>> i'm laura garcia-cannon. we have an update to tell you on the breaking news this morning. 20 miles west of detroit, where a large warehouse fire now destroyed by massive flames in the town of livonia. the warehouse stores paint, which is fueling the fire. the sign in front of the building reads environmental recycling group. we're told the fire now is under control. this is video shot earlier. no one was hurt. the cause of the fire is under investigation. new this morning, milpitas police investigating the city's first homicide of the year. officers responded to a shooting outside a hotel. when they got there they found the victim lying in the parking lot with a gunshot wound. it happened at executive inn hotel near 680. this went down 10:30 last night. bob redell live at the scene with an update on the investigation. >> reporter: good morning. here we are, 7 1/2 hours later, you can see milpitas police are still processing the crime scene

located in the parking lot of the executive inn here in town. the coroner hasn't even arrived to do their part of the investigation. no arrests new york description of a person shot and killed a young man that was found in the parking lot of the hotel. but what could help investigators are witnesses. apparently there are several who police have been interviewing overnight at the police station. they tell us that when they arrived, around 10:30, there are several people in the parking lot, hysterical, crying, because lying on the ground, unresponsive, was this man. lieutenant tells us he appears to be 20, 25, with a gunshot wound to the face. he was pronounced dead within 15 minutes of the officer's arrival. police have not said what led up to the killing, only several shots were fired and that a dark sedan was seen leaving the scene. that's the only tidbit of suspect inknow they have. they don't have a suspect of the person who pulled the driger, ju

trigger. >> this is the first homicide of the year. only one homicide last year. here we are early 2014, investigating their first murder of the year. lieutenant with p.d. tells us they're not sure if it's gang or drug related or the result of something else. live here in milpitas, bob redell, "today in the bay." 6:03. new details on a deadly crash involving a man walking along highway 580 overnight. the chp says that man was hit and killed by a car in the eastbound lanes of highway 580 west of keller in oakland. it happen 1:00 this morning. the pedestrian was pronounced dead at the scene. the lanes were shut down for an hour. the driver stayed at the scene, cooperating and with investigators. it's unclear why the victim was walking on the highway in the first place. >> southern california residents rattled out of beds when the ground began to shake. the magnitude 4.4 earthquake struck near fontana in san

bernardino county 1:30. multiple aftershocks, the largest a magnitude 2. 3. people reported feeling the quake as far as 65 miles away in santa monica. it was a 4.4, not that big, but some say, listen to this, knocked them off of their feet. >> like shaking, like a thunder, like a big noise, like, boom. i was on my knees and i fall down, like -- >> strong enough to push you down? >> yeah, yeah, really hard. everything started shaking here. everybody started running. >> no injuries or significant damage reported. 6:04. today the supreme court will hear arguments whether abortion protesters are having their rights violated by having to stay at a distance from doctors, employees and patients entering abortion clinics. p peggy bunker joins us. >> the case that the supreme court is hearing today, mccullen

versus state of massachusetts, a 77-year-old grandmother who says buffer zone laws are violating her free speech in her efforts to talk women getting out of an abortion as they head into the clinics. massachusetts, colorado, montana have buffer zones around the clinics. zones are marked bay yellow line, and protesters step over them, they are asked to move back. supporters of the buffer zone say they're necessary as demonstrators have at times blocked entrances to clinics and subjected people coming in and out to verbal and physical taunting. >> but what it does do is protect women and the administrative staff and doctors from that kind of in your face harassment that's really damaging. >> but others including the mccullen say buffer zones violate their right to free speech. >> massachusetts is picking sides in one of the most divisive issues in our country today. they're saying, abortion clinic representatives are free to speaking but sidewalk counselors are not.

>> now, what will come up today is the fact that in 2000 the supreme court did uphold the buffer law in the state of colorado. since then changes at high court. roberts and alito replaced members who leaned in favor of the production. they could swing votes in favor of protesters pursuing free speech claim. reproductive clinics are not the only locations where buffer laws put into place. funerals using buffer laws or elections, polling locations have buffer laws set at 150 feet. laura and terry, even the supreme court has a buffer law. the court bans all demonstrations and protesters completely. only allowed to protest on a sidewalk. >> anti-abortion banners like some in san francisco now the subject of a new resolution introduced by a city supervisor. the banner posted on lamppost as long market street say "abortion hurts women," the supervisor who

introduced the resolution says banners are misguideden and correct, denying abortion is what hurts women. banners which lined the street after christmas associated with anti-abortion rally set for next saturday. time to check your forecast. step outside, look at san francisco where they are looking at a record temperature coming their way. i do believe. >> amazing. >> not the only place a record temperature today. christina loren will break it down right now. >> you know what the funny thing is we only have 150, in some cases, 200 years worth of records. today's one for the books. about temperatures are going to climb 15 to 20 degrees above average. 42 degrees now in san jose. part of the reason for the climb, mild start that we're getting. half moon bay at 64 degrees. at 6:07 in the morning, as we're getting into late january. so temperatures today are going to be warm. our warming agent is that offshore flow.

