bob redell joins us live from the scene with an update on san jose's first homicide of the year. >> reporter: good morning to you. based on what residents are telling sjpd they heard this man get shot around 12:30, 12:45. they heard several gun shots, heard a car driving off but for whatever reason no one bothered to call 911. perhaps because gun fire may not be unusual in this part of town. it wasn't until 45 minutes to an hour later that someone driving by did call 911 to report a man lying on the ground near a driveway a few houses down from where we are standing on east san antonio not far from where it crosses over 101. the man, an adult, shot at least once was unresponsive, paramedics tried to revive him but they couldn't get him to come back. he was pronounced dead here on the scene making him the first

person murdered in san jose in this new year of 2014. police have not touched the body since he was pronounced. they are waiting for homicide detectives to arrive. they might have arrived in the past few moments, also waiting for the coroner to get here on the scene to see if he might have identification. police tell us people here are cooperative, again they are telling them about the sound of the gun shots and the car driving off. apparently nobody know who is that man is. reporting live in east san jose, bob redell, "today in the bay." >>you can see an active scene. thank you so much. >> also new this morning one person under arrest after leading police on a car chase through san francisco. it started last night near 25th and connecticut when officers tried to stop a car matching the description of a vehicle involved in an armed robbery. the car did not stop. the car lasts until the car

crashed into a pole. during the pursuit someone reportedly threw a gun out of the car but police were able to find it. another still on the run this morning. >> also new, officers in brentwood responding to reports of a home invasion robbery. the robbery happened in the 800 block of green zone court. police chased them to autumn valley way where the two people tried to abandon the car. turns out the two were welcome guests in the victim's home before the robbery. a third suspect was arrested down the street. police are looking for a fourth. >> new details on the fire at the chinese consulate in san francisco. investigators say it was deliberately set. the fire was reported around 9:30 last night at the building on laguna street. today in the bay live with more. good morning. >> reporter: good morning to

you, scott. the damage to the building is pretty bad. the front doors are metal. one of them is laying on the ground. and i have to tell you i can still smell gasoline. san francisco police have an officer out front. the chinese consulate condemning an arson attack and violent crime. we do have some images of the fire ball out front of the building. these are from cctv, china central tell gigs. according to the konsle when a when 18 minivan got out and poured two buckets of gasoline on the front of the consulate building here and set it on fire. police say people were inside at the time, fortunately no one was hurt. this fire was knocked down pretty quickly and police and investigators arrived while a consulate spokesperson urged the government to provide protection for personnel and property and i

wanted to show you something out here. you can see there is camera that is pointed to the front of the building so it's very possible that they may have capture who had may be involved. i have calls tine san francisco police. i'll let you know what they had to say. this morning authorities are trying to figure out how a human skull ended up in an oakland park. police found it near children regional park after receiving several dahls, police are not saying too much but say the skull was, quote, right throughout in the open. >> ontoing coverage on a fight to keep their daughter on a ventilator. the attorney for the family says he is working the phone lines to get the girl moved to another facility. children's hospital oakland they have not heard from a single person involved in those plans. >> the family attorney created a

hoax, a very sad hoax that jahi mcmath is in some way alive. she is not. she is deceased by every law in the state of california. >> he wants the child to make the hospital the victim and pretend that this is a hoax and say that my lawyer is perpetuating a myth. >> a sad case either way. terri shiavo's life and hope network, you may recall, says it wants to help the family. she was kept on life support for 15 years, her family last their battle in court against her husband that wanted to end terry's life. the organization says though terry's case is very different than jahi's the girls case shows a problem with the u.s. health care system. >> the supreme court will decide if an undocumented immigrant can get his legal license in the state. sergio passed the bar exam.

