girlfriend's birthday party. it was a smaller or medium size group and pretty much everyone knew each other so that could play a factor in this case for san jose police. but the party was saturday night into early yesterday morning. it was around 1:00 a.m. we're told at a home on suncrest avenue in east san jose when the fight broke out apparently things escalated and everyone moved to the front of the house when this victim, richard fan a 22-year-old student at san jose state, was apparently trying to break up the fight and someone stabbed him several times. he was rushed to a hospital and later died at the hospital. we're told that the person who stabbed fan did not stick around to wait for police. >> try to ask my niece for information about whoever come to the party, tried to get the name. >> reporter: san jose police were outside that home most of the day yesterday collecting

evidence and of course talking to witnesses because there were 20 or 30 people, we're told, at the home. police tried to talk to as many as possible. we're told it was an invite only party so it's likely the person who stabbed fan knew him and his girlfriend. his girlfriend did talk to us yesterday. she was too upset to go on camera. she is hoping that police can figure this out soon. again, we're told that fan was a student at san jose state. we're live here outside police headquarters, chase cain, "today in the bay." >> thank you. a san francisco police officer will be in court to face charges of lewd acts with a 15-year-old in possession of child pornography. an arraignment and bail hearing for richard hastings, he is charged with ten felony counts. police say he had a sexual relationship with a 15-year-old boy between june and august last year. he says the relationship was consensual and the teen misrepresented his age. he is suspended without pay

since his arrest. >> the redwood city man accused of torturing a puppy to death in front of his 4-year-old daughter is expected in court for a preliminary hearing. he has pleaded not guilty to animal cruelty and child endangerment. police say he became angry when the dog fef i kated in the apartment. some of the abuse allegedly occurred in front of the young girl. >> pleasanton police searching for a man they say opened fire in a pub, injuring one person. they don't even know if the person did not know he was shot. police say the shooting happened just before 1:00 yesterday morning at the red coats british pub and restaurant on st. mary street. witnesses say the male suspect was acting strangely, he then pulled out a gun and started firing. one of the shots hit a man in the rear end. he was not seriously injured. officers say the shooter got away before they arrived.

>> a 19-year-old who went to school in the bay area facing charges of possessing a weapon of mass destruction. this morning his former classmates say he was shy and quiet in class. vladislav miftakhov, a russian citizen, graduated last year, and he now attends penn state. police say when officers went to his apartment in pennsylvania on friday looking for an illegal marijuana grow they found a homemade bomb and with exposed fuses and what they describe as bomb making chemicals. they don't say what. vladislav miftakhov reportedly told an officer he was going to blow things up but didn't get specific. a former classmate of the boy told us he was quiet and socially awkward but never seemed damagerous. >> i had to look twice and look back in my year book to make sure this is the same kid. like how is that even possible? >> vladislav miftakhov told investigators he exexperimented

fog from this shot but there is thick patches around the entire bay area. we're still going to hit the upper 60s later on today. these are your highs. 69 in the east bay, 69 in san francisco and 67 in north bay. on the seven-day forecast, scrolling at the bottom of the screen the first three days of the week unseasonably mild, then we bring in the rain and the very cold air trailing behind it. if you want to wear your spring wardrobe the next three days keep it handy but you have to dust off the umbrella and the heavy winter coat. right now let's check your drive. good morning to mike inouye. >> good morning. we're looking to the bay bridge toll plaza which is moving smoothly but look to the top of the screen. just above those, you see a glow. low clouds around the area. the view of the bay bridge looking toward san francisco, you see also more low clouds above the deck of the bay

bridge. we'll show you the maps where it's an issue approaching the san mateo toll plaza. the orange on the map tells us that the index reading both say it will be an issue but also i'm hearing a lot of reports along the peninsula 101 through palo alto, tough visibility. i'll show you the camera shot a little later. san jose, an easy drive in the northbound direction. we saw low clouds and we'll again show you how this is affecting the maps and of course tied together with the weather. back to you. >> google apparently working on plans to expand its ferry service for employees. the mountain view voice reports the company has received such good response to its experimental ferry it's now planning a similar run from alameda. the service would start near the

end of this year if both work out google could buy its own ferries to increase service. >> san 0 say work on a deal. the sharks are on a short list to host one of the future sites. possible locations for the outdoor hockey game would be levi stadium, at&t park or stanford stadium. it's far from a done deal, the league did pull out a game on saturday even though it was 62 degrees. this year the nhl has planned six outdoor game, hoping to have nix more text year. >> i grew up in wisconsin we used to play on the pond. it's not same as l.a., google making a big purchase as it continues to explore artificial intelligence. >> plus, new efforts to change the labels on the food you buy. what the federal government is talking about doing.

