we do have patchy fog we forecussing in on this morning developing up in the north bay. we are expecting more to continue to develop for the next couple of hours. 70s on the way. your full forecast in just a few moments. all right. let's take you outside for a live look here as we see the bay bridge twinkling in the background. gorgeous start to our brand new year. wednesday, january 1st, happy new year. this is "today in the bay." good morning to you. thank you for joining us on this first day of 2013. laura garcia-cannon has the morning off. we have breaking news out of the east bay. a 19-year-old mother has died. she was taken to the hospital along with her three-month-old baby after they were hit by a truck in fremont. the woman was carrying the baby in her arms and walking with her 17-year-old sister on pa say owe padre parkway south of mourry

avenue. the baby was thrown from the mother's arms. someone driving by took the baby to a nearby hospital. the child had severe injuries. the 17-year-old sister was treated for minor injuries. the driver of the truck, a 64-year-old man, said he did not see the three walking on the side of the road. he is cooperating with police. police say no alcohol was involved in the situation. christie smith is on her way to the scene at this time. we'll have a live report coming up. two people were shot in oakland. the first at east 21st and third. the victim was a woman riding in a vehicle. the driver took her to a local hospital where she later died. wi also, a teenage boy was t on 104th near walnut. oakland police say they don't know if that young man will survive. gilroy police are spending the first day of 2014 looking

for a new year's eve bank robber. this man walked into the union bank yesterday afternoon, handed the teller a note demanding cash. he managed to get away before police arrived. it is still not clear how much money he was able to steal. the new covered california health insurance program is now in effect for 400,000 people state-wide. so many of them are wondering if they still have coverage. bob redell is live with his concern. they signed up. they are not quite sure if everything is in effect, if they are covered. >> reporter: good morning. happy new year, peggy. if you are one of the 400,000 that signed up for health care, you might be asking yourself, where is my insurance card? i have not received it yet. does that mean i'm not covered under my new plan. generally speaking, the answer is, yes, you are going to be covered. you will be covered retroactively to january 1st,

which is today. you must first pay your premium by january 10th. that's a week from this friday. we spoke earlier this week with the head of coverage, california. that's the state's health exchange, who tells us if you have not received that first bill, you should be sometime this week. >> they need to pay their bill. we have actually extended that deadline. the health plans in california say, you pay by january 10th, you will get coverage effective january 1. you need to pay the bill. what we're moving to is exciting, to getting people health care. >> reporter: maybe you enrolled into your new health program weeks ago. what's taking the insurance company so long to send me that first bill. covered california waited several weeks to pass your information on to your respective insurance company. they wanted to make sure the companies were ready before dumping the data on them. with regards to the insurance

card, insurance companies are supposed to send that to you within ten days of receiving your first premium. if you are uninsured and have not enrolled in a health care plan, you have until march 31st to do so to avoid a penalty. reporting live, bob redell, "today in the bay." ringing in 2014, if you weren't in san francisco to see it, here is a look at the midnight fireworks show from treasure island. tens of thousands were on hand to see the show. that means big business for san francisco as well. restaurants were packed. vendors cashed in, selling fun light-up suf nears and cab rides were popular with ladies tired of walking on the high heels. for most, it was about soaking up the final moments of 2013 and looking forward to the new year ahead. >> become a better basketball player. >> what more can you ask for than good health, stable friend

and family and hopefully i get to travel some more. >> i'm with him. good goals there. about 5,000 fireworks were launched from a boat in the bay. what a beautiful night. meteorologist, christina loren, joins us from the nbc bay area weather wall. you can imagine out there spectacular. sometimes it is bogged in and you can't see them. >> yeah, yeah. sometimes i forecast that it is not going to be fogged in and then that happens. thank goodness, this time, we were right on the money. 43 degrees in san francisco. it was fogged in yesterday morning. by midnight last night, completely clear conditions for the whole bay area. for everybody to enjoy the fireworks. as we head throughout the day, it is going to be warm. if you want to get outdoors, great day to do so temperaturewise. a couple things we want to point out. 38, san jose. 32, right at freezing in san

