area hero again. >> we're watching 32 degrees in the north bay in santa rosa, yet high fire danger. the full forecast coming up. >> we're looking here trying to sort through the commute, 580 getting busy in the tri-valley. we have an issue through the castro valley. >> a live look outside at the bay bridge. today is thursday, january 23 and this is "today in the bay." >> a very good morning to you. thanks for joining us. i'm laura garcia-cannon. >> and i'm scott mcgrew. it is a tough morning to say the very least for one east bay family trying to figure out how their loved one, an 11-year-old boy, ended up dead. officials found the boy shot to death around 7:00 last night, 1300 block of yosemite circle in oakley near antioch. bob redell is live in oakley.

officials think this was probably an accident. >> reporter: yes. emphasis on probably. the oakley police department has not said definitively that this was an accidental shooting using the words that it is possibly an accidental shooting. it appears that's what happened. around 7:00 last night the police and paramedics called to a house in the neighborhood of behind me here in oakley, neighbors gathered outside to figure out what was going on. when the authorities arrived they found an 11-year-old boy suffering from a gunshot wound. it was so severe he never survived the trip to the hospital. police have not said if any adults were home at the time or how the shooting occurred or how this child got his hands on the gun. all they would tell us he was 11 and appears to be an accidental shooting that left him dead.

>> bob, thank you much. >> a single mother from vallejo seems to have a chronic case of being in the right place at the right time. she was on interstate 80 yesterday when she saw two cars crash, one flip on its roof. williams jumped out of her car, ran to the scene and pulled an injured woman from the smoking car. she had practice. this is the second time she saved someone. in 2011 she was on 101 when she saw a big rig crash. she pulled that driver out and away from the burning wreckage. i remember that one. >> that was a big one. the science building is going to be closed for the rest of the semester. accord ago the chronicle a recent inspection uncovered uncontained mercury, lead paint and asbestos dust in the building. the building is used by 2500 students and staff members. >> the flu is not discriminating, 28 people died in the bay area.

we have a map that shows you which counties hit the hardest. several counties reported more deaths and officials expect the number of flu cases to rise as it continues for the next few months. young and middle age adults are most at risk. everyone over 6 months old should get flu shot. >> our warm weather has people dealing with an increase in allergy patients normally suffering in the spring but feeling the symptoms now. warm weather and the lack of rain is to blame. without the rain an increase in the particulate matter and the plants are producing more pollen. >> i'm pretty good but i'm worried there are so many blossoms f we have the need how it's going to change. you should be planting bare root roses right now. >> the trees like the rest of us confused by the weather.

seeing early blooms. you can get nasty cold snaps in february and march and typical winter, so the pollen count, moderate to high. that is unusual. normally you don't see that. air quality forecast today in the moderate range for the north bay, peninsula to the south bay for smoke pollution. off shore winds, air pollution not bad in terms of smoke particles. 30s and 40s, it may seem strange, talking 30s and a chance of a read lag warning. it has been so dry even in january you get a dose of offshore winds and then the north bay through 3:00 red flag warning above 1,000 feet. humidity in the teens, and really, we should be talking about 10 to 20 inches of rain in the north bay. we've seen less than 3 or 4

matches back to spring of last year. it continues to be a problem. you see as the low tracks off shore it wit try to kick off an isolated shower but that's about it. in terms of potential rainfall. today upper 60s, close to 70, peninsula mid to upper 60s, san francisco in the upper 60s and in the north bay watching out for the dry gusty winds, santa rosa 70, low 70s around the tri-valley. our temperatures could be in mid-70s by the middle of next week. >> i don't want to hear anyone complaining about anything weather wise. we're looking toward oakland where travel flows nicely. let's show you the area on the maps. here is 880 on the maps, on a smooth drive as well as 580 both directions. southbound 880 off the curve south of the bay bridge we have

slowing, this happened yesterday as well. this is about the time a road crew is starting to clear from downtown. this is more severe than we see but we saw this heading to 980. should last about 10 minutes by the time you react it will be clearing. we're looking here toward mission boulevard. route 185 at rose street. that's sort of hayward, castro valley. hayward in the area, there is a power pole hit. it's local traffic rerouted a couple of blocks. it's off foothill boulevard. we'll track it. it will be there all morning. san mateo bridge we'll look at the san mateo bridge and 92 moves smoothly. it's okay, no drama on the span. back to you from this map over to you guys. there is a live shot. >> no drama. back to you. >> giving a different perspective there. the fuel out over the government secret spying programs continues. the recommendation on how the

national security agency does business and the man in the middle edward snowden, will be speaking out for the first time since he leaked classified documents. peggy bunker joins us live with more. >> good morning to you. since last summer edward snowden has been in exile in russia after releasing top secret u.s. government documents about nsa surveillance programs. snowden is holding a live chat to offer his perspective. here is the site. it will happen at noon pacific time, it is www.freesnowden.is, people who want questions for snowed tune answer can do so via twitter with #ask snowden. some call him a national hero for exposing the surveillance programs that had everyday person americans in the crosshairs. others say it's put american troops in danger and given aid to terrorists.

