where he was supposed to be when his parents came to pick him up. christie smith is live at the school in belmont with the latest on the investigation. christie? >> reporter: good morning. it's been almost 12 hours since any one has seen tyler simmons, he is 16 years old but he has autism and what police are saying is that developmentally he is closer to the capacity of an 8-year-old. he was last seen here at ralston middle school. police looked here, also at the high school where he attends. here is a picture from last christmas that his family shared of tyler edward simmons, she 6 feet tall, 140 pounds, he has a thin goatee. a custodian saw him last night around 7:00 p.m. at the middle school and contacted his family. the family came out to look for him. no sign of him, though, and in an hour they called police and the search went on we're told until about 1:00 this morning. there were dogs out looking for him as well. and investigators from the

sheriff's department. tyler simmons is actually a student at carlmont high school where class is dismissed about 3:00 yesterday. normally we're told he would go to the public library, wait for his dad to pick him up about 5:00. this time, though, when his dad came he wasn't there. he was wearing a gray sweater when he was last seen, black jean, a black hat beanie, white shoes and he was carrying an orange back pack, a dell lap top computer and a purple nintendo game system. police don't suspect foul play. he may have left because he got into a disagreement, a dispute with his parents but of course everyone wanting him to return home safely. reporting live in belmont, christie smith, "today in the bay." >> officials want to talk to any one who came in contact with a registered sex offender caught trying to get into a bay area school. 42-year-old theodore lorigo has

been dressing as a woman but on the day he showed up at the hebrew day school, officials say he looked more like a man. the head master says lorigo said he was interested in the school for his kids but prospective families make appointments in advance. it raised red flags. he was asked to leave. >> once he was confronted by the senior leaders of the school he left on his own. i think that's what people like this do, look for the weak link so he didn't find that wisconsin and i think that's why he went away so quickly. >> according to the megan's law website lorigo has been a registered sex offender since 2001 after kidnapping a child under 14. after a month-long investigation he was arrested for being a registered sex offender on school proxt >> the b.a.r.t. officer shot and killed by a fellow officer will be remembered today. b.a.r.t. officials say sergeant tom smith was accidentally shot by another officer while

searching an apartment in dublin. the public is invited to pay its respects for sergeant smith tonight. a funeral will be held tomorrow at 10:00 at the neighborhood church of castro valley. santa clara valley water customers could soon be asked to cut back on water use. the district's reservoir -- bob redell joins us from the lexington reservoir with a look at how the low water levels, how low they are across the bay area. good morning. >> reporter: good morning to you. santa clara valley water district should be noted can't force its water customers in the south bay to cut back on water use but they can certainly ask and that's what the board of directors is expected to do tonight at its meeting. one of the reasons is because the water levels in the reservoirs are so low. i know you can't see behind me but the lexington reservoir is

at 30% capacity. take a look that the video. looking at the cracked, pashched ground of the almaden reservoir. that is at just 3% of capacity. the district wasn't going to consider this reduction until spring but because there has been so little rain they decided to move it up tonight. the board expected to ask customers to cut back by 10%. which is on the low side. when you consider that other bay area water districts and the governor are requesting 20%. >> our plan looks at the water supply we have available, all of our different water sources and with those calculations at this point it looks like what we really need locally is a 10% reduction and then as things go on in the winter that might go up. >> reporter: cutting back by 10% means losing about 20 gallons less each day, that would be

cutting your shower by five minutes, should be noted though the south bay reservoirs are low district tells us that the ground water supply is in fair condition. cal fire is also taking measures to deal with the dry conditions. the agency is asking homeowners to cut back on dry brush and maintain 100 feet of defensible space. that's not unusual. what makes the request unusual is the timing of this request. usually they are not asking homeowners do that until summer. here we are in january where the conditions are typical of what we see in august. reporting live, bob redell, "today in the bay." >> the drought is causing serious concerns for one of california's big industries, the napa valley grape growers will neat discuss what they can do to protect their industry during the drought. the goal is maintain napa valley's reputation as a world class wine growing region. >> and what is the thing we need is water. the rain.