martin this morning. spare the air. as we head throughout the afternoon, you want to keep this in mind. you are going to get the best air quality at the immediate coast. east bay, moderate levels of pollution. meanwhile, everywhere else, unhealthy issues. limit your outdoor activity or go to the beach where you will get better air quality. look at your temperatures for today. absolutely unbelievable. 70 degrees in morgan hill. that's a comfortable afternoon shaping up. no need for the heater. 67 degrees. mid to upper 60s. north bay, same for you. lots of sunshine headed your way. east bay and the tri-valley, comfortable conditions and the 60s and a couple of low 70s. your seven-day forecast, 2014, at the bottom of your screen. every region across the bay area is covered.

some firefighters spent new year's eve watching for hotspots from a 40-acre fire. it started yesterday morning near mt. hamilton. the deputies say they think it might have been started by a stolen car. they have been investigating several stolen cars being dumped on mt. hamilton road. that's where the cars were started. neighbors have seen them dump the cars off of cliffs. a fare increase goes into effect for b.a.r.t. trains. riders will have to pay an average of 19 cents extra for the trip. the program was implemented in 2003. b.a.r.t. is running on a sunday schedule for today. for the first trains, they start rolling at 8:00 this morning. expect to pay more on your pg&e bills in 2014. they did improve a 3% increase

in natural gas and electricity costs. that means typical customers could pay an extra $3.38 per month. pg&e says that the increases will help pay for higher wholesale energy costs along with maintenance and upgrades. san jose's styrofoam band goes into effect. >> today was supposed to make a change on the city-wide bags. they have decided not to increase paper bag prices to 20 cents, as was originally planned. people will pay just 10 cents for each paper bag they received at the store. everybody seems to be bringing the bags. the bay area tech couple that is taking title as fill aphilanthrn

breaking news out of fremont. a 19-year-old mother has died after being hit by a truck in fremont. she was carrying her three-month-old baby in her arms walking along the road with her 17-year-old sister. all three were hit by the truck. "today in the bay's" christie smith is live in fremont. this is one of those terrible stories, christie. it is developing as we speak. what's the latest? >> reporter: good morning. it is a terrible story and a horrible start to the new year for one family. right now, the intersection has

cleared. there are quite a few flares left here in the street. a 19-year-old woman is dead. her three-month-old baby boy clinging to life in the hospital. the woman's 17-year-old sister was hit. they were hit by a 64-year-old man driving a pickup truck. he tells police he didn't see them. it was dark late last night. they were crossing paseo padre. the baby thrown into the air by the impact of the hit. as bad as it sounds, there was a slight silver lining. a passer by saw what happened, picked up the child, and drove him to washington hospital nearby. the baby being taken to children's hospital in oakland for treatment. the 17-year-old sister suffered minor injuries in all of this. police are telling us they don't believe alcohol was involved and the driver is cooperating.

that's the latest. reporting live from fremont, "today in the bay." iphone users beware. your mobile device could be used as a secret listening device. software designed by the nsa could hack into your iphone turning it into a pocket-size informer by secretly recording audio and stealing contact information. they say they are unaware of the program and would never deliberately weaken any products target apologizing to customers, this time over gift cards. an unknown number of gift cards sold were not properly activated. leaving customers at the registers with valueless cards. target says it will honor the affected cards and customers don't need a receipt. this past month, tag get was rg with a massive hit. mark zuckerberg and his wife

donate to the silicon valley community foundation, total of $1 billion, making them the first under 30 philanthropist to top their annual ranking of publicly announced gifts. they donated the same amount of facebook stock, 18 million shares, but came in second, because the company's stock had still not risen above its ipo value. honoring a bay area navy s.e.a.l. a dangerous mission proved to be deadly for the navy s.e.a.l. the monta vista high school grad died while serving his country. they are making a film about it. >> this is the last picture we took of the family before he went off. >> reporter: jeff axleson will always have memories of his brother, navy s.e.a.l., captured in personal photos displayed throughout his home. >> they found a half empty clip

