san jose police looking for the person they say stab add san jose state student to death in front of his girlfriend. it happened around 1:30 yesterday morning at a home on sun crest avenue near piedmont high school. chase cain is live in san jose. chase, this happened at a house party? >> reporter: it was the victim's girlfriend's house party. she was turning 21. there was some kind of fight that broke out and that's what eventually led to the death of the 22-year-old san jose student richard fan. the party started saturday night into the early hours of yesterday morning. we're told it was 1:00 or 2:00 when the fight broke out and escalated outside. the san jose police were out at the home most of the day yesterday collecting evidence and talking to people at the party. there were about 20 or 30 people there. most of them knew one another so that should be something that helps the san jose police in their investigation. but a relative tells us that richard fan was actually trying

to break up the fight, trying to be the peacemaker when he was stabbed, rushed to the hospital and later died. but the person who stabbed fan did not stick around. >> he tried to ask my niece for information about whoever come to the party, tried to get the name. >> reporter: san jose police have not made an arrest yet but that could be coming soon because again, all of these people at the party knew one another so that should be a help for detectives. and this is the fourth homicide so far this year in san jose, at this time last year there had been three homicides, so unfortunately that puts us slightly ahead of pace of last year's total of 44 homicides in the city. we're live outside police headquarters, "today in the bay." >> san jose state police providing safety escorts to students after two sexual assaults over the weekend. on saturday night police say a man rode his bike behind each of the victims and touched them

inappropriately. the suspect who was last seen riding toward the campus village apartments described as a white man twrks to 30 years old with a thick mustache. the victims not hurt but some students say they are on edge. >> i usually when it's dark i have it ready. >> i'm more cautious when i come out, i'm always like you want to go with me? i get my friends to walk with me. you never want to walk around out here. scary. >> campus police urging students not to walk alone at night. >> a college student who went to high school on the peninsula facing bomb making charges. 19-year-old vladislav miftakhov was arrested on friday in pennsylvania after police raided his apartment. christie smith joins us live from belmont where the suspect attended high school. good morning.

>> reporter: good morning. vladislav miftakhov graduated from high school here in belmont last year, friends say he was a little socially awkward but didn't seem dangerous. but now he's facing very serious charges. the 19-year-old russiannalnallist accused of possessing a weapon of mass destruction. we spoke with a woman who told us she will go to pennsylvania as he answers to these charges but she didn't elaborate. according to police this started when they wenthis apartment looking for an illegal marijuana grow operation. in addition to the pot they found a suit case containing a homemade bomb, a fuse and other chemicals like potassium percolate and sodium nitrate. he reported hi told an officer his plan was to blow things up.

a former classmate described him this way. >> when we were at classes together he was very shy, very to himself. >> reporter: one legal expert says that because vladislav miftakhov is not a u.s. citizen he could be sent back to russia if convicted and added that because of the apparent lack of federal involvement it's believed this is not likely related to any terrorism. he is currentlying held on $500,000 bail. >> thank you. 6:05. the marin county sheriff's office trying to track down three suspects who tied up a man. the suspects rang the doorbell at a home on friday. the victim says the men asked for a woman. one of the suspects stole cash

and valuables. victim says the suspects tied him up and droked him in a linen closet. he was abe the 0 call 911. >> concerns, several new conservation policies, the board at the water district expected to approve a preliminary water use reduction target of 10% less than what the county used last year. the district will vote on whether to spend half a million to broaden the programs that give rebates to people who install water efficient appliances. >> we are finally going to get some rain, right? >> yes. i can tell you the first half of february looking promising. we're going to get two or three opportunities for rain each week now through then so looking

that point with low clouds. and along the peninsula. that will be the case until about noon. the highs and mid level clouds return so they are going to be back, that mean as mild not, we bring on the rain wednesday. temperatures today are comfortable. enjoy this today, tomorrow and wednesday we're looking unseasonably mild. upper 60s along the peninsula limited sunshine. out in the north bay and the tri-valley where the fog burns off the quickest, approaching 70 degrees. 69 in pleasanton. in the north bay, 65 in sausalito. in the east bay where the fog ligers it's cool.

