flu season is really just beginning and the virus has killed nine people in the bay area alone. it's the age of one of the victims that has health officials so alarmed this morning. >> plus, it could take days to make sure this massive warehouse fire is out in san jose. officials are warning some people near the scene to stay out of their own back yards. >> a principal resigns after allegations ever sexual misconduct 2,000 miles away. >> a look outside and it's a very nice day and you won't believe this forecast, folks. warm and then getting warmer. it's friday, january 10th. this is "today in the bay."

good morning. it is 4:30. i'm terry mcsweeney. >> i'm laura garcia-cannon. lots to get to. let's look at the forecast with christina. >> hey, good morning to you. welcome to friday morning everybody. temperatures mostly are going to end up in the 60s for today. we're still tracking that rain chance for this weekend. it's actually looking even better this morning and then just as terry pointed out, we are going to get that warm-up going. your mind might be blown when i show you where temperatures are headed. first, though, let's check your drive. you might be blown by how light it is. >> we're watching reports for that on the roadway. none so far. a smooth drive at the toll plaza. look at the bottom of the screen, a few cars waiting in line off to the left. all cash lanes are not yet open. we have them reopen before 5:00. looking here toward fremont, a smooth drive southbound, and the truck scales, no problems there

and no backup or on the freeway. we have construction work going on, i'll check on the latest for the sensors. i'll show that coming up. >> new this morning oakland police are trying to figure out what caused a deadly crash overnight, it happened after midnight on maritime street not far from the port of oakland. a car lost control, crashed into a pole. one woman was killed. >> the number of flu-related deaths in the bay area jumped to nine, that could go up later today when the state department of public health shares the recent information about flu activity in california. several counties are reporting death deaths. doctors say even healthy young people are in danger of getting sick and developing complications. the sonoma health department says one of the victims was a 23-year-old man with no underlying health issues. >> people that are younger to

middle-aged, and this was very kipt with what happened during the 2009 pandemic. it's the same strain. >> doctors say a flu shot will protect you against the h1n1. the season can run through may. last year health experts say the flu season peaked in february. for tips on flu prevention head to our website. we have a link to the cd krrc. that's at nbcbayarea.com. >> new this morning the san jose "mercury news" reports that english teacher at a school in palo alto resigned after two students contacted the school and said she had inappropriate relationships with them at other schools back in the 80s. the teacher has been there for 20 years. it's a private school for girls grade 6-12, school officials say as soon as they learned of the allegations they placed the

teacher on administrative leave. the teacher has not been charged so her name has not been released. they claim she engaged in sexual misconduct while they were in tennessee and texas. >> a judge could decide whether a.accused of lighting another teenager on fire should be tried as an adult. prosecutors are charging richard thomas as an adult with a hate crime enhancement. today thomas' attorney is expected to ask the judge to send the case to juvenile court instead. thomas is accused of setting 18-year-old sasha's skirt on fire on a transit bus in november. he suffered second and third degree burns in that attack. a new hearing is set for the man accused of kidnapping and killing sierra lamar. he was in court in san jose yesterday but did not enter a plea. he was arrested more than 18 months ago but his lawyers say they need more time to review all of the evidence. lamar disappeared on the way to

high school nearly two years ago. a hearing will be march 3. >> new detail it is on the warehouse fire in san jose. firefighters say they are going to be on the scene for days making sure it does not flare up. we brought you this video all morning long yesterday. the fire quick ltore through th warehouse the length of a city block. there were several explosions as well and thick black smoke could be seen for miles. neighbors evacuated were allowed to back home last night. >> we allowed folks back in their homes, the ones evacuated but they are not allowed to go in the yards to be safe that we don't have a wall collapse. >> two schools forced to cancel classes yesterday will be back open this morning. >>. >> that warehouse fire was actual think biggest of four fires yesterday. look at this map. firefighters worked nonstop all day going from fire to fire, one

was so worn out he was taken to the hospital, treated for dehydration. battling this fire at a condo complex near camden avenue, this one broke out about 6:00 last night. three condos were damaged but no one was hurt. firefighters say it appears it started on the second floor of one of the homes and quickly spread. officials are investigating the cause of each fire and as of now they do not appear to be connected. >> oakland police hope you can help identify a man who tried to kidnap a woman near lake merritt on new year's day. police released this sketch. the suspect is african-american, his mid-20s to early 30s, about 5'7", 180 pounds, wearing a gray hooded parka, dark pants and smelled strongly of cigarettes. the victim was walking on 17th street near jackson near lake merritt when the suspect appeared and grabbed her. they both fell and the victim was able to run away and get