let's take it to christina. >> that storm track is going where we need to the in order for the storm window to open up. it's still to our north. you can see those showers are now starting to push along the spine of the sierra nevada. there are two sides to every system. this is the warm side. behind the cold front the cold blast will move in. you can check it out on your seven-day forecast right at the bottom of the screen. the bay area is not getting a lot of activity. we're not expecting this to stick around. i think it's going to subside by lunch time you should be able to put the umbrella away. this is prefrontal precipitation. throughout tonight into tomorrow and especially thundershowers, the main front arrived. 53 in oakland. at 50 to start in san jose. in san francisco you're starting out 2 degrees away from average so. as a result temperatures are

going to climb into the 60s today. it will be cool, keep that in mind. san francisco, you're going to need that jacket. 64 in the north bay. temperatures are going to be unseasonably mild today and tomorrow. even with the rain coming in. i want to show you the difference between san jose and san francisco. we're going to wait on those showers probably until thursday morning. look likes you're going to get activity for the second half of the day in thecy. then look where our temperatures are headed. 56 by friday with residual shower activity. this should subside friday. but the snow is what we need. we need snowpack in tahoe and we're looking pretty good for that. let's give you an idea. this is purely computer generated. i think we're going to get more. hey, the models now bringing in nine inches of powder in truckee. the higher elevations could pick up two feet. great news, ski week around the

sweatshirt, carrying an orange back pack. >> the santa clara water district is expected to vote on water policies. the district will likely urge people to cut back use by 10%. >> two colorado farmers responsible for a deadly listeria outbreak are scheduled to be sentenced today. 33 people died, nearly 150 more were hospitalized. in 28 states including california. the brothers face up to six years in prison and $1.5 million in fines. >> president obama will deliver his state of the union address today. but it will come as he faces low approval ratings. peggy bunker joins us now with a look at the poll numbers just released. >> good morning. some call this the president's last chance to turn things around. the pressure on for him to address head on the public pessimism about what our government has or not been able to accomplish. recent poll numbers show the president will address the country with a 43% job approval

rating, very tough to do. that's a tough number to rally the country on. and also they get worse. look at this poll which shows a huge level of dissatisfaction. 68% of americans say that the country is stagnant or worse off since the president took office. 31% say we're better off. 60% think the country is headed in the wrong direction and a huge 70% are dissatisfied with the economy. the most telling here it's not all on the president, whopping 81% of people disapprove of congress. so those numbers are what will make tonight's speech one of the most important of the president's career. on a brighter note bay area will be well represented at tonight's state of the union speech. the first lady is keeping wake-up the tradition of hosting americans in her viewing box and mayor ed lee will be one of those. he will have a prime viewing spot for the speech. the white house didn't say exactly why mayor lee was chosen but like the president he is an advocate for immigration reform

very light, pesky showers. we'll take anything we can get. the showers are developing, mostly along the marin county coast line and up in sonoma county. if you live in the north bay north of the golden gate bridge or in san francisco, be ready to dodge drizzle this morning. sunshine and 60s later on today. take into your wednesday where we get that major shift. rain arrives late. mostly beyond 1:00 p.m. for the greater bay area. and for the most part we're only expecting shower, areas to the north of the golden gate bridge. then thursday into friday that cold blast rainfall moves in action and let me show you what we're working with. we stop the clock for you starting this morning 6:00 a.m., as you can see we'll see a little bit of activity. it will subside throughout lunch time. then we stop the clock into wednesday night. yep, the main event arrives. 3:00 p.m. to 10:00 p.m. the action starts up in the north bay. this is all going to spread to the south as we head throughout tomorrow morning. thursday morning, stop that

clock thursday, 4:00 a.m. you can see this, moderate rainfall from palo alto all the way to livermore, san jose starting to get wet at that point, then the rich moisture maintains its organization and we get maybe a quarter inch right here in the south bay. so a quarter of an inch expected, areas in the higher elevations could pick up an inch of rainfall. after the system comes through temperatures are going to tumble. this is video from this weekend in morgan hill. you can see how brown our hills are. we need this rain for beautiful green hills to return. overall i want to talk about your temperature trend in the south bay. 67 for today, tomorrow mid-60s, upper 50s on the way for thursday. pull out the winter coat. you're going to need it for friday and into the weekend. then late sunday into monday we get another chance for light showers and overall, the first week of february is looking active. so hopefully we can see these brown hills turn green once

again. dublin usually looks like ireland this time of year. not the case right now. >> not the case now but we hope we get a little more green to the dublin hills. we're looking here, a look at the bay bridge toll plaza. the metering lights have been on so 20 minutes and the overcrossing and back past the 880 overcrossing in west grand. slow off the berkeley curve. the slowing you see now out of richmond and into berkeley past golden gate field for westbound 80, and also west 24 your commute there. i told bu a wrong way driver reported. someone going east on a westbound lane. they are over on the shoulder. the car is facing the wrong direction. that person is out of the car, chp is there to help out. i don't know exactly what happened but all lanes are clear. this person is on the shoulder. so traffic is starting to slow a bit toward the caldecott because of that volume. we're looking here toward the tri-valley, smooth for 580. and now look at that the build

