2 1/2 months the beginning of the next year to use up what they have left. the thing is it's not your choice, it's your employer's. >> that's what i was going to ask you about. you clarified it for me. thank you. >> let's turn things over to meteorologist christina loren on this friday. very comfortable temperatures even reaching 80. >> 80 for the first day of november but we're starting out cold. one of those days we're going to see a broad spectrum where we're starting and where we're headed. 47 degrees in livermore. 48 in san jose and 40 in gilroy. so jumping 40 degrees between now and the heat of the day n.

is the warmest day of the week. by this weekend pretty significant changes. temperatures are going to drop off particularly into sunday. but it's a wind event we want to tell you b. winds starting to pick up late saturday night into the first part of sunday. that mostly goes for the coast, the higher elevations. keep in mind that could impact your outdoor plans, if you have loose objects in your yard taye tie those down or bring them inside if they could get damaged. 50 miles per hour wind gusts starting late saturday through sunday. bay side 75 and 73 at the coast. looking really good for a warm sunny finish. and then things change. we're going to show you how that looks on the seven-day forecast. talk about the sun rise and sun set. first, mike's tracking that traffic alert in milpitas. good morning. >> good morning. this is unexpected so heads up if you travel out of the south bay into the tri-valley or the east bay. this shot i'm showing you from damian trujillo who is on scene

of this deadly crash investigation. crime scene investigation now. one lane is coned off. you have two getting by northbound with all of this spectator slowing and funneling down on the freeway. we're looking at the traffic flow here. i'll show you on the maps to the top of the screen. there is the bay area. as you travel north through milpitas and up into fremont you see the corridor for northbound 680 away from us f. you can we'll take over to 880 and use that to mission boulevard. back over to 680 northbound up in the tri-valley. that's opposite the main commute. you saw from the live shot the commute direction southbound for 680 is moving so that's the better news for the morning commute. coming into fremont out of union city, there is a car fire at alvarado boulevard for northbound 880 which may add slowing through that portion. here the south bay slowing. clear from tully, still paperwork going on.

87, 85 showing slowing. a live look across the bay for the san mateo bridge. more company but no big drama. there is a trash bag, 880 at the connector so watch that and also the bay bridge toll plaza. the metering lights on. no big drama for the maze or approaching and the north bay typical slowing for 101. back to you. >> if you want to walk or bike the bay bridge get there early. soon the bike path will be 7:00 a.m. to 5:30 p.m. the specific hours begin on sunday. the new 7 a.m. to 5:30 p.m. will last till march. >> as soon as it's dark out the lights on the bay bridge will shine all night line. since the sculpture was put up in march the lights have been on every day from 2:00 a.m. until dawn. but the group that installed the lights got the time extended to

a police chase in standoff and gun fight. the chase began before 11:00, the driver pulling out a gun on a police officer. then driving away. the police officer gave chase and soon dozens of squad cars joined in. the chase lasted for an hour until the driver eventually crashed into a tree. he then even refused to get out of the car for four hours. s.w.a.t. team arrived and about 3:30 this morning they opened fire. we have not been told the suspect's name or his condition. >> this morning investigators in kansas are trying to figure out how a school bus carrying children toppled off of a bridge into the water below. we have new video of the scene this morning and as you can see from this, the bus is still on its side in the creek. all ten children and the driver were pulled out safely after it landed half submerged in a creek yesterday. everyone escaped through a roof

hatch. rescuers reached the bus with lines and put the kids in life jackets before pulling them to dry @cground. sections of the bridge was covered by water. one child said the bus hit bumps before it fell in the water. >> severe weather to tell you about moving east after hitting the south in nashville violent storms claimed the life of a 9-year-old boy. he died after being shocked by a downed power line. in texas, roads and neighborhoods filled with water as 14 inches of rain fell in 24 hours. look at that. people have to try to get around. more than 60 people rescued and rescues are likely to continue today. so far two people have died in the flood waters there. >> 6:41. live updates to two breaking stories in the bay area. the first in hayward where a woman is fighting for her life after an overnight shooting in

you want to keep that in mind. look at the temperature spread in santa rosa, climbing by about 42 degrees in the heat of the day so. you'll hit about 36 as a low in santa rosa, jumping to 78 degrees by 3:30, 4:00. gilroy is going to climb by 40 degrees. we'll climb by 28 degrees in san jose. so a nice warm day headed our way. and changes for the weekend. 81 for livermore, 77 concord, 75 in fremont and 76 degrees in redwood city. san francisco will be comfortable at about 73 degrees. so that's a nice temperature. for this time of year. i want to point out where we're headed throughout this weekend because we've got an area of will be slated to bring showers to tahoe so saturday if you are headed up there, 57 degrees, makes sure you have chains. we might get snowfall through saturday night. and look what the area of low pressure is doing to your temperature sunday.

it their multidisciplinary accident investigation team. they haven't showed up yet. they have to process this scene for any possible evidence that they might have in this what appears to be a dui case. the chp says that the construction workers were picking up signs, construction signs in zones after completing some emergency repair work along highway 680. that's when a silver nissan veered off and collided against the worker's truck, pinning one of the workers. that worker died at the scene. another at work sustained minor injuries. the driver of the nissan is at the hospital now. they were able to do some dui testing on him, that's how they were able to determine that this was perhaps a dui investigation. nevertheless, once that person, the driver of that nissan, once

this was his third strike. he could face 40 years to life in prison. his previous convictions mol vary manslaughter. >> a man accused of opening fire at a store in san francisco's jewelry mart will be back in court. a status is scheduled for barry white jr. white is charged with 16 felony counts including murder an attempted furd. he has pleaded not guilty. police say he enters a jewelry store and opened fire killing through women and injuring the owner. white was upset about the value of jewelry he previously purchased. >> a family from brazil is searching for a missing loved one. anna and her mother flew in after 23-year-old paulo netto called family monday night. he said he was in trouble and someone was trying to hurt him. his phone's location was on shot well in the mission. no one heard from him since