now, typically this time of year, we've got storms riding in uf off the pacific or the flow keeping us cool. but in this pattern, high pressure in control winds driven offshore. you get the frictional warming and today is going to be the peak of it. i want to make sure everybody's ready for the different parts of the day. high pressure's in control today, that's going to bring temperatures up by 45 degrees. watch this. 41 degrees now in san jose. come about 2:00, 3:00, we're talking about 77 degrees down here. santa rosa's going to climb by 45 degrees over the day. 72 the forecasted high in livermore. you're going to climb by 30 degrees today. want to make sure you're ready for the unusual and we're not going to cool off any time in the near future. you can see that on your seven-day forecast there at the bottom of the screen. every region is covered across the bay area. every region reporting above-average temperatures

the search is on for whoever shot and killed a man in milpitas overnight. police found the man lying in the parking lot on dempsey road off of 680. he had been shot in the head. this is the city's first homicide of the year. a roswell, new mexico, middle schooler allegedly shot

by a classmate, has undergone a second surgery. the boy and a 13-year-old girl, wounded yesterday when authorities say a 12-year-old boy opened fire in the school gym. the boy's family expected to make a statement today. "new york times" reporting the nsa implanted software in 100,000 computer around the world. allowing the u.s. to conduct surveillance on machines. the "times" says radio waves used to gain access to computers that other countries tried to protect from spying or cyberattacks. one of the most important people in silicon valley and tech is steaming mad. >> scott mcgrew, he's saying he's treated unfairly. >> all of clean tech treateden fairly. the venture capitalist found of sun microsystems says 60 minutes report on sunday mischaracterized him and his investments in clean technology. he's posted an open letter to

his blog this morning, taking the report apart point by point, denying some of the basic numbers used. i have not invested a billion dollars of my own money into cleantech. it's substantially less, and a simple query to us would have corrected this error. the report on cbs focused on the failures in cleantech. now khosla say failfailure's paf business, you need one facebook to make up for a thousand failures. he pointed out michael jordan 26 times taken the game-winning shot at the buzzer and missed. tesla, it's one of the great success stories in cleantech. it's paid back its government loans early, and wednesday the company said it sold 20% more model ss than its own accountant expected it to sell. make the argument that a clean tech company, helps you save on

snowboarders and skiers, though, because they wait for this time of year to get to tahoe. it's not bad. live to squaw right now with kevin wallnerp how are you getting creative up there with a lack of mother nature's help? good morning to you. >> hi, good morning. you know, the creativity is coming down to snow making and grooming now. we have a nice storm over the weekend that brought us about three, four inches on the mountain and it's been really cold at night. i heard the snow guns firing all night last night. and between the two mountains we have 18 lifts spinning with almost 50 trails open. so we might not have the whole mountain open but what is open, it's groomed. and frankly, the weather couldn't be better for skiing. we've also got some olympic heritage events coming up this weekend. with the olympics coming in

temperatures. let's take it to your microclimate forecast wednesday. south bay the warmest. just as warm along the peninsula at 78 degrees today in belmont. san francisco, touching on records for today. 72 in the outer richmond district. wine country, we're going to climb by 45 degrees over the span of the day. starting out in upper 20s. headed toward 73 today. east bay, tri-valley, also touching on the 70s. 73 fremont. pleasanton, one of the warmer cities, hit 75 degrees. this isn't going to last forever. today is the peak. surfers, boy, they're taking advantage of it. this is fantastic individual video from terry mcsweeney out there yesterday. he said it was nice and warm, comfortable conditions. it's clear as a bell. the air quality's not bad. normal. santa cruz, 61. today 80 degrees. 77 for thursday.

getting into friday and saturday, temperatures low 70s. even on monday, with a weak disturban disturbance, 67 degrees, well above average, kicking off next week. regional seven-day forecast, throughout the weather reports, tells that story. let's say good morning to mike inouye. >> good morning. goodness, what a wonderful forecast. getting to work, i'm forecasting a backup. you expect that anyway. it's calmer than we would have expected earlier this morning bay bridge toll plaza, lanes to the left, they are clear as far as cash lanes. it's fas-trak lanes to the right backed up past grand avenue off the berkeley curve. there's a smooth flow down the east shore freeway as well. early burst of traffic through richmond causing metering lights to go on early calmed down. maze moves smoothly, getting out of arrent da, throwing for west 24 approaching the caldecott tunnel a crash. and we also might have the

homes. >> christie smith joins us. some welcome change, others fear a negative impact on tourism. >> reporter: that's right. good morning. you know, tour operators are not pleased with this one at all. alamo square is one of the top pleases people want to see when they visit san francisco. it's in the opening sequence of "full house," it's been in movies. people who live here see a different side. the peak of the season, they can see up to 50 of these large tour buses clogging streets around alamo square. this morning, it's settled, signs are up, tour buses and vans with seating capacity of eight or more passengers are prohibited. one longtime neighbor told the examiner that she hopes it will encourage people to come and taki take walking tours. but one blunt neighbor posted a sign around here that said, get off your big fat tour bus and experience san francisco. still, they say, distucouraging

