what a beautiful way to wake up. we're watching the sun rise over oakland this morning and the bay lights just turned off on the bay bridge. very clear skies this morning. thanks for joining us, i'm kris sanchez along with meteorologist anthony slaughter. and the good news is, beautiful weather. the bad news is, not supposed to be happening today. >> yeah, we should be talking

about rain, fog and drizzle this time of year, but unfortunately we are talking about another spare the air alert, all categories expected to be back into the moderate and up healthy levels north bay to the south bay and take it easy if you have the respiratory illness. if you have to be outside any portion of the day, that's when you will find the fine, hazy particulates in the atmosphere, in the south bay the haze hugging the mountaintops. overall, though, sunshine is expected all day long really from sunrise to sunset as temperatures cleimb back into te 70s today. a few record-setting temperatures for afternoon highs anywhere from 70 degrees over in san francisco to low 70s from the north bay to the east bay off towards the south bay, warmest location today will be the south bay with 72 expected there. we're talking about a few records and we'll talk more about it coming up and the potential for fog and drizzle,

we'll see, not a whole bunch of rain and trying to twist the story to make it sound like we're going to get something but unfortunately no rain in the next seven days. we'll talk about it more coming up. and while the california drought is now official, governor brown used his executive powers to declare a drought emergency. he made that announcement in san francisco calling on all californians to cut water use by 20%. that was his advice. his warning that mandatory restrictions could be coming soon. >> now we're facing a phenomenon of nature that makes this realize we're dependent on rain. we're dependent on one another. >> the governor outlined 20 steps the state will take to deal with the drought at the government level including asking for federal help and hiring more firefighters to make sure cal fire is staffed for conditions that are now as dry as they are during the peak wildfire season in the summer. new this morning

firefighters in marin county are battling a wildfire in the remote hills west of fairfax this morning. crews are working the fire along the bolinas-fairfax ridge line. this fire started around 9:20 last night. fire officials say it's in a remote location and there are no evacuation orders that are in place right now. many of cal fire's resources are targeted at the southern california wildfire which has already destroyed at least five homes. firefighters now chasing flare-ups after that brush fire that started on thursday. the flames raced down the hillside forcing some 3,700 people in the communities of glendora and to evacuate. at this point officials say it is 30% contained. authorities say at least 17 structures including homes and

garages have been dagmaged. many residents s have been alld to return home. calls to conserve water has restaurant owners evaluating where they might be able to save. tony & alba's restaurant in san jose uses 40 gallons of water every day to cook their pasta. following the governor's request will be a challenge for them and a slice of new york management says they can't cut the water they use to keep a clean kitchen or for employees to wash dishes and to keep their hands clean so that means they're going to have to look to their menu for places to save water and the manager says that could cut into profits. >> i'm nervous. i'm nervous. because if they actually mandate us cutting water that means we make less products. we're going to lose customers and lose business. >> again, right now we are in the voluntary stage of water restrictions. the two restaurants we spoke with last night say they are

taking it seriously and trying to figure out how to handle things if water restrictions become mandatory. more details now some bay area food struck operators also keeping track of what happens with california's drought. they're worried the price of california produce will rise as produce from other parts of the country also becomes more expensive. corn prices went up two years ago during a drought in the midwest. and that had domino effects other food products. with the governor's call to conserve at least 20% east bay mudd plans to expand on a program that alerts consumers how their water usage stacks up with their neighbor's use. the utility says everyone can scale back, check your home for leaky toilets and make sure you don't leave the faucet running too long and cut the shower a little short. our coverage continues online at nbcbayarea.com. this you can find water conservation tips and hear more of governor jerry brown's press conference at nbcbayarea.com. just search drought emergency.