help. >> a yahoo! employee has not been seen since celebrating new year's eve in san francisco. police say a missing person report has been filed for luke. he posted photos on line on the night of his disappearance. he then took an you beer car. there are tattoos of his. she considered at risk. >> a warning about a phone scam in the east bay. the contra costa county sheriff's department says a man is calling pretending to absheriff lieutenant. the man identified himself as lieutenant jackson of the warrant unit. the scammer demands money from people to clear up fake traffic tickets or other violations. several have been victimized. >> talking about a heat wave on the way again. generally it's a nice thing. not a heat wave but a warm-up. >> a big one.

had the antioch closed. it's reopened. good flow into and out of the north bay. we had highway 4, bay point. the interstate 80, back to the fox city area, san mateo bridge and now we'll send it back to you. >> we're going to take to you vallejo. part of highway 37 in vallejo will be renamed to honor fallen police officer james capoot. it will be known as james capoot memorial highway. it runs along the wloy he was killed in the line of duty. in 2011 he was chasing a man suspected of robbing a bank when the suspect shot him. he worked in law enforcement since 1990 and served in the marine corps prior to that. he left behind a wife and three daughters. >> 4:40, still ahead, new job numbers due out. what they are expected to say about our economy.

a very good now friday morning to you. doesn't that make everything better. as well as this live look outside this morning, it's the beautiful bay bridge illuminated in its greatness. we'll check the forecast. 4:44. new details on the political scandal around new jersey governor chris christie. today we expect officials to release thousands of internal documents about the intentional traffic jam reportedly orchestrated by one of christie's top aides. yesterday christie denied knowing anything about his deputy chief of staff ordering lane closures on the george washington bridge. the move was reportedly made as payback for ft. lee's mayor who did not support christie's re-election campaign. kelly has been fired. >> it's not believable she is the only one responsible in this administration.

>> i am humiliated by the fact i did not know this and that i was deceived. >> three other members of christie's camp were also fired though he insists he had nothing to do with it. six people who got stuck in the jam filed a class action lawsuit against the governor. >> more than half the members of congress are millionaires, based on the financial disclosure reports filed last year at least 268 of the 534 members of congress have an average net worth of $1 million or more. the wealthiest is california representative darrell issa. democrats with 1 poyp 04. gop about the same about $1 million. job numbers for december are due out in about 45 minutes. they expect the unemployment rate to stay at a five-year low. for that and the rest of the news before the bell let's go to

bertha coombs in new jersey. good morning. >> good morning. great expectations for this morning's earning report. the futures pointing to a higher stafrmt often we see investors hedging their bets ahead of that jobs report. on thursday we did see the markets close with the dow posting its first back-to-back decline in nearly a month. and what will be looking for in terms of numbers forecasts calling for 200,000 jobs added in december and unemployment to hold steady at 7%. it could well be the biggest monthly jobs since the recession ended in 2009. the dow slipping 18 points yesterday to 16,444, the nasdaq losing 9 to 4156. the outlook, though, for those unemployed is dimming. looks as though talks to suspend the benefits, 1.3 million lost

those benefits this year. democrats and republicans are at odds over how long to extend the benefits and how to pay for them. the gop reportedly angry at harry reid for preventing them from attaching amendments to the bill. it's unclear when the senate may hold a final vote on the measure. if you are applying for a new mortgage new rules that regulators say will help guard against the risky practices that fueled the housing bubble. for most it will have little impact but you will likely have to show more proof you can afford a mortgage and required to weigh your income, assets, savings and debt against your estimated house payment. new qualified mortgages will nol contain features such as interest only payments or carry more than 3% in up front points and fees for loans above $100,000. all that sounds like common sense, doesn't it. >> all of the other things sound like year 2000.

