morning fire destroyed a home. flames broke out at the home on south 17th street near east san antonio street. bob redell joins us live at the scene. did you talk to the homeowner? >> reporter: we did. good morning to you. you see the fire behind us is out, we did speak with the homeowner moments ago. him and his wife made it out okay telling us she thankful for his smoke detector. this fire started after 2:00 this morning. it was either in the dining room or the outside wall along the driveway. the fire department doesn't believe it's suspicious. they just are trying to figure out what caused it. this went to a three-alarm fire, they had to call for backup not once but two times. and part of the challenge of this fire, this is older construction, it has what they call a balloon structure, basically mean there is's a lot of space for the flames to travel. it's easier for the flames to go

up in the attic which did it. there are actually two. and became a mess. the house became involved and the front porch was destroyed. we spoke with the owner. he tells us he has been add amount keeping batteries in his smoke detector. that paid off. >> my wife heard the smoke detector and the front room was on fire. that was it. >> the detector? >> saved us. yes. >> without it? >> without it probably be toast. >> reporter: that was the man who lives here. obviously him and his wife are okay. they are grateful. upset about his home. he said he put 20 years of hard work into restoring this old home that obviously was severely damaged to say the least. the fire department if you look to the left had to deal with exposure for the home to the left. there was some bubbling on the

side of the wall there. that's from the radiant heat. gives you an idea how hot this fire was. it started am some of the shake shingles on fire. the department was able to keep that safe. all of the firefighters, none were hurt, all accounted for. no one was hurt in this fire. reporting live in san jose, bob redell, "today in the bay." >> that's good news there. thank you, bob. in the meantime, two homes are destroyed, two damaged, after a massive fire near santa cruz. it happened after midnight on highway 9 between san lorenzo way and fall creek drive. they are trying to figure out how that fire started. the people that live in the four homes made it out okay. highway 9 was shut for several hours while firefighters battled the flames. >> a santa clara university student is recovering in an oregon hospital this morning after officials say someone ran him over on purpose. the following pictures might be

disturbing for some. connor was visiting his family for the holidays, after the new year's eve party mcmahon and friends walking down the street when a man in a minivan or small suv, pulled up, offered a ride. mcmahon says their son and the friends declined. mcmahon suffered a broken pelvis. doctors expect him to survive. >> his rehab is going to be six months to a year and he may still have to face a new normal. >> the driver has still not been found. the parents of a 16-year-old girl who died after the asiana aircraft crash has filed a claim. investigators believe that she was killed when two fire trucks ran over her while responding to the july crash. the chronicle reports that the claim says firefighters

knowingly left her in harm's way after the crash and the department employees were not properly trained to avoid hitting victims at disaster scenes. the city attorney's office is reviewing the claims. if it rejects it the family can file a law suit. two others died when the boeing 747 came in low and struck the sea wall before bursting into flames. >> oakland police hope new evidence will help find the men 18 road rage. a photo of what they think is the killer's car. not clear but here it is, a newer silver four-door sedan. on june 12 last year ia was driving home when he was rear-ended. investigators say when he got out to exchange information with the other driver two men got out of the car and shot him. his family is offering a $100,000 reward for information leading to the arrest of his

killer. >> police are investigating reports after home invasion robbery. it happened around midnight. peggy bunker has been in milpitas all morning. she joins us live. what have you learned? >> reporter: good morning to you. this must have been terrifying for the homeowners. imagine after midnight about 12:11 a.m. three armed intruders burst into this house and this happened as you mentioned the 1700 block of tea hoe drive. all we know is that the three unknown race male suspected armed with firearms burst into the home, confronted the residents. we don't have an accurate description. one of the victims received minor injuries as a result of this intrusion into their home. they were treated there at the scene by the fire department which also showed up. big response t midnight shift

responded to this 911 call. the sergeant told me any time there is a home invasion in this area, it's fairly unusual so we're looking to get more details and see what we can find. police did arrive, they were at the home about two minutes after the 911 call. all three suspects did get away. we'll see what else we can find out for you and get right back. peggy bunker in milpitas. >> thanks very much. >> the palo alto police department is reviewing taser policy after an incident with a teen on a stolen bicycle. an independent auditor found the officer violated department policy when he fired his taser to try to stop a teen on a bicycle who refused to obey officers commands. using a taser on a sicklist is dangerous because it could cause a fall leading to an injury. it's now considering updates on