in on this they are news more charges. we're getting some critical new details about the san jose arsonist. patrick brennan faced a judge for the first time in connection with the 13 fires he's accused of starting. marianne favro has the story. >> reporter: patrick brennan visibly shook. he's charged with ten counts of arson and three counts of attempted arson. court documents said he admitted to police he set several fores in san jose and he even gave them a tour explaining how he did it. he told officers he put a back of debris in a paper bag and threw it underneath this warehouse on julian street and set it on fire with a lighter. that fire alone caused $5 million damage. >> the total amount of damage that we estimate so far from these fires that were caused is in excess of $6 million. six of the structures were occupied by individuals, by people, by residents of our county at the time these fires

were set. >> reporter: brennan also admitted to police he was aware there were people in some of the homes he set on fire. >> we have charged at this point the crimes that we believe we can prove and we've charged that as ten counts of arson and three counts of attempted arson. we haven't charged attempted murder at this point. we'll always review the evidence in the case. >> reporter: brennan 11th in this trailer in this mobile home park in san jose just a few yards from a church he's accused of setting on fire. he's already considered a serial arsonist, convicted of setting 16 fires in the santa clara county foothills in 1999 and setting debris on fire in the grand canyon in 1995 because of that extensive record, this is considered a three strikes case. >> based upon the charges and other criminal acts that are alleged in the glant he's looking at multiple live terms. >> reporter: a judge ordered brennan to be held without bail.

fire crews worked on this garage fire in south san jose last night. firefighters tweeted this photo from the scene. they got the call about the fire around 9:00 last night near highway 85. they say the fire spread to the attic of the home but fortunately no one was injured. a fire near redwood city burned for hours yesterday triggering an aair alert through all of san mateo county. it spread to three other buildings including an apartment building. that mean 17 residents had to kind another place to sleep. the fire on douglas avenue was the third industrial fire in the area in less than three months. the fires are raising questions and concerns from people who live nearby. city leaders say it's not uncommon for industrial zones to have more fires. >> the very matter of some industrial buildings is that they generate heat. and so whenever you have the possibility of heat, you can

have a fire. >> investigators say the machine shop did not have sprinklers and it took more than 100 firefighters more than four hours to get those flames under control. an unusual accident at san jose's reid hillview airport right around the 5:00 hour yesterday evening a small plane was in the process of taking off when it lost engine power. it struck another small plane that was parked on the tarmac waiting to take off. the two pilots and one passenger, though, were not hurt. the faa and the national transportation safety board are now investigating. and now to our coverage of the 49ers quest for six. the party has started and the guests of honor have now shown up. the 49ers arrived for duty last night. players and coaches checking into the team hotel. but even though they are 800 miles away from home, they're

still getting lots of love in seattle. dozens of fans waited in the 40-degree weather to cheer on their favorite players. >> we're fired up. they're going to the super bowl this year, been knocking on the door for a few years, it's exciting. >> this is awesome. the game hasn't even happened. it's friday and it's already been an awesome experience. >> this is a familiar drill for the 49ers. believe it or not, this is their fourth road game in the last four weeks. well, earlier in the evening 49er fans rallied at team headquarters in santa clara. team buses honking at the fans and it was a cheerful send off. one more when and the 49ers are headed back to the super bowl. it would be the sixth super bowl appearance. >> i'm so happy. i'm elated. this is his tre in the making right here. this is history in the making. we're going to go to the super bowl. >> we'll take it to slat and we'll bring seattle down with their 12th man. >> the nbc chopper was overhead as the team buses made their way

bay in the background. but the game, of course, is in the other part of the bay, in a different bay. back to the 49ers quest for six, the time to prepare is just about over and the third consecutive nfc championship game is now looming. so, how ready are the 49ers? we've got the report from seattle. >> the 49ers and the seahawks will face off for the first time ever in the postseason, but this division rivalry will feature two of the best running backs in the league. oakland's own marshawn lynch for seattle and frank gore san francisco's leading rusher in franchise history, but what will be interesting in the running game that could decide the game but both running backs will be facing very different defensive fronts. >> they will. and both of the teams have had difficulties containing the other team's running back. for frank gore he's the focus of the defense. they'll put eight men in the box to try to stop him and force

colin kaepernick, dare him to throw the ball to try to beat him. as far as martian lynch seattle will come out with a lot of three wide receiver sets means the 49ers will counter with the nickel defense which means they'll have six guys four linemen and two linebackers to contain m conta contain marchand lynch, and the 49ers run defense will have a huge challenge. >> that's what navarro bowman thinks how this game will be decided how they are able to stop him with only six men in the box, but how does frank get into the end zone against the defensive front of seattle? that's very powerful as well. >> it is very powerful. what the 49ers will want to do, they'll want to mix it up and be able to utilize anquan boldin and michael crabtree and vernon davis to at least put in the seahawks' meend minds the threa the passing attack.