good morning to you. happy thursday, the second day of january, 2014. taking a look over san francisco. the embarcadero, a lot of people down there weighed in the new year with a beautiful fireworks show. a nice morning so far. >> researchers in mit unveiled technology allowing people to interact with 3d images. one person puts an object in front of a depth sensing camera, that sends signals to a motorized pin screen. the 3d image pops up. if someone on camera moves their hand for example, that will show up on the screen in the other location. researchers hope the technology can be used by doctors and other who need look at a ct scan. walmart doing its part to help out people waiting to get confirmation they even signed up for coverage under the

president's new health care law. for that and the rest of the news before the bell this morning let's turn to bertha coombs live at cnbc world headquarters. good morning. >> good morning, scott. the futures pointing to a lower start, we had sort of lower trading on the first day of the trading -- first trading day of the year in europe already. the markets closed the books on a really big year of gains, the dow rising 26%, the best annual gain since 1995, the s&p 500 was rocking it like 1997, up 29%, and the nasdaq jumped 38%. its best year since 2009. we are going to get the unemployment claims in about 15 minutes or so. also manufacturing and construction spending that should help set the tone for the open. the dow will start at 16,577 after gaining 77, and making its 52nd record close of 2013. the nasdaq adding 23 to 4177.

walmart offering a 30 day supply of prescription at no up front cost to people who enrolled in obamacare. but this yet to receive their i.d., the front end of the system was working better but there are issues with the files that go to insurers, all of that paperwork has been problematic and insurers complained that they continue to receive applications with inaccurate data. it's unclear whether walmart will ask to be reimbursed once customers get their i.d., it was good to give last year. if you had a lot of money. apparently folks did give. report by the chronicle of philanthropy shows the top donors gave more than $3.4 billion to charity and more gifts of at least $100 million than back in 2012. could be a sign of the improving economy, certainly the fact that the stock market was rocking made it easier. the top donation, nearly $1

south bay. temperatures today are going to climb nicely, just about as warm as yesterday. we're starting out a little milder. 70 degrees in the east bay. south by about 68 and 67 degrees today in the north bay. take you through the next few days. mild with hazy sunshine, you're going to see that haze, by tomorrow we're going to see wind pick up. we need that mixing to get that particulate matter, building breeze, cleaner air for friday. then into the weekend a little cooler, really no significant changes to tell you about until we hit next week. early next week we're talking about a major cooldown, and some showers on the way. and you know what, it's a little ways out, some of our models are bringing it in. this is the year european models. temperatures comfortable, even when this system comes in on tuesday at 5:00 p.m., we're talking about a little bit of light rainfall.

investigation under way after catholic priest was found dead in his church rectory. police responded to a call from saf around 9:00 yesterday morning. investigators have not revealed how the priest was killed. the mayor did confirm it was the reverend eric freed. >> a tremendous person and this is a absolutely tremendous los not only for the parish but our community in general. >> investigators say they have no suspects or possible motives for the murder at this point. >> a press photographer is dead after collapsing on the field of the georgia dome. look at some of the last pictures that dave martin took, this is after the texas a&m beat duke. martin had a heart attack after working on the sidelines. he covered nearly every major news event in the south for the past 30 years and conflicts in

afghanistan, haiti and iraq. >> around the new year many do make a resolution to lose weight. one man has the story to tell. robert gibbs weighed 764 pounds and could barely move. it led him to record a plea for help and post it. the video went viral. gibbs was on the dr. phil show attending a wellness camp. he is 254 pounds lighter and says he is not embarrassed about the video. >> i don't think i would be standing here talking to you now if my video had not gone viral, if everybody hadn't reached out. >> he should be very proud. gibbs works out at the gym, walks up and down the stairs, he is working to achieve his next dole which is losing another 200 pounds. >> what an accomplishment. an 11-year-old girl had to be rescued from the family washing

machine after she got stuck during a game. >> she climbed in, kids, never ever do this. trapped for 90 minutes as the family tried peanut butter and ice and warm water. they couldn't find a way so called 911. firefighters arrived they were carrying an assortment of tools. >> they got some gas power tools out, some big snips, to get people out of cars. they were thinking they were going to have to cut down the middle of the washer and open it up. >> firefighters were able to remove the drier above and pull the girl out. the girl is embarrassed, does not want her identity revealed but she is just fine. >> she was invested in that game of hide and seek. good to know it ended well. 5:21. coming up more and more wild animals could soon make their way into the bay area's busy streets. we'll explain wye.