big time warm-up the temperatures in the 70s as of early next week. first let's check your drive. good morning to mike inouye. >> talking about the low clouds touching the bridge. they touch the top of the fires. not a problem as far as visibility yet. the flashing lights at high street have cleared, traveling north. the map shows you north of the coliseum into downtown. you'll see yellow from here and there as those drews continue to clear. no major issues. watch over to the left if you can. the try value, light volume. there was confusion. the oushl report was a truck and a bull. it's a pickup and also female different than a bull. the car is walking around so apparently it fared better than

during its meeting today the alameda county water district will hear public comments. the increase would offset rising costs now but the district warns with the cost of employee pensions going up, there will likely be more rate hikes in the future. if approved the hike would go into effect later this year. the stock market has not been able to get much going so far in 2014 but currently the year is young. scott mcgrew, one exception is yelp. >> all time highs. the company gained 8%, almost 8% in active trading. back in the spring of 2012, they first brought the shares to market after the ipo. yelp got an upgrade from morgan stanley who thinks the stock could hit $89 a share. yelp gained $5.76 on wednesday to close at $78.42 so it's got some distance to go.

we are watching the court case out of virginia involving yelp over a ruling that says yelp has to give up the real names of reviewers who left negative reviews for a carpet cleaner in that state. the reviewers would seem were not real customers and may not be protected by the rights of free speech if they are being fraudulent in the process. let's check the broader markets. bertha coombs is live at cnbc world headquarterheadquarters. >> good morning. not sure folks will give wall street great reviews but we had a mixed close on wednesday. investors reacting to better than expected data from adp on job growth for december. we're going to look ahead to tomorrow's jobs report. we also had the minutes from last month's federal reserve meeting which showed officials decided to cut back on sometime you loss program because they didn't think they were as effective as they once were. today we're going to get in

about 15 minutes weekly unemployment claims and tomorrow is the big jobs report that we'll focus on. the nasdaq will be at 4165 after gaining 12. scott. >> thank you much. apple and samsung trying to avoid going back to court. the two companies reportedly in negotiations trying to avoid this chalk drawing scene. you remember this case in san jose federal court. it dealt with samsung copying apple in some of its older cell phones. the next court case t one the two sides are trying to avoid, involve samsung's galaxy 3 phone allegedly copying apple's iphone f. they can stay out of court they may be able to settle this amicably or at least between as far as apple and samsung goes. last time it dragged out as you'll remember, forever. >> good news for lawyers, though. >> good news either way. it's always good news for lawyers. >> doesn't it seem to be the

case. let's check in with meteorologist christina loren. good news in the weather department? >> yeah, we need the rain, we need any sort of moisture, even smells like rain out there. a welcome change. san francisco at 52, i want to show you how dark it is here, though. you can vaguely make out part of the bay bring. it's hard to make out anything because of thick low clouds. we'll keep tabs on that. light showers early, a cloudy finish headed our way. make sure you bring that jacket, you're going to need it. we head throughout your friday, we love friday, we're looking good. temperatures comfortable. you can check that out here on seven-day forecast. the next weathermaker arrives through late saturday. we're timing out our next season. about 1:00 p.m. to 7:00 p.m. on saturday for that next round of showers. after that we have a major warm-up headed our way, temperatures in the 70s. i'm going to give you a taste of that. but first, let's time out that next weathermaker.

hey, the weekend is around the corner. you can see i stopped the clock at 3:00 a.m. maintaining organized right now and then look at this. it falls apart by 1:00 p.m. loses that organization. we're going to get spotty activity. we might pick up 1 to 3 inches of powder above 7,000 feet. we need that snow up there. and then look at this as we get into next week, we have a major, major jump in our temperatures. normal is about 61 degrees, by monday we'll be at 68 degrees, by tuesday, 74 degrees. i know, it's crazy weather. but hey, 70s, not too bad in jachblt i'm not complaining about it. >> i'm not complaining. i'm going to sthaend to my cousin kathy in chicago and she can complain. the traffic northbound 101, look here at the mckee off ramp, that's in the area where they reported debris. they meaning chp. i don't see slowing and no cars swerving. it looks like the traffic is flowing past the area on the map

