family of four dead. authorities say they found the bodies in a home in fontana about 50 miles east of los angeles. they say they went to the home after getting a call from the 16-year-old who told them his family members had been hurt or possibly killed in the home. police have yet to identify the bodies but family members at the scene confirm the bodies were those of the family that libed there, a middle-aged couple, two kids around 10 and 12. more than one weapon was found at the scene. >> happening now, officials in north dakota evacuate an entire city following a two-train derailment. look at this huge black cloud you could see no matter where you were in the area. this after a derailed train was hit by another train yesterday afternoon. the second train was carrying crude oil. the collision caused several fiery explosions and filled the air with that black smoke. >> we were taking a nap and all of a sudden we heard this big boom and we ran outside and seen black smoke and then orange

smoke. >> grabbed whatever and leave because they were outside my house waiting. >> the red cross and salvation army organized a shelter at a middle school in fargo for evacuated residents. the ntsb's go team is on the way to investigate the cause. >> the family of 13-year-old jahi mcmath has more time to move her to another facility. yesterday a judge ordered the oakland girl to be kept on a ventilator until january 7. christie smith joins us live with the latest. good morning. >> reporter: good morning to you. this extension came at the very last minute and essentially means that children's hospital will have to keep jahi mcmath on a ventilator here for at least one more week. during that time the family can appeal to a higher court and they can also arrange to get the teen moved to some sort of long term care facility, a facility willing to take her even though she has been declared brain

dead. the family says they think they have something lined up in new york. her family says they have been praying for more time for her to recover and two facilities backed out, but they again they think they do have one. the 13-year-old had her tonsils and other tissue removed here at children's hospital december 9 to help her breathe better. there were severe complications and she was declared brain dead three days later. the family has fought all along to keep her on a ventilator. with this new order a hospital spokesperson said they had not heard from a new facility and the doctors there would need to understand that they are taking on a deceased person on a ventilator. her family still believes there is hope. >> no matter what i do, somebody's going to say i'm wrong like i said before if i didn't fight for her they would say that mother's no good, she didn't fight. now i'm fighting, now they say i do too much. >> it's not unusual for a court given these sorts of

circumstances and the charged situation to give more time to a family like this. we're not sure it was the right judgment call but that was the judgment call of the judge and we'll comply with it. >> reporter: the family also released a photo that they said is of jahi's uncle holding her hand and that they have video of the teen moving. the hospital spokesperson says sometimes not specifically referring to jahi but sometimes they have movement. the hospital says they are going to fight the family's filing. we reached out to the family but haven't heard back from them yet. christie smith, "today in the bay." >> thank you. an officer opened fire in san francisco overnight after the suspect reportedly tried to hit a police sergeant with his car. the police chased the suspect from the bay view district to 19th avenue where the suspect crashed into a car. an officer fired one shot but missed the suspect and hit the vehicle. the suspect then crashed into a barrier a couple blocks away in

front of the police station and was taken into custody without incident. it's unclear if the suspect had a gun no. bystanders were hurt and the suspect was taken to the hospital. >> 6:05. with the new year comes new laws for us in california. actually a lot of them. everything from transgender student rights to where you can and can't light up. even changes to tips at restaurants. bob redell joins us with a look at some of them. >> good morning. starting tomorrow the state will offer new protections for celebrities, students and workers, through new laws that go into effect at midnight tonight. so for workers who earn minimum wage, about to see more, employees -- employers must pay their employees at least $9 an hour, that's starting tomorrow instead of the $8 minimum. and by 2016 the minimum wage will jump up to $10 an hour. for restaurant servers, they might see less in their paycheck. a new law will require the state to tax any tips that are

automatically added to bills. that's usually the case when you have a party of six or more at a table you see for example an 18% tip added to that. employers will no longer be able to fire an employee because they are the victim of a domestic abuse or sexual assault, and the employer must now change that employee's at-work phone number if that will help protect them from a stalker. for a k-12 student those who identify as transgender schools must allow them to join the sports team or use the bathroom that correlates to their orientation. so for a student born a boy who identifies as a girl will be allowed to use the girls bathroom and join, say, the girls basketball team. for college students the university of california is going smoke-free. no use of tobacco on the ten uc campuses, and finally, for the movie stars, tough new rules for paparazzi. a photographer or paparazzi type caught harassing the children of celebrities, law enforcement, or

