jersey, and our first look this morning at the alleged gunman who walked inside new jersey's garden state plaza and opened fire. that mall which is the largest in the state is in the town of paramus about about 15 miles north of manhattan. the gunman stormed that mall just before closing. marla tellez is in the newsroom with all of the overnight developments. >> a lot has been going on. early this morning the crisis came to an end when officials say the 20-year-old suspect shot and killed himself in a remote area of the mall. and in the last 60 minute this is picture was released of him. he is richard shoop, police say he is from new jersey. authorities say he does not have an excessive criminal history though they know of him for his drug use. shoop was found after 3:00 a.m. local time with a self-inflicted gunshot wound to his head. authorities found a note at the scene indicating he intended to hurt himself. >> i do not believe mr. shoop

thought he would come out of here this evening alive. it could have been a suicide by cop intention, but it did not appear at least at the outset from what we know now his intention was to shoot anyone. >> unlike other recent shootings we've seen lately this is different in that no one else was hurt. it was just before 9:30 local time last night before the mall was set to close that officials say shoop walked into the mall and opened fire using a modified ak-47. witnesses say he was dressed in black wearing a motorcycle helmet. one witness says shoop appeared calm as he fired off more than six rounds. >> looked like he was having fun enjoying shooting but i don't think he was shooting anybody as far as human beings. i didn't see anybody in the mall getting hurt. people were running around. >> we've seen live pictures from the mall. it's just after 8:00 a.m. there. it looks like business as usual.

paramus police say hundreds of people, customers and employees were forced to stay in the mall as it was in lock-down mode. once shoop was found the people t customers and employees were allowed to leave in the last couple hours and be reunited with their family. coming up i'm going to talk about where police think this gun that shoop used, where it came from. one hint, it's not his. >> frightening for a lot of people. it's 5:03. closer to home after a heated debate over gun rights, pleasant hills council passed a proposal limiting gun rights. last night the city voted to limit areas where gun stores can open and also require owners and employees to pass criminal background checks. dozens of people were at last night's meeting. the ordinance will get a final vote on november 18. sunnyvale voters expected to take on the issue of gun control at the polls. it's a measure that's considered

so controversial depending on the outcome it could land the city in court. christie smith live in sunnyvale with more. good morning. >> reporter: good morning to you. a lot of people keeping a close eye on this one. if voters here in sunnyvale approve this gun control measure, go way beyond what state lawmakers and even the governor tried to do f. that happens, the nra is saying that they would go ahead and sue if measures pass. they are looking at cases it could take to the u.s. supreme court. proponents say it would help prevent mass shooting tragedies like the one we saw in new town, connecticut and also suicide gun accidents. opponents say it would do nothing to reduce gun violence or violent crime. measure c would require people to report lost or stolen guns to police within 48 hours, require firearms to be locked up when not in use, and require

registration for ammo purchased kept on file for two years and prohibit magazines with more than ten rounds. feelings are mixed. we spoke with one resident who asked he not be identified. >> i think it's due. all for it. >> probably keept most locked up. if you have one gun set up for home defense, it's really no good locked in a safe. you can't stand there and say hold up on the robbery, i got to unlock my gun. >> reporter: and up in san francisco, voters will decide on prop b which would repeal waterfront height limits near the embarcadero between washington and broadway. what's happening here is this has to do with a proposed site of multi-million-dollar condos, the water front battle asks voters to sign off on a complex called 8 washington. you may have seen commercials about that.

reporting live, christie smith, "today in the bay." >> thanks so much. today voters in palo alto will be asked to decide the fate of the housing project. the city wants to rezone the area to allow 60 affordable apartments for seniors and 12 single family homes. in san mateo county measure it's aimed at relieving overcrowding. mr would renew two parcel taxes. >> a new study focusing on california finds child care requirements are not strict enough. in the study the department of health and human services finding 21 states including california do not require a yearly unannounced inspection of licensed child care providers. only 15 states require background checks. it even when unannounced inspections were required they were not always done.

