right there. good sunday morning. i'm sam brock in for kris sanchez. bundle up. at least bundle up if you're going to be in green bay for the game. for the local weather outlook, let's start this morning with rob mayeda with a look at your first forecast. >> good morning, sam. by our standards these temperatures are pretty chilly. 35 degrees in san jose right now but that's about 45 degrees warmer than the temperature we'll probably see in green bay a limb later on this evening. 20s in the north bay though and you notice san francisco, 53 degrees. quick check of the forecast as we get into the afternoon. we have some offshore winds, so san francisco mid-60s. close to 70 out near the coastline today. down towards santa cruz, 68 in the north bay, 66 around san jose for the afternoon. here is the good news about the wind. it's not a spare the air day for a change. the air quality has improved just a bit. for the hilltops where fire danger is concerned, we have to watch the wind gusts close to 35 miles an hour for the afternoon. full look at your afternoon forecast and what you can expect

coming up in a few minutes. we begin with breaking news. all flights on hold at jfk airport after a plane skids off the runway. the faa made the announcement shortly after the plane carrying 35 people from toronto landed safely on the runway but then skidded into a bank of snow while preparing to taxi. so far there are no reports of injuries. aviation officials say the ice and freezing rain are to blame for the closure. it is also impacting laguardia airport which has a traffic management program in effect due to this weather. jfk is expected to reopen around 8:30 this morning west coast time. after an intense search overnight in oakland, a 5-year-old boy is safe back home. but there are new questions arising this morning about the little boy's disappearance. police say 5-year-old darryl carter iii disappeared yesterday afternoon while attending a weekly event at arroyo viejo recreation center. he was waiting for his mom to pick him up at the rec center on 77th and krause. his mom is appalled that the rec

center staff could lose track of such a young child. >> you let a 5-year-old walk home. a doesn't matter, you see other kids walking in that direction and especially if you know i'm picking him up and dropping him off. it's crazy. i'm glad my son was smart enough to know to go home. even though he couldn't find a pay phone or a phone to get to. >> any persons associated with it we'll look into. >> as the mother just alluded to, the little boy was eventually found nearly four hours later at home and unhurt. new details about a brazen kidnapping at the same parking lot where police say a 7-year-old girl from antioch was followed home and later abducted. antioch pd said 43-year-old david allen douglas approached another woman and her daughter in in walmart parking lot explaining he worked for soutci

services. >> he asked the daughter to come with him. the mother quickly realized he was not from social services and he left. >> douglas is currently being held on $4 million bail after police arrested him on friday night. they said douglas allegedly followed a 7-year-old girl and her mother home from walmart. as they was unloading the car, he drove up and grabbed the girl. when the mother tried to stop him, douglas pulled out a gun. authorities say the girl appears to be unharmed. on our continuing coverage over the fight over jahi mcmath. last night family gathered with friends and family at oakland hospital. a judge ruled jahi can be removed in her current condition as long as jahi's mother is willing to assume full responsibility. the mcmath camp says they look forward to moving her to another facility where they feel they will get better treatment. >> absolutely, that will treat

her like the human being she is and not some deceased body like children's hospital has been calling her. >> i said, hey, jahi and she moved her legs and arms. heart is beating good. she's warm and she looks beautiful. this is the best glow i have ever seen she had. >> you think she understands what's happening? >> yes, i do. >> she was declared both brain dead by hospital physicians and independent doctors after complications following tonsil surgery in mid-december. another hearing is scheduled for tuesday. until then she will remain on a ventilator at oakland children's hospital. vallejo police released the identity of a 61-year-old man struck and killed while cross the street. police say sergio palais pelay crossing the street when a car ran into him. another car drove over him. officers say it does not appear,

drugs, alcohol, or speed were a factor. investigators in fairfield are looking for anybody who witnessed the deadly shooting on friday night. there's a memorial for the victim at the parkway gardens apartments on san lucas drive. that is where police were called out about 8:00 on friday evening. they found the lifeless body of 21-year-old terrell brumfield of fairfield. police are trying to determine what motivated the shooter, though they have no suspects at this time. a man wanted in connection with the killing of a german tourist in san francisco in 2010 is behind bars this morning. police say 21-year-old devante laws was taken into custody by members of a u.s. marshals task force on thursday. laws is a suspected gang member who has been on the northern california most wanted website for years. investigators believe he was an accessory in the murder of mechthild schroerschroer.