for 680 southbound heading down to sunol. yesterday we had a lot of fog through the area. it looks clearer but we have the build because of the commute heading down into fremont. northbound 680 out of milpitas we have this crash as well. two cars in the center divide. the earlier tire reported in lanes no update on that either no. lanes are blocked. a smooth flow or the commute south into the south bay. a smooth flow throughout san jose. 101 shows slowing, 87 both directions slowing as more cars hit the roadway. that volume is building and probably going to see some over the next few minutes a. look at the peninsula, 101 through palo alto, a smooth drive here as well. not a problem past 92 into san francisco. across 92 a look at the san mateo bridge westbound the commute from the high rise to the peninsula. you do have a lot of company. back to you. >> new friends. 6:21. still ahead on "today in the bay," thousands of flights canceled as another cold blast

happening now more than 2500 flights canceled due to winter storms across the southeast and the midwest. airports with the most play, atlanta, houston and chicago-o'hare. millions are dealing with cold winter weather including frigid wind. in ohio an example of that weather, high winds and snow combine to create snow rollers. look at that. people are bundled up from chicago to houston where icy roads are making travel dangerous. officials are asking people to be mindful of the propane shortage and conserve even though demand continues to soar. >> frigid temperatures forcing players and fans to bundle up ahead of super bowl sunday. right now that cold snap has temperatures in the teens. we're looking at new york city, 17 degrees. >> right. sarah joins us live in times

square in new york city. how is the weather today? you look bundled. >> reporter: yes, it is chilly. and you know the weather is an issue when there is more buzz about what it's going to be like on sunday than buzz for the actual game. right now don't want to jinx anything but things are looking good. we're cold but things are expected to warm up with game day weather forecast to be in the upper 30s, we're going to see some sun that day. that is great news for the tens of thousands of people who will be heading down there. right now they are starting to trickle in. i want to show you some of the things they are doing in anticipation of the game. this is broadway transformed into super bowl boulevard. they are putting the the final touches on this five-block-long stretch of activities. perfect your spiral, look at statistics and talk smack with fans of the opposing team.

raise the minimum wage, but his main message to congress will likely be that government can help americans who have had trouble recovering from the recession. republicans already talking about tonight's speech. for more on the gop response we'll check in with tracie potts who joins us live on capitol hill. good morning. >> reporter: good morning. the gop has crafted their response, three of them in fact. we'll hear that after the president speaks. the focus or the message in the responses, all talk, no action. in fact, they have gotten an ad out you may see it on line or on air talking about what the president said last year and the year before. they pulled clips of repeated comments that he made in state of the union addresses saying that this is nothing but the president saying the same thing over and over again. here's the head of the republican party. >> i at least want the american people to understand that while this president enjoys giving speeches, he doesn't actually enjoy following through on

lunch time. here's what we're working with today. temperatures starting out in the 50s, sun starting to make an appearance in the south bay, i want to show you that, give you your daypart forecast. this afternoon, it's going to be nice and clear out there, temperatures are going to be comfortable. then as we head through tonight into tomorrow, those soupy conditions arrive. expecting the cold front on time, wednesday night at about 11:00 p.m. spreading to the south bay by about 5:00 a.m. on thursday. so for today, get out there if you still have the outdoor activities putting off. 67 degrees today. down in san jose along the peninsula we'll see the mid-60s, low 60s headed your waxt plenty of cloud cover in san francisco bay area. up in the north bay we're getting light showers, you're fair game for a mix of sun and clouds, upper 60s in fact in places like napa and santa rosa. east bay good for the mid-60s. 5 to 8 degrees above average there. the warmest spot across the bay area as it was yesterday will be the pleasanton, livermore, tri-valley area with

temperatures so close to that 70-degree mark. our numbers are going to tumble. here is the five-day forecast for san jose and san francisco. if you want your seven-day forecast it's there at the bottom of the screen. every region is covered. i want to show you the microclimate difference between san jose and san francisco the next couple days. here's what we're working with. on wednesday, tomorrow, looks like we're going to be mostly cloudy in the south bay. showers arrive in san francisco by about 3:00 p.m. on thursday, widespread rainfall especially for the early morning hours right in the heart of your morning drive. keep that in mind. then we'll see residual activity friday morning in san francisco and san jose. i want to draw your attention to these temperatures. look at the difference between today and friday. we're going to drop off and stay unseasonably cool as we get into saturday and sunday. super bowl sunday. might i add. then after that, this weekend we have fan fest on saturday, super bowl on sunday, the pebble beach pro am is the following week on

