i'm laura garcia-cannon. and. >> i'm scott mcgrew. >> begin with breaking news in the east bay. crews on the scene of an apartment fire in berkeley. that fire broke out 4:00 this morning at a complex on the corn of blake street and shattack, a few blocks from the campus. the fire is under control and people inside the complex were able to get out of the building. take a look, huddled on the ground. so far, no word on how many apartments were damaged and no reports of any injuries. the cause of the fire is under investigation. another developing story, oakland police are investigating two deadly shootings involving chp officers that happened within a couple blocks each other. latest around 9:00 last night on wentworth near bancroft. "today in the bay's" christie smith live in oakland. investigators say the shooting started wthd a rwith a routine traffic stop the. >> reporter: officer-involved

shooting happened like the one yesterday in oakland. oakland police saying two chp officers on patrol in east oakland. they spotted suv that had paper plates. the they're saying suddenly, a passenger jumped out with a handgun that was visible to those two chp officers. again, this was around 9:00 last night on wentworth avenue in east oakland. according to police, this was a marked chp canine unit. the canine was deployed and two chp officers chased the man on foot. the canine tangled with the suspect. officers opened fire and the man was shot but so was the police dog. the officers performed cpr on the man but he died at the scene. the canine, though, expected to survive from the gunshot wounds. oakland police are the lead on this and they're saying that a loaded handgun was recovered at that scene. but this morning, they are asking for the public's help

looking for the driver of the suv and other passengers inside. this is a silver toyota suv, newer model, with red and white paper plates. reporting live in oakland, chris smith "today in the bay." >> this marks the second deadly shooting involving the chp in oakland in the past day. both happened within blocks of each other on the east side. we brought you yesterday's deadly shooting as breaking news. in that case, chp officers shot and killed a man on 57th avenue after a short chase. the suspect was armed with a gun. both officers on routine leave during the investigation. 6:03. new this morning, flags are flying at half-staff at the state capitol in sacramento to remember the life of a b.a.r.t. police officer killed by a fellow officer in the line of duty. the department is greening this morning but there are growing concerns how the deadly shots could have been fired at all. is investigating this morning. he's gathering new information at the apartment complex where the officer was shot. we'll check in with him later in the newscast. the investigation into officer smith's death will take a hard look at procedures by b.a.r.t. police in the moments before that shooting. the b.a.r.t. police department did enact reforms in the wake of the controversial shooting of the unarmed passenger, oscar grant, on a b.a.r.t. platform 2009. last month an independent auditor praised the police department's progress in improving its officer accountability and training. now, attorney john burriss represented grant's family. he's been monitoring reforms made in the department. he believes procedures will, once again, be the focus of the current investigation into officer smith's death. >> i know that b.a.r.t. police officers go to the academy. i expect the training was proper. that would mean somewhere else there was a breakdown and that's what the investigation will determine. >> we will continue coverage of the deadly shooting on air and

online. nbcbayarea.com. search for b.a.r.t. police. families waking up in hotel rooms after a fast-moving fire gutted their apartments. crews are not sure how that fire started at the oaks apartments near monterey road and blossom hill road in san jose. take a look from the neighbor's cell phone moments after the fire broke out. flames shooting out of the second floor apartment. everyone made it out okay but four units were damaged. the four families put in hotels for the night. firefighters don't know how or even where it started. it took firefighters 30 minutes to knock down the fire. >> still waiting to find out what started a separate apartment fire in san jose. we first told you about this as breaking news yesterday on "today in the bay." that fire happened on the west side near winchester and hamilton. the fire destroyed one unit, water damaged five others. two dozen people were evacuated. power, gas, shut off to the complex for most of the night.

talk about it. peruse your seven-day forecast at the bottom of your screen. 67 in san francisco. later on today, 72 in the north bay. in the south bay today, we'll hit 70. well above average again. cooler than it was yesterday. by two to three degrees. as we get into the afternoon, changes headed our way. want to talk about that. onshore flow, cool ocean breeze for the next six to eight hours. things are going to change. winds turn back offshore and we're going to ramp up wind gusts as well as we head throughout friday. we are watching for a return of those fire winds. keep that in mind. high pressure driving that wind offshore. we'll talk more about this coming up in my next report, and when rain returns a look at mavericks forecast. it's next. mike inouye right now. >> good morning. looking over here to the south. traffic moving smoothly now. full screen, this is north 101, north of 680 where things were

backed up solid a few minutes ago. we'll explain what happened. this is the south bay. this is a gentle build northbound. now slowing at bottom of the screen for 85, shifting over to 87. 280, we've seen blips come down. earlier crash in lanes in north 101 at 880. from the pattern here, they have cleared lanes, chp did arrive a few minutes ago and maybe push those out of the roadway. speeding starting to recover now. backed up 680, traffic start to flow. a slow drive from tully into 880. assisted by the crash and the backup there. tri-valley, typical slowdown for westbound 580 towards dublin. dublin interchange. eastbound, crash reported at airway boulevard. no problems there, it's out of lanes. 84 through livermore, pattern here with slowing around valecitos. smooth drive towards the maze.