judges, could now face up to a year in county jail, and a fine of up to $10,000. coming up new rules that could affect the way you drive in to work. take a look at that. already 2014 in new zealand. the clock struck midnight over three hours ago in auckland, the first major city to ring in the new year. we like to check out their celebration. in the bay area people are rushing to get everything ready for their celebration. on the waterfront in san francisco crews are busy on two barges preparing the fireworks show. 200,000 people are expected to watch the 15-minute show at the stroke of midnight. it's a busy time for hotels and downtown san francisco as well. the officials at the westin st. francis say they are nearly fully booked. most hotels with views and

restaurants with views near the fireworks as you might imagine, they are booked. >> transportation will be running extra service to get people home safely after they ring in the new year. extra trains and operate until 3:00 a.m., no free rides though. cal train is free, the last train scheduled to leave the city at 2:15 a.m. that will be a fun one to be on. muni will have free rides and some lines will open until 5:00 a.m. sam trans will let people ride for free all night long on the bus and light rail lines. there will be extended hours, light rail and express bus service from fremont to san jose. >> if you are still looking for something to do this new year's eve we have suggestions. visit our website nbcbayarea.com, search new year's eve events. there you can find a list of things happening around the bay area tonight. >> sometimes we have fog, and you worry can we see this fireworks show. we're checking in with meteorologist christina loren to find out how it's going to be looking.

>> good morning to you. yeah, especially this morning when you wake up and you see we've got plenty of low clouds blanketing the bay area. that's probably the first question on a lot of people's mind headed to san francisco. good news not expecting the fog to continue throughout the day. by tonight should be clear. as we ring in the new year. temperatures in the 30s and 40s. it's cold out there but look where we're headed. into the upper 60s in some cases, that's the east bay. san francisco will be cool at 61. mostly cloudy conditions. and in the south bay 64 degrees. i do want to point out we have reduced visibility in the south bay. down to about 3 miles action traffic cautiously. fog drifting around. the fog has returned. but it's not going to stick around. we are expecting widespread clearing. so we're looking good. also looking good for all of the other events across the bay area. it's going to be a good night. we'll talk about your forecast for some of the major events. i want to check your drive now and yeah, if you're headed to work tomorrow morning at this time, really want to travel

cautiously. >> yeah. watch out for others and also i mean you might want to take a tylenol. not that i have experience. looking here toward the bay bridge, no headaches for anyone across the span. early morning road crews cleared and no problems. smooth flow. we'll look at the bay bridge toll plaza. we're seeing more traffic now. a steady flow off of the maze, off the east shore freeway and the berkeley curve. all lanes about the same volume of traffic. and no backup, not even for the cash lane. on the maps we'll show you the vicinity coming up through oakland, 5880, 880 at the limit, speeds down to 59. not a big deal. the walnut creek interchange. easy flow of traffic. even back in antioch we have a light volume of traffic. highway 4 hasn't seen slowing, get a idea for the valley around the bay. look at the south bay, san jose, traffic does start to pick up a tiny bit so we'll see a little

olympics only 400 miles away. >> crews around the bay area are busy getting ready for new year's celebration. on the waterfront 200,000 people expected to watch a 15-minute fireworks show. many hotels are booked. >> ride sharing companies are a convenient way home like new year's eve. but one company is getting criticism for what it calls surge pricing. san francisco based uber charges depending on what the demand is. when more want a lift it costs more. while convenient it can be pricey depending on what time you call for a ride. >> the first thing is if it's before 8:00 p.m. on new year's eve, you are pretty good. like it starts to heat up around 7:30, sort of -- starts really getting going around 8:00 p.m. if you can get to where you're going that first stop in the evening before 8:00 p.m. you're going to be in a good spot. >> i always feel safe. i know i can get a ride home. that's something that's really

important to me especially on a night like new year's eve. >> uber has used surge pricing for four years. people haven't stopped calling in. if you are concerned the company says it will let you split the fare with other riders. >> a major snag in the hunt for oakland's police chief. the firm cuts ties with the city. the firm hired to compile a list of final candidates for the job stopped its search saying someone in the mayor's office undermined the process by spiking to applicants on its own. the company will not say who is at fault but the oakland tribune reports that the mayor's chief of staff spoke to at least one person. the mayor's office denies the report. oakland has not had a permanent chief since may. >> customers who have eaten at a popular sandwich shop may have had private information stolen. according to the chronicle the sandwich shop was hacked.

