even though with traffic tuesday, call it turkey tuesday, we expect less folks to hit the road. you see the lights, there is moisture in the air. 116 at 121 a crash, a tow truck should be arriving, maybe a telephone pole hit that's in the north bay. in the south bay an easy drive, we have a lot of construction on 680 and southbound 680, reports of a crash off the roadway actually a car went off the road into the dirt there. no major injuries, we have a crew on scene. traffic flows smoothly. back to you. >> it's 4:32. happening today more than 1,000 people are expected to attend a vigil for a beloved east bay high school football coach tonight. a memorial at fremont's john f. kennedy high school for john webb is growing. the chp says the 76-year-old was directing traffic around a wreck on 680 saturday when he was hit by a car. the san jose state alum was the

football coach at jfk high school. his colleagues say he had opportunities to coach in the nfl but his focus was on student athletes. the vigil will be outside jfk high school at 6:00 tonight. >> the alameda county sheriff's office made a pair of arrests in connection with a 23-year-old cold case murder. steven ruttinger was murdered back in 1990. now deputies from the cold case unit made a break in this case. they will hold a news conference at 10:30, how they identified the accused murderers. >> police searching for a suspect who opened fire sending seven people to the hospital. he opened fire near 96th in east oakland last night. seven men ranging from 23 to 31 were hit. five are expected to survive. two are in critical condition. a motive is still unknown. police are asking anyone who saw

anything to come forward. >> friends and family of a legally blind teen killed in san jose are sending a strong message to neighborhood gang members. 18-year-old pedro cortez was shot at a san jose park. it was the city's 44th homicide of the year. last night people gathering at capital park to honor cortez. his family says was walking with friends when he was shot in a drive by. they say he was not a gang member. and his father even addressed the young men in the neighborhood. >> supposed to be working. i went to work alone. >> heartbreaking listening to that. the family right now is working to raise money to pay for cortez' funeral. during last night's vigil friends gave whatever they had,

coins and bills, they put them in a shoe box, trying to help the family out. >> it is 4:34. the naacp wants four san jose state students accused after hate crime to face harsher felony charges. at a news conference the civil rights organization also called for the district attorney's office to charge the students with false imprisonment. at a march before the news conference students wore tape over their moths to symbolize not being heard. they say the school's president ignored their concerns about the treatment of african-american students at san jose state. the district attorney acknowledged the seriousness of the allegations but stood by the misdemeanor charges. >> it's becoming popular and also hip but one man says uber is dangerous. james says the san francisco based transportation service is not doing enough to monitor its drivers and protect passengers. he says he took this video while he and his uber driver waited

for police in san francisco this weekend. he says the driver hit him and used racial and homophobic slurs. >> my sister lives in san francisco. i can only think if she had been in that car what would have happened to her and that scares me. >> he worries the man was not an approved driver and possibly driving for somebody who is. but uber says the driver did complete a background check and works for an approved provider. in a statement uber says authorities that responded to last weekend's incident determined that no action was necessary. however, as a precaution we suspended the accounts of the involved parties until further notice. >> this morning police on the peninsula are warning people not to leave any valuables in your car. police say there have been a spike in car break-ins. 30 car burglaries in the last two weeks. it's a common problem around the holidays because people are more likely to leave gifts and bags

in plain sight. this morning we're hearing from the life long raiders fan now called a hero. donnie navidad rushed into action breaking the fall after woman who jumped from the third deck of the coliseum after the raiders game on sunday. this morning navidad, a veteran, still has the bruises to show for it. >> when she was falling, i held my arms out so she can land, then i was going to lock her in and as we fell we were going to fall together. so that way i endured the impact. and nothing was going to happen to her. they called me a hero. i'm a hero to them. but to me i just reacted the way i did. >> the oakland raiders are showing appreciation as well. hall of famer willie brown personally drove to his house to thank him and gave him the sunday game ball. navidad said he would love to hear from the woman or her

