charges could be filed against the man who admitted to kidnapping a 7-year-old girl from her own bay area driveway. "today in the bay's" christie smith, live in martinez with more on the case, including his jailhouse interview. >> reporter: good morning. the district attorney's office here is expected to get the kidnapping case from antioch police later this morning. the man accused of kidnapping a 7-year-old girl is speaking out from his jail cell, offering a bizarre and disturbing explanation of what led up to the kidnapping. the 43-year-old david douglas spoke from his jail cell, saying it took three days of repeated situations, looking for the perfect kidnapping victim. he says that he followed the 7-year-old girl and her mom home and took the girl on friday. he says he scanned the antioch walmart parking lot looking for the perfect victim. he called the kidnapping a cry for help, claiming people from the government have been

following him, and told him to do it. >> i said, i don't know, i'm supposed to take you, i just know that i am for some reason or other. these people want to see this happen, i don't know why. i said, why don't we both try to calm down, first, and then we'll talk about it more in a minute. >> reporter: he says he had no intention of harming the girl and did not touch her. police found them at the marina a short time later. court documents show that douglas' stepfather unsuccessfully applied for a restraining order in november, claiming douglas was threatening the family and was mad at his mother for not getting him an appointment at uc berkeley psychology department. christie smith, "today in the bay." >> thanks very much. the man accused of gunning down a 26-year-old in berkeley last july will make his first

court appearance today. arrested on monday, expected to be arraigned this afternoon on charges he shot and killed davis on derby street in south berkeley july 17th of last year. berkeley police say that shooting prompted retaliation against york, which led to the fatal shooting of the 8-year-old, four hours later in east oakland. reportedly at a sleepover with york's daughter when someone rang the doorbell, opened fire. she was killed and three others injured. the men will be in court today. new this morning, police hope neighbors have surveillance video showing who broke into a hillsborough home and stole thousands of dollars of jewelry and coins. the burglary happened on al bbea drive. the suspect broke a glass door in the back of the home and stole 100,000 worth of valuables. the house does have an alarm

system but it was not on at the time. 5:03. officials confirm a second person in the bay area died from the flu and fear it's just the beginning. this flu season could get worse before it getting any better. peggy bunker in san jose. it's not just the elderly at risk anymore. >> reporter: that's something that we talk about every year, especially if you have a compromised immune system. this year, it's aggressive strain of the h1n1 virus that has officials concerned. now we are getting reports of the second flu-related death here in the bay area. let's show you where these deaths took place after these people contracted the flu. yesterday, contra costa county revealed a 48-year-old woman died within the last week. she did have an underlying medical condition that preceded her contracting the flu. however, that condition was not revealed. last week, though, a santa clara county woman died, 41, from h1n1

strain. so the exact strain that the cdc is talking about. both relatively yoing wom lly yh dead from the flu. more states are reporting flu-related deaths and increasing numbers of people getting sick, even young people. sometimes you think it only affects the elderly. doctors are saying this year, young people can get the flu. >> a lot of people previously healthy in the 30s, 40s, 50s, getting very sick with flu. >> did you put it in already? >> reporter: state health officials are warning the flu looks like the 2009 strain that killed thousands who contracted the flu. here in san jose, standing in front of a walgreens, there's a sign offering up flu shots. you don't need an appointment to come in here to get the flu shot. many drugstores and doctor's offices are offering this, no appointment required to get the shot. we'll keep you posted as we

continue to watch the story. peggy bunker, "today in the bay." >> thank you. bitter cold temperatures continue to cause trouble in half of the country, but relief is on the way. temperatures expected to warm just a bit today. one day after cold arctic air covered everything from the midwest to the northeast, down south as well. setting record low temperatures. at least 21 people have died because of the cold. seven of those in illinois. authorities say, many of those who died were homeless people who did not make it to a warm place. cold weather being blamed for a busted pipe aboard an american airlines flight. the plane was in the air after taking off from dallas when the bathroom pipe ruptured. a morning executive producer on the plane. he said the water spilled down the aisle, soaking several passengers. the plane made an emergency landing in little rock and passengers had to get off so crews could clean up the mess. they were allowed to reboard and