a chp officer in less than 24 hours. authorities say two officers opened fire on an armed suspect they say was trying to run away during a traffic stop last night. police dog was also shot but expected to survive. yesterday morning an officer shot and killed a man after a short chase. expecting to learn more about the circumstances surrounding the deadly shooting of a b.a.r.t. police officer. sergeant thomas smith shot and killed by a fellow b.a.r.t. officer during a probation check at an apartment complex in dublin yesterday. a 20-year veteran of the force. governor brown will deliver a state of the date address. he's expected to talk about the budget and drought concerns. syrian government is meeting with the opposition for the first time this morning since the start of the violent conflict. secretary of state kerry and the head of the united nations joined several other countries at conference in switzerland. head of the syrian opposition

says the purpose of the conference is to set up a transitional government. secretary of state kerry says the current syrian president will have no place in a transitional government. >> there is no way, no way possible, in the imagination that the man who has led the brutal response to his own people could regain the legitimacy to govern. >> syria's foreign minister says no one has the right to remove assad from power except syrians themselves. at least 100,000 syrians have reportedly died since the start of the conflict in 2011. a boy among seven people killed in an explosion in northwest pakistan. new video showing the aftermath of the blast which was set off by a bomb tied to a bicycle and detonated by remote control. explosion hit a police patrol car that was on its way to guard a polio vaccination team and

injured and 11 people in a nearby market. it's unclear who is responsible for the blast. the attack is the latest in a surge of violence across pakistan that's killed more than 100 people this month. thousands of people in the philippines evacuated following three days of rain and rapid flooding. a tropical depression sparked the floods and severely damaged public infrastructure. bring bridge broke. several other bridges damaged making hard for vehicles to even cross. fish fish officials think the floods displayed 800,000. the second round of wicked winter weather hitting most of the east coast. bridge id temperatures from georgia to main, mid-atlantic area could see a foot of snow. >> kids of all ages taking advantage of the snow in philadelphia. take a look at that, sledding down the iconic steps of the

philadelphia art museum. the ones made famous in "rocky." more than 13 inches of snow has fallen in the city of brotherly love. >> over on the jersey shore, restaurants and shops closed. the snow not stopping people to going to neighborhoods and can't stop them from going to one bar that stayed open. in fact, some of the bargoers came back outside to take a smoke break. some people decided to walk home instead of finding a cab. >> we'll find that out. the a bit treacherous but i think it's beautiful out. i don't mind doing it. >> life will find a way. snow is also falling in times square in new york city. new york broke three snowfall records yesterday. some parts of the city getting ten inches of snow. >> getting so much of it there. we need a touch here, especially the sierra. >> we really do. we are tracking some significant changes as we get into the next

snow tuesday into wednesday. we have a better opportunity as we transition into the first couple weeks of february. every time i check, it gets better and better. wednesday and thursday, looking good. cold enough overnight for the machine groomed snow to stick around. conditions aren't bad. if you like to ride snowboard parks that's an awesome thing to check out. 37 degrees if concord. 35 in livermore. 40 san jose to start the day. forecast for san francisco, it will be a cooler day here today. 64 degrees. downtown, 69 degrees. ocean side of san francisco upper 50s to low 60s with return of low clouds hugging the coastline. that will be the difference. 72 in the north bay. south bay 70 degrees. 71 along the peninsula. city by city changes really reveal the microclimates across the bay area. today, stay in the 70s in the south bay where we don't get marine influence. cooler in san francisco and along the peninsula. north bay, not a lot of the

marine influence. 73, not a bad day in santa rosa. 67 fremont. 73 pleasanton. the peninsula trend tells the story. we're going to stay unseasonably warm. closer to the weekend. normal 58 degrees. as we head through saturday, sunday temperatures above average. then monday, with return of the storm track to the south, that's when our numbers drop. you'll see here on your futurecast how much closer the storm track is as we head through monday noon, yep, to the north. we'll track that for you. check on your drive mike inouye. >> backup continues to bill. bay bridge toll plaza, metering lights are on. all lanes backed up. a slow drive. at the berkeley curve toward the bay bridge toll plaza. i should say from the straightaway to the toll plaza. east shore freeway, look at the maps, slowing from rich monday down into toward past the other of the golden gate field where we had debris. a traffic break that caused more slowing but that's moving smoothly through berkeley and