on a ridge somewhere. it had a.x. on the bottom and that's how they knew it was matt's. >> reporter: he was one of four navy s.e.a.l.s whose mission was to capture or kill ahmad shaw in 2005 in the missions. the mission failed. axleson and two others s.e.a.l.s were killed in action. their story is called in a film called lone survivor. it was based on a book by the lone navy s.e.a.l. that survived. jeff axleson had already seen the film three times at special screenings. he admits it is difficult to watch a visual representation of how his brother died. >> it wasn't until the end. at the very end, they actually show video or pictures of the guys. that's when it kind of hits home. >> actor, ben foster, portrays matthew axleson in lone survivor. he met with the family to get a better understanding of the war hero and to capture his spirit. >> ben captured my brother as

well as i could expect anyone to. >> axleson honored his courageous brother by naming his 2-year-old son, matthew, after him. one day, he plans to tell his son about his uncle. he chokes up thinking about it. >> i figured the moment sometimes captures the memories and at those times, you withily know what to say. >> if anything, he will teach his son about the brotherhood, the values matthew axleson represented. >> despite life's challenges and tribulations and that brotherhood and that joy and that camaraderie that you have, just kind of takes you through life and will take you through the tough times. >> george kiriyama, today in the bay. all of them. i need to share the love and spread it out a little more. >> how about you, peggy? >> i have some pups and the usual, lose weight, the standard. >> we are in the same boat together, thanksgiving, christmas, maybe you enjoyed a little too much like i did. 43 degrees in san francisco. east bay, 38 degrees. if you want to get out there and get that resolution started early, you can go for a run. in the morning is when we get the best air quality. if you head throughout the afternoon, as the day draws on, the air quality continues to suffer. it is spare the air day. keep that in mind. with all the fireworks, you are going to be able to see that haze out there in the atmosphere. high pressure builds in. it produces a cap over the bay area. we don't get a lot of mixing or wind. all the pollution gets trapped over the bay area. we're going to get temperatures that are really comfortable by january's standards.

you are also going to get the best air quality today where you get the most mixing, near the coast and the higher elevations. we'll take you through the changes. coming up, back to you, peggy. >> new this morning, one person has died after a car plunged into the freezing hudson river overnight in new jersey. police say dive teams pulled a man from his 20th out of the river two hours after the car crashed. it appeared, police said, that the man was the only one in the car. the hudson river is about 40 degrees. former first lady, barbara bush, is in the hospital this rng month. she was admitted to a texas hospital with a respiratory issue, possibly pneumonia. the bush family says the

88-year-old mate trriarch is in great spirits. no word on when she will be released colorado is about to become the first state to allow the legal sale of recreational marijuana as a new law goes into effect. potshots don't open until later this morning. that did not stop people from lining up to buy the newly legalized pot. they have built the most complex regulation for pot since 2012 with sales tax topping 25% and strict rules for growers and sellers. not everybody is a fan. >> i think it is going to be a huge disaster. there are just some things that there are more harm to society than there are benefits to it. >> now, pot shops will only sell 1 ounce to customers over 21 with a colorado i.d. out of state buyers are limited to a quarter ounce. 1 ounce before taxes will set you back $320. not inexpensive. a landmark change in the boy

scouts of america policy. the organization will now accept gay boy scouts, not gay scout leaders. there are some rules that go along with the new policies. scouts cannot use their uniforms to promote gay political causes. it went into effect thanks in part to that. he gained national attention in 2012 when he was denied eagle scout by the boy scouts of america because he was gay. today marks a change in the way we see things. it is illegal to manufacture 60 and 40 watt incandescent bulbs. it is aimed at making americans more energy efficient. traditional 75 and 100 watt incandescent bulbs have already been phased out. other incandescent bulbs, still used in chandeliers are legal to

buy. 5:20 right now, volunteers are putting the final touches on the 45 floats that will take part in the tournament of roses parade today. today's event, not without some controversy. the floats that have some people upset coming up.