someone accessed credit card information of people who dined there between august 11 and october 2. officials say the hackers took names, security codes and expiration dates. >> a well known bar is looking for a new location after three decades in the prune yard shopping center. boswell says represent is getting too high. the restaurant and bar has occupied the same spot in the prune yard for 36 years. it will hold a new year's eve bash tonight before shutting down. boswell's is the latest business to leave the prune yard. the popular restaurant hobby's announced it will close. >> the woman known as the tamale lady to many in san francisco is close to having her own shop. chronicle reports that virginia is in the final stage of signing a lease for the corner of mission and 16th. for years she sold at city bars but earlier this year she was told she couldn't sell them

because of the health department complaint she was not a licensed vendor. she has raised $150,000 to help build a brick and mortar shop. >> some movies will be purged from netflix. it does this so often because of licensing contracts so here are some titles you might miss. "titanic," top gun, brave heart, flash dance, and do the right thing. also as good as it gets. you might miss several seasons of "saturday night live" but you will be able to order the titles through the mail. >> 6:18. state fire leaders announce a ban on open fires. there are extremely dry conditions. it's now illegal for any one to burn just about anything outdoors. that includes fireworks which are illegal in most cities but may be an extra temptation on

new year's eve. >> because of the fuels are as dry, it's no different than firing off fireworks in july. the high risk for fire danger is still there as it was back in july. >> camp fires in designated camp grounds are still allowed. >> it's very dry out there i know that meteorologist christina loren has been watching that. not a raindrop in sight. >> not a raindrop in sight. there is a very slight chance, only 10%, i don't want to get anybody too excited. that comes into play tuesday into wednesday. for the next few days at least we're looking dry as a bone with northeast winds ramping up as of tomorrow. 32 degrees now in the north bay, right at freezing there, cold enough for a little patchy frost and fog. the fog is drifting around. our visibility is okay but watch out. down in the south bay, into this afternoon in the south bay temperatures are going to climb. morgan hill will see upper 60s. a little bit of sunshine for the first part of the day, mostly

sunny by about lunch time in the south bay. the peninsula is going to see a lot of cloud cover, low 60s headed your way. and san francisco mostly cloudy for the first part of the day. clearing out in time for fireworks. that happens right at the stroke of midnight. 63 degrees in the outer richmond district. as we head throughout the remainder of the day, this is what we are expecting. we stop the clock for you. at about 10:30, we are expecting a little bit of clearing action then by midnight mostly clear conditions for the bay area. wherever you're going to be it will be chilly it's going to be dry out there. just make sure you're ready for that and yeah, we want you to make sure you stay safe. always on mike inouye's mind as well. good morning. >> yes. you're always on my 0 -- bad way to end the year. looking to the southbound side, 101 shows a smooth drive. light volume. you see the glow to the lights. low clouds around many parts of the bay. traffic and weather together,

there is the orange, the north bay, that means a chance for fog in many spots south down 101 through novato, off 37 and down to san rafael where we took a look at the glowing lights. smooth drive across the richmond/san rafael bridge with no. major issues, the east shore freeway moves smoothly. volume around university avenue. speeds toward 58, 57. not a problem down the berkeley curve. the bay bridge toll plaza. we have a build coming off of the berkeley curve and the 880 overcrossing. nothing as far as the backup or problems. easy drive if you pay cash. that's about it for your drive. back to the maps we'll see traffic getting into the city. the bay bridge and the golden gate bridge. 10:30, 11:00, the backup is going to start at the bay bridge toll plaza and into the city off of the golden gate bridge. plan for that. then continue to build