common problems include not enough staff, unscreened people living in family child care homes and broken play ground equipment. the study sampled five states, california, florida, illinois, ohio and texas. california does require unannounced inspections every five years, that's the least strict of the five states. it does, however, require background checks for child care employees who interact with kids so does not include employee likes janitors. >> a morgan hills day care worker could soon in in court after she was accused of being drunk on the job. 58-year-old ana marie lopez was arrested yesterday at the child development center on west main near peek avenue. she is right now facing child endangerment charges. >> 5:07. time to check the forecast with meteorologist christina loren. she's going to look at it for us. >> good tuesday morning to you. we're starting out nice and

clear. not tracking any fog. this is san jose. we have the same beautiful clear sky this morning right over san francisco. so, as we head throughout the next couple hours it will be cold, then by about 11:00 you can probably peel off your first layer. layer up because we'll see a sunny mild finish. 50 degrees in livermore. 45 in san jose. 48 in sunnyvale. it's mild in livermore because we're getting the nice dry northerly wind. we lost that in napa and you lost 8 degrees as a result. so temperatures are going to go in and out. the winds will drop off. this afternoon about 76 inland, 72 bayside. at the coast around 69. i'll have a full look at the forecast and tell you about the showers, i'll let you know when we expect those raindrops. right now let's check on the traffic. any improvement in livermore? >> there is. i'm happy to nail request. looking at fremont to show you a light flow of traffic.

this is getting into the south bay for 880. the south bay is clear. better news for our maps. this is the bad news. dublin pleasanton a lot more crowded. a rush of traffic because of these folks that were held up behind this crash west 580, all lanes cleared. 2 1/2 minutes ago. now all of the traffic will flow from this area into the dublin interchange westbound out of the altamont pass. that is the big backup. here north 680. reports after metal box in lanes. they have to clear it. that is counter commute. we're looking that the commute moving smoothly despite this crash. west 80 at central, reports of debris in the lanes. one vehicle on the shoulder and there may be injuries. an ambulance is heading to the scene. back to you. >> thank you. it's 5:09. when we come back a startling new development in the disappearance of a san francisco general patient. what attorneys are saying.

well. bob redell is joining us live. he has more on what we can expect. good morning. >> reporter: good morning to you, jon and laura. you look inside the resort and casino it's a las vegas style gaming venue. definitely the largest in the bay area. and one of the largest if not the largest in the state of california which will be opening just a few hours from now. give you the lay of the land around the gaming floor. facility is 340,000 square feet. you've got 3,000 slot machines, some of which you're looking at. 144 table games, this is an indian casino owned by the federated indians, this is created 2,000 jobs in sonoma county and according to analysis this is expected to generate a little bit over a half billion dollars in revenue by 2016. that means a lot of people are expected to visit this location which as you mentioned is just situated off 101 and rohnert

park. the projection is extra 10,000 vehicles per day on that stretch of roadway. police will have extra officers on duty to deal with traffic jams and chp tells us they have a few tricks up its sleeve as well. >> we are prepared to override the traffic lights, we're prepared to open up the carpool lanes to full traffic. we have social media. we'll be updating our personal facebook here. >> i'm going to try to avoid it as much as possible. yeah. >> you think it's going to be a mess? >> i do. really bad. >> reporter: we should get a good sense of what the traffic jam will be like, what's going to eventually happen in a few hours from now. the grand opening at 10:00 a.m. you can imagine if there are people who want to get her early may start arriving around 9:00. we could get a good idea later this morning what is going to happen with 101. bob redell, "today in the bay."

