killing an armed man for the second time in less than 24 hours. investigators say the latest shooting started as a routine traffic stop. "today in the bay's" christie smith live at oakland police department. good morning, christie. what happened? >> reporter: good morning. according to oakland police, that's right. they say this started with a traffic stop, and the driver did pull over but that's when a passenger jumped out of the suv and had a handgun very visible to the two chp officers that were on patrol in a marked car on the 5200 block of wentworth avenue around 9:00 in east oakland. investigators deployed police canine unit and the officers also went on ahead and chased the man on foot. the police dog, they say, engaged with the man and both officers opened fire. police say their canine was shot and so was the man. the canine expected to survive. officers performed cpr on the

suspect but he died tat the scene. a loaded handgun was recovers at the scene. they say they're asking for the public's help. they are looking for the driver of the car that is a silver toyota suv later model with paper plates that are red and white. oakland police are the lead agency. they're expected to speak on the incident later this morning. christie smith "today in the bay." the second deadly shooting involving a chp officer in less than 24 hours. last night's shooting happened less than a half mile away from the one this morning just before 3:00 a.m. police shot and killed a robbery suspect after a car chase. the 19-year-old of oakland had a loaded gun when he ran from police. expecting to hear more details in the investigation of the first b.a.r.t. officer killed in the line of statute

doou duty. shot and killed by a fellow police officer. bob redell live where it all started where the shooting happened. >> reporter: good morning. a huge part of the investigation into the shooting here at the park sierra apartments will focus why did one b.a.r.t. officer fire his gun in the direction of his colleague, sergeant thomas smith, seen here from a press conference. killing smith, 20-year veteran of the force. this happened before 2:00 yesterday afternoon when smith and several other b.a.r.t. officers were performing a probation search here at the park sierra apartments in dublin. they knew the probation suspect wasn't at home in the unit but not sure if anyone else was there. officers suited up in bulletproof vests, drew weapons, and kicked down the door. >> made entry into the apartment and it was during that subsequent search that one officer fired his weapon, which fatally struck another officer

inside of the apartment. >> reporter: it is believed that that shot entered into the area of smith's armpit, not protected by his vet, an area exposed. he, too, had his arms extended with weapon drawn. smith rushed to eden medical center where he was pronounced dead. several officers saluted his flag-draped body. later officers formed a circle and prayed for smith and his family. smith was 42, lived in san ramon with his 6-year-old daughter and wife, who is also an officer with the b.a.r.t. police department. last night governor jerry brown expressed his sore reand ordered flags be flown at half-staff. smith, the first b.a.r.t. officer to be killed in the line of duty. for the officer who shot smith, b.a.r.t. police have not identified him but say that he has been with the police

october 22nd, shot and killed by a deputy who mistook the replica rifle lopez was carrying for a real gun. a task force is still investigating the death. a hearing held today to set a trial date for disgraced santa clara cousupervisor, pleaded no guilty to charge his impersonated someone in a mailer meant to discredit a political rival. prosecutors say they'll call the 14 people examined by the grand jury that chose to inindict him. among the witnesses, current san jose city councilman compose and his sister, norah compose. already serving one-year jail sentence. a snowstorm from kentucky to new england left more than a foot of snow in some areas. hit the hardest between philadelphia and boston, believing 13 inches of snow on the ground in philly. one new jersey town got 16

inches. self-cities ordered schools to close down. >> i think schools will be open because the weather looks pretty darn good. >> here. >> yes, here. good morning. >> much of the chagrin of the students around here because it's been so nice. now we've got big waves coming in. i'm picturing myself out on the beach later on today. i don't know about you. 37 half moon bay. chilly on the beach now. this afternoon, another round of warm weather. however, you will notice a difference at coast, inner bay, with return of the onshore flow. the influence not making its way to the east bay. temperatures in the mid-70s in places, talking about the tri-valley, livermore, pleasanton. 64 san francisco today. there's the cooler weather. north bay, we'll hit low 70s. the same for us right here in the beautiful south bay. so here's where we're headed throughout the next couple of days. changes headed our way. high pressure the reason why those wins wrap around that

ridge of high pressure which is great news for surfers out there. i can tell you, this is not great news when it comes to fire weather which is a factor even this deep in the winter. this is what we're watching for. red flag warning in effect. throughout tomorrow, that's for the north bay hills, east bay hills and of course the santa cruz mountains. wind gusts to 45 miles per hour at times. these are the dry downsloping winds. keep that in mind. not a great time to have a barbecue though getting great weather. if you're going to i have camping excursion or you want to have a barbecue, don't leave the fire until it's out. want to keep the bay area beautiful and of a. onshore flow, cool ocean breeze today. things change. overall pattern going to shift back to winter. we'll get into that in the next report. mike inouye about your morning drive. >> little bit of a shift as far as speed go for the nimitzing oakland, northbound. taillights. light volume of traffic.