>> it's our firm position he ought to return to the united states and face the charges against him. >> recently support for snowden has grown with major media sources such as "the new york times" calling for immunity, "time" called him the runner up for person of the year and there is no denying that his revelations have initiated change. >> by focusing on facts and specifics rather than speculation and hip theticals. this review process has given me and hopefully the american people for change. >> about an hour prior to snowden's web cast, sweeping changes being made on now the nsa does business so. a lot of change coming up. one of the key changes to be announced is that the nsa will be required to stop collecting american's phone record the data on that.

that will take place just an hour from edward snowden. >> thanks so much. >> new information pop singer justin bieber under arrest this morning for dui and dragracing in miami. officers saw two cars racing. the two vehicles had been used to block off an area for the drag race, bieber who was driving a yellow lem bor keeny, the other in the red ferrari. bieber failed a sobriety test. he was taken to the police station for a breathle icer processing. he is expected to be taken to jail soon. we'll bring you updates throughout the morning. >> oh, biebs. still ahead a possible policy change in response to the deadly shooting of a tsa agent. >> dramatic video out of the you crane. we'll tell what you is smarking

a very good thursday morning to you. what a beautiful live look outside at the bay bridge this morning. pretty clear out there. you can see the cars moving across the span. we're goi ing to check that commute coming up. >> a plan to build a new jail in downtown san francisco heads to the board of supervisors. the $290 million jail would replace aging facilities at the top floor of the hall of justice. supporter sas the change is needed because the old jail is not seismically safe. others oppose the idea saying money should be spent on programs to reduce the jail population. today's meeting begins at 1:00 this afternoon at city hall. >> new information on sales of existing homes due out today.

the national association of realtors set to release its report for the month of december. the report coming off two straight months of a drop in sales of single family homes, condos and town houses. in the bay area data quick reported last month's number of home sales dropped to the lowest in six years that drove the median sail price up more than 21%. keep in mind, the drop may be due to a lack of available homes for sale, as opposed to a lack of buyers. netflix considering changes to better serve its customers. for that and the rest of the news before the bell, hampton pearson is live at cnbc's washington bureau. good morning. >> how you doing, scott. we start with market futures, lower after a mixed day for the markets. the dow dragged down by ibm's earnings but the nasdaq closed at levels not seen since july 2000. there will be data on

unemployment and existing home sales plus earnings from mcdonald's, southwest airlines, microsoft and starbucks. the dow falling 41 points to close at 16373, the nasdaq up 17 closing at 4243. the treasury secretary is warning he will run out emergency measures to help avoid a possible default in february unless lawmakers raise the debt ceiling. when congress struck the deal back in october they suspended the debt ceiling or the borrow are limit. lew says a late start to filing will likely increase the number of refunds. the treasury will have less cash to pay the nation's bills. netflix is toying with changes to its streaming video service. it's considering a plan for $12 a month to let four people in the household stream movies and tv shows at the same time.

not so good if you are not prepared. we'll see up to 15 feet building to 20 to 30 come tomorrow. at the same time we're seeing this dry area of low pressure dropping in from the north, so fire danger high where you see the off shore winds. those will be some of the east bay and north bay hill tops. the combination of the dry winds, low humidity and lack of rain causing problems. speaking of the lack of rain, the lows that go from east to west, they don't have a lot of moisture. we may see more coastal fog and mist into tomorrow morning. then the sierra may be an isolated shower or two. this low acting as a wind machine than a chance of seeing any rain. highs around san jose upper 60s, closer to 70. san francisco mid-60s as the winds start to pick up out of

the south may see subtle cooling. seeing that at the beginning of the seven-day forecast. next week the numbers coming up as high pressure builds in. for the north bay highs, 72 degrees and the rend as we get into the weekend we see them dip, up to the 70s through the weekend. should be in the 50s and low 60s. not only are we not seeing the rainfall, high temperatures almost 10 to 15 degrees above  average. other than maybe coastal fog which could slow things down on the commute along the coast. >> you come across that fog, the lower visibility. low ter speeds and do not use high beams. a smooth drive along the coast and the peninsula, 280 and 101. and not this morning. down to the south bay where those crews, that interchange