this is is where that is. north 101 past the 680 so we typically show that interchange but i turned the camera the opposite direction. easy flow for 280 and 85. we see a little blip here north 280. no incidents reported but i'm going to track that. that should clear up. i'll let you know if it doesn't a. smooth drive 580 and 84. we have the crash at altamont pass involving a cow and pickup truck. it sounds like there is an officer heading to the scene a. smooth drive to the peninsula. 101 and 92 both at the limit. getting into san francisco via the bay bridge, a nice drive, lower clouds here and over the san francisco side as well. a quick look, getting more company southbound 101 through san rafael. back to you. >> mike, thanks a lot. california's department of social services is apologizing and changing its policies after

more than a dozen elderly residents were left to fend for themselves at a castro valley assisted living home last year. the agency fell short of its mission to protect the residents. a review found the state should have sent theep make sure the residents were cared for until they found new homes. in october last year more than a dozen were left for two days with only a janitor and a cook. >> it's 5:19. years of reports of hair loss and eye irritation at berkeley high school's pool forced them to change how they monitor the pool. parents have complained for years about the ph balance of the pool. the unbalanced chemical levels have caused swimmers to complain of hair loss and eye irritation. the city has shut down the pool at least twice. the school has a history of failing to address problems at the pool so the district took

over responsibility for maintaining it. >> starting today union city will impose districter rules on e-cigarettes. they can be bought and smoked but face the same restrictions as traditional cigarettes. they cannot sell to anyone under the age of 18. union city is not the only east bay city taking a look at this. later this month the hayward council will consider new rules on selling tobacco products. >> the police department reached its goal of collecting $3500 to implement a canine program. eight days ago the department started a go fund me site to raise money for the lone canine ajax. over a week 57 chipped in and the department reached its goal. the money will pray the handler with training equipment that

we are 28 days from the olympic games. we're starting to getting a better picture who will represent team usa. >> the olympic trials get under way in boston. san jose has a number of hopefuls including stanford's rachel flats. she was 17 years old when she competed in the games in vancouver where she placed seventh. this time around she says she's better prepared to compete for that gold medal. >> colina will compete in the

figure skating. >> and robby of newark is at the u.s. trials in the men's event. madeleine heritage and nathanial hope for a spot in the ice pairs. >> seahawks fans giving back to the bay area. become a war of good deeds. good war. check it out. seattle fans have 12th spirit, to raise $20,000 for children's hospital. san francisco. we checked and they are more than 3/4 of the way there. this campaign is in response to this one by the 49ers fans. they wanted to raise money for a billboard in seattle when they were overwhelmed, they promised to donate the rest of the money to the seattle children's hospital. the combined campaigns raised $53,000. that is fantastic. kind of make you like those

>> a very good morning to you. thanks for joining us. i'm laura garcia-cannon. >> and i'm terry mcsweeney. we have an update to breaking news. >> investigators are trying to find out what sparked an early morning house fire. flames erupted at a home on south 17th street near east san fernando street. you see by the map not far from san jose state. bob is live at the scene. the homeowner says the smoke detector saved his life. >> reporter: that was. he was very adamant about that. the home was severely damaged. this was a little after 2:00 this morning. the fire has been out for some time. the reason you see the smoke come out of the roof the firefighters are doing what is called overhaul where they try to take the burning embers, the timbers apart so they don't restart up and aren't producing

flames. you're seeing the smoke. a man and woman, husband and wife, they live at this home, living here for at least 20 years. he is quite upset over the fact he spent all of that time trying to refurbish the home. it's basically destroyed. but he is grateful he followed simple advice, he had smoke detectors in every room in the house. >> change the batteries twice a year, the whole thing. >> you're adamant. >> yes. got to be. everybody's fine. just i mean, 20 years of work restoring that house. >> reporter: they are not sure what the cause is, the fire department that is. they don't think it's suspicious. but it appears it started either in the dining room, the area in the front, or in the outside wall along the driveway. this did go to a third alarm, they had to call for backup at least two times. and the reason why they had to go through a third alarm this is an older structure, it has what