the map will show you the same area new york slowing on the sensors there. we did have slowing and starting to improve in the last couple of minutes, north bound 16th and 23rd. we had earlier crash, blocking one lane. that cleared 20 minutes ago. also, construction north of there. both of those caused slowing into downtown. those have cleared up. slowing southbound for ten minutes. that has cleared south as there were other crews on the south bind of 880 toward 980. we'll see that over the next half hour as crews move through the area. word of disabled vehicle on westbound deck towards treasure island. sounds like a car and couple cars very slow behind it. might be a slow rolling vehicle trying to get to treasure island. not a lot of traffic on the bay bridge now. starting to build. the tracks, b.a.r.t. trains, san jose, recovering from the west oakland station, 10 to 20 minute delays because of earlier equipment problems.

welcome back. ohio man yanked out of the movie theater by federal authorities for wearing google glass. wearing glasses like those during the showing of jack ryan shadow recruit. an hour after he was pulled out by officers with immigration and customs enforcement which investigates piracy and counterfeiting. officers let the man go after determining the prescription and recording function was off. the theater company says it takes movie piracy seriously so it reported the man to the motion picture association of america. google, a follow-up, san francisco. muni approved 18-month pilot program allowing private buss to use muni bus stops. the program expected to raise $80,000 to $100,000 a year when it launches in july.

companies like dole and facebook use shuttles to transport employees from san francisco to the headquarters. opponents complain the convenience encourages tech employees to live in the city, and that sends rents sky high. crushing blow to appmakers all over the world. gamemaker behind the popular candy crush saga has received a provisional trademark for the word candy. experts are stunned. u.s. patent and trademark office gave the gamemaker the rights to the word kandy. they're worried this will open floodgates to trademarks on other every day words. king says it's trying to protect its product from copycats, not askingmakers who use the word candy legitimately. earnings seasons continue. investors get the first chance to react after amd offered better than expected numbers

bay area if anything happens with that. 37 degrees half moon bay. best surfers in the world on standby. 34 in concord. 35 right now in livermore. chilly start to the day. another 25 to 30-degree jump in temperatures between now and later on this afternoon. another round of 70s headed our way. you will notice a cooler day along the peninsula and in san francisco with return of the onshore flow. not reaching the north bay. it's a little bit softer out there. 71 degrees as a result. you'll get the robust, onshore flow in san francisco. back down to mid-60s. closer to average. 57 degrees for this time of year. let's talk about the big waves. the story i want to focus in on today. looking for temperatures for the next few days, seven day at bottom of the screen. surf's up bay area. we've got the big west northwesterly swells headed our way. don't turn your back to the ocean. watch out if you plan on going in the water. they have dangerous rip currents

as a result of big swells. expecting really large surf through the next couple of days. part of the reason why, you've shore flow. i'll show you how this offshore flow makes big, beautiful waves and how the weather ingredients now are going to be impressive, just right for the competition. first, say good morning to mike inouye. >> good morning. no one competing for lanes because there are plenty now northbound 101 underneath the 680/280 interchange in san jose. map of the south bay. unusual thing is that there's not a lot of construction crews out there. we have them scattered throughout. this morning, focusing on south 880, around stevens creek boulevard. typical as they em prove the off-ramp and exchange where folks back up getting on towards the mall. smooth drive northbound. good stuff for the south bay. move out and show you overall things are moving nicely around the peninsula. bay itself, nothing unusual.

check on a few things heading over toward the bay bridge. earlier stall towards treasure island. a quick look from emeryville camera. traffic westbound towards treasure island tunnel, nothing as far as problems for the flow. there may be a stall as you enter the tunnel and head toward the san francisco side. back to the maps, another issue, earlier crash northbound 880 at 16th that cleared. slowing cleared as well. construction crews clear from both directions. that added complication to flow but that has cleared up tri-valley, smooth drive. west 580 toward dublin interchange. no problems. tiny build out of livermore. volume of traffic is the issue. back to you. you see them on the roads, popular mini cars, they're getting poor marks when it comes to safety. testing 11 models of mini cars,