continue on to baltimore. check out this from dunwoody. a water main broke out, sending water into the air. seconds later, water froze. >> wow. >> turning trees and power lines to ice. crews are still working to repair the break and dig up ice. >> power lines and people don't get power to homes and in cold temperatures, having a tough guy. >> yeah. changes in our forecast as well. not to that extreme. >> not frozen pipes anytime soon or anything caused by the severe cole. we'll get rain. we need it. our hills are brown and thirsty for that rain. temperatures right now, in the 40s and 50s. not too cold. notice that when you walk out your front door. good idea to give yourself extra time as temperatures are going to be cool. we've got that fog and drizzle back as well. make sure you're ready. jacket weather for the next 48

censors are concerned. lower the speeds when you come off the off-ramps. the mist and drizzle after a dry period means grease and oil rise to the top of the water, causing slicker conditions. smooth drive through this tri-valley portion. we have considerable slowdown out of the altamont pass. a burst of traffic starts at this time. a pickup on fire blocking one lane. no one injured but a slowdown out of the altamont pass. once you pass vasco, moving toward the dublin interchange. earlier interdent, cleared from the lanes. back to you. this morning, mountain view based google using a new ferry service to get its employees to work. bob redell joins us with more details. >> reporter: good morning. this recent decision by google to start ferrying its employees by waters from sf to in the

south bay seems to be in response to protests over google's use of charter buss in the city. the tech giant started chartering a catamaran ferry to shuttle its employees between the ferry building here in sf and the port of redwood city in mountain view. the ferry, called the triumphant seen here in a video provided by its manufacturer will do two run in the morning, with two return trips in of the and a half noon, carrying almost 150 employees on each run. the company saying it's trying to find alternative ways to get employees into work that it doesn't want to inconvenience people who live in the city. google's use of charter buses, which has been going on for some time, for its employees, has irked some sf residents. so much so they protested their use, even blocked the buses. their gripe, they're upset with the rising rents caused by the

surge in a number of tech workers who live here and work elsewhere and they make more money. google is one company that makes it easy for workers to live here providing this free charter service. protesters don't think it's right google buss have been using the muni bus stops without paying for that privilege. that did change, it should be noted earlier, when the tech giant agreed to pay sf $100,000 a year to continuous of mini bus stops. bob redell, "today in the bay." time now, 5:11. food shortage that has experts scratching their head. mayor chuck reed moves forward with his plan to reform california's pension system. the development to bring the issue to voters. the latest from ces in las vegas.

the san mateo police department is nearing its goal of raising thousands of dollars to implement a canine program. this video, right here, posted on gofundme.com, shows officer shawn keller the handler of the lone canine, ajax. the efforts began new year's day and going well. the department needs to raise $3500. it's $1,000 short, that's a cool video. less than $1,000 short now. money needed to provide ajax and officer keller with training equipment, which will last for years. love velveeta? stock up. it's in short supply. i don't think i ever purchased that. kraft foods won't say why, there are reports some stores running low on the processed cheese. the company told usa today, quote, it's a short-term issue

given the increased seasonal demand. experts question the response saying, there's no popular holiday dish that relies on velveeta. >> why is there seasonal demand? >> it's cold and people want comfort food, i suppose. yahoo!'s big cheese -- speaking of which -- made first appearance at ces last night. marissa mayer with her first ever ces keynote. >> good reviews all around. mayer, who is new, ceo of yahoo! spoke before a massive crowd in las vegas where she introduced katie couric and david pogue of "the new york times," two people who will help mayer turn yahoo! into a media centric site, she hope, with news and entertainment. ceo of ford is not willing to become the ceo of microsoft. that he's offered the job, but if he were, he wouldn't take it.

he's a valued ceo. after he said he would stay at ford, ford stock went up, and microsoft went down. let's check the rest of the markets. bertha coombs live at cnbc world headquarters. good morning. >> good morning. i'm not on the short list, just in case you were wondering, not moving to redmond anytime soon. futures are pointing to a higher start. not moving very much, despite new data. we just got data out of adt on private payrolls for december, up 238,000, led by construction and business services jobs. stocks rallied tuesday with the s&p 500 snapping its three-day losing streak. dow erasing all of its losses for the year with yesterday's rally. investors taking an optimistic stance ahead of friday's jobs report and earnings season. the adp data not moving the futures much. folks priced that in.

also getting some data in a few minutes on consumer credit. the minutes from last month's fed meeting this afternoon, more insight on the fed's decision to cut back on its stimulus efforts. dow starts the day at 16530, after rising 105 points. nasdaq at 4153 after adding 39. sometimes feel like your friends are more family than blood relatives? now you can add them to a framily plan at sprint. a plan for friends and family, up to ten people can get big discounts on service, if they sign up as a group. each person gets the bill separately. the plan could cost as little $25 a person. but if someone leaves the group, costs go up for everyone else. make sure you're going to stay friends, at least through the life of the contract. scott? >> bertha coombs, interesting, thank you. 5:17. 5:18 now.