jose, one of the warmer spots around the bay area today. should be perfect for whatever you have planned. returning now to the 49ers coverage, a nervous mom in the east bay is getting ready to watch her baby this weekend. her baby is star player for the seahawks. in fact, there are several members of the seahawks with bay area ties including their head coach and running back. "today in the bay's" cheryl hurd has that story from oakland. >> i got my momma lynch on, i don't know if you can see the back, but i'm all ready. >> reporter: with a huge smile on her face, she's on her way in seattle to see her son marshawn lynch play against the san francisco 49ers. >> marshawn has worked hard, he's worked hard sense maybe his junior high days. >> reporter: lynch is born and raised in oakland and even though his mother wears her seahawks jersey every chance she gets, she has a confession to

players. >> reporter: cheryl hurd nbc bay area news. >> it's nice to see when he comes home and gives back. anthony slaughter in the weather center right now. we want to see your beast move mode. come on, give it to us. >> the key, though, is that we're all friends after the game is over, right? let's keep that in mind, fans. it's belligerent in the bars and i've seen the rivalry action. let's talk about the weather. we have to spare the air today. if you are visiting from out of town and you are here this weekend enjoying the beautiful weather, we've been unusually dry over the past couple of months and today will be no different. we are talking about an unhealthy air quality bay for the north bay and peninsula and today really one of those days where it's a catch-22 you want to be outside and enjoying the weather but we've got unhealthy air to deal with. we're waking up to beautiful clear skies. this is a spectacular look that we're taking across the bay area. you can see off in the distance

the hazy particulates sitting in the lower atmosphere. kind of the deirty look along te mountainside. the temperatures will be very warm today. in fact, we're talking about highs today that will be back into the low and mid-70s. this is record-setting territory even to get back into the 70s this time of year. so what we're going to be looking at is the temperatures back in the 70s for the most part. increased fire danger and poor air quality will be with us once again for today and also for tomorrow. here's the thing as we head through the upcoming week it doesn't look like there's any rain in the forecast. the microclimate forecast shows that temperatures will be back in the low to mid-70s for the north bay and east bay and the tri-valley but here's the other thing we were talking about earlier, a few records possible in places like san jose. you get up to 71 that will tie the old record of 71. livermore, 72, will smash the old record of 70. san francisco if you get up to 69 today that would beat the old record of 68 degrees, again, you don't have to get very warm here

across the bay area to at least see temperatures that will be setting records even for oakland and concord. low 70s. beat out the old records. look at this, 66 degrees the old record in oakland. you don't have to get very warm across the bay area. the other thing we're paying attention to is the four-month precipitation trend this graphic shows you how much rain we're going to be looking at across san francisco on average for the next few months, february, march and april where you'll notice the rainfall totals really fall off. we're talking about only an inch we average in april, so if we do not get this rain that we're expecting for january, you'll notice each and every moppnth w look at our chances dwindling, our fingers are crossed we'll get showers but unfortunately the next seven-day forecast that you find scrolling at the bottom of your screen it does not look like showers in the forecast. the good news wednesday and thursday we'll see more fog roll in so that will increase the onshore breeze and that will increase our air quality. there a little bit of good news

in january of 2010 the news cycle was dominated by a single event, but now four years later you might not remember what that was. it was the devastating 7.0 earthquake in haiti. since then other crises have pushed it out of the headlines, however, not for three young sisters in portola valley, and garvin thomas tells us how they are still trying to help. >> reporter: there's a home labeled the greenest in america. perhaps it's no surprise, then, that in such an extraordinary structure you will find three

extraordinary sisters. ♪ the holland girls, kiley, devin, and piper have recently formed their own rock band. they call themselves zeus sisters. it's what they've been doing for years now that makes them stand out. you could say these three have been humanitarians, almost as long as they've been human. >> okay. you can go. you can go ahead. >> we were kind of born into a family that likes to help people. >> reporter: their impact can be seen online with a website they developed years ago called earth savers club for kids. the impact can be seen in their community with any number of projects to help those in need locally. but their latest endeavor is by far their most distant and ambitious. haiti, the country the poorest