she was caught in what police are calling a gang shootout. now to an nbc bay area follow-up. the baby boy who suffered life threatening injuries when his mother was struck by a pickup truck on new year's eve is still fighting for his live. doctors are still assessing the extent of his injuries. his mother, ashley capuchin, did not survive the accident. on wednesday nearly 100 relatives and friends gathered on pa say yo padre parkway. the family has established a fund on give forward.com. much more still to come on "today in the bay." next, california leading the way in what could be a landmark case for immigrant rights. the decision that could lead to a ripple effect across the country. at the very end they actually show video or pictures of the guys, and that's when it kind ever hits home. >> and the story of a brutal

you are watching "today in the bay." >> 7:10 on your sunday morning on january 5th. a live picture right now of san jose as the sun starts to peek out from behind the mountains. immigration rights activists are calling it a victory. the california supreme court ruled that an undocumented immigrant from chico, california, can get his law license. "today in the bay's" joe rosato, jr., has more on his legal battle that could trigger changes across the country. >> reporter: sergio garcia did everything you need to do to become a lawyer. he went to law school, passed the bar, but when it came to getting a license to practice law in california, the doors closed. that's because garcia is an undocumented immigrant. >> this is the land that you want to have a happy ending and you want to show that the little guy can overcome insurmountable

on obstacles. >> he came to the u.s. when he was a teenager. four years ago he challenged law refusing people who enter ed th country illegally from receiving licenses. >> the state must enact a law that says they can get them. >> reporter: attorney jim wagstaff argued the law. the oaks opposed garcia's license. but california's legislature passed a law allowing garcia to get a law license the day after the law took effect, the state supreme court ruled in his favor. >> i believe this will become a lighthouse of nondiscriminatory approaches to who becomes a lawyer. other states one can hope will follow this beacon and allow people to become lawyers solely on the content of their character and not based on their status as undocumented immigrants or their race or religion.

you are watching "today in the bay." >> 7:15 now on your sunday morning. a live picture of the sleepy east bay town of pleasanton. in communities all over the east bay, the peninsula, the city, all going to be tuning in today to watch the niners take on the green bay packers. in a game where the freezing temperatures could rival some of the lowest in nfl history, the 49ers will take on the packers in green bay this afternoon in a wildcard round of the playoffs. here at home, local bars and restaurants are just getting ready for that big game. and the onslaught of enthusiastic fans. kimberly tere ventures into the fray. >> reporter: with refrigerators packed with kegs and the kitchen ready to go. britannica arms are just waiting for the football fans to show

up. >> we are ready. >> reporter: the 49ers are facing a familiar foe against the packers. >> i'm hoping that the weather is going to, you know, defer san francisco a little bit. so i'm hoping green bay sneaks it out somehow. >> reporter: any predictions? >> niners. by ten. >> reporter: it seems fans are ready to see their respective teams play in the less than perfect weather conditions expected in green bay. >> always fun to watch them at lambeau in the cold. >> i'm hyped. it's so exciting. i'm just glad i'm back here in san jose where the weather is really nice and not freezing. >> reporter: the packers have announced they will be offering free coffee and hot chocolate to fans. >> try to stay ahead of it. we'll have a high demand for hot drinks. we'll do everything we can to make sure we have enough for the fans. >> reporter: as for the beer, it's so cold in green bay to keep it from freezing vendors are putting heaters on hundreds of beer towers.

kimberly tere on "today in the bay." >> the snow on the field, the visible breath from fans. it's not quite as cold as we thought it would be. >> if you could, i guess, feel the difference between five degrees below zero and maybe six degrees above zero, we're just going through the numbers this morning. a little warmer when you talk about a little extra moisture to the atmosphere. enough we could see a few snow flurries late in the game. the problem is the wind speed plus that air temperature in the single digits. it will feel like 12 degrees to 20 degrees below zero by the time it gets towards the fourth quarter. it doesn't look like this is going to be in the top five of the coldest of all time. perhaps in the top 10 or 15, but the windchills will certainly continue to get a little worse as the wind speeds pick up. it's possible if we get into overtime, we could really see those windchill factor numbers drop below 20 degrees below zero for the end of that 49ers and packers game. the weather system that's pumping in this cold air, you can see, it actually will cause more flight delays out towards chicago and it's been a mess