emeryville and the approach. it's a wednesday, a typical bill for the 24 approach to the caldecott tunnel and b.a.r.t. system with a five to ten-minute delay out of the west oakland station recovering from earlier equipment problems. north bay southbound 101, a crash, three vehicles involved, some damage to the cars themselves. that was causing a slowdown southbound 101. it looked like from the sensors traffic smooth from san rafael but expect more congestion because of the volume of traffic. smooth drive to and from the area across the richmond/san rafael bridge. peninsula, not a problem. tad bit of slowing develop between san mateo and palo alto auz of the volume traffic build. northbound 101 slowing up toward an earlier crash around 880 that cleared out. seeing traffic run smoothly as well. 87 buildup. froo ti from time to time, a blitz. right around 65 miles per hour.

smoother drive north. but watch for the equipment and flashing lights. over to the tri-valley, smooth drive typical build through dublin and pleasanton. problems with slowing for 680. look at volume of traffic. show you camera here, 580 and dublin. there's the shopping center. smooth drive westbound with the headlights. no major problems, just folks coming out of the altamont pass. 6:21. welcome back, everyone. this morning, a community in upstate new york remembering an 8-year-old boy as a hero. 8-year-old tyler woke up his grandparents in his mobile home sunday night to find a fire had broken out. the boy woke up all nine of his family members sleeping inside to warn them, four adults, two children made it out safely. mismother says, tyler died when he went back inside the burning home to save two other relatives. >> he heard my dad screaming for help and, like, what is going on? what is going on? tyler ran back in and tried to

get him. >> tyler, his grandfather and another relative all died in the fire. it's unclear why so many people were staying inside the mobile home at the time. it appears electrical problem sparked the flames. the search for a motive at purdue university after a student shot and killed a classmate inside the classroom. 23-year-old cody cousins now charged with murder in the death of his fellow engineering student, 21-year-old andrew bol. the shooting happened in a basement classroom, electrical engineering building on campus, west lafayette, indiana. investigators say the suspect did not attempt a mass shooting. they tell us the suspect has started talking after being uncooperative initially. right now, it's unclear if there had been any trouble between the two men before the shooting. new details in the deadly shooting of a tchbltsa officer l.a.x. two armed officers with the police department went on break

moments before the november shooting. officials say the officers did not let the dispatcher know they were leaving. two were outside terminal three when the gunman opened fire with an assault rifle, killing a tsa officer and wounding three others. today a federal court appearance for the three men accused of sparking a wildfire in southern california. all three of the men spent the night in federal custody. they are accused of starting an illegal fire in the dry brush of the angleless national forest. investigators say the fire likely spread when the men used paper to fuel the flames and a federal complaint says the men smoked marijuana as the brushfire flared. the fire destroyed five homes, injured six people. it's almost entirely contained with full containment expected by noon. >> will google buses get a free ride in san francisco? the results of the heated debate there central valley gets a

propose an emergency bill that allows farmers to pump water from the sacramento/san joaquin delta. other parts having the opposite prem problem. a foot of snow in some areas. >> reporter: if you think he's the only guy, no, i saw another person walk by in shorts earlier today. but we can tell you, we've been looking at the airports. i was talking about reagan airport. all over the country, there have been cancellations. over 1300 so far today. >> affected us in the bay area as well. the sun shine's on you, keep warm. that beach that you were talking about, plenty warm. christina, good morning. >> on the opposite end of the spectrum. good morning. and as we start to cool off, we get that storm track back in the bay area, that's when they'll have an opportunity to warm up. we're tracking that through the end, very end of january, into the first week of february. but the morning, it's going to feel like another spring day. starting out with levels that are traditional for the wintertime. 35 degrees now. a few degrees away from freezing in livermore. by this afternoon, we'll climb nicely. difference today is, more of that onshore flow. more low clouds as a result.