in the western hemisphere was in difficult straits before the quake, so it is little surprise four years later there is still much to be done. and while much of the world's attention has moved on to different causes, the girls decided to revisit this one. >> this is generations of poverty they've got that they're now trying to deal with on top of the devastation of the earthquake. so, it's still a problem. >> reporter: they have pledged to raise $250,000 through the sales of a record they have released on their own record label, of course. ♪ >> reporter: invitation to dream is a collection of lullabies sung by devin. >> so i decided to donate 100% of my profits to that organization. >> reporter: the money will go to project haiti, to help build an orphanage, the greenest in the world, for the children of haiti. they have already raised $10,000

would call a pinklicious sunrise in the distance. very pretty way to start the day. thanks so much for joining us i'm kris sanchez along with meteorologist anthony slaughter. it is a very technical term you're welcome to use in your weather forecast. >> thank you, thank you, pinklicio pinklicious. i'll leave it to the girls. we've got to spare the air today. if you are making plans to head outside across the bay area even though it is spectacular as kris' girls like to put it pinklicious we do have to spare the bay and unfortunately in the north bay and peninsula is expected and even in the south and east bay moderate levels expected there. we are talking about plenty of sunshine, however, this is the time of year where we need some rain. we're in a desperate drought, we are wairking up to clear skies. temperatures in the 30s and 40s for the most part and what you'll find is later on this afternoon it will warm very quickly, even in san francisco, expecting to set a new record of 69 degrees. breaking that old record set over 50 years ago. so, it's going to be very warm not only there but even off

affair and their drug addiction issues. authorities say they dropped charges who lockyer went above and beyond to rehabilitate herself, she's still married to state treasurer, bill lockyer. afghan police investigated the aftermath of an attack on a restaurant in kabul that killed 21 people including four united nations personnel and two american citizens. the taliban claimed responsibility for the attack. officials said a suicide bomber blew himself up outside the restaurant while two men opened fire in back. 13 foreigners and eight afghans were killed in the attack. the u.s. embassy in kabul confirmed that two american citizens that worked at the american university in afghanistan were among the dead. a spokesman said the u.n. strongly condemns the attack but it will not have an impact on operations in afghanistan. russian president vladimir putin is in sochi this morning. kicking up controversy once

again three weeks before the opening ceremonies of the winter olympics. he tried to defuse the issue over a russian law banning so-called gay propaganda that bans homosexuality to minors. we aren't banning anything, everyone should feel at ease, but please leave the children in peace. that's his quote. a suggestion that gay people might prey on children. gay rights activists are protesting the sochi olympics because of that law. and we are about 32 hours away from kickoff in the nfc championship game in seattle where the 49ers, of course, looking to earn their seventh super bowl appearance. comcast sportsnet's mindi bach joins us to talk about how the 49ers offense stacks up against one of the more physical defenses in history. >> the marquee matchup between the 49ers and the seattle seahawks feature two of the best defenses in the nfl known for their physical nature, and, matt, seattle's defensive

secondary particularly known for their physical attributes. they're not only huge defensive backs, they're fast, powerful, they like to talk and very physical as well. it will be quite the challenge for san francisco's receivers. >> it will be. jim harbaugh made a big deal of how physical this the seattle seahawks secondary was and even asked if it was legal some of the stuff they were doing. richard sherman is probably the best cornerback in the league. he's playing at a very high level, but there's also no mistaking of the fact that he does like to put his hands on receivers and at times grab them. now, what's going to be interesting about this game is the officiating. how is it going to be called in the defensive backfield because that will really set the tone for this game. the referee did not do a 49ers game all season but it's an all-star officiating crew and the three guys in the secondary each had a 49ers-seahawks game this season and in one of those games one of the officials in this game did throw two flags on richard sherman for holding.

