two sticking points were originally part oof deal that both side himself agreed to back in october, but bart management wanted to remove the two items from the deal claiming those provision himself been included by mistake. >> san jose police are investigating a double shooting near the san jose state university campus. shots were fired on south second andes fernando street after 10:00 last night. the two victims were each found with am-m gunshot wound. investigators are still searching for a motive. >> and police in p are searching for a gunman who opened fire mall in san liandro. >> there appeared too have been specific sort of a verbal

already. their position is she's dead and there's no treatment she's entitled to. >> on december 9th, jahi went into the hospital for surgery. she suffered severe complications and she three days later she was declared brian dead. the hospital has the right to turn off ventilators. the family is fighting that. >> as sad as it is for the family to come to grip with the fact that their daughter has passed away, there is no sign of brain activity and there has been no sign. >> reporter: jahi's tonsilectomy was not a simple procedure. he says three procedures were being down simultaneously.

>> the hospital says it will comply with the judge's ruling. the next step is to bring in an independent doctor to review jahi's case. the hospital suggested five doctors out of ucsf. the judge gave the family until monday to pick one of the five. while the hospital will check on each doctor's availability. the judge said he would like jahi examined monday so the family knows whether further treatment is warranted. >> and our prayers go out to the family. >> and a person dead after being hit by a car. the car ran into the person head on. the victim was pronounced dead is he scene. the driver is now cooperating with police and alcohol is not believed to be a factor.