family to see how she is doing. investigators say the only reason she survived is because of his actions. >> great story there. president obama wrapping up his three-day west coast tour in los angeles following a whirl wind visit to san francisco. today he is visiting dream works studios for a speech on the economy. then he will attend a fund-raiser of the home of marty kauffman. looking back the president's san francisco stop included a speech on immigration reform in chinatown where he was greeted by a line of protesters. his five-hour bay area visit also included a fund raising event, along with a tech roundtable. >> and don't forget a lot of our bay area sunshine that was out yesterday. >> it was a nice day doing everything. >> it's a cool start to the morning. what are we in store for? >> another beautiful day shaping up. good morning to you. temperatures this morning are

mostly in the 30s and 40s in the south bay we're at 46, 45 along the peninsula and it's chilly at the north bay. 36 degrees so another round of patchy frost as we wake up especially in the north bay. later on this afternoon we expect 66 in the south bay, the peninsula 65, east bay 67 degrees for you. low 60s in san francisco, what i can tell you is we have major changes headed our way. this will be the warmest day of the week, then the rain moves in. i'm going to detail that, time it out coming up plus we're going to take a look at some of your thanksgiving forecasts and travel forecasts throughout the morning. it's clear at sfo or oakland. here's mike. >> we're going to get crowded later on and tomorrow and wednesday, thursday, a lot of local traffic. we're looking at 101 northbound. we may see a lighter flow for a tuesday. let's look at the maps because a lot of folks take days off. southbound 680 at mckee, we have the off ramp blocked for a couple minutes. trying to pull that car off of

the side of the road and back on. the tow truck, again that affects the off ramp. 101 at sick 80 down on the bottom of the screen. the south bay moves smoothly. no problems through the northbound commute direction. you'll see slowing, a commute should be shorter lived. typical tuesday. here the tri-valley no slowing shows up yet as you come out of the altamont pass. 580 to 880. the nimitz a live look past the coliseum, the taillights past high street through downtown to the bay bridge toll plaza. an easy flow. we'll probably see the lights turned on. yesterday they were turneden later than we typically see on a monday. about with 6:25 i think it was yesterday so we'll possibly see similar today. back to you. >> sleeping in maybe. >> time of year to concentrate on helping. the st. anthony foundation hoping to meet the goal of 1,000 turkeys. >> it collected 920 this season so they are close.

welcome back. it's 4:44. the u.s. supreme court could decide today whether to hear several cases challenging the affordable health care act. hobby lobby is one of 40 companyings asking the supreme court to decide if it is legal for the government to force them to provide health insurance that covers birth control.

they say it violates their constitutional right to religious freedom. if the justices announce they will hear the cases we could see arguments in washington, d.c. next spring and a decision in late june. meanwhile we're four days from president obama's self-imposed deadline to fix healthcare.gov. the president told supporters yesterday that coverage will be available. >> a south bay congressman speaking to the public about his efforts to expand social security and strengthen medicare, representative mike honda holding a meeting in fremont. he will be joined by advocates in the field of medicare and social security for a panel discussion followed by a q and a session. it will get under way at 10:00 this morning at the fremont main library. >> a california group will announce its list of potentially dangerous toys. the report will feature toys

that pose dangers from choking, lead content, toxic chemicals and other problems and publicize an online safety quiz for parents. organizers say the report highlights toys that have previously slipped through the cracks and toys that are excessively loud and put children at risk for hearing damage. >> soon it will be easier for people with diabetes to get their hands on a popular drug. let's turn things over to kayla tausc tausche. good morning. >> good morning. futures are higher after stocks faded late in the day on monday, the dow and nasdaq and s&p 500 hit new highs, only the dow managed to close in record territory. the nasdaq did break above the 4,000 mark, a level it hasn't seen in 13 years. we get data on housing permits, home prices and consumer confidence. the dow rising to 1673, nasdaq adding 3 to 3995.