b.a.r.t. police officers returning to work this morning with heavy hearts. one of their own killed in the line of duty, shot by a fellow officer. good morning, everyone. thank you for joining us. scott mcgrew. >> i'm laura garcia-cannon. sergeant tom smith of san ramon killed yesterday during a probation search at an apartment in dublin. "today in the bay's" bob redell live at the apartment complex where we're expecting to learn a lot more about what led up to the shooting. good morning, bob. >> reporter: good morning, laura and scott. probation search that took place here at the park sierra park

complex was related to a crime that took place on b.a.r.t. property. the officers involved in the search knew that the person on probation wasn't going to be home but they weren't sure if there was anyone else in that person's unit. so when they made entry just before 2:00 yesterday afternoon, that's why b.a.r.t. officer thomas smith and several other of his colleagues were wearing bulletproof vests. it's also why they kicked down the door and had guns drawn. during that entry and the search of the apartment, one of smith's colleagues, a ten-year veteran of the b.a.r.t. police force, fired his gun. that bullet found its way past smith's bulletproof vest, near his armpit as he had his weapon drawn, and it entered his body, killing him. smith rushed to eden medical center where he was eventually declared dead. several members of the law enforcement community gathered outside the hospital to salute smith's flag-draped body as it was taken to the coroner's

office. >> condolences goes out to immediate family and friends and extended b.a.r.t. family and entire b.a.r.t. district. the. >> reporter: officer who shot smith with the other officers on the probation search were questioned at the dublin police department though it's the alameda county sheriff's office leading the investigation as to what happened at the apartment complex. overnight, governor jerry brown offered his condolences and ordered flags to be flown at half-staff in smith's onnhonor. smith was with the police department for 20 years, he's the first officer to be killed in the line of duty. he was 42 years old, lived in san ramon with his 6-year-old daughter and wife, who also happens to be a b.a.r.t. police officer. live here in dublin, bob redell, "today in the bay." >> thank you. also learning officer thomas smith played a role in the investigation into the deadly shooting of oscar grant.

"today in the bay's" christie smith live at oakland police department. what's the latest? >> reporter: good morning. yeah, second officer involved shoot on the streets in as many days. what they say happened, two chp officers tried to pull over a toyota suv, driver complied but a passenger jumped out with a handgun visible to the two officers. the officers opened fire. this on the 5200 block of wentworth avenue around 9:00, blocks away from another officer involved shooting the morning before on east 57th and east 15th street. also involving two chp officers. now, oakland police say it was last night two chp officers were in a marked police unit. they released their canine on that man who ran with the gun, both officers chased hip as well on foot. canine they say engaged him and officers ended up opening fire.

suspect was hit and later died from his injuries after the officers tried to do cpr. the police canine shot, too, but expected to survive. police say they did recover a loaded handgun at the scene. yesterday a 19-year-old man was shot by chp officers as he ran from what police say was a stolen bmw x-5 suv following pursuit. chp says he was carrying a gun at the time. also that bmw did not have plates. in the latest incident, police say they're looking for a silver toyota suv with red and white paper plates, looking for the drive somewhere also the passengers who remained in the car. christie smith, "today in the bay." one of the four students charged with a hate crime will be back in court today. lawyers expect the 18-year-old colin warren to enter a plea on charges he and three others

harassed another student because he was black. they are accused of putting a u of shaped bike lock around his neck. two of the students, a 19-year-old and 18-year-old, have already pleaded not guilty. the fourth student is a minor and his name has not been releaseded. happening today, governor brown is set to deliver the state of the state address in scram. we don't know details yet. the governor will likely talk about the state's recently balanced budget, giving additional funding to schools and what he's learned from detroit's bankruptcy case. another possible topic, how to deal with the drought. house speaker john boehner in the central valley to talk about make a fix for water problems. he'll meet with three californian republicans to propose an emergency bill allowing farmers to pump water from the sacramento/san joaquin delta. california's the nation's leader in farming. we could be facing the worst dry

spell in the country. >> already to get into practices conserving water. meteorologist christina loren, the woman in the know to know when we are going to get rain. >> targeting two significant opportunities. starting next week, overall storm track comes back. that's going to keep temperatures closer to average. we have been blowing past average every single day for the past two weeks in the 70s. in fact, this could go down as the warmest january of all time right here in the bay area. want to show you, clear this morning. out in oakland, no problems. check on the drive with mike in a moment. microclimate forecast. we'll see significant differences today throughout the microclimates across the bay area. starting in the south bay, one of the warmer regions, not much of a rain influence but you'll see that along the peninsula and san francisco. temperatures only reach into the low 60s in the inner richmond district. north bay, 70s. a beautiful day up in wine country although it's funny,