>> thank you. appreciate it as always. we can tell you the north bay is hoping it will do what casino has done for san jose. that opened in august 2012. it's generated about $10 million in tax revenue and created around 780 jobs. >> 5:15. to washington, congress is considering reining in the nsa. scott mcgrew by cutting the powers of the man in charge. >> keith alexander has been called the second most hower powerful man in washington. the director of the nsa and the head of u.s. cyber command and some in congress think that is too much power in one person. alexander is expected to retire next spring. it's possible the white house will wait until then and take that opportunity to break that job into two. alexander denying reports that the ns sarks reading traffic to and from the yahoo! cloud.

jacket, though, all the way through lunch time and then peel it off. 70 in san francisco, because of that clear start, same for oakland and san jose. 73 degrees now in gilroy, 74 degrees up in santa rosa. 69 down in santa cruz. so let's talk about the changes headed our way. i stop the clock for you. we get through the second half of wednesday we're going to see cloud cover move in. i stop that at about 8:00 p.m. mostly cloudy conditions for the greater bay area. the jet stream moves to the south. that means the storm system, the window will be open for these areas of low pressure to move over the bay area. then we get our first chance for rain. we head through 7:00 p.m. thursday. not expecting a lot of activity. may a stray shower or two. that chance gets better as we head through sunday into monday. overall soupy and much cooler as we head throughout the end of the week into saturday. mostly dry until late sunday into monday. you can see the storm track starting to slowly move to the south. for us we'll meet back on monday

we'll likely be tracking light showers, not expecting much but as long as the jet stream stays south that means we're going to continue to see this chance for rain. it could last into the midsection of next week. so, best chance like i said before right now looks like sunday into monday. we'll let you know if things change. count on a cooler cloudier pattern. thursday all the way through the weekend. 5:19. let's check on the drive. >> i kind of like that cooler cloudy weather. watch for the rain. looking here, i am watching the commute. so far looking all right. the south bay, starting to build with a few more cars, no big drama. we had big drama for the tri-valley. this jam out of the altamont pass. look, it's slow. the sigalert probably has finally cleared. all of these cars heading toward 884 and the dublin interchange

so this area here is going to get a lot of traffic. you'll see that burst through this area. we'll follow that and the ripple effect throughout the tri-valley. the east bay moves smoothly. the earlier debris has cleared. a crash but not a lot of slowing past central, it's on the shoulder. we'll look at the bay bridge toll plaza. we see traffic is light here and no problems down the east shore freeway. another look to the north bay. a warning about that casino. so in rohnert park expect a lot of traffic. >> thank you. this is kind of a strange story here. how did a bus rider in oakland catch fire for no reason? investigators they hope to answer that question today. strange story, the bus was driving near mcarthur boulevard and ardley avenue. the driver noticed the man was on fire and stopped the bus to

call for help. a lot of people jumped out of the back of the bus. the victim has not been identified but we can tell you he has been treated at a hospital in san francisco. however, the severity of his injuries remain unclear. >> new details in the case after patient found dead at san francisco general hospital. 17 days after she disappeared from her hospital room. the chronicle reports an attorney for deputies are questioned in that disappearance. disputing accounts that a witness spotted an unresponsive woman on the stairs. the body of the missing patient was found inside that stairwell several days later. an attorney for deputy says he is basing his assessment on statements from the deputies and, quote, common sense. >> coming up on "today in the bay" pretty amazing video of two sky living planes colliding in midair. believe it or not, everybody on board the plane, they survived.

in about 300 days the mars rover will have new neighbors. india launched a spacecraft today on a mission to orbit mars. it's due to reach the red planet in 300 days. the mission's goal is to search for methane which has been detected previously in the martian atmosphere. this is india's launched a moon probe. amazing story of survival. two planes collide above wisconsin, somehow all nine sky divers on board and the pilots they all survive. >> it's so hard to believe everybody is okay. we're very happy this morning. they are speaking about those death defying moments, doing that on the "today" show.

this is exclusive video from the skydivers' helmet cam. you can see one of the planes hits the top of the other one. there is that fire ball, then the skydivers plummet to the ground. they probably felt safe with their back packs on. the divers were able to open up the chutes. crazy. you see chunks of the plane. one of the pilots had to escape with his emergency parachute. the other was able to land. there is a piece of that -- it looks like something out of a movie. it's going to be talked about with matt lauer today. >> let's not forget there are spinning propellers. you heard those close to you. >> the sound behind me i'll never forget. that's all i could do is stay forward. >> that is you there? that is you getting knocked off of the plane trying to hang on thinking you might get cut in half by one of those propellers.