around new york and boston this morning. the system will eventually head off to the east. rain coming into the upper northeast for tomorrow. so flight delays very likely across that nerortheastern corridor today and into tomorrow. for bay area standards, chilly temperatures, 20s around the north bay. 35 in san jose and the winds will be part of the story. enough wind we will see temperatures out towards the coast today warming up, and you can see the direction of these arrows offshore. winds offshore. temperatures tend to soar on the coastline. we're going to see that today. mid to upper 60s, closer to 70 around santa cruz. better mixing of the atmosphere and we do not have a spare the air day. moderate air quality from the north bay into the south bay and the pattern that is still holding strong keeping us dry is a super sized ridge of high pressure for this time of year. really just blocking off these incoming weather systems from crossing over the coast. however though, a little later as we go through the workweek, we'll start to see some changes.

that ridge of high pressure will start to break down just enough it will allow some relatively weaker systems to kind of drop up and over the bay area and maybe give us a chance of seeing a few showers, especially out towards the north bay and a few snow showers possible in the sierra. more so for wednesday into thursday. watch the system here, largely most of the moisture bypassing the bay area but dropping down over the sierra. we hope it gets us some more snow. we could certainly use the snow in the sierra and we'll see if we get measurable snow in the sierra. down from the upper 60s we'll finish the weekend with highs in the upper 50s to low six. today in san jose, about 66 degrees. upper 60s south of downtown san jose. close to 70 around morgan hill. san francisco looking pretty nice. a shame this game could not be at candlestick. you'd have gorgeous weather. nor the north bay, santa rosa, with winds out of the north approaching 70 for the afternoon. oakland could be approaching a record high if we get close to

70 today. we'll be close to that and around the tri-valley you will see those numbers in the upper 60s and here are the warmest spots to be around the bay area and beyond. 71 in gilroy, 70 in santa cruz today and relatively mild for this time of year in the sierra. still dry for now. hopefully some snow showers coming in as early as tuesday. sam? >> thank you very much, rob. a dangerous mission in afghanistan proved to be a deadly one for a navy s.e.a.l. from the bay area. matthew axelsson died in 2005, and now his story is a focus of a new film. "today in the bay's" george cure kiriyama spoke with matthew's brother titled "lone survivor." >> this is the last picture of the family. >> reporter: jeff will always have memories of his brother captured in photos and personal items. >> a couple rangers found like a half empty clip on a ridge somewhere and it had a.x. on the bottom. that's how they knew it was

matts. >> reporter: he was one of four navy s.e.a.l.s whose mission was to capture or kill an al qaeda leader. the mission failed. axelson and two other s.e.a.l.s were killed in action. their story is being told in "lone survivor." the trailer for the movie is even on youtube. jeff has already seen the movie three times. he admits its difficult for him to watch a visual representation of how his brother died. >> it wasn't until the end -- because at the very end they actually show video or pictures of the guys, and that's when it kind ever hits home. >> reporter: actor ben foster portrayed axelsson in "lone survivor." he met with the family to capture his spirit. >> ben captured my brother as well as i could expect anyone to. >> reporter: he named his 2-year-old son matthew after his

you are watching "today in the bay." >> a once in a generation project, that is what experts say high speed rail could be if it ever gets off the ground. 20 years ago californians voiced the same douts about the bay bridge project. 80 years ago it was the golden gate bridge. so what lesson does history have for us now? this this morning's "reality check", we look at what hope can be gleaned, if any, from these historic stumbling blocks. >> these are some of the studies i do. >> reporter: in a flat in soma, donald mcdonald takes us behind the curtain of his architectural lab. at the moment he's sketching the next stress ribbon bridge. you're probably familiar with some of his earlier work. like the eastern span of the bay bridge. >> it's been the highlight of my life basically. >> reporter: and clearly mcdonald is a patient man. >> supposed to get down in four or five years or something but,

as you know, the politics got involved with jerry brown, our mayor, willie brown, and we had all kind of concessions they wanted in mitigation. >> reporter: not to mention governor sha wachwarzenegger scrapping design plans at one point. there were five cities involved and a price tag that ballooned to five times the original zime estimate. but the bridge got done. consider the troubles faced by the golden gate bridge which was close to never seeing the light of day. rod deeradon names a few obstacles like lawsuit and money. >> the golden gate bridge in 1930 had 2,300 lawsuits against it. 2 stsht 2,300 lawsuits against it. >> compared to fewer than a dozen for high speed rail. then there's the cost. >> the price tag had gone up dramatically.