>> exactly. >> when you could get everything. >> thanks very much. >> checking with christina. we're looking forward to the weekend. >> boy, are we. people headed back to work this week. might have been a long one. on sunday, showers in the forecast for saturday, remember you can see that on the seven-day forecast at the bottom of your screen. temperatures are warmer than yesterday. we'll see more sunshine, it's clear off the bat. 64 in the north bay, 67 in the east bay, around 60 degrees in the south bay. we're going to see clouds return quickly as we head throughout the overnight hours. an area of low pressure on the way and as it comes through, showers for saturday. all across the bay area. right now i'm bull's eyeing between 10:00 a.m. and 5:00 p.m. showers are going to start in the north bay and workthe south. on sunday the climb is on. this is for outdoor plans. let me give you a taste of where we are headed. this will be the warmest bay area city. between sunday and monday you're going to jump 64 to 72 degrees,

where normal is 61 degrees. then as we get into tuesday up to 75 degrees, and that is really warm. so you can imagine if we're talking about levels in the mid 70s in the bay area they could hit the 90s in so cal into the last couple weeks of january. this like i said, this is going to be the warmer area you'll find your seven-day forecast at the bottom of the screen in san jose though we're talking 70s next week so yeah, break out the muscle shirt, terry mcsweeney. >> if i had the muscles everything would be fine. breaking news, we confirmed for san jose fire department three fires set in the past hour and 20 minutes or so. the first came in about 3:50, 24th and peach, that is where someone threw some kind of incendiary device on a porch. the porch burned. slight damage. not too bad. ten minutes later at 24th and east san fernando, another fire. then a half hour after that at

4:30 about 20 minutes ago, 28th and east san antonio, another fire. so san jose fire department jumping today just as they did yesterday. and a big concern right now so many fires in such a fairly close area. and all happening in the past hour and a half or so. >> something to watch this morning. 4:50, los angeles high school senior who survived two plane crashes that killed five members of his family was back on the basketball court this week. what we're about to show you video of austin hatch taking his first shot in his first basketball game in nearly three years. keep an eye on 33. if you could keep an eye on him. he sinks that shot, his team sprints on the court because they know how far he has come and how much he has lost. in 2003, hatch's mother, 11-year-old sister and 5-year-old brother were killed

when his father crashed a small plane. in 2011, hatch was put into a medically induced coma for two months after his father crashed again. his father and stepmother died in that crash. hatch spent two years relearning how to breathe, eat, and walk. the teen is now living with his uncle and will play basketball at the university of michigan next year. amazing. >> comes back with a three. in style. another amazing recovery to tell you about. a red-tailed hawk is going to be released more than a year and a half after she was found burned in fremont. crews found the bird in october 2012. she had several burns on her wings, feet, chest and face, couldn't fly, very bad shape. the bird was taken to the humane society, then transferred to the wildlife center in silicon valley and cared for. all of her feathers grew back. today she will be released at grant ranch park in san jose. so good news out there. >> 4:51.

popular deli in the south bay is busy breaking bread this morning to feed hungry 49ers. >> feed the athletes. in the willow glenn neighborhood of san jose whipping up 70 sandwiches for the 49ers to take on the road. >> having panther burgers. >> sounds like high school. these are photos on the deli's instagram. the team will be on the way to carolina in a matter of hours. before they leave special teams player bubba will hand out the sandwiches at team headquarters just like he does every get away day. sandwich of choice, it's an off the menu item of several deli meats and cheese. >> many deli meats and many cheeses. >> they need a lot of protein. 49ers are going to square off sunday morning, kickoff at 10:00. >> and we're now 27 days from the start of the olympic games in sochi, russia.

a bay area teen is twirling her way into the picture. >> san jose's paulina is in second place at the figure skating championships in boston. the sophomore scored a personal best last night and trails the leader by about five points heading into the free skate competition tomorrow. the top three skaters earn a trip to sochi next month. >> she is behind the one with the game gold. >> exactly. >> stanford junior rochelle flat finished 20th in whether what she says will be her last. men's competition kicks off today. >> the bay area produces a lot of great athletes. >> there is an interesting bay area aspect. >> we're looking forward to it. the commute, is it light? >> that was nice regards athletics. >> she didn't mention it. >> time traffic watcher.

101, i follow the laws, southbound side we did have at the bottom a set of headlights pulled over for a few minutes. i was tracking that but no incidents reported by chp. that cleared. a smooth drive here. tiny bit of slowing through construction southbound through san rafael and we did not see problems, now that cleared toward the san rafael bridge. we show you the commute direction through the east bay no. problems through richmond or the caldecott. >> thanks so much. >> still ahead we continue to follow breaking news in san jose as fire crews are trying to get the upper hand on several fires burning. >> it could be days before this massive warehouse fire is completely out. why officials are warning some people near the scene to stay out of their back yards.