"today in the bay's" tracie potts joins us live in washington, d.c. the fcc opening up public comment. people not holding back. >> a lot of people think it could lead to air rage. a story following up on. we first told you last fall about the fcc opening comment, they want to approve use of cell phones, including phone calls, on airplanes. safety isn't the issue anymore, they say. the issue seems to be people getting aggravated by not being able to have a quiet car on a plane. listen to some of the nearly 400 comments that have already come in to the fcc. i am begging you, please, do not allow voice calls on flights. this isn't an issue of technology. this is an issue of comfort and courtesy. that woman from southern california. a man from colorado follows up, flying is bad enough with the cramped seats and long delays. i can think of nothing worse, he says, than adding 100 passengers all talking at once on their

cell phones believe it or not, 400 comments, 4 people said, it's a good idea, like this one. i would like to voice my full support for allowing cell phone and voice calls on airplanes. i think that is extremely un-american that we bar an individual from doing something that someone else may find objectionable. people or some of the few people, i should say, in favor of this, business people who fly a lot and can't be on the plane for an hour or two without access to their phone. we'll see what happens. 60-day comment period. more likely to start flowing into the fcc. >> thank you very much. today marks five years since miracle on the hudson when danville native captain chesley "sully" sullenberger made an incredible landing that saved the lives of everyone on the board. katharine craig joins us in new york city where sullenberger and others will participate in a

special commemoration ceremony. >> reporter: good morning, from new york, where we are, the fog is really rolling in. but this is the area on manhattan's west side where so many people will be gathering later this afternoon. you'll see passengers, crew members, also ferry workers, and they will be gathering here to remember that miraculous day. they'll toast and take a boat ride out to the spot where the plane landed in the middle of the hudson river five years ago. us airways flight 1549 crash landed in the river within a few minutes of departing laguardia airport. birds struck an engine, the plane lost power, captain chesley sullen sullenberger decided the hudson was the best option because the airfield was too far away. ferry workers coming to the rescue. all 150 passengers and 5 crew members survived. captain sullenburg said for all that went wrong in the first

the temperature is cooler. the wind is our warming agent. 31 degrees santa rosa. a sustained speed seven miles per hour, straight out of the east, pushing to west in san francisco. that's bringing the temperature up to 50. those is a beautiful sunrice that you're notice, haze thicking up out there. that's why it was able to leave on time, as most will be able to across the bay area today. we don't have fog in the forecast. and it's not a spare the air day. through tomorrow it likely will be a spare the air day. keep in that in mind. winds are going to drop off tomorrow. as they move from land to sea today, we get that friction, that warm-up. look where our temperatures are headed, 41 degrees in san jose. 77 degrees, in the heat of the day. santa rosa is going to climb by 45 degrees over the span of the day. up to 73 degrees. that is really, really strong high pressure. as you know, our days are short. so let's get a little bit deeper into the forecast. hit the 70s today.

as we head through the next couple of days, things will change, especially friday and saturday. as that storm track starts to return. it's not going to be able to get that close to the bay area. high pressure's going to nudge it back to the north. so even next tuesday, when the storm track is offshore, temperatures are going to be above average. you will see that on the seven-day forecast. we're in it for the long haul. over to you. >> quest for six. no, different, different. that's reaction. looking toward fremont. northbound, there was a little slowing there. volume of traffic here, i'll show you the map, explain why there was slowing. crash on the southbound side at center divide. both sides had a quick slowdown. all lanes clear. it quickly recovered. watch for flashing lights fremont. north 101 slows tully road. bogging down around 680.

the big slowdown continues after the crash at curtner, in lanes for a few minute minutes. a distraction. slow from capitol expressway to alma, downtown highway 87 there. smooth drive jump up toward the maze and bay bridge. smooth flow. talk about the city, north 101 at vermont, stalled school bus reported in your slow lane. no word on kids on board. it's early for that. check in with chp for updates. we don't have any issues other than slowing there. smooth drive across the eastbound direction of the bay bridge. backup on the toll plaza on the oakland side. back to you. time now 6:37. still ahead, a run-in with a humpback whale. >> coming up, the story behind the video of a kayaker's sudden surprise in the water, i'd say. ♪

6:40, happening now, firefighters in australia trying to get a leg up on fires as authorities warn of worsening conditions. heat and dry conditions helped start and spread as many as 350 wildfires in that country. most sparked by lightning. crews managed to keep many fires from spreading. new video, and amazing video, of unexpected confrontation that took place on the waters in norway. a kayaker going along and, yeah,

"today in the bay's" bob redell spoke with detectives. they're looking for more than one suspect? >> reporter: correct. good morning to you. we just spoke with milpitas police not long ago. they are still processing the scene here at executive inn in milpitas. they tell us they are looking for not one but at least two suspects who are involved in the murder of a young man in the parking lot of the hotel. no description yet except they were possibly seen leaving in a dark sedan. police tell us that the shooting now might have been related to a party going on upstairs. >> our technicians are