couple hundred million dollars. goodness, a couple hundred million dollars. 1935, that was a few bucks. >> reporter: in today's money, the golden gate bridge would cost around $1.5 billion according to the bridge's highway and transportation district. high speed rail, estimates in current dollars are around $70 billion minimum. and here is where the difference between high speed and other projects really stands out. not just the scope of money involved. but also the part where pen meets paper. attorney michael brady, who represents the plafs suing the high speed rail authority says the conditions outlined in prop 1a, the voter ballot measure, that it harder to spend taxpayer money than any major public works project in modern history. >> unique thing here is all these rigid protections and safeguards were put in by a legislature which did not want a big dig to happen. they did not want a bay bridge to happen again. they wanted to be sure that the taxpayers were protected and

that's why we filed this lawsuit. >> and a sacramento judge found the law requires the rail authority to come up with $25 billion. that's a massive sum. they need to identify that money soon as well. so high speed rail might not get going this time around, but when there's a demonstrable need, projects get done. the bay bridge was built in the 1930s when the city kos no longer ferry 40,000 cars a day and similarly when our roads and airports could no longer support 60 million californians, we'll get high speed rail. much more still to come on "today in the bay." next, the vacation is over. president obama and his daughters return to washington after spending the holidays in hawaii. we'll tell you why the first lady was left behind. and b.a.r.t. riders could be paying more but not for their tickets. we'll explain coming up next.

7:30 on your sunday. a live image right now of the city of san francisco. appears to be a little bit of wind just based on that camera shaking. good morning. thank you for joining us. i'm sam brock in for kris sanchez today. snow in the northeast, freezing temperatures in the midwest. how about right here in the bay area? let's check your forecast with meteorologist rob mayeda. >> other than the wind this morning, pretty nice. clear skies from our emeryville cam looking across the bay. fog-free and temperatures where we're seeing the winds up in the 50s this morning. you have that in san francisco and, yes, the camera is bouncing around quite a bit. dry air and clesh sar skies hel the temperatures to dip into the 20s and 30s. a little taste of maybe some lambeau field weather for you to get the morning started. for the afternoon mid to upper 60s today and actually numbers closer to 70 out on the coast thanks to the offshore winds. another thing the wind is doing is helping our air quality today. it is not a spare the air day for a change. moderate air quality levels

ever seen she had. >> do you understand she understands what's happening? >> yes, i do. i know she do. >> she was declared brain dead by hospital physicians and independent doctors after complications following tonsil surgery. the teen will remain on a ventilator at oakland children's hospital. traffic on the embarcadero in san francisco was tied up for hours yesterday after a muni trolley crashed into a big rig. it caused significant damage to the trolley car. it happened around 12:45 on the f line interthe intersection of embarcadero and bay street. four people were taken to the hospital with minor injuries. not clear why the trolley and big rig collided. b.a.r.t. is another step closer to a new contract. members from one of b.a.r.t.'s largest union approved a tentative four-year agreement. the 945-station agents, trained operators, and workers approved the agreement on friday evening. members of the other largest union representing more than

1400 mechanics, custodians, and clerical workers will be voting on january 13th. the board of directors vetted to approve that tentative contract. some riders will be paying more to park their fees. parking fees will be going up to $2 from $1.50. the parking fee at daly city is riding to $3. riders parking at west oakland will be paying the most, $6 a day. the money raised will be going to improved programs according to b.a.r.t. good news for people who signed up for covered california. they have an extra nine days to pay for the first month's premium. it makes sure health insurance companies have times to mail invoices and consumers to receive documents. insurance companies stress this is just a one-time payment deadline extension so keep that in mind. the holidays are over and it's time to get back to work.