>> at 6:12, a look at top stories. the search is on for the person police say stabbed a san jose state student to death. trying to break up a fight at a birthday party. happened about 1:30 yesterday morning at a home not far from piedmont high school. friends tell us the victim is richard fan. >> a 19-year-old who graduated from karlsmont high school in belmont facing charges of possessing weapons of mass destruction. police in pennsylvania searching the home of vladislav miftakhov, a russian citizen, looking for an illegal pot grow, instead they found homemade bombs with exposed fuses and what they describe as other bomb making chemicals. >> a mall where two were shot and killed will reopen. darion aguilar shot two

employees of a skate score. he killed himself. the motive is still unknown. >> peace talks between syria's government and its armed opposition will likely become more difficult today. the two sides have been meeting with piece negotiators since last week. today the syrian government and its opposition will talk politics. one of the biggest problems is that nobody can predict how often the two sides can stand to be in the same room together. >> new jersey democrats will pool resources to investigate a growing scandal traffic jam scandal linked to aides and governor chris christie. they will vote to create a joint bipartisan committee look into the abuse of power allegation. the governor has said he was not

involved in this scheme to cut down traffic. it appears christie's deputy chief of staff authorized the plan. she has since been fired. >> we should find out if disgraced former journalist steven glass can practice law. in the 90s he made up parts of 42 articles in several magazines, now he works as a paralegal. he applied to be a lawyer. he did that six years ago and the bar committee opposed that application on moral grounds and its been pending ever since. he has undergone therapy and kept out of trouble. >> this morning most of the midwest heading into another deep freeze. >> frigid from minnesota all the way down to kentucky. chicago is going to be particularly cold. temperatures, yeah, that's right. negative 15. at least with the wind chill.

that's where we find wendy. she is joining us live from navy pier. good morning, wendy. >> reporter: good morning, scott and laura. how are you doing? i can tell you right now i'm pretty cold. this is the fourth arctic blast of the season. it's supposed to be the coldest one yet. we've been out at navy pier since about 2:00 this morning. the temperatures have fallen and the winds picked up. as my photographer will pan out to lake michigan, don't let the sun deceive you. it is a gorgeous sight but let me tell you the temperatures are brutal out here. most of the time the navy peer kem come, walk around but i'm quite certain there won't be many walking around on the navy pier. as beautiful as it looks most will enjoy it from their home. you can never stay out for long

precipitation. take a look. .6 inch in santa rosa. we have the rain expected, the greater bay area a dose of rain through thursday. throughout early thursday, .6 already in the bucket potentially up to an inch of rain. we'll keep you updated. >> the areas expect the heavier rain, look agent that, here i'm looking at westbound out of oakland toward treasure island. reports of a stall closer to the tunnel. the area hasn't seen major problems. look at that, you see the taillights heading into san francisco without major interruption. a stall possibly for the upper deck.

there is the bell. last full week of january. monday, the 27th, this is "today in the bay." >> a very good monday morning to you. thanks for joining us. i'm laura garcia-cannon. >> and i'm scott mcgrew. it's a busy week in washington, tomorrow president obama will outline his goals and priorities for the next few years, in his fifth state of the union address. today congress is scheduled to get back to work, the country hits the debt ceiling again next week and will not be able to pay bills. some republicans insist to raise the ceiling democrats have to give up something. >> of course we should do something, we shouldn't just write a blank check. >> i do not believe that republican leaders will follow ted cruz over the cliff once again. >> lawmakers may actually compromise on unemployment but raising the minimum wage, that could be a tougher fight. also on the agenda the farm bill

and immigration, both of which have previously stalled on capitol hill. >> lawmakers will also consider a bill that would make sure federal funds are not used to pay for abortion. but the bill would allow for some exceptions. tracie potts joins us live in washington, d.c., a divisive bill. how much support does it have on capitol hill, tracie? >> reporter: well, in the house with republicans probably much more than we'll see on the senate side if it even gets that far. this would bar federal funding except for rape, incest and the health of the mother. we learned about it last week. remember the thousands marching through d.c. for the march for life, majority leader eric cantor mentioned they were going to roll it out. they are earned about the new health law requiring insurance companies to pay for abortion inducing drugs. not the first time the house dealt with this. in june they made an attempt to outlaw abortions after 20 weeks. the supreme court which is where

this march went last week also has been dealing with this. challenge to the massachusetts law that established buffer zones around abortion clinics. so lots to talk about this year. it's rolling out across america. we've seen the impact on political races in virginia, in texas, and now coming up also in senate races in north carolina and arkansas. >> we're seeing the debate continue thanks so much. over the weekend the debate over abortion rights took center stage in san francisco. tens of thousands gathered at civic center plaza for an anti-abortion rally before marching down market street. a smaller group of pro choice dem staters gathered. >> let's check our weather this morning. we give you a live look at a foggy foster city. christina loren joins us. it has been low clouds all morning. >> yeah, kind of nice. change is definitely in the air. 6:32, taking it live.