the aftermath of an awfully big party. a lot of people sleeping it off. not a lot of folks in times square in new york city. a very chilly night. about 1 million people entered those temperatures to ring in 2014. happy new year. in just a few hours, the 125th annual tournament of roses parade will get underway. many spent the night on the streets to get a good view of

the floats and bands that will be walking by. they will be led by 86-year-old los angeles dodgers broadcaster, vince skully. this year's theme, dreams come true. this is not without some controversy. danny leclaire and his partner, aubrey lute, plan to be the first married. they have created a facebook page. they are saying they should not support something that is still illegal in more than 30 u.s. states. he asks people to boycott the 2014 tournament of roses parade and tell them no to a gay wedding on the float during the parade and send a message to their sponsors as well. leclaire and lute say they don't understand why people are so upset. >> we are getting married. >> we are expressing our love to each other. >> the couple has been together for 12 years. they will exchange their vows on

top of a giant wedding cake on the aids health care foundation float. another float drawing criticism, seaworld, people for the ethical treatment of animals, better known as peta, is upset that they keep killer wells in captivity. they are calling it a publicity stunt and saying that peta is an extremeist organ game. in 2011, they protested a float that featured an elephant towing a carriage. the rose parade will air right here on nbc bay air why this morning. the "today" show will cover the parade from pasadena starting at 8:00 a.m. a lot of people looking forward to that. we saw some preparations. all the different petals and everything being meticulously glued in place. >> it is just beautiful out there. i love the hd view of that. it takes a lot of times to put the floats together. after that, hockey.

temperatures are chilly to kick off the new day of the new year. 38, east bay. 43, san francisco. we are expecting the upper 60s for most cities across the bay area. even a couple 70s on the map today. for morgan hill, that's you. along the peninsula, temperatures are still going to be nice and mild. plenty of sunshine. hazy, a milky sky with all that particulate matter sent up there. that should provide much better air quality to the entire bay area. the north bay started out cold in the 20s. you are going to end up in the upper 60s today in santa rosa. the east bay, a comfortable day shaping up for you out in the tri-valley. 70 degrees straight up in pleasanton for the first day of january. hard to beat that. we do have to spare the air.

over. >> it is really wide. in fact, two lanes, three lanes. there is two more turning lanes over there. the driver is telling police that he just didn't see this trio chosing the stre trio crossing the street. you can see what is left of the flares. the 19-year-old woman was carrying her three-month-old baby boy when they were hit along with the woman's 17-year-old sister. the baby thrown from the mom's arms into the street at paseo padre near mauri. they drove the baby boy to washington hospital, which is nearby. he is fighting for his life, transferred to children's hospital in oakland. fremont police arrived on scene and tried to do cpr on the 19-year-old mother. she was taken to eden valley medical but did not survive all of this. the 17-year-old sister was treated for minor injuries. police tell us the driver was not drinking and is cooperating

with investigators. reporting live in fremont, christie smith, today in the bay. >> the park boulevard on ramp to westbound 580 in oakland is back open at this hour. it was closed while officials investigated a deadly crash. something caused a car to flip over on the road and trap someone underneath the car. it is unclear if the person that was trapped is the person that was killed. a setback for the family trying to keep their brain-dead daughter on life support. a judge has denied the request to force children's hospital, oakland, to surgically insert a breathing tube into jahi mcmath. a new york care facility has agreed to take her but she must have the medical procedure before she is moved. the r. the 13-year-old has been there since december 9th. they are required to keep her on a ventilator until january 7th.