especially at immediate coast or the peninsula. higher elevations getting the same. here's where the low clouds and fog are developing now. san francisco socked in, as you can see here. barely able to make out anything. 54 degrees there. 52 east bay. 49 in the peninsula for today. as we head throughout the afternoon, temperatures are going to end up cooler. microclimates, i want to head and add moisture, it's going to feel that way throughout the day. notice that smell of rain in the air. more moisture in the atmosphere. ladies, frizzies will be back. it's been dry, which is great for our hair, but we need the moisture. 60 in los gados. upper 50s along the peninsula. san francisco 50s today. not a lot of microclimate separation. best chance for rain, as we head throughout tonight, along the peninsula and in san francisco. also for the north bay. east bay, south bay, tri-valley, wait for the showers until tomorrow morning. i'll show you when on futurecast

warned they'll get mud up the back, yeah, tire kicks it up. i had that happen to me, too. a smaooth drive through 880. no problems through the tri-valley. south bay, we don't see problems. those construction crews starting to pick up around the south bay without incident and major slowing. up towards the peninsula, 101, palo alto, smooth drive. northbound, taillights, willow, easy flow of traffic through san mateo into and out of san francisco. watch for patches of fog, coming across towards the bay bridge. get a look at san mateo bridge, which is moving smoothly, there's the high-rise new york problem for visible or flow across 92 or the dumbarton to the south. there's the bay bridge. low cloud as long the east shore freeway and across the span. 5:21. state attorney general allowing san jose mayor chuck reed to move forward with his plan to

cut costs. it will allow to renegotiate future pensions. right now they cannot change once promised. in order to qualify for the november ballot, reid has three weeks to raise $2 million to start a petition campaign. if he waits longer than three week, the cost to qualify will go up. time now, 5:22. how the deep freeze caused an escaped inmate to turn himself in.

>> seems like a punch line to a joke but the deep freeze caused hell to freeze over, literally. this is hell, michigan. name of the town is hell, it's in michigan, where temperatures were well below zero, thanks to the polar vortex. hell is a small town 20 miles northwest of ann arbor. >> in kentucky, it was so cold, an escaped inmate turned himself back in, just to get warm. robert vick escaped from a minimum security facility in lexington sunday when temperatures dropped to negative 20 with a windchill. vick walked into a hotel, turned himself in, telling the hotel clerk he needed to escape the arctic air. vick dressed in prison-issued pants, shirt, jacket when he escaped. he was treated for hypothermia but how now expected to be okay, when it comes to the cold. >> he might be on the lam right now if he watched christina loren's forecast. the zoo in chicago left its polar bear inside monday because

ultimately led to the killing of aya nakano, shot to death on market street in mid-june. he was leaving a basketball game, heading home to emeriville, when rear-ended by a car. investigator two men got out of the car and confronted before shooting and killing him. his mother hopes $100,000 rewar will lead to arrest. >> i'm hoping that somebody is able to grow a conscience and, for once, do the right thing because oakland is known for no-snitch culture. i believe somebody out there knows something and money's a powerful incentive. >> rewar signs are posted posted across the east bay. am c transit you buses across the east bay. >> police in los gados are trying to figure out if woman was the victim of a disturbing and painful prank known as the

knockout game. the prank is happening across the country, where a person goes up to someone at random, hits them in the head while someone else videotapes it. police say monday afternoon, a woman was dropping her daughter off for dance practice at a studio on blossom hill road when a man came up, punched her in the face, knocked her down, took off. police say the attack happened for no reason as far as they can tell. teachers at the studio say they're on edge because they don't know where the man came from or why he did what he did. >> it was shocking. i make sure i try to keep teaching so the kids are feeling safe and everything normal. but it was shaky, because we are not used to it around here. >> police are looking forren in who saw the attack.e)kñ they say the suspect ran away from the scene, a man wearing a white t-shirt, jeans, and a backwards white baseball cap. the victim's cheek was red and swollen but refused to go to the hospital. 5:32.