you're seeing that in palo alto. we'll check on that drive with mike in a moment. stick around for that. 68 degrees out there 4:00 p.m., down from 70 yesterday. the biggest difference between san francisco and south bay. inner bay and the coast going to see the biggest change today in terms of the cooldown. it's because of the cool ocean breeze. not going to make its way to the tri-valley. we have changes headed our way. wind direction's going to stay onshore for today and tonight. through tomorrow, offshore flow returns. winds move from land to sea. warm up along the way. notice on the key, getting warmer colors, that's substantial wind. we do have high fire danger as a result of that. winds are going to stay offshore for most of the weekend. what we're talking about when it comes to fire concern, north bay mountains, east bay hills, santa cruz mountains, 10 to 15 miles per hour sustained, gusting to 45 miles per hour. targeting late thursday night into friday. now, one thing that the winds are going to help out with,

monster waves. a surfer's dream, mavericks invitational. slight chance for that as of today. much better chance tomorrow and friday's looking good. surf's up, over to you. >> all right! cool! all right. let's take you over here to the south bay where traffic's slow but all right. this is north 101 mckee. reason why there's a slowdown, because where we have a typical congestion point but also the map we've marked a crash that has happened, second crash for the corridor between 680 and 880. both quick to move to the shoulder. but we have slowing developing in the congestion point and that's making things back up approaching. a slow drive off the capital expressway. 87, more volume and slowing from curtner into downtown san jose, 50 miles per hour through the area. that's slow driving in, it feels really slowed. northbound 17. towards saratoga, you have your build. slower drive developing, right

around 60 for that portion. look at fremont, into the area southbound 880 with headlights past the truck scales and mission boulevard. just about 55, 60 at the worst. the map will show you the same. yellow sensors on 680 travel towards mission, as well as 880 with the arrow. slower between the bridges but no problems across the spans. here the volume continues to bill for the castro valley y, 880 or north. approaching the bay bridge toll plaza, congestion around 880 overcrossing toward the backup, toll plaza itself and metering lights. >> thank you. a story we brought you yesterday, san francisco has approved a controversial pilot program allowing silicon valley tech company buses to use muni stops. now, activists, angry about the decisions, blocked several buses yesterday. the buss are provided by companies like dole and facebook to take their employees from

san francisco where they live to silicon valley, where they work. opponents say with all of the tech employees living in the city, rents have skyrocketed. but supporters maintain shuttles keep 35,000 cars off the road and companies are paying the city for the stop. the program will start this sum. >> 6:37. another follow-up. a gun store will be allowed to operate for one more year. the go gatos agreed to a one-year permit but impose financial penalty. it opened in 2012. at the time, it only had to apply for approval once. but last year the town council adopted an ordinance requiring existing gun stores to be reapproved every single year. it's the only gun store in los gatos. >> 6:3. a bill dollar bracket. how predictions could win you a billion dollars courtesy of warren buffett.

"today in the bay's" christie smith live in oakland. investigators says the shooting started with a routine traffic stop? >> reporter: that's exactly right. oakland police tell me they're going to be talking about this. but this is the second fatal officer-involved shooting involving the chp on open city streets in as many days. this started with a routine traffic stop on a toyota suv that happened to have paper plates on it, but 9:00 last night at wentworth near east 14th in east oakland. the driver stopped, they say, but a passenger suddenly jumped out with a gun that was visible to two the two officers and ran. the two chp officers in a marked police canine unit and the police dog went after the suspect. the officers tried to chase them down on foot.

"today in the bay's" bob redell live in dublin at the apartment complex where the officer was shot. good morning. >> reporter: good morning. central part of the investigation into yesterday's shooting here at park sierra apartment complex in dublin will focus why a b.a.r.t. police officer fired his gun in the direction of his colleague, sergeant thomas smith, hitting and killing smith, who was a 20-year veteran of the force. this happened just before 2:00 yesterday afternoon when smith and several b.a.r.t. officers were performing a probation search related to a crime that took place on b.a.r.t. property. they knew their probation suspect was not at home in his unit. but they weren't sure if anyone else was there. the officers suited up in bulletproof vests, drew weapons and kicked down the door. >> made entry into the apartment and it was during that subsequent search that one officer fired his weapon which fatally struck another officer inside of the apartment.

>> reporter: it's believed that shot entered into the area of smith's armpit, an area not protected by his bulletproof vest, an area exposed because, remember, he, too, had his arms extended with weapons drawn. smith was rushed to eden medical center where he was pronounced dead. several deputies and officers saluted his flag-draped body as it was escorted out of the hospital for the trip to the coroner's office. later officers formed a circle and prayed for smith and his family. smith was 42 years old, lived in san ramon with his 6-year-old daughter and wife, who is also an officer with the b.a.r.t. police department. smith is the first officer to die in the line of duty with that department. as for the officer who shot smith, b.a.r.t. police have not identified him, only to say he's been with the department for ten years. he, along with the other officers on the search, were interviewed at the dublin police department. the alameda county sheriff's