is called a balloon structure inside which means there is space in between the studs that goes up higher and further than you would find in newer construction which basically allowed the flames to shoot up inside the attic and from there it spread. you can see live where it's venting, the smoke is, from the top of this home here, single story home on south 17th street. again, everyone got out okay. the husband and wife, no firefighters injured. damage to the house to the left but the fire department was able to knock that down pretty quick. bob redell, "today in the bay." >> good thing they made it out. thanks so much. >> growing concern this morning over foster farms chicken after cockroaches were found in a california plant. this is not the first time. the usda is shutting down the plant in the central valley town of livingston, that's between merced and modesto. it employs 3500 people. inspectors say this is the fifth time they spotted the pests

since september. foster farms admits to the problem and saysed maintains an ongoing pest control program. livingston plant along with two others in california were being investigated for a salmonella outbreak. some customers say they will be buying other brands until foster farms is given the all clear. >> it's disheartening to see a brand like foster chicken is not controlling the sanitary requirements of the processing. it's just you know, unacceptable. >> as of right now there is no recall for the chicken from that plant. foster farms rehe'sed this statement saying, quote, a single incident is not acceptable and we are committed to a zero tolerance pollty. >> the man accused of kidnapping and killinging sierra lamar may enter a plea. garcia torres was arrested in may 2012 on murder charges even though lamar's body has never

been found. lamar disappeared on her way to school in morgan hill in march of that year. garcia torres' plea has been delayed because lawyers on both sides are still sifting through evidence. he is also charged with carjacking and attempted kidnapping related to the attack on three women back in 2009. >> breaking news out of milpitas, police on the hunt for three armed men after an overnight home invasion robbery. it happened on tahoe drive. peggy bunker is live in milpitas. what are police telling you? >> reporter: good morning to you. we're at the milpitas police station, we've been talking to them about this event that occurred overnight, very scary for the homeowners. this happened after midnight as you mentioned when three armed men stormed into a house on tahoe drive, the south end of milpitas, and this is what we know so far about the situation. you can look at the neighborhood here. a very quiet neighborhood, not a lot going on.

just after midnight that's when the three suspects burst into the home, armed, confronted the residents who were quite terrified. the trouble is we don't have a good suspect description and despite a quick response to the scene they were there in two minutes, the three suspects did get away and this is who they are looking for. take a listen. >> further investigation revealed three unknown male -- unknown race male suspects entered the house armed with firearms and confronted the residents inside. >> reporter: in fact, there was a huge response to this quiet neighborhood. the entire shift of police officers, the fire department responded to this 911 call. there was a minor injury to one of the residents during a scuffle with these three intruders, they were treated by the fire department and went home and stayed at the house. right now of course police are looking for the three suspects. they don't have a good description because they say the residents actually weren't able to provide a very good description. it was dark, it was after

midnight. that's what they are working on this morning. >> thanks very much. the flu is spreading quickly across the bay area. one local hospital has run out of rooms. regional medical center in san jose setting up a large tent to treat patients with flu symptoms. they say the flu is hitting adults unusually hard and the h1n1 so called swine flu is more rev lent this season. this is the first time the hospital had to set up the flu tent. >> checking the forecast with meteorologist christina loren. a little bit of something for everyone i'd say in the next what, ten days. >> seven days even. we have some major swings in our temperature. finally much needed moisture in our atmosphere. we need that for our air quality and any sort of relief from that drought is going to help. we're watching these cells develop. we're noticing that moisture is

intensifying, more flashes of green. keep in mind there are showers around, nothing heavy but yeah, enough to get the roadways slick for 10 to 15 minutes. mike's going to be on top of that all morning long as he always is. let me show you what we are expecting. throughout the day take to the your future cast, the best chance for showers is happening now. we're going to keep that chance going. as we progress deeper into the day, the storm track sits to our north. it's going to be cool but really this is our only window for showers. we get a better window into this weekend. check that out on your seven-day forecast. let's get in your microclimates for this thursday. 60s in the south bay, you're going to see plenty of cloud cover over our local mountains, the western facing slopes. the peninsula, san francisco, temperatures in the upper 50s to low 60s. lots of low clouds for most of the day and potentially we could see delays out of sfo because of

low ceilings. we'll check on that throughout the day. i want to take you into the north bay. terry's neck of the woods. temperatures comfortable. upper 50s to low 60s. the east bay is looking good and the tri-valley we expect the upper 50s to low 60s. livermore might hit 62. a touch above average. i'm going to show you the showers for the weekend coming up. first, as promised, here is mike inouye. >> as promised i did have my eyes on the road. no reports of problems as far as wet roads but we'll continue to track that again. we're looking toward oakland, 880 southbound with taillights away from the camera. just the very top of the screen i see flashing lights, looks like a sign is reinstated. the chp was concerned there were road crews at the on ramp and they have not cleared. the signs say they are clear. the map shows you no slowing in the area, a smooth drive for 580 and 880, both directions. a nice easy drive through the south bay.