area so they try to get in as much as they can. northbound routes moving smoo smoothly. clear until chp lets us know. you had quite a few minutes. we're looking at westbound. just do the volume. it's eastbound as el charo. i'm going to track this tri-valley. we're watching this all morning. this is brent food boulevard. you're watching because there was a pole that was hit. use walnut. it's not affecting the highway. so it does affect local traffic. folks will be able to make that reroute. a couple extra minutes. we have another closure, this is state route 185 at rose street in hayward, that's the address

for a lot of the restaurants and stereo shops in the area. that's where there is a power line down so that intersection closed as well. hopefully open by most of you, it's a clear and not a problem. toward the approach, how things are stacking up. a light flow off the berkeley curve. smooth across into san francisco and the north bay. southbound route a few cars for 101 but no delays, all the way in through san rafael. >> a judge could decide to limit the use of immigrants who appear for judges. the hearings will be in a san francisco federal courtroom today. immigration enforcement is agreeing to avoid shackling immigrants unless there is a safety threat. they will be shackled at brief hearings.

the aclu says the agreement applies only to the san francisco court which seevs more than 2,000 a year. >> we have inevidence of fires that continue to burn in ukraine. at least two died. protesters burned barricades demanding their president call early elections within 24 hours or face more street violence. the demonstrations in deeverybody began in november after the decision not to sign a deal. if day two of peace talks in syria. they meet separately with a u.n. negotiator. the hope is to bring an end to syr syria's civil war. both sides still far apart but show a willingness to bend on local cease-fires and delivery

of humanitarian aid. the negotiator will determine if there is enough common kbround to talk directly since 2011. >> in response to a deadly shooting of an agent the administration is considering a policy change. the change would let tsa screeners carry cell phones so they can call for help. right now no cell phones are allowed. yesterday we learned two armed officers with the los angeles airport police department actually went on a break moments before the november mooting without detting a distacher know. >> a penalty flag for the raiders. why a raiderest says the team owes her and others tens of thousands.

you are looking at live pictures of palo alto this morning. we'll check in with mike in a minute. a woman who used to cheer for the raiders getting a win on the field hopes to lose in court though. lacy t in court documents she is suing the raiders alleging the team is in flagrant violation of california's wage and employment laws. the first year raiderett says her fellow cheerleaders receive about $5 an hour. she says they are not being compensate forward rehearsal times and other expenses like hair and makeup. >> if nothing else we deserve minimum wage for every hour worked and for out-of-pocket expenses and paid in a timely manner so that is what comes out of this then it was 100% worth it. >> not paying somebody until the end of the season blatantly

coastal fog, though, will slow your commute at times and you see temperatures toward the tri-valley close to 70 degrees. >> while we have that going on here we'll take the roadway where we have what we have an issue. i found with it the camera, eastbound 580. you see a big rig and a car off on the shoulder. not a problem, out of lanes. the arrow marks the slower drive, westbound through the tri-valley. 84 showing a typical build. not so bad and you should see more cars on the road. highway 24 moves over to the caldecott tunnel and the bay bridge approach is nice. southbound 880 had slowing as crews cleared the area, we saw all of that start to clear and we're back at the limit down into downtown oakland. one more, there is fremont.

>> good morning. thank you for joining us. i'm scott mcgrew. >> i'm laura garcia-cannon. it's a very tough morning to say the least for one east bay family. they are trying to figure out how their loved one, an 11-year-old boy, ended up dead. officials found the boy shot to death about 7:00 last night in the 1300 block of yosemite circle in oakley near antioch. bob redell live in oakley this morning. officials say it was an apparent accidental shooting? >> reporter: oakley p.d. saying it was possibly an accidental shooting that this boy somehow got his hands on a gun and accidentally shot himself. this happened around 7:00 last night. this is at a home on the 1300 block of yosemite circle in the neighborhood behind me. you can see in the video it's got a lot of attention from neighbors trying to figure out what happened and tragically what happened is when police

arrived and the paramedics arrived they found this boy suffering from a gunshot wound. it was so severe that he didn't even survive the trip to the hospital. they pronounced him dead on the scene. police have not said if adults were home or how the child got his hands on the gun. they have not released the name of the boy only to say he was 11 and that he did die possibly from an accidental shooting. live in oakley, bob redell, "today in the bay." >> thank you, bob. >> 42-year-old bart officer killed by one of his own in the line of duty is being remembered as a serious civil servant, husband and father. an independent police auditor promises a report soon. flags fly where smith lived with his wife also a member of the b.a.r.t. police department and their 6-year-old daughter. officials say smith, six other