>> 5:24. a lack of rain could bring mountain lions and other wild animals into bay area neighborhoods. wildlife officials say the dry weather is driving thirsty animals, probably not chickens, closer to cities. there is a bad guy. it's an issue in southern california, as people could see here in northern california more mountain lions and bears, even deer can be aggressive if thirsty and desperate. >> they need to eat and they need to drink water as much as we do, so what happens is when they can't find a natural stream they are going to go to where the water is which is often in people's yards. >> wildlife officials say as tempting as it is to set out water for thirsty animals, they advise doing that. >> while the rest of the country

is getting pounded by snow california's run of dry weather is creating a lot of concerns for the ski business. most ski shops in the bay area say they are still seeing a steady stream of customers heading to the resorts. it seems manmade snow is keeping them afloat. the owner of snow drift ski shop says he scaled back the number of employees from 10 to 3 as a result of the dry year. some of his customers say conditions are not ideal but they are skiable. >> you just have to expect a lot of runs that aren't open but you know, the worst day of skiing is possibly better than your best day in the office. >> boy, i second that. i couldn't agree with that more. tomorrow the california department of water resources plans to conduct the year'shfq c first snow survey. early data shows the snowpack is 20% of normal for this time of year. >> so let's figure this out. dry weather means bears are coming out of the mountains, skiing isn't that great, christina loren joins us when does it end?

it is the city's first homicide of the new year. it happened hours ago near 33rd and east san antonio street, that's just north of the highway 101 and 680 interchange. bob redell is live at the scene with an update to the investigation. good morning, bob. >> reporter: good morning. in the past 30 minutes the homicide detective with san jose police have arrived and focusing on a driveway a couple houses down here on the 1600 block of east san antonio where a man is lying dead. someone driving by around 1:30 this morning called 911 to report that he was in that driveway when the paramedics arrived he was unresponsive. they performed cpr. they were not able to revive him. he was pronounced dead making him the first person to be murdered in san jose in this new year, 2014. what make this is story a little odd is that residents actually heard gun shots about an hour to 45 minutes prior to that 911

call, they also heard a car driving off but for whatever reason, no one bothered to call 911. police have been talking to people around here, no one seems to know this man. they don't know why he was shot and killed and of course they don't have a suspect as of yet. so what they have been doing, they tell us, people are being cooperative, trying to figure out what was the motive behind this shooting and who was the person who shot this man. again, the first homicide here in san jose taking place here in the eastern part of the city. >> thank you much. >> a developing story out of israel to tell you about. a hospital official says former prime minister aerial sharon's health is declining. he has been in the hospital for about eight years remarkably but his condition has drastically deteriorated. they say some of his organs including his kidneys are malfunctioning. the 85-year-old has been in a

coma since 2006, that's when a stroke incapacitated him at the height of his political power. elected prime minister in 2001 sharon was one of israel's iconic figures. new details at the chinese consulate. investigators are looking for an arsonist. the fire was reported last night. christie smith is there live in san francisco with more on what the consulate describing as a violent crime. >> reporter: yes, that's right. good morning to you. you can still smell gasoline out here. i want to step aside so you can see the front doors. one of them was pried off and is laying on the ground. so the chinese consulate released a statement condemning what they call an arson attack and very violent crime against them. i want to show you an image from cctv, china central television, a fire ball outside of the

survivor after deadly house fire christmas day. the san francisco man opening up about the life he and his long time partner built together. the fire broke out in a victorian home on baker street, from his hospital bed patrick ferry told us his partner of nearly 30 years has died. ferry recovering from severe burns to his hands, the pair spent several years restoring the house and had a shop, the sword and rose. >> the last thing he would want from me is to be curled up in a ball refusing to go on because of my grief. >> ferry says she choosing to celebrate the 29 years he had with sapp. there will be a ceremony at the sword and rose though that hasn't been scheduled yet. >> 5:35. time to get a look at how the temperatures will shape up for the day. good morning to you. >> good morning, peggy, scott,