a quarter mile in santa rosa, same for napa. fog is drifting around so you want to travel cautiously. thanks for waking up with us on a monday. we know it can be difficult to get up at this hour but this fog means you don't want to mess around, get throughout with plenty of time so you don't have to rush. with conditions like this a mile and a quarter of visibility in san jose. we progress closer to sun rise the next hour, the fog is going to get worse so keep that in mind. not too cold to start the day, in the 50s in san francisco and oakland 46 in san jose, and i want to take you through your day part forecast for san francisco. about lunch time mostly cloudy, 60 degrees. the clouds keep your temperatures cool. sweater weather to the city by the baxt 61 degrees at 4:00 p.m. in san francisco. microclimates show you temperatures are going to climb into you the upper 60s in the north bay, 67 for you, in the east bay, 67 degrees today in the south bay. so this really tells the story,

the five-day spread for san jose in san francisco reveals the changes headed our way. today all of that fog keeps your temperatures about 5 degrees away so make sure you have the sweater ready in san francisco, you can ditch it by the time you get back to san jose. 66 on tuesday, temperatures level off with more clouds coming in, we're going to get showers first on wednesday in san francisco, then they make their way into the south bay on thursday and another round early friday morning so how much are we expecting? i'll show you in my next report. let's check your drive. >> we're going to hold on this for a second. e-mail here from the emergency system talking about there is a traffic collision at san carlos avenue. near the performing arts center. pg&e warning there may be folks affected by that power outage. we'll watch that and see how much further we get from pg&e coming up. traffic flow on the freeways for the peninsula are moving pretty smoothly. we'll see how things are developing around the bay a.

smooth drive on 101 and 280. the bottom of the screen, first of all the orange overlay across the south bay where dense fog might be an issue. the road weather index, likely a factor. slowing you down for 85 northbound, 87, we also have the build there. 101 not so bad, a little slowing around capitol expressway and north of 680. the tri-valley has been moving, it has been southbound 680 we're seeing heavier traffic. out to sunol we saw early slowing, continuing north from 580 to the area and that's heavier than we typically see. the rest of your east bay, drive to the bay bridge toll plaza, you do have all lanes and the metering lights are on. back to the foot of the maze. we look to the span and the curve reports of a stall, actually a flat tire.

we see traffic moving but slowly starting to build off of that curve. it's affecting the on ramp but might be visible. >> thanks so much. 6:36. san francisco police officer will be in court today to face charges of lewd acts with a 15-year-old and possession of child pornography. a hearing will be held for richard hastings charged with 10 felonies. police say he had a sexual relationship with a 15-year-old boy between june and august last year. hastings says the relationship was consensual and the teen misrepresented his age. he has been suspended without pay since his arrest. >> the redwood city man accused of torturing a pup tee death in front of his 4-year-old daughter is expected in court for a preliminary hearing. allen valete pleaded not guilty to charges.

police say he became angry when the dog defecated in the apartment leading to weeks of torture that included punching and kicking the dog and taping its mouth shut. some of the abuse allegedly occurred in front of the young girl. >> 6:37. still ahead hundreds of people sick to their stomach aboard a cruise ship. we'll tell you what's being done to figure out what caused the illness to strike.

>> at 6:40, it was one year ago today, 242 men and women died when a brazil nightclub caught fire. officials vowed they would never let anything like this happen again but little has been done in the time that passed. the nightclub was overcrowded, the band had an indoor pyrotechnic show. concongressman says he tried to push a national fire safety code through congress but hasn't passed because he says leaders quickly forgot about the deadly fire. >> a battalion chief says two firefighters may have become disoriented before they died battling an apartment fire in toledo, ohio. autopsies on the two firefighters will be done today. one was a 16-year veteran, the other had been on the job for just six months. the firefighters were overtaken

by smoke and fire in the two-story building. everyone else did make it out. >> tests being taken on a ship after hundreds got sick to their stomach. the cdv boarded the ship which is docked in the u.s. virgin islands. it's a royal caribbean ship called "the explorer of the seas." the crew left tuesday. >> coming up a college student trying to break up a fight is stabbed to death. we'll hear from those who knew him as police try to track down the suspect. >> plus, google ferries about to expand the route. today we're going to play a little game.