five here on this street, the 16-year-old boy last night the only one not home at 10:00 when whatever happened happened. he returned to find his whole family dead in the house and called 911. investigators found inside a girl 12 years old, a boy who is 10 years old, the mother and father, they say different areas of the house with more than one weapon. they of course are still on the scene and will be for some time investigating exactly why this might have happened. some of the neighbors i'm told last night heard some screams and even some say they heard gun shots. we'll stay on this story. >> thank you. it's 6:31 we continue to follow developing news out of russia where officials are operating on high alert following two suicide bombings in volgograd. new year's eve events have been canceled. police are asking people not to set off fireworks. seven of the people injured were

taken to moscow earlier this morning for treatment. they were being wheeled off planes in stretchers. 70 people were hurt in the twin bombings, 34 others killed. police reinforcements and troops have been sent for increased security. the city is 400 miles from sochi where the winter olympics are scheduled to take place in over a month. some countries have responded to the bombings by increasing security for their olympic athletes. australia's committee says its athletes will not be allowed to travel locally, by car, train or bus and not allowed to compete outside the city. one athlete who experienced the security of the olympics is jessica. she and her sister helped team usa to a gold medal in water polo back in 2012. the london games had a massive security presence, 13,000 police officers and 17,000 members of the british armed forces. security is= expected to be

tighter in sochi. >> it's unfortunate when outside influences try to take that away from these athletes because we're there to compete. we trained our entire lives to get to this position. >> she says the athletes can only control what they can control, the physical and mental preparation needed to do well in those games. >> we are learning new details on the condition of racing legend michael schumacher, doctors are treating the formula one champion, he is showing small signs of improvements in a brain scan, this after undergoing a second operation for brain injuries he suffered during a skiing accident in the french alps. while schumacher is not out of danger yet they have gained a little bit of time. >> breaking news right now, we're getting word of a possible brush fire in or around grant ranch park, that's in santa clara county east of san jose. it looks like an arson fire. two cars are vandalized and possibly set on fire that

sparked the brush fire. quipby road is closed in area. we'll bring you updates as soon as we get some. so far we know that at least 15 to 20 acres engulfed in flames. we'll continue to give you updates. >> the indonesian government on highest alert as the mount tan continues to erupt. it has at least six eruptions today, spewing out hot ash and rocks. people are warned to stay 1 1/2 miles away from the volcano. the disaster management agency says more than 19,000 people in the area have been evacuated and they are staying in temporary shelters. so again that's sounds like cinnabun. >> it will be --

6:40. the ice storm that left hundreds of thousands in the dark for days could have lingering impacts on the northeast industries. >> in vermont maple syrup makers assessing damage to trees. the heavy ice caused some trees to bow or snap, damaging the network under them that carries sap in the spring to be boiled down into syrup. it's too early to tell how the season will turn out but likely some syrup makers especially near the canadian border could face deep losses in the spring. >> it's 6:40. a new year means new laws.

mcmath from a ventilator, something her family has been fighting. what this means is the family has another week to try to get her moved to a long term care facility. they think they have one lined up in new york who will take the teen who has been declared brain dead. jahi went in to have tonsils and other tissue removed and suffered complications and was declared brain dead three days later. the family says that two care facilities backed out but children's hasn't heard from medical staff. but her mom says she believes that her child's response to her voice so she think there is is hope. >> i'm not trying to hold on to a court. that is a live girl in there. >> our hearts go out to the family over the death of jahi mcmath. we're doing everything in our power to help them transfer her body an a ventilator to another

facility. we have yet to have one of the three facilities they named so far come forward and accept her body. >> the family shared a picture they say is her uncle holding her hand at the hospital. a spokesperson says in regards to the movement that sometimes brain dead patients have involuntary movements, and says that children's hospital will also be filing some motions of their own. reporting live, christie smith, todd in the bay. >> an officer opened fire after a suspect reportedly tried to hit a police sergeant with his car. the police chased the suspect through the city and the man crashed into another car. an officer fired one shot but missed the suspect. he was taken into custody. it's unclear if the man had a