in a few hours new jersey governor chris christie is expected to address accusations his staff deliberately created traffic problems to target a democrat who refused to back christie's re-election campaign. tracie potts live in washington with the latest on this political scandal. tracie. >> reporter: good morning. this will be the first time we've heard from governor christie since these e-mails and texts making these allegations were made public and it comes as the justice department here in washington received a request to take a closer look at this to see if federal laws may have been broken. it appears the four-day traffic jam that backed up over the george washington bridge last september may have been orchestrated to punish a democratic mayor who did not support chris christie. according to e-mails subpoenaed by new york lawmakers. >> none of this surprises me. i'm embarrassed for the people involved.

i'm completely disheartened. >> reporter: in the e-mails this woman, a top christie aide, tells one of the governor's high school bud es at the port authority, time for some traffic problems in fort lee. got it the official replied. is it wrong that i'm smiling, eerd says. someone jokes that the children stuck in traffic are children of christie's political opponent. >> got to come clean and say what he knew and when he knew it. >> last month governor christie denied having anything to do with. >> absolutely not. >> but now with the e-mails officials say he's got explaining to do. >> either he doesn't know what's going on in his front office or there is lying going on. >> in a new statement christie says his staff misled him to the e-mails are completely inappropriate and that he knew nothing about it. david wildstein, a friend ever christies who worked at the port authority, he is scheduled to testify today before a committee in new york but he is fighting that subpoena saying that he

two. it moved and traveling past mckee. no incidents reported yet for san jose. we'll look at the map. we see slowing but that's because of the volume of traffic. and maybe some sort of debris or a minor crash. whatever the case that crew cleared. we have slowing, volume into downtown starting to build. a smooth drive before the dublin interchange. the earlier issue, the cow hit by a pickup truck the cow wandered out of the area. the truck was damaged. that's a tough cow but an easy drive. 880 shows a little bit of increase in volume but no major slowing, toward the san mateo bridge. a smooth drive here toward the peninsula, no delays on there and we'll get a quick look at the bay bridge toll plaza. we see no problems, we have the cash lanes. back to you. >> thanks very much. >> right now we want to bring you breaking news.

5:54. breaking news now. you are looking at it in san jose a. warehouse is burning. this is near 28th and julian. in san jose about a block from the mckee exit off of 101. so a lot of people going to be seeing this as they drive along 101. the fire raging now has been going on for some time. as you can see, black smoke nowhere close to being hit by the hoses from the fire department getting knocked down so it's raging out of control.

peggy bunker is on her way to the scene and we're going to have a live report from her in a couple minutes. the new comedy doesn't debut until april but critics say the show is full of laughs. the screening session in pasadena gave critic as chance to see what they call an unpolished version. "mercury news" reporter says silicon valley is funny. it portrays a fairly accurate picture of what the area is like. it follows a computer program here works with others at a start-up. mike judge is the same guy that brought us office space. >> controversy is brewing over at&t's plans to give you free data over your cell phone. scott, who doesn't like free data? >> maybe not the fcc and a congresswoman doesn't seem to, a civil rights group. palo alto congresswoman speaking out against at&t's plan to offer some content to its smart phone users for free.

it's near the spot where julian turns into mckee east of downtown. we hear it would be as large as 80,000 square feet. it's huge now sending up a thick black plume of smoke in the air which could impact traffic in the area including 101. >> it's burning not far from the mckee road exit. mike has how it is impacting traffic. the black smoke coming up. they haven't gotten water on it. >> this is the view from our traffic camera. that's where our camera is located, spun it around and there's the fire that we see all of that black smoke like you said clearly visible from 101. the commute is in the northbound direction, it is stacked up quickly happening as you approach storied road past toward 880. the southbound side is lighter