>> good morning. rayovac recalling 25,000 flashlights because they can over heat and melt. it covers led industrial flashlights, value blue led and value bright flashlights. these were sold between february of 2012 and last month. on line and in stores. a plan to build a new netflix headquarters will be put before the voters. the registrar says the town has enough signatures to put this issue on the june ballot. voters are going to be asked to change the city's general plan to allow rezoning so netflix can build the headquarters on all bright way. the council will discuss the issue at its meeting next week. >> google continues its expanded

reach into artificial intelligence. overnight we learned the company purchased a uk startup called deep mind for 242 million pounds, that's about $400 million american. deep mind specializes in algorithms and machine learning for e-commerce and games. you remember earlier this year google bought the military robot makers boston dynamics. keep an eye on cupertino's apple. it releases earnings after the bell. holiday sales could set records for the third consecutive year. iphone sales topping 50 million for the first time in company history. if the news is that good, investor carl icahn will likely increase his demand that apple do something with its big pile of cash. >> for a look at the rest of the market let's turn to bertha coombs. good morning. >> good morning, scott.

caterpillar, reporting better than expected earnings, annou e announcing a $10 billion stock buyback. we're now looking at what looks like a higher open, seeing better trading for france, that is good news for the bulls after a sell-off when the dow fell more than 300 points, losing 3.5% for the week. invest terse watching emerging markets closely, though, currency crisis that helped fuel that sell-off last week continues to be one of the main things people will be watching. sam's club says it is letting go of about 2300 workers or 2% of its workforce. the subsidiary of walmart says a little less than half of the cuts after salary assistant managers and some hourly workers. normally this time of year you get some of the people hired for the holidays, hired full time, but after disappointing sales, could see more pink slips. >> thank you much.

quarter mile. so thanks for waking up with us. you want to hit the roads so you can get your family and you to work safely. temperatures looking good. 48 along the peninsula. 50 degrees to start the day, good morning in the east bay. 41 in the north bay headed to a comfortable afternoon but you will notice the microclimates making an appearance. dense fog returns to the area. microclimates see great temperature separation. it's going to clear the inland valleys and linger around the coast and the peninsula until about noon. by lunch time widespread clearing and temperatures are going to be on the rise. 67 degrees today in the south bay. 66 gilroy, 66 degrees in los gatos and 66 in san jose. the peninsula mild, mid-60s, same for san francisco. probably need a sweater there for the first part of the day. a gorgeous day shaping up especially in the north bay and the tri-valley. temperatures in napa around 69 degree, and in the other wine country of the bay area through

livermore about 69 degrees. in the middle we have the east bay. the the lingering fog will keep temperatures down to 61 in oakland and 64 on the way to fremont. rain on the way. we stop the clock wednesday night and you can see that deep rich moisture is starting to move into santa rosa. this is going to be a warmer system. we're not going to see a lot of snowfall immediately in tahoe, have to wait for that. snow levels are going to start at 7,000 feet. we could be talking an inch, maybe an inch and a half of rainfall. wait till you show you the rainfall amounts we are expecting. some are going to get quite a bit. i'll show you that in the next report. let's check your drive. good morning. >> welcome back. and you know what, the rain as

long as it adds to the total that's what i care about the most. the roadways moving smoothly. we'll find slowing because of watches of fog. no problem now at the dublin interchange. a subtle build for 580. we see slowing for 84. they have cleared the road through livermore out of pleasanton. starting to back up here. a typical pattern for the tri-valley. across the bay we had thick dense fog around the hayward side. we get that data it translates to the roadway conditions. we had the clearing. i have slowing north of menlo park to belmont, there is some dense fog at times through the area. also the orange here filling in the south bay. shows you where you have dense patches of fog based on the weather data. it shows a smooth drive now northbound and southbound all green. you are close to the estimate

there. a look at fremont we have a crash. tough to feature the same area. this is an issue. palo alto, a similar situation on the peninsula side. tough to see you. >> thank you. 5:18. jury section for the ex-mayor of new orleans gets under way. ray nagin accused of bribery and fraud charges. prosecutors say he took more than $200,000 in bribes and accepted free trips. he led to 210 all the way through hurricane katrina and the rebuilding process. >> the labels on food could soon look different. the fda has new kbls. one of the proposed changes is making the number of calories more prominent and using more teaspoon measurements.