6:43, a san jose student stabbed to death while celebrating his girlfriend's birthday. the person who did it nowhere to be found this morning. the stabbing happened yesterday morning at a home on suncrest avenue not far from piedmont high school. chase cain live in san jose this morning. investigators think it started with a fight? >> reporter: they do. that fight apparently escalated quickly in the early morning hours yesterday and ended with 22-year-old richard fan dead from several stab wounds. he was a student at san jose state. that party started saturday night and went into the early morning hours yesterday. police were out there most of the day yesterday collecting evidence and talking to witnesses because this was the victim's girlfriend's 21st birthday party. so everyone there apparently knew each other. there were 20 or 30 people there so certainly a number of witnesses for police to talk to. of course that could help them

make an arrest in this case even though there have been no arrests yet. we were able to talk to a relative about exactly how fan got tangled up in this whole thing. >> around 1:00 some of the girls get into some conversation. my brother triedto break up the party. he tried to be the peacemaker. tried to break up the fight and somehow got stabbed. >> reporter: whoever it was that stabbed fan at the party did not stick around for police or paramedics. fan was rushed to the hospital where he died about an hour or so after that stabbing. this is the fourth homicide so far this year in san jose, at the same time last year there had been just three homicides in the city so we're slightly ahead of pace with last year's pace of 44 total homicides in san jose. hopefully police will make an arrest in this one soon.

chase cain, "today in the bay." >> in the east bay police in antioch looking for the gunman who shot a man outside a jack in the box restaurant. police say the 33-year-old victim was shot several times while sitting in this silver van. this happened around 4:00 yesterday on lone tree way about a mile from highway 4. the the man was air lifted to a hospital. we're told he is expected to survive. the reasons behind the shooting are unclear. >> police say this man, 21-year-old jason is now behind bars in current weather conditions a shooting in a pub and restaurant. investigators say he was acting strangely before pulling out a gun and opening fire yesterday. most of the bullets hit the ceiling but one man was wounded. he is expected to be okay. the suspect was booked on charges of assault with a deadly weapon and p possession of methamphetamine. >> state police providing safety escorts to students after two

bay bridge. likely they will drop off. you want to keep that in mind. good looking day shaping up. temperatures climb into the upper 60s in the cities that aren't expecting that. it won't be thick in the tri-valley. you'll hit the upper 60s. in san francisco, so the microclimates making an appearance. you don't have to wait for your seven-day forecast. it's always skroging here at the bottom of your screen. let's get into your forecast. dense fog returns to the bay area, this is the weather story i want to tell you now because as a result you likely need to pull out the sweater but only at the immediate coast and the peninsula. we expect that clearing by about noon today. most of our inland valleys clearly mid morning, then looking good for showers later on this week. let's get into the forecast. as of tomorrow morning, look at this. tuesday at 7:00 a.m., this is what we call prefrontal precipitation. we're not expecting a lot

tomorrow but enough moisture to get highways slick up in the north bay we'll likely be tracking showers tomorrow. then as i widen out you can see the front arrive, as we head throughout wednesday at 11:30. i want to show you this is a very moisture rich system. typically the warm ter system the more precipitation we get out of them. not great news for tahoe, at about 7,000 feet but i stop the clock at 5 p.m. on wednesday, we're getting the oranges, the fellow, that's what we need. our hills are thirsty for rain and boy are we going to get it throughout wednesday at 7:00 p.m. the front starts to drop in. throughout wednesday into thursday, the first part of the action starts. thursday at 3:00 a.m., picking up almost a half inch of rain in santa rosa. .2 inch in napa. decent considering the main event has not arrived.

vladislav miftakhov was arrested on friday in pennsylvania after police raided his apartment there. christie smith joins us from belmont where the suspect once attended school. good morning. >> reporter: good morning to you, scott. vladislav miftakhov is an engineering student at penn state. he graduated from high school here in belmont. he was socially awkward but didn't seem dangerous. now he is facing serious charges including possessing a weapon of mass destruck. when police went to his apartment he let them in. they were looking for an illegal marijuana grow but what they found was much more than pot. they found a suit case that contained a home made bomb, fuse and chemicals like potassium percolate and sodium nitrate. he allegedly bought them on line. friends in belmont say the russian national now 19 was shy