everything is blooming up there because it has been so warm. we're hoping that we don't get a big cold snap as we start to see our pattern change getting into next week. for today, change in the east bay and tri-valley. temperatures dropping off a touch. marine influence making its way to pleasanton and not much. 73 degrees. your wind direction tells the story. as you can see, onshore wind continues until we get into thursday 10:00 p.m. offshore flow returns and that's that's warm pattern. this, however, will produce big waves. one thing it's going to produce that we don't love is dry fire winds. that's a developing weather story. i want to get into right now, watching a red flag warning, high fire danger for higher elevations above 1,000 feet. santa cruz mountains, east bay hills, north bay mountains, thursday into friday. hills gusting to 45 miles per hour. so keep that in mind. high fire danger for the bay area for now. when we get into the wet weather

pattern. i'll talk about that. stay tuned if you can. mike and your drive. >> toward emeryville. bottom of the screen, flashing lights, that's a disabled vehicle. stream of traffic, you can see the silhouette in the middle, that's university avenue, up until 4 minutes ago a traffic break in the westbound commute direction. metal debris reported. they have cleared all of the metal, good news. one car there, sounds like it had an issue because of the debris. everybody else moving smoothly toward the bay bridge. let's look at the map and you see a smoother drive on sensors through the area. no problems for the berkeley curve. we'll see slowing. b.a.r.t. system reported 5 to 10-minute delays out of the west oakland station as a result of earlier equipment problems. trains on the route, it's just got a little bit of a delay getting out of there. across the bay bridge, we had a stall reported westbound around treasure island. haven't had an update but haven't seen slowing either. a stall reported the treasure

island tunnel and that was blocking slow lanes. no problems so far. we'll continue to track that. to the south bay, smooth flow northbound. increase for the volume of traffic. we'll check in between the two, san mateo bridge. west 92 fine. and 101 and 280 report nothing delays. 5:39. the mavericks surf contest could be called any minute. an update on how the surf looks, coming up. record snowfall all over the east coast. live to washington, d.c., the federal government still shut down. temperatures only expected to hit 22 today.

at winds kind of whipping in that shot. you know the second big storm of the winter season sweeping across the midwest and the east coast. this one packed a much bigger punch than the polar vortex a few weeks ago. live to washington where "today in the bay's" tracie potts is outside this morning braving the storm. sun is shining on you. >> reporter: we're finally getting some sun. i can tell the temperature is warming up since negative 10 windchill. the federal government's open today, opening two hours late. people do have the option of staying home if they want to. that might be a good choice, considering what we're seeing from here up through the northeast. >> reporter: with schools and businesses closed today, morning rush hour may look nothing like this. >> it's crazy. cars stuck in the middle. cars stuck on the side. >> no plows from the city here. >> reporter: what happened? >> ridiculous. >> reporter: officials were stuck, too. >> slow response so far because

half moon bay today not quite as warm. we do have return of onshore flow and see a gray start to the day. when it comes to giant waves, the waves are kicked up by a series of storms out in the pacific. one in particular is really big. we're talking about 50-foot waves in hawaii from the same system that's going to bring us big waves. in combination with swells, we have the offshore flow. as wind blows from land to sea, it clears out the barrel making a beautiful, clean, surfable ride. and this is the kind of thing that surfers dream about. oakland right now, nice clear start to the day. temperatures going to climb out of the 30 and 40s into the 60s and 70s. looking good to reach near record levels today. want to show you the story via tri-valley forecast. through the next few days, average out in the tri-valley, 56 degrees. today, 73. tomorrow, 70. 68 friday. and as we get into saturday and sunday, temperatures are going to level off.

jose international airport. the build is on. we should see 87 and 280 following in close suit there. following rest of the bay, peninsula drive 101, 280 not a problem. and the same follows suit. south drive across the dumbarton bridge and san mateo over to the peninsula. north bay, a bit of a build south. right now the tri-valley shows a similar pattern which is typical, westbound 580. slowing towards dublin interchange and 84 through livermore. 680 not a problem. 580 smooth drive through the castro valley area. at the limit pleasanton, walnut creek past the interchange. 24 easy drive at the limit towards lafayette. 880, similar build. slowing approaching 980 through downtown. but not a problem. bay bridge toll plaza, we have a minor backup before the cash lanes. a couple of cars deep. fas-trak lanes are clear. easy flow off the berkeley curve