among the athletes five time olympic medalist bode miller. the 36-year-old is the first alpine skier to make five olympic teams and will be the oldest alpine skier to compete in the olympics. other names, 2006 gold medalist julie mancuso. also on the team, the 18-year-old reigning world champion in slalom and a favorite to win the gold. with lindsey vonn out she is expected to be the u.s. team's headliner in russia. snowboarder sean white is ready despite a shiner. white posted this yesterday the caption still in the fight for sochi. white is also nursing an injured left ankle sprained last month. he is 110% healthy for the

>> i'm laura garcia-cannon. a 19-year-old college student who went to school in the peninsula facing charges of possessing a weapon of mass destruction. christie smith joins us live in belmont where the suspect once lived. >> reporter: good morning to you. that's right. the 19-year-old graduated from carl mont high school up the hill from here last year and now he is facing serious charges. this started when police came to his apartment near penn state. initially they were looking for evidence of an illegal marijuana grow operation, but what they found was totally different. vladislav miftakhov is now facing a number of charges including possessing a weapon of mass destruction. but he didn't appear to be hiding as he didn't object when officers came to his apartment in altoona. the russian national let them in and investigators say that what they found was quite shocking. they say they found evidence of a homemade bomb with an exposed fuse and other chemicals he

allegedly bought on line. those reportedly include potassium percolate and sodium nitrate. he reportedly told police he was going to blow things up but he didn't say what it was or why. one former classmate here in the bay area told us he seemed a little awkward and quiet but not dangerous. >> i just had to look twice and look back in my year book, make sure this is the same kid like how is that even possible? >> reporter: according to the complaint, vladislav miftakhov later said he had only intended to set the devices off in a field. a woman at his home in san carlos identified as a mom said that she will go to pennsylvania as he faces criminal charges but one legal expert tells us because he is not a u.s. citizen he could be deported if he is convicted, he is due in court on february 5. reporting live in belmont, christie smith, "today in the bay." >> thank you very much.

>> san jose student stabbed while celebrating his girlfriend's birthday. the person who did it nowhere to be found. the stabbing happened yesterday morning on a home on sun crest avenue. chase cain live in san jose. investigators think this started with a fight. >> reporter: scott, they do. what started that fight that is still a question for police as is the whereabouts of the person responsible, although this was a party that was invite only so essentially everyone knew each other. the party started saturday night and went into yesterday morning. san jose were at the home most of the day yesterday collecting evidence and talking to people at the party. we're told there were 20 or 30 people at this 21st birthday party for the victim's girlfriend. the victim is richard fan, 22, he was a physicology student.

we did talk to a relative how fan got involved and then ended up getting stabbed. >> around 1:00, some of the girls get into competition, so my brother tried to break up the party. after he leave he try to be a peacemaker, tried to break up the fight. and somehow he got stabbed. >> the 22-year-old was rushed to the hospital but doctors were not able to save him. he did die at the hospital about an hour later. so police are trying to figure out who is responsible. obviously they had to talk to a lot of people. this is the fourth homicide of the year. the girlfriend was very upset but as you can imagine she is also hoping for an arrest in this case. live at san jose police

headquarters, chase cain, "today in the bay." >> thank you. >> 5:33 t teen girl who was hit and killed by a vta train will be laid to rest. danica was riding her bike to a choir performance when she was hit. the teenager was honored yesterday and her family will take part 18 burial procession today. she leaves her parents and a brother in the fifth grade. >> san jose 8 police providing security escorts after two assaults. police say a man rode his bike behind the victims and touched them inappropriately. the suspect who was last seen riding toward the campus village apartments is described as a white man about 20 to 30 years old, with a thick mustache and wearing a black hoody and pants. the victims were not hurt. police urging students not to walk alone at night. >> spring semester starts at san francisco state thufrt morning

but one building will be closed off to students. high levels of mercury, lead, paint and asbestos dust were found in one of the science buildings. the university must find space for more than 2500 students, faculty and staff that use that building during the school year. the chronicle reports the university is working with health and safety efforts to understand what needs to be done to make the building safe. >> it's 5:35. let's take a live look outside this morning from the south bay. it's a little foggy out there in san jose. you know what, later this week we could be packing that umbrella. you got to find it to get out of the closet or threat rain do that. >> that big heavy coat as well you've been able to ditch. as of today you probably need a light sweater. the fog is back. the first of the changes this week. remember, if you want to get a peek at where we're headed, plan