already, the h1n1 strain killed two women here in the bay area. "today in the bay's" peggy bunker in san jose. what do we know about the people who have died? >> reporter: you know, it's so interesting, terry, because when we think about the flu, we think about maybe people who have compromised immune systems or the elderly. doctors want you to know, this year they're seeing an h1n1 strain that is affecting young people. and recently, two young women here in the bay area have died. let's show you the counties where these two deaths took place. these are flu-related deaths, just confirmed. yesterday a contra costa county revealed 48-year-old woman died within the last week. she had an underlying medical condition that contributed to the situation. also, last week, in santa clara, a 41-year-old woman died from h1n1 flu strain. this is a deadly situation, if you catch the flu. don't have to have any other kind of medical complication, just the flu alone can kill you. noted, both women relatively young. this is more and more states

reporting flu-related deaths and increasing numbers of people are getting sick. interesting twist how young these people are who are getting the flu. >> based on 20%, the median age of our hospitalized cases is in the mid 40s. we are seeing more pneumonia than last year. >> reporter: all right. pneumonia taking hold here. take a look at what's happening nationally with the spread of the flu. the map shows where cases of the flu are widespread versus regional. california still listed as having regional cases. however, taking a look around the country, minnesota, state officials reporting 96 people hospitalized, just this week with the flu. in texas, 19 people have died from the flu. and tragically in florida, an expect ant mother has died after contracting the virus. if you are pregnant, we want to let you know, medicaid is offering to give you flu shots for free, that is for expectant

mothers. doctors want to get them immunized. standing in front of a walgreens, talking about coming by to get your flu shot. you don't need an appointment. pop by whenever it's convenient. get that flu shot especially if you have any condition or pregnant. it's very important to do that. also, wash your hands, eat well, get sleep, all of the regulars that we all know about. >> good advice. not too late for the flu shot. >> not too late for you. >> thank you. >> you're welcome. >> she's like my consultant. >> the winter weather's going to bring that remainder back into the mix as well. through the next couple of days, temperatures drop off, i call it chowder weather for today. it's soupy out there, thick, low clouds and bring in showers, as we head throughout tonight but into tomorrow morning. that could interrupt a smooth commute. this morning looking good.

president obama will put government surveillance programs on review. "today in the bay's" danielle lee live on capitol hill. all this amid concerns the nsa may be stepping over the line when will it comes to our privacy. >> that's right. good morning to you. president obama's looking for feedback, as he finalizes his decisions about how he's going to reform that nsa program. that's why he's meeting with leaders of the intelligence community and also members of the privacy and civil liberties oversight board. niece meetings follow recommendations that president obama got from his own panel he needed to make overhauls of the practices, just to name a few, ending the practice of bulk collection of american's phone records and storage of phone records. and cutting back on surveillance and spying of foreign allies.

officials say president obama is open to some of the changes. he's looking for some middle ground. expected to announce his decisions by the end of the month, some things we're hearing that he's looking at include allowing private companies instead of the government to store those phone records. also appointing advocate to the secret court that oversees requests to make sure civil liberties are considered. tomorrow, president obama will meet with congressional leaders, and they're divided whether or not the practices of mass collection and storage should end. >> thanks very much. nearly 200 million people still feeling the freeze this morning, though temperatures expected to warm today. temperatures in the east and deep south shattered records that, in some cases, have stood for more than a century. mercury plunged into single digits and teens from boston to new york, atlanta, birmingham, nashville, little rock. 21 people have died just because of the cold. thousands without power and

heat. workers are putting in long hours to try to bring furnaces back to life. we all know the extreme cold can be dangerous to humans, pets and plants but also can be bad, yes, for smartphones. when the weather gets cold, battery drains faster, and the screen is more susceptible to cracking. it can stop working altogether. phones of different temperature thresholds. iphones should only be used down to 32 degrees. when it hits freezing, put it in your pocket, they say. samsung smartphones used in temperatures as low as negative 4 degrees. 5:44. mountain view's google running a ferry service to shuttle employees up and down the bay. chartering a ka ta ma ran ferry. a short drive from the google campus in mountain view. the ferry called the triumphant, seen here, provided by its manufacturer, will be doing two runs in the morning, two return trips in of the afternoon, cape only of carrying almost 150 employees on each run. google running this on a trial basis. the company's trying to find alternative ways to get employees into work that it doesn't want to inconvenience people who live in the city. google's use of charter buses on the ground, for its employees, irked some sf residents so much so they've been protesting their use, blocking buss. they're vc]upset with the risi rents in the city caused by the surge in the number of tech workers who live here and work elsewhere. they do make a lot of money, so they're able to drive up rents. google is one company that makes it easy for workers to live here