getting clear. may break apafrmt ledded to the castro valley y, a smooth drive 880 approaching the san mateo bridge. moving nicely to the peninsula with no delays along 101 or 280 and the dumbarton bridge, it's university on the peninsula side. past the coliseum, taillights and southbound with the headlights we see more cars but not a lot of slowing. about 60 miles per hour. that's great for the nimitz t bay bridge toll plaza, head up there off of 880 you have the slowdown approaching the toll plaza and the berkeley curve as well. everybody is turning to make the westbound direction into san francisco. you have to wait for all of these as well. >> thanks a lot. 6:36. angry postal workers will be outside two bay area staple stores to protest a deal between the u.s. postal service and staples to offer mail service. the union is angry it will be

enthusiasm this morning the prime minister of ukraine is stepping down after protests in kiev. the prime minister made the announcement earlier this morning during an emergency session ever parliament. moments ago after the announcement parliament replaced harsh anti-protest laws imposed earlier this month. the pro western protests began in november after the president shelved a treaty with the european union and accept add huge bailout from the russian president vladamir putin. at least three protesters have died in clashes with police. >> the trial of ousted egyptian president mohammed morsi has been postponed for a month. morsi flew to cairo for the trial. prosecutors say morsi and other leaders of the muslim brotherhood were freed from jail illegally during the country's 2011 uprising.

considering a request that they would like to put on customers to ask them to cut back. it should be noted the district cannot force the customers to do that but can ask and that's something they are going to do because these levels are so low. the reservoir at 30%, look that the, that's parched ground with the cracks, that's also in san jose. the almaden reservoir south of san jose. it's at 3% of capacity. the district was not going to consider this voluntary reduction until the spring but because there has been so little rain, because things have been so dry they decided to move it up for consideration tonight. the board expected to ask customers to cut back by 10%. one customer we spoke with doesn't think that's enough. >> i think that's a minimum we should cut back. it's clearly been a drought. we haven't had rain for months so we need to cut back. >> reporter: cutting back by 10%

means using about 20 gallons less each day or equal to cutting your shower by five minutes. it should be noted though the reservoirs are low the district tells us that the ground water supply is in fair condition. cal fire also taking measures to deal with dry conditions. it is asking homeowners to cut back on dry brush and maintain 100 feet of defensible space around homes. that request is unusual because cal fire usually doesn't ask this of homeowners until the summertime. as we've been speaking all morning about here we are in january with conditions that are typical of august. reporting live at lexington reservoir, bob redell, "today in the bay." >> let's check in with christina. so rain is headed our way. >> it is. you know what, it's looking really good especially up in tahoe. we need that snowpack. in the bay area the snowpack is important for our water supply, and we could pick up two feet of fresh powder so. yeah, no joke with the system coming in. i want to draw your attention to

the bottom of the screen. the seven-day forecast shows you mild today, mild tomorrow, then cold and we include showers. let's break it down for you starting with the live radar. showers to the north. activity spreading into the north bay. these are going to subside by about lunch time. we are getting a really pretty sunrise in the south bay. 50 degrees in san jose, 55 with the low clouds coming down in san francisco. you can tell the conditions are changing out there. nonetheless, we're still going to hit highs unseasonably mild for this time of year. especially in the tri-valley, it's going to take time for the system to arrive. so 69 degrees in the east bay today, 60 in san francisco, north bay at 64 and south bay at 67. a little bit of a.m. drizzle and that makes way to a beautiful day, a lot of sunshine and hey, that moisture is good for our air quality and people suffering from allergies which have been

bad. the rain is going to help out. even more so it lays down all of that particulate matter in our atmosphere. as we head throughout thursday into friday t cold blast, rainfall moves in. and let me time out the changing conditions. we'll start this morning, 6:00 a.m. you can see a little bit of rain mostly to our north. we expect light showers, especially in sonoma and marin county. we continue that futurecast, stop that clock again for you as we get into your wednesday at 3:00 p.m. and this is when it's all going to begin. especially south of the golden gate bridge. all of that presses along the peninsula. we expect moderate rainfall. we wake up and meet back on thursday morning, look at all of this blue on the way to tahoe. like i said before, two feet possible above 7,000 feet. stop that clock for you one more time. 8:00 a.m. on thursday morning. starting to clear out but hopefully after leaving us with a quarter inch of rain in the south bay. let's check on your morning drive. here is mike.