everybody at home. another unseasonably warm finish with temperatures ending up in the 70s again. it's going to be about as warm as yesterday. yesterday was pretty nice. we're looking good for 68 in the south bay, the peninsula at 68, 70 in the east bay. san francisco at 66 and 67 degrees, comfortable in the north bay. we do have changes headed our way. it's going to be nice, we're going to hold on to unseasonably warm conditions. you want to find out when major cooling comes in. also counting on showers as we get into next week. over all looking did as we head through the next couple days to hold onto the 60s. by next tuesday we're talking about the 50s. give and take. along with cooler temperatures we're going to get better air quality. a spare the air day. throughout saturday and sunday, our air quality will be much improved. with the reinforcing shoft clear

were plucked hours ago from the ice. the rescue was the third attempt to get the passengers off of the ship stuck since christmas. tracy spots live on capitol hill this morning with more. they are finally off of that boat. >> reporter: they are finally off of that boat on another boat now where they will be for a couple of weeks until they make their way to australia. there are treacherous conditions there but this russian vessel was stuck in 10 feet of ice since the day before christmas. this morning yet another rescue attempt. several failed, this time despite early concerns they were able to make a number of chopper trips back and forth to get these 52 people, the passengers off of that messle onto an australian messle that will make its way to land. what was so interesting, one of the professors was tweeting during the rescue so we saw the helicopters taking off for the

second time. we saw some of the photos when they landed on that australian vessel. but they got a bit of a ways to go. also interesting here, 22 people are not going to be leaving that ship. they are the crew, and the captain says they are going to stay with the ship until the ice breaks up and they can maneuver their way out. >> a huge effort to get them on the boat so good news there. thank you so much. today our first look at an american ship that will play a role in the destruction of sellia's chemical peps. the cape ray will be run through sea trials. there are two machines to reduce chemical weapons to inert material and been bolted to the ship. parts from a third machine have been loaded on board this morning, toxic chemicals will be loaded in syria, transferred onto the cape ray at an italian

port where they will be destroyed there on ship. >> firefighters in minneapolis say they don't know if anyone remains trapped 18 building after an explosion and fire yesterday morning. first just can't get inside because the roof has partly -- the building which housed 10 apartments and store was destroyed. investigators say some people may have been pushed out of the building by the blast. >> family members and friends continue to mourn for a 19-year-old mother hit and killed by a truck in fremont while carrying her 3-month-old baby. dozens showed up to a vigil for ashley last night. she was walking with her sister when the three were hit on mowry avenue. investigators say the impact caused the baby to fly out of his mother's arms. >> her son was everything to her. he changed her completely. everything she ever posted on

social media was about him. every picture is pim. it's unfortunate that she's not here. but i know that she will be watching out for him. >> the baby is in critical condition. capuchin's sister has minor injuries, the sisters got into an argument with other family in a car, got out to walk and that's when they were hit. officials don't believe the driver had been drinking. the driver told him he did not see the three in the road. >> new details about a girl hit and killed on new year's eve. it happened at the intersection of ellis and polk streets around 8:00 p.m. a 7-year-old girl, her mother and brother were walking when they were hit by a honda suv. mother has life threatening injuries. police don't think drugs and alcohol were involved but the driver was arrested for vehicular manslaughter. the driver's name has not been

releas released. there is speculation she or he was an uber partner. uber released a statement saying in part quote our olcy is to deactivate any law enforcement matter. if the driver is in fact a partner of uber she will be deactivated using that uber technology. so uber, it's unclear whether it was an uber car at all. >> police have identified two people shot on new year's eve as a college student and a boy. the boy, lee, was reportedly talking home when he was shot near the circumstance of 104th and walnut. he was taken to the hospital where he was pronounced dead. investigators say 21-year-old ashley walker was shot while

well, good morning to you, san jose. some people having to go to work this morning, if you are one of them good morning. if you arstanford cardinal fan, waking up disappointed following that tough loss in the 100th rose bowl. thousands of fans packing the stadium in pasadena. this was close all the way to the end. i mean on the first drive stanford you thought was going to win this 7-0 on the touchdown from tyler gaffney. but then you fast forward to the fourth and things were all tied up at 17. until this one. connor cook of michigan state finds tony lippett. stanford falls, 24-20. >> you play the game to get to these opportunities and have these games. so to lose is difficult. but there's no greater high than achieving that kind of level as a team. so it's difficult. we were happy with the way we