that wardrobe. your seven-day forecast is there at the bottom of the screen. it shows you much cooler as we dip into thursday. a quarter mile visibility in san to rosa, a half mile in a. because your city is reporting 9 to 10 miles doesn't mean you're not going to encounter the fog on the way to work. give yourself extra time. try to eliminate those. we're going to get an update in a moment. a quarter mile visibility. we're at 10 in livermore. a nice sunny start. we head throughout the next couple hours, 50 in oakland, 50 in san francisco with the nice blanket. you can see what happens where you lack that blanket of low clouds. you're at 41 in livermore versus 50 in san francisco. here's where we're headed. right now san jose at 47, we'll see a mix of sun and clouds by lunch time. then ditch your jacket at 4:00. still running 5 to 8 degrees

above average across the board except for in san francisco. 61 degree there is for today. average is 57 so a touch above for today. 67 degrees in the north bay. looking good in the south bay, temperatures really looking good for the first three days of the week. we drop like a rock. this is what we're counting on throughout wednesday into thursday. look at this. let me put things into perspective. showers are going to start late wednesday and the whole bay area is expecting action on thursday. before we even get into thursday beyond 2 a.m., over a half inch of rainfall in the north bay. that's a good looking total. throughout thursday, we're going to see these come way up. we could pick up a quarter inch in the south bay, which is a high for any storm system. first here is mike inouye. >> so we're looking for the rain. right now we have this glow.

>> congress gets back to work 20 one day after president obama gives his address. the debt deadline is creeping up. tracie potts on capitol hill where the hard work begins. hopefully they are at it. >> reporter: they have been, the farm bill could see a compromise today with a vote as early as wednesday. immigration which has been on the back burner may pop up in the president's speech tomorrow, but more pressing now is the debt ceiling we're about to hit again next friday. the president's speech he is likely to urge congress to raise that debt ceiling so america won't experience an historic default. the other issue they need to

deal with unemployment insurance that ran out at the beginning of the year for millions, bot sides say they want to reinstate those benefits, the question is are they going to insist on cuts to do that. there are numbers issues that have come up, the minimum wage for example that the president may talk about tomorrow. but we may or may not see quick action on capitol hill. sometimes we get a sense of what the president's going to emphasize based on who is attending the speech. just this morning we got an update who is in the first lady's box, including some of the victims from the boston marathon, and the d.c. teacher of the year. >> always interesting to hear. thanks so much. >> an unusual winter weather pattern is driving air from the arctic circle south leaving a large portion of the nation in yet a deep freeze. wendy is live in chicago where public schools are closed and buses barely running because of the extreme wind chill. good morning, wendy.

>> reporter: good morning, scott. don't let the sun deceive you, this is the fourth arctic blast of the season and it's supposed to be the worst one yet. >> oh, man it's terrible. this is pretty rough. >> reporter: much of the nation hasn't thawed from the first arctic freeze and now we're bracing for another. >> it's an utter mess. the roads are completely covered in snow. >> reporter: from ohio to new york, snow and ice have blanketed the region causing treacherous conditions and accidents on roadways. in buffalo, the wind even overpowered this 18-wheeler and challenged crews trying to help. >> the wind chill is terrible. the wind is bad so we got to watch the empty trailer doesn't get blown over too. >> reporter: whether people choose to brave the elements or they have to to get the job done, time outdoors in these frigid temperatures must be

the 60s, the gap there is extraordinary. 80-degree difference in some cases. >> we're talking near-record warmth here and record lows there. the earth is always trying to come to equa librium. just like man and wife. it's chilly. our ridge of high pressure is going to head that way so we're trading off scenarios. we'll get the cold and the rain where they are going to get our warmth. they are looking forward to it. 48 in palo alto, you can see the visibility crept up. 15, 20 minutes ago you couldn't see much. we'll be all over this. count on the fact that fog drifts around. you might walk out your door, it's clear, then you hit the highway and you lose visibility. take it easy. the thickest fog along the

peninsula. 67 in the north bay. the forecast shows you it's going to be mild for the first three days of the week, then those drop off and we bring in much, much-needed rain. i can tell you i'm always looking 15 days out. all the way through february 14, valentine's day, don't you forget it, we're pretty active. valentine's day coincides with president's day. you get a three-day weekend and a full moon. dense fog returns to the bay area, that's the story of the day. clearing by about 10:00 a.m. the weather story i want to focus on is what's on everybody's mind. when is the rain arriving and how much are we going to get. here is a great om, we're seeing a deep system digging to the south. this is going to come over the bay area. we're seeing pretty big changes.