that includes the president who just landed back in washington with everyone except, you know, his wife, the first lady. after some two weeks on vacation in hawaii, the president and his two daughters are expected to return home today. as for michelle obama, she'll remain in hawaii where she'll be spending some time with friends before her 50th birthday which is at the end of the month. it's apparently a part of the president's birthday gift for her. there's no word yet on how or when mr. and mrs. obama will be returning to the white house. a southern california pet owner makes his way to find his loyal canine missing from the back yard. "today in the bay's" reggie kumar shows us from the owner's surveillance camera captured. >> reporter: a shocking discovery captured by cameras on a sun valley home. >> wow. we can't believe the size of this cat. >> reporter: that cat seen in the video just before 3:30 friday morning, an l.a. wildlife specialist says, is 110-pound

mountain lion. you can see the animal at the top of the screen walk across the front lawn and head directly to the backyard gate of the home where the dog rocky was sound asleep. >> i don't see rocky jumping the fence. he's eight or nine years old. >> the video doesn't show this part but the homeowner thinks the mountain lion jumped onto this trash can and walked into this area where rocky was asleep. at this point the homeowner believes the mountain lion grabbed rocky and took him. >> it is feasible for a mountain lion to pick up a dog and carry it away. >> reporter: possible tracks were found near the backyard fence says wildlife officer gregory randall. he searched for the dog's remains in the foothills behind the home. >> it would be very difficult. they would have to drag it. in some cases they don't get it out of the property. >> reporter: randall is somewhat skeptical that a mountain lion went after the owner's dog.

you are watching "today in the bay." here is an idea. is california too big for its own good or more to the point for the good of its residents. some people think so and want to divide the state up, just carve it. for more on this idea, we're joined by nbc bay area political analyst larry gerston. we've heard this idea before. any merit to this iteration? >> it all depends on how you think about it, california has 38 million residents. that's more than a lot of countries. really the second most populated state is texas at 25 million. then you think about the fact that in terms of calculating size, it's eclipsed only by alaska and texas, third largest state in the texas. if you think about california's

thousand-mile coast line that's surpassed only by alaska and florida. we're talking big here. you put all those facts together and, you know, some people, yeah, they think that this state is just too big to meet the needs of its varied population. >> we have heard this idea come up before. it's not a novelty. my question would have to be, what needs to happen to actually effectuate this kind of change? >> well, first, a little history here. ever since california became a state there, have been more than 200 of these efforts. some consider them kind of wacky, but nonetheless, serious efforts to break the state up. currently there are two big efforts to do just that. first would take ten of california's most northerly counties and connect them with several southern counties in oregon and that would create the state of jefferson. it's been going on for some time, this idea. the for example behind it are tired of seeing their water go south after being saved in the huge dams they say do nothing but ruin the environment. then we've got another one going right now, and that's the brainchild of venture capitalist

tim draper who wants to see california broken into six states because each area is just so different from the others. one would be called the state of silicon valley. tell that to your friends. and why? because he thinks we need to understand and appreciate the differences of the state. and by the way, draper wants to put an initiative on the ballot in november 2014 to do just that. >> any indication that the public would go along with this? they'd be able to garner enough signatures to make it happen? >> there's a little history to it. we can look at it that way. in 1863, you have to go back a ways, i realize that, in 1863 west virginia broke away from virginia during the civil war and was accepted into the union by congress as a free state, and other than that, wow, it's hard. there's never been another state or states created from an existing state, and if you think about the question of, well, can we get the signatures, you know, you're going to need somewhere upward of 800,000 or 900,000

signatures just to get it on the ballot. then the question is what kind of money would there be behind it to push it. >> that gets to a broader arching question which is what were the incentives be? is this a grab over resources, is it politics, is it a culture clash? we have a large state, lots of different populations. what's the driving force behind this idea? >> in no place do we see the variety of people and ideas and values that we see in california. yeah, i think this is largely a culture battle. we see the culture issue played out nationally. california is a microcosm of that battle. we're whether talking about finances, the wealthy versus the poor, talking about natural resources, all the water, 75% of it in the north going down to where 75% of the population is in the south. put all those things together and, yeah, this is a massive culture battle. >> do you think there's a sense of possessiveness in silicon valley about our intellectual