welcoming in 2014 means well he welcoming in a series of laws for californians. a big change for those that identify as transgender. schools must allow them to join the sports teams or bathrooms that coordinate to their orientation. restaurant servers are required to tax bills when you have six or more to the table. employers will no longer be allowed to fire an employee because they are a victim of domestic abuse or sexual assault. they are now required to change the employee's work phone it it will protect them from a stalker. on the road, new protection for cyclists.

you must give them three feet for clearing and if you can't, slow down and let them pass. there is a grace period. police will issue warnings now and start fining drivers in mid-september even if there is no crash or a cyclist is not hurt. teens under 18 are completely banned from texting while driving. they have made it illegal to use voice recognition devices. law enforcement has more power to prosecute hit and run drivers that seriously hurt or kill someone in a crash. they have just three years to charge with the crime. drivers with hybrid that love to drive solo in the hov lane will get to do so for another five years. there isew production for abducted children. law enforcement must activate an amber alert if they are a custodial parent or guardian that poses a serious risk to the

child. under a new law, wardens must capture or scare off mountain lions unless they pose a threat to people or public safety. tough rules for the paparazzi. any photograph caught harassing the children of celebrities, law enforcement or judges could face up to one year in the county jail and a fine of up to $10,000 u.c. campuses are going smoke-free today no use of tobacco on any of the ten campuses. the ban includes all tobacco products and e cigarettes. many people will see a jump in pay this morning. state-wide, minimum wage is $9 per hour. as of this morning, it will jump

to $10.15 an hour. that's up 15 cents. san francisco's minimum wage going up today. workers will get $10.74 per hour. san francisco has steadily increased their minimum wage based on consumer price index every year since 2004. many californians have been complaining that signing up for health insurance has been tough. bob redell joins us live. happy new year to you. >> good morning to you, peggy. more than 2 million americans have signed up for new private health care plan, 400,000 of whom are californians. if you haven't received your insurance card, here we are january 1st, you might be wondering, hey, do i have

way. both pittsburg and oak grove's bands are expected to march just before 7:00 this morning if you are looking to see them. it is game day for the stanford cardinals football team. this he will go head to head with michigan state at the 100th annual rose bowl. they beat wisconsin to talk that title. before the game, it is the rose parade and the concord playground designed for children with disabilities will be featured on one of the floats. concord resident and visionary, liz lamont will road on the float along with christian campbell, a boy with cerebral palsy. mateo, who was wheel-chair bound and blind has since passed away. you can see the rose parade

three, two, one, to the fireworks. the las vegas strip lit up with fireworks early this morning as the west coast welcomed the new year. not only was the stratosphere tower lit up, the fireworks were going at a number of other hotels along the strip.

treasure island hotel had its own display. there were lights behind the minieiffel tower. >> let's talk about these newborn babies. there appear to be several firstborn in the bay. a baby girl born two seconds past midnight at kaiser permanente. she weighs 8 pounds, 7 ounces, 21 inches long. another baby born at 12:01 just down the hall at the same hospital. now, to san francisco, where a baby boy was born eight seconds past midnight at kaiser permanente, san francisco. and another boy born at the california pacific campus at 12:01. welcome to the world. cleanup in "new york times" square is underway. they get rid of all this confetti.

as soon as the ball dropped, they got there and started to remove 50 tons of confetti and trash and other debris in the streets and sidewalks. roughly 1 million people jammed in for the nation's biggest party last night. mike wilbur caught up with hollywood celebrities to find out their goals for 2014. last year, i got six cookbooks for christmas and my resolution was to cook something new every day. i lasted until almost april. i might try that again and see if i can get into the spring. >> i have to restate my vow to not cuss but i always -- there it goes. >> just become a better dancer, a better performer. i'm doing that every day now. >> it would be to try to stay off my iphone. i love social media. i love my instagram. i love twitter. i have to remember not to get into my work zone 24 hours a day. i wanted to take a whole day and