>> wide receiver anquan boldin said you can't worry about the officiating you have to play the game and wait and see how the calls are, but how do the 49ers receivers handle the physical nature? >> anquan boldin is in a good spot because when you talk about physical wide receivers, he's at the top of the list. the 49ers have a tandem of wide receivers with boldin and crabtree that are kind of similar. they're not speed guys. they operate very good against press coverage. so, in that case it's going to be strength versus strength. the physical cornerback for the seahawks and two very powerful wide receivers for the 49ers. >> and let's not forget their physical tight end vernon davis as well, i'm sure he'll come into play. we are looking forward to the nfc championship game, division rivals but the first-ever postseason matchup between these two teams, it is sure to be a good one. well, a pair of pants distracted football fans this weekend. it all started with the wife of

head coach jim harbaugh who complained about his bargain bin khakis in a radio interview. a fan tweeted this photo of the pants and it went viral. harbaugh has promised to go pleatless at sunday's game. the niners decided to sell his old pair for charity and they were snapped up for $500. i say if you're winning don't change a thing. vino is on the line for governor brown. the governor tweeted this game-day bet a few hours ago saying he'll wage a case of california's finest wine on sunday's game. he added that he's looking forward to tasting the best that washington has to offer. still ahead on "today in the bay" it was a record-setting kind of night in oklahoma city. we'll let you know if that was a good thing or a bad thing for the warriors. >> step back. 28 points. right?! is this the bacon and cheese diet? this is the creamy chicken corn chowder. i mean, look at it. so indulgent. this is so much more... what's different?

all right. welcome back. time for your microclimate forecast. unfortunately we've got to spare the air as we've been telling you all broadcast. the north bay and the peninsula expecting the worst air quality, meanwhile east and south bay still expecting moderate to unhealthy levels there and for tomorrow this is expected to increase and tomorrow doesn't look like there's much relief on the way. as far as what right now looks like, you'll notice as we take a look outside to our skycam ra network. waking up to sunshine and the hazy push up against the mountains, you can see through 2001 san jose, but we're expecting a bright day. temperatures will be back to the mid to upper 60s in some locations, even to the low 70s across our inland valleys. afternoon highs shape up like this, 69 in san francisco, 70 towards the east bay and 71 in the peninsula and 72 off towards

the south bay. here's your hour by hour forecast basically temperatures at noon in the south bay at 60 degrees and falling back by 50 at 5:00 and even by the noon hour we'll see temperatures warm back into the 60s and off toward the east bay, tri-valley and north bay you'll notice a wide array of sunshine and plenty of temperatures that will warm back into the 60s by noon and expected into the 70s by this afternoon. so, it is going to be a warm day. in fact, record-setting territory for many of our inland cities, san jose, live move, and san francisco and oakland breaking old records set back 50 to 60 years ago, it will be another stretch of warm weather heading into the weekend. we've got an area of high pressure sitting right on top of us and this has been the way it's played out really all winter long. another day of record-setting heat. increased fire danger for the weekend and also poor to moderate air quality.

here's the thing even though we're not talking about rain showers, i do want to show you the futurecast as we move through the upcoming week, monday you'll notice the clouds start to increase across the bay, but look what happens as we head towards tuesday, that onshore wind really starts to rev up and we may even just get a little bit of drizzle by the time we head into wednesday and that will be enough to clear out the air and at least return us back to some more at least healthy air quality levels. if you are making plans to watch the game tomorrow or at least head out to seattle, this is what the conditions will be like towards game time, by falling into the low 40s by 5:00 and the 49ers won't have to deal with showers there. we'll be back with more coming up right after this. ♪

this morning. firefighters in san jose are battling a massive fire at a business on hillsdale avenue. it is a coffee shop ironically the flames coffee shop on hillsdale boulevard near ross avenue. this fire started around 6:00, and the blaze escalated now at four alarms, however, no injuries have been reported. there are other businesses in the area, and as you can see the air quality is being impacted in the area. we will get you more details as we get them this morning. you can check nbcbayarea.com. and this morning we have our friends from pets in need, volunteer lisa simmons is here with camilla who is ready for her home. she looked like maybe she stepped in white paint. she has teeny tiny paws. >> her toes are so cute on the back as well. she's a 4-month-old puppy, we feel that she'll grow into a