resources and not wanting to share those elsewhere or the proceeds of them? >> there's some people in silicon valley who kind of think we're kind of smart, and that the rest of the state is sort of like following behind. it's a fair statement by the way to say that right now silicon valley is the economic juggernaut of the state. there's no question about that. and so like other it's, they're wondering do we want to share all this? that's, by the way, quite similar to the way the folks feel in extreme northern part of the state. somewhere along the line people have to decide whether they're one state or whether we're microclimates, if you will, to steal from rob mayeda, of many states. but i'll tell you something, don't be spending too much time waiting up at night to see what happens here. because even if, even if this thing gets on the ballot, it would still need the approval of state legislature. it would still need the approval of the united states congress, and can you imagine those guys in congress saying, let's go not just have two senators from california, let's have 12. when they consider the west and california, as crazy as it is in

their eyes, i don't think you will see it happening. >> you would think congress has larger priorities other than approving the carving up of california for whatever the motivation may be. one final question. tim draper's proposal has been widely kind of documented at this point. who are the types of people, what kinds of people would like to actually see this sort of plan go into effect? >> politically speaking we're talking about libertarians, people who really want to be left alone, who don't really want to share their resources with others, and frankly, don't care about the resources of others as well. they are people who want to see small, small is beautiful for these folks and those are the folks, but i think you're going to find that most of these folks are on the fringe of politics in california. of course, no state has as many fringes in california. >> as you 15said, a massive population, that comes with the territory. professor, thank you. i appreciate it. up next, sweet nuptials, the unusual way one couple decided to tie the knot.

delicious granola bars made with the best ingredients in nature. nature valley. nature at its most delicious. and we're off to a cool start this sunday morning, but not as cool as things will be out around lambeau field this afternoon. we're going to look at temperatures, the air temperatures just a little bit above zero during the game, maybe a chance of some snow flurries late. the combination of the wind and air temperature though still looks bone-chilling cold out there as the game goes on between the 49ers and green bay packers. could see windchill factors or the feels-like temperature dropping to my news 20 as that game aproproaches the end of th fourth quarter. later on today we'll be watching that. across parts of wisconsin and michigan is a snow system starting to move off to the east. we've had a lot of problems in new york city and the airports.

flight cancellations out toward chicago and maybe new york city. bay area, completely different story. clear skies, offshore winds. you can see how clear things are from the emeryville cam, but the san francisco camera just hanging on. the 49ers' flag looks good but look at the camera rocking around. winds offshore. flag pointed off to the west and that's the reason as the air gets forced down to the coast, it warms and drys out places near santa cruz. a chance of getting close to 70 degrees. top wind speeds, around oakland into san francisco, the direction of the arrows, that's a dry air flow as opposed to the more typical sea breeze that pushes the marine air and low clouds in. it's the opposite of that today. the side effect though is some good air quality, at least better air quality than we've seen over recent days. moderate air quality levels from the north bay into the south bay. enough wind out there to prevent the smoke from piling up in any little pockets of the bay area

for today. high pressure still holding its ground so we're going to stay dry and it does look like we'll be staying dry probably for monday. now, tuesday we'll have a chance with this weak system brushing by, may see a stray shower and then a bit of a stronger system dropping in mainly up and over the bay area down into the sierra wednesday into thursday. that system as we pass the middle part of the week gives us the best chance of seeing showers. highs today around the bay area quite gorgeous as you plan your 49ers football forecast and afternoon plans. mid-60s and san jose. upper 60s around are two began hi -- toward morgan hill. close to 70 in santa rosa and the tri-valley. we'll be jumping from the 30s to maybe close to the upper 60s to near 70 for the afternoon and the warmest temperatures again right on the coast. santa cruz looking great, 70 degrees. and pretty warm there. 71 degrees this afternoon in gilroy. sam? >> who needs wisconsin when you can live in the bay area. thank you very much, rob.

also speaking of who needs, what about a wedding cake? you don't need a wedding cake when you have wedding doughnuts. this couple tied the knot at the voodoo doughnut shot in denver, colorado on 1/14/14 at 1:14. the day and time were not preplanned. >> it was the first saturday they were going to be open and ready for us. >> so then we realized it was 1/4/14 and it just sort of all fell into place. >> the ceo says while weddings are common at the original store back in oregon, this is a first one at the denver location. the couple says they picked that doughnut shop because it best represented their family and i could be mistaken but i think i spotted a doughnut with froot loops on it or some sort of childhood ccereal. >> you wouldn't expect that's a wedding chapel. >> we could get behind a merging of doughnuts and weddings. >> it looked interesting. >> big game on today. appreciate the red tie. we'll see you at 5:00, 6:00, and