b.a.r.t. officers and a sheriff's deputy went to a dublin apartment belonging to 20-year-old john henry lee tuesday afternoon. they knew he was in custody, they went to the apartment to recover items stolen at the fruitvale station last week. a sheriff's department says the apartment door was unlocked. that could have raised tensions f. your door is unlocked it usually means somebody was there. i'm sure that was in their mind. >> they went win guns drawn. sources identified the officer as michael mays, a 13-year veteran of the department. it's clear what led mays to fire his gun. smith and mays were partners for years. in california history 35 officers have been killed by accidental gun fire, 13 of those the victim was shot by a fellow officer -- we'll continue to cover this. stay with nbc bay area news. we'll cover this on the air, on

phone records. that will take place one hour before snowden. >> thanks, peggy. >> prosecutors expect the teen charged with setting another teenager's skirt on fire to enter a plea. they charged 16-year-old richard thomas with a hate crime enhancement. a judge denied a motion to move it back to juvenile court. thomas admitted to setting sasha fleischman's skirt on fire. thomas says it was just a prank. he identified this agent. >> the teen convicted of shooting into a pickup truck carrying his love interest and her friend, 19-year-old max wade was found guilty of trying to kill a man riding in the truck with eva. his attorney calls it young love gone wrong. in 2011 wade tried to wow her

with a stolen lamborghini. wade 17 at the time of the crime. >> rob rob is in for christina. >> we're watching in the north bay and on the coast. fire danger unusually high for this time of year. we've got 30s and 40s, still need a jacket as you step out especially 41 in san jose. 30s around the north bay, down to 32 in santa rosa, no wind, dry air, clear skies so it can start off chilly. a little around concord. heading to half moon bay, some fog and we're watching that high surf building into tonight. we'll see wave heights generally teen 15 foot. higher out to mavericks tomorrow morning. temperatures on the coast in the 60s. we have high fire danger because

instead of an area of low pressure coming off the ocean we have one dropping down over land. this is going to give us winds, will tops above 1,000 feet till 3:00 in the afternoon. so unlike a low that moves over the ocean this is going to go in reverse from the sierra out to the sea as we go through the next 24 hours. it's going to bring up coastal fog. and we might see enough moisture pull up out of southern california may abstray shower around the sierra south of lake tahoe into tomorrow afternoon. but the main effect may be slight cooling. you see in the seven-day forecast. highs around the south bay upper 60s to near 70. we'll probably see a patch or two of low clouds. san francisco in the upper 60s. dry and breezy in the north bay.

watching for fire danger today. close to a record, and the tri-valley seeing the low 70s and those could be as warm as the mid to upper 70s by the time we reach the middle of next week. here is a check of your morning commute. >> call it a juneuary. past the coliseum picking up the volume. close to the speed limit. a couple things going on. the area of oakland over the tube has no delays with the closure so you are open again from the island back to downtown oakland. southbound 880 reports after crash there a. big rig is blocking lanes so use davis before you get or if you don't realize you use washington. northbound shows -- a little bit of slowing.

go because there may be trouble. the europeans say this has come around, they don't think it's credible. the u.s. says it wasn't specific. they are not overly concerned about it but it comes after the hunt for the four so called black widows who may have been possible terror suspects trying to plan something. it comes after the bombing so it has raised the concerns about security. the chair of a homeland security committee has been to sochi, he checked out the venues. while there is remarkable security there and unprecedented level there are concerns especially considering the fact it doesn't appear the u.s. and the russians are cooperating on intelligence. >> very interesting. thanks so much. >> a new poll finds less than a third of americans think president obama is an above average commander in chief. the policies that most people think the president is at least

a likable guy, apparently he got a boost from the government shutdown. the president's personal image is up 9 percentage points since october but his figurest fans have become laes than enthusiastic. being an outstanding president has dropped 6%. >> the purdue university student accused of killing a fellow student is scheduled to make his first court appearance. he was arrested after reportedly shooting andrew boldt in the basement of the electrical engineering building. police are not talking about a motive but officials say there was no attempted pass shooting. cousins is being held without bail. >> counselors will be on hand at a preschool to comfort the friends and classmatess of two girls and a woman.

32 in santa rosa. 30s around concord and livermore. 47 in san francisco. one of the things we'll watch little be a relatively dry area of low pressure that's going to give us the winds, red flag warning to 3:00 this afternoon, after that we see a little more of a southerly wind which is going to bring up jog. maybe a slight chance after shower in the high country. we'll see if the mid level moisture tries to approach the mountain. this time of year should see cold fronts instead it's a cutoff low off the coast bringing us fog for some of the coastal areas into tomorrow morning. highs around the bay area, upper 60s to near 70, about 68 in san jose. the peninsula temperaturers, san francisco also in the mid-60s. look out for gusty winds into the afternoon a. high of 70.