the fda lifted restrictions on a diabetes drug as new data show the drug doesn't increase heart risk. that means patients will no longer have to enroll in a special registry to receive the drug. it was one of the top selling drugs before concerns about it being linked to possible heart attacks. the fda imposed restrictions in 2010. a judge will issue his decision on whether detroit is eligible for bankruptcy protection next week. the city filed for chapter 9 in june t the largest municipal bankruptcy in u.s. history. retirees and pension funds have objected saying city officials didn't negotiate in good faith and michigan's constitution protects their pensions from being cut. certainly an important source for the residents of michigan. for now back to you. >> appreciate the update. >> the forecast this morning checking in with christina. >> good morning to you. a lot of people have family

coming in to town. it's going to be pretty nice all the way through thanksgiving day. then the showers move in. i'm going to show you what we're working with. not expecting a lot of activity. the north bay at 36 degrees, give yourself extra time to warm up your vehicle. 48 in san francisco, the peninsula at 45 and here's the south bay at 46, so a nice start to the day. just about as cold as it was yesterday. temperatures are going to end up unthe 60s. pretty good for that and all of the regions across the bay area. mid-60s in the north bay, east bay, and the tri-valley warm today. 67 on the way to livermore and pleasanton. talk about the showers, the system is going to arrive. and right on time as we head through about 4:30 to 9:30 this morning, the clouds will increase. by the end of the day it will be mostly cloudy. as we head through wednesday, things start to change. temperatures drop off, i stop the clock wednesday 9:00 a.m., our one break from the cloud cover. it's going to be pretty cloudy as we progress throughout the

rest of the day tomorrow. then by the end of the day into early thursday, look at this, showers on the radar. so, let me show you what we're working with. they are going to move up from the south pushing to the north. san jose has the best opportunity of measuring precipitation all this activity will move to the north as we head throughout thursday at about 5:00. getting some of the deep rich green in here, moderate rainfall in fremont and livermore at about 5:00 p.m. the whole thing blows out of here in time for your family and friends to get back to where they are headed nice and safely. so that's the good news. a few showers we need the rain, so it's a good thing, remember catch your seven-day forecast at the bottom of your screen. back to you, jon and laura. >> thank you. it's 4:49. it's that time of year and this year more than 43 million people planning trips out of town to celebrate thanksgiving. that's a slight decrease. if you are traveling brace yourselves. nasty weather across the country means airports and roads will be crowded as ever.

experts now predict major delays and hundreds of cancellation, a large storm slammed the southwest last week, now slowly moving ahead toward thanksgiving. every big airline now has a hub in the storm projected path creating a ripple effect across the country. >> and the weather isn't going to clear out until thursday, and unfortunately that is after all of the major travel is supposed to have occurred. >> both u.s. airways and delta put out travel advisories for the northeast. >> mcafee facing a stalking complaint after a company says it evicted him. he tells bay area he was not evicted, he chose to move out of the portland high rise apartment two months ago. the complaint says mcafee sent the property manager threatening e-mails, and associated with armed security guards. mcafee admits he has an armed

treasure island. an easy flow around the east bay. top left hand corner you are see the orange in san rafael, the 0 glow we saw. fog not so much of an issue a. potential problem over the course of the morning. we have guadeloupe canyon parkway. this is top of san bruno mountain a crash there. not a big deal. 280 and 101 moving smoothly. and the south bay we have a new crash reported north 85 at north 87. a lot of debris reported in the roadway. sounds like it's going to close for a few minutes. >> thanks, mike. >> rescuers, this is amazing, they pulled a puppy from the storm drain in dallas who was stuck there more than a week. >> happy endings, we love them. teachers from the school heard about the labrador mix. they could hear him yelping for help. for days they brought the puppy food and tried to rescue him. had no luck. eventually crews came in and

sent cameras down the drain. they spent hours looking for the puppy. you can see right there, looking pretty good for the rough ride there. finally a trap with food did the trick. they pulled him out and the dog was rescued unharmed at least physically. maybe mentally a little spooked. >> what a cutie pie. >> that's nice. >> 4:57. still ahead, a house fire on the east bay forces at least five people out of their homes overnight. we have new details just in. >> plus, two days until thanksgiving and local food banks are struggling to get enough donations. the item organizers say they need the most coming up.