>> give you a look overall, the bay area looks good. it's traffic tuesday so a heavier volume of traffic. that commute is going to hit hard. the peninsula immune until later on. about 7:30 that's when we start to see the slowing, that's the pattern we're seeing. the build for the south bay as folks go up toward the peninsula and looking at 101 from capital expressway all the way past tully. 87 had an early start so from capital heading up to curtner. 85 and 280 starting to show the building heading up to cupertino where that will be congested later on. in the tri-valley moves for 580, we had an early start south 680, 84 joins up with the folks through sunol and more folks joining as well. northbound side reports after crash around sunol boulevard. sounds like everything is moving to the shoulder quickly. that's north into sunol. to the castro valley y, the build at the top of the screen, more heading south down the

nimitz. a smooth drive across the bridges. we'll talk about that shortly. a slow drive develop forge fremont in the southbound direction. across that san mateo bridge let's look at a live look outside what we have. this is fremont southbound, we talked about the build. that's the reason for the slowing down to mission and on mission between 680 over to 880 westbound is slowing a well. a live look as well. we travel across, a live look for the san mateo bridge. smooth drive starting to develop. saw slowing because of that burst of traffic now moving nicely. all lanes filled in. visibility not a problem for both and the backup at the toll plaza. don't be shy. back to you. >> thank you, mike. happening now investigators searching the area around a bay area school looking for a teenager with autism who has not been seen since yesterday. a staff member at ralston middle school reported seeing the teen last night but wasn't sure where he was supposed to be when his

parents went to pick him up. christie smith is live at the school with the latest on the investigation. good morning. >> reporter: good morning to you, laura. classes will start again here in belmont soon this morning so certainly police will be keeping an eye on the high school where tyler simmons attends but also here at ralston. this is the last place he was seen last night. he is 16 years old but has autism so developmentally he is closer to an 8-year-old. he is antisocial. i wanted to show you a picture of tyler edward simmons, this is taken at christmas time last year. he is 6 feet tall, 140 pounds, brown curly hair, green eyes and a thin goatee. he was last seen wearing a gray zip-up sweatshirt, black jean, black beanie hat and white shoes. he was carrying an orange back pack. he had a dell lap top compute wer a black cover and purple nintendo ds. he attends carlmont and got out

of school around 3:00 p.m. normally after school he'd go to the public library and wait for his dad. zad saying when he went to pick him up he wasn't there. he wasn't where he was supposed to be. family members searched around and they looked at ralston middle school where a custodian had said he saw him around 7:00 p.m. the family couldn't find him. soon after they called the police. search dogs were out overnight looking for him. unfortunately no signs yet. police don't think that foul play was involved, they say he may have had a disagreement with his parents and that may have led him to walk off. they will search again this morning. christie smith, "today in the bay." >> thank you. campus police at san jose state reminding students to be vigilant and avoid walking at night following reports after possible fourth sexual assault. this in addition to three other assaults reported on campus from saturday night to sunday

with an average build and a pot belly. >> the couple accused of using a job at pet smart to commit a crime spree will be in court. ashley and her husband juan will attend a preliminary hearing this morning. kirk worked at the pet smart pet hotel in san carlos. she used her knowledge of when people were on vacation to plan at least eight burglaries. they pleaded not guilty. >> the cost to park at meters in downtown san jose could double. the council is set to order new smart meters next week, those will let drivers pay through their smart phone and provide real time data for a new app that shows where parking is available. but here's the catch. the meters themselves are expensive, they cost $1.5 million. so to raise money for the meters, the parking rates near downtown will double from $1 to $2 an hour so. meters could be installed by the end of march.

course tonight he lays out his plans for the sixth year of his presidency and the importance of the speech not underestimated. none of his top programs made it through congress. recent numbers show how disappointed americans are with the state of capitol hill. the president will step up to address the country with a 43% job approval rating. that is a tough number to rally the country on, take a look at this recent nbc news wall street journal poll which shows huge dissatisfaction. 68% of americans say the country is worse off since the president took office, 31% say we're better off. 60% of americans think that the country is headed in the wrong direction and a huge 70% of americans are dissatisfied with the economy. the most telling not placing the blame on the president alone, 81% disapprove of congress. the president's closest advisers say he's not one to be swayed by the polls, he relies on the personal stories of americans to gauge how he is doing. the bay area will be well