>> reporter: good morning. in many ways the national gun control debate is being played out right here today in sunnyvale. this would put four limitations on gun owners in the city limits. if measure c passes the nra has said they will step in and sue. one attorney for the national rifle association said that it would put gun owners' lives at risk if it passes. emotions very high on this. one gun store trying to fight back with words on its website. mayor michael bloomberg even weighed in with a contribution to measure c. if approved it would prohibit sunnyvale residents having magazines that hold more than 10 rounds, require people to report lost or stolen guns to police within 48 hours, and require guns to be locked up when not in

do know of him. >> he's someone that does have a drug history, he has used drugs, but what possessed him to do tonight what he did is no one can say. >> here is a live look at the mall. you can see all seems to be back to normal just about 8:35 there. the lockdown has been lifted, this mall is more than 2 million square feet. for some perspective. one of the biggest in the bay area is valley fair mall. just under 1.5 million square feet. you can imagine it was quite a search for this gunman as he had acres to roam free. of course now the investigation into really what caused shoop to snap begins this morning. back to you. >> new this morning the search for a suspect after a police chase that spanned a good deal of the south bay has been called

off. the chase started around 10:30 in sunnyvale. the chp joined the pursuit as the suspected headed south on 101. the chase ended when the suspects crashed at the tennant avenue exit. one suspect is in custody, a second fled the scene and is on the loose. this morning police have not revealed what started the chase. >> an east bay man will be in court facing charges of sex trafficking of children. 23-year-old jamar broussard is accused of forcing two underage girls to work as prostitutes. the girls worked as prostitutes in several states over a period of 2 1/2 years. if convicted broussard face as mandatory minimum of 15 years in prison for each time one of those women was transported out of the state.

for showers thursday night, that chance extends into saturday and sunday. we're going to talk about that. i'll show you the forecast, who has the best chance of seeing showers. enjoy the sunshine. 77 in almost. 73 degrees here in san jose and 71 degrees on the way to los gatos. 70 in san francisco. let's check on the drive, picking up at this hour. good morning, mike. >> we have problems here by the oakland coliseum. look at this shot. on the right-hand side the off ramp, north of there on the northbound side you see the flares late out. chp arrived. they are 00 slowing dow. one lane is blocked heading to the ]ñcoliseum. another crash perhaps related to this crash, that's why you see this. up to high street, that is your commute direction. westbound 580 is not a problem. this should clear up.

a bill moving through congress would outlaw discrimination in the work place against gay and less beion employees. will it come up for a vote? tracie potts is live on capitol hill with all of the latest. good morning. >> good morning. it may not if the republican leader has his way. some lawmakers are trying to do what california has done, ban discrimination in the workplace against people based on sexual orientation and in california they took an extra step on gender identity. here the senate is moving forward, they voted last night to open debate and they could vote by the end of the week. there were 7 republicans who supported the measure. it may hit a halt in the house where speaker john boehner said he does not think this should even come to the floor for a vote. he thinks it could spark frivolous lawsuits and cost jobs. not all republicans agree so we wait to see how much pressure his own party may put on him to bring this up for a vote.

safe area. i turned around and there was a gunman and shot me twice. >> tsa agent james fear was also injured and has been released from the hospital. brian ludmer was shot in the leg and must undergo surgery. the alleged shooter, paul ciancia reportedly used a semi-automatic rifle which was legally purchased. he was shot by police in terminal 3 and is still unable to communicate with investigators but his condition is said to be improving. >> police in denver giving new details about an overnight stand-off with two young boys. police say that pair entered an empty middle school armed, what appeared to be rifles and back packs. police say the teens were probably just carrying bb guns but they were not armed when they were arrested. they reportedly ransacked several rooms, the bomb squad was called in as well after janitors reported the break-in.

this is and what impact it could have on the bay area. it is certainly the largest vegas style casino here in the bay area and one of the largest if not the largest in the state of california. we just got done speaking with the general manager here. he tells us that this new facility has created over 2,000 jobs, some of the workers are out here on the floor this morning prepping for their first day of operation. according to analysis by standard & poor's, this casino is expected to generate for itself a little over a half billion dollars in revenue, that would be by 2016. that means that they are expecting a lot of people to visit which is off 101 and rohnert park. the projection is extra 10,000 vehicles per day on that stretch of roadway. rohnert park police tell us they will have extra officers on duty to help deal with traffic jams.

here is what management has to say about all of that. >> i don't know a californian that doesn't know how to navigate an interstate or find an alternate truitt a place that is important to them. i'm one of those people now. and i know that i know how to navigate roads in california. >> are you saying you don't think it will have a tremendous imsnakt. >> i think that people who are savvy and familiar with traffic which all northern californians are, they are going to figure it out. >> reporter: so, police will have extra officers on duty to help deal with traffic jams and chp as well. they tell us they have a few things they can do. override the traffic lights, open up carpool lanes to help. again we don't know what it's going to be like until the grand opening scheduled for 10:00 this morning here in rohnert park. bob redell, "today in the bay." >> everything shiny and new. >> going to be fun. might have to check it out as a team we'll go out and win big

through about sunday morning into monday morning, that's when we have the best chance. right now we're picking up light totals. i've seen this pattern before and this chance could really ramp up as we head throughout the next couple days so stick with us. i'll keep you updated. it looks like everybody is going to get precipitation as we head through late sunday into monday. today and tomorrow, enjoy the beautiful 70s that we have for you. 77 degrees in livermore. 70 in fremont and 71 in redwood city. the 70s even in san francisco. but that is all going to change and i want to show you your seven-day outlook to get you into the mind-set. hey, it's going to feel like winter here. starting on friday, only reaching the low 70s inland. we'll be at about 72 by saturday, then the upper 60s sunday into monday. and monday look at that, highs only ranking into the upper 50s, 60 degrees bay side and 63 inland. so it's going to get cold.

>> snuggy weather o the footy pajamas, all of that stuff. slipping and sliding around the wood floors. we're doing a nice move here for the peninsula, no problem, the south bay also pretty predictable flow north of 101 with your build, first early there. looking here at trouble spots in the east bay. we have west 580 now starting to recover because of an earlier crash here. that sigalert very early this morning backing up into the altamont pass. i didn't see the flood i expected. toward west 580 it's behaved nicely toward the dublin interchange and 84 through livermore. no problems for 680, smooth into sunol and the south bay. an easy flow westbound through castro valley. 880 past the coliseum. a live shot here, we have one of the crashes. this is northbound 880 approaching hegenberger.

one lane is blocked with these flares a distraction. the next crash up the roadway is on the other side so folks having to weave back and forth. causing additional slowing. it's slow through the area to the second crash on the southbound side at high street. the maze not a problem. it's here, west 80 out of richmond where you have a crash at central, still there, debris, big slowing. one look at the bay bridge toll plaza. you see no problems at the toll plaza. it's the upper part of the east shore freeway. back to you. >> thanks so much, mike. >> it is 5:51. final prep under way as russia gets ready to send the olympic torch to space. >> and stores back up black friday even further.

rocket. two companies will make news. scott will start with tesla. >> we get to see all kinds of numbers. i think the most interesting thing is how many cars tesla sold in europe. this will be the first quarterly report the car company has made since it started selling cars on the continent. tesla is kind after dime a dozen here in fair weather northern california. but sales in countries with much poorer weather, that's going to be a big question mark. tesla shares are up in anticipation of the report. so here's musk. he has his son on his hip. middle last december he sold solar city to the public for the first time. solar city is going to report profits wednesday, on monday the company said it would offer a financial program to investors, they can lend solar city money and get paid back from the money coming in from consumers. they are basically securitizing solar. i said it before t key to
